PLANNING & ZONING MINUTES
August 11, 2026 at 7:00 p.m.
Call to order: The meeting of the Planning & Zoning Commission was called to order by Chairman Bruns
at 7:00 PM on Tuesday, August 11, 2026. The Public was able to attend in person.
Roll Call: Chairman Bruns, Commissioner Stewart, Commissioner Summers, Commissioner Love,
Commissioner Wymer. Commissioner Aycock arrived after roll call.
Absent: Commissioner Marhanka, Commissioner Goodmon.
City Staff: City Engineer and Zoning Officer Girondo, Alderman Lesh, Attorney Gillam, City Clerk Barfield.
Approval of Minutes: Regular meeting on July 14, 2026.
Motion made by Commissioner Wymer, seconded by Commissioner Love to approve the
minutes. A voice vote was taken with an affirmative result. Opposed: none. Chairman Bruns
declared the motion passes.

Motion made by Commissioner Wymer, seconded by Commissioner Love to approve the
minutes. A voice vote was taken with an affirmative result. Opposed: none. Chairman Bruns declared
the motion passes.
Public CommentGene Elkins, stated he was still concerned about Beltline coming back. He has a rare Cardinal bird that
visits his place. He shared a picture. He hopes Beltline does not disturb him.
Public Hearing
A. PZ-2026-11: Text Amendment-Zoning and Annexations
Conditional Use Permit, AMW Legacy Properties, LLC, applicant. A Public Hearing to consider an
application for a Conditional Use Permit (CUP) at 1980 Highway N, Pacific, MO 63069. (Franklin
County Parcel # 19-6-14.0-0-099-029.000). The applicant has submitted a request for a Conditional
Use Permit (CUP), for obtaining the zoning entitlement to operate a short-term rental on the property
in question.
Chairman Bruns read the Public Hearing into the record. She opened the public hearing for comments.
Zoning Officer Girondo gave his staff report. There was discussion if the owner was also occupying
the premises. The relator stated the applicant could not attend the meeting, but yes, they may occupy
it between rentals. There was discussion regarding the driveway being worked on today.
Commissioner Aycock asked about the number of pets allows. Zoning Officer Girondo stated this
would be based on the code. Commissioner Love asked about the number of people that can occupy
it. Zoning Officer Girondo stated the number is based off the Residential Building Code and eight is
appropriate. There being no further comments, Chairman Bruns closed the public hearing.

New Business
A. PZ-2026-11: Conditional Use Permit
Conditional Use Permit, AMW Legacy Properties, LLC, applicant. A Public Hearing to consider an
application for a Conditional Use Permit (CUP) at 1980 Highway N, Pacific, MO 63069. (Franklin
County Parcel # 19-6-14.0-0-099-029.000). The applicant has submitted a request for a Conditional
Use Permit (CUP), for obtaining the zoning entitlement to operate a short-term rental on the property
in question.
Chairman Bruns read PZ 2026-11 into the record. Commissioner Aycock was still concerned about the
number of pets and wanted that to be clear. Alderman Lesh stated the limit is no more than 3, or
with a cat no more than 5. She also has concerns about the neighborhood and if anyone has spoken
with the neighbors. Chairman Bruns stated as of Friday there were no comments from the neighbors
about this. Zoning Officer Girondo stated the letters were sent out. Attorney Gilliam stated this is
currently allowable. Commissioner Wymer stated this is allowable now, there is nothing that will
interfere with traffic or safety and he did not see a problem.
Motion by Commissioner Wymer, second by Commissioner Love to approve PZ 2026-11 with the
number of occupants and number of animals allowed per the code. A roll call vote was taken with
the following results: Ayes: Commissioner Wymer, Commissioner Love, Commissioner Summers,
Chairman Bruns. Nays: Commissioner Aycock, Commissioner Stewart. Abstain: 0. Chairman Bruns
declared the motion carries.
Old Businessa. PZ-2026-10 Text Amendment Short Term Vacation Rentals. Amendment to several sections of
Chapter 400 to eliminate the use of “short term vacation rentals” as a conditional use in the
NU “nonurban” District and all Residential Zoning Districts. (Tabled 7-14-26, hosted worked 728-26)
Chairman Bruns suggested this remain on the table so all the board members can weigh in on this.
Commissioner Summers agreed. Zoning Officer Girondo stated he was asked to do some research and
this was included in the packet. He also has an additional map, if anyone wants it, let him know. After
further discussion it was the census of the Board to carry this to the first meeting in September.
b. Planning and Zoning Bylaws review
Chairman Bruns suggested this remain on the table also until the first meeting in September. She would
like to have the Board present. It was the census of the Board to carry this to the first meeting,
September 8th.
Committee Reports
Board of AldermanAlderman Lesh stated the short-term rentals are on the Board of Aldermen’s next agenda, as it was
tabled at the last meeting.
TM Performance - Next, he stated TM Performance had a CUP application and the Board had
the first reading, the applicant was not present. The Board requested him to attend for questions, but
he was not in attendance. This CUP failed at the Board of Aldermen meeting.

Beltline – Alderman Lesh stated it was requested of staff to schedule the Beltline hearing.
Beltline has now withdrawn the application at the Crooked Creek property. There is no public hearing
needed. This does not mean it will not be heard at Franklin County.
Commissioner Love stated he has something to pass out for data centers, but it was not for discussion
today.
Board of AdjustmentZoning Officer Girondo stated there was no report.
Zoning OfficerZoning Officer Girondo stated there was no report.
Motion made by Commissioner Love, seconded by Commissioner Wymer to Adjourn. A voice vote
was taken with an affirmative result.

AN ORDINANCE AMENDING SEVERAL SECTIONS OF CHAPTER 400 TO
ELIMINATE THE USE OF “SHORT TERM VACATION RENTALS” AS A
CONDITIONAL USE IN THE NU “NONURBAN” DISTRICT AND ALL
RESIDENTIAL ZONING DISTRICTS
Whereas, the amendments set forth herein have been the subject of
a public hearing and a recommendation of the Planning and Zoning
Commission.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF PACIFIC,
MISSOURI, AS FOLLOWS:
SECTION 1.
The following subsections of the following sections of
Chapter 400 of Title IV of the Municipal Code by the deletion of “Short Term
Vacation Rental” as a conditional use in the NU “Nonurban” District and all
Residential Zoning Districts. All other subsections and provisions of the listed
sections are not amended in any way and remain in full force and effect.

Section 400.080, Subsection G
Section 400.090, Subsection F
Section 400.091, Subsection F
Section 400,092, Subsection F
Section 400.100, Subsection C
Section 400.110, Subsection C
SECTION 2.
It is hereby declared to be the intention of the Board of
Aldermen that each and every part, section and subsection of this Ordinance
shall be separate and severable from each and every other part, section and
subsection hereof and that the Board of Aldermen intends to adopt each said
part, section and subsection separately and independently of any other part,
section and subsection. In the event that any part of this Ordinance shall be

determined to be or to have been unlawful or unconstitutional, the remaining
parts, sections and subsections shall be and remain in full force and effect.
SECTION 3.
This Ordinance shall be in full force and effect from and
after the date of its passage and approval.

Pacific – Planning and Zoning Commission
Short-Term Vacation Rental Research
Surrounding Communities allowable uses:
Eureka – Prohibited in residential districts for single family dwellings.
Washington – Vacation Rental Dwellings – allowed in Commercial and conditionally in R-3
Wildwood – Not allowed in residential districts. Seems conditional in others.
Union – no regulations
Austin TX – Allowed in most location with different types of licenses. There is a limit on the
number of STRs but it is per owner or multi-tenant building and not overall. They don’t have
many restrictions on them other than licensing and taxes. Most of the restrictions are
about the owner and what they are required to do and are similar to Pacific’s STR code
section.
St. Charles, MO – Limited to the “Extended Historic Preservation District” overlay boundary
which is essentially the older parts of town. They are allowed in commercial and
residential districts within this superimposed district with certain restrictions for each.
Mainly a 500 feet separation distance from other STR’s in residential districts. Not allowed
anywhere else within the city.
Note: It appears that short term rentals are not allowed or severely limited within
residential districts in surrounding cities.
There was no mention of a petition or signatures for surrounding property owners/tenants
in any of the permitting or licensing requirements I found in other municipalities.
Licensing requirements vary across cities but most are similar to those imposed by Pacific.

Some thoughts to change:
Section 400.237 – Short-term vacation rentals: revise the definition of the rental to state
“dwelling units” and not residences and that it may be used as a whole or in-part for guest
accommodations. This current section only uses a portion of single- and two-family
residences for definition.
Add a separation distance between units within residential areas.

Limit the location of these STVRs to commercial areas or the box identified in C-1 with
some changes. It could state they are allowed in C-1 & C-2 or within an area bounded by
4th Street to the west, Neosho street to the east and I-44 to the North. This would include
most all the old town area, including residential and commercial areas and allow them in
this area as permitted use. This should be added to Section 400.237 to be clear where they
are allowed.
Prohibit them in M-1 districts outside of the box mentioned above.
The uses are already conditionally permitted within current N-U and all R-X districts. The
commission could choose to either remove them as uses from these districts or allow
them to stay conditionally permitted and deal with each application as they come in. They
already have to come before P&Z and the Board to gain approval in these districts and there
is the chance to deny the use if they are within subdivisions or groups of homes that the
commission does not believe they should be in.
