EMERGENCY TEMPORARY RESOLUTION N.J.S.A. 40A:4-20

R-82-26
WHEREAS, NJSA 40A:4-20 provides that, in addition to temporary appropriations
necessary for the period prior to the adoption of the budget and regular appropriations, the
governing body may make emergency temporary appropriations for any purposes for which
appropriations may lawfully be made for the period between the beginning of the current
fiscal year and the date of the adoption of the budget for the current fiscal year and the date of
the adoption of the budget for the current fiscal year; and
WHEREAS, the amount of such emergency temporary appropriations shall be
included under corresponding headings in the budget as adopted or, if such appropriations are
adopted after the introduction and approval of the budget and were not included in the budget
as approved such appropriations shall be included by amendment in the budget as adopted
without public advertisement or public hearing; and
WHEREAS, the Township has deemed certain emergency temporary appropriations
to be necessary and such appropriations are conforming to the provisions of NJSA 40A:4-20;
NOW, THEREFORE, BE IT RESOLVED (not less than two-thirds of all members
therefore affirmatively concurring) that in accordance with N.J.S.A 40A:4-20 the following:
1. Emergency temporary appropriations are made and the same are hereby made for:

2. That said Emergency Temporary Appropriation will be provided for in full in the 2026
budget under the titles as listed on the attached worksheet.

FOR THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF FRANKLIN

WHEREAS, N.J.S.A. 10:4-6 "Open Public Meetings Acts" of the State of New
Jersey, generally requires that all matters of public bodies be opened to the public; and
WHEREAS, the "Act" also provides that a public body may be excluded from a
public meeting in which it will discuss various specific subjects, as enumerated in the "Act"
N.J.S.A. 10:4-12 Paragraph B-7.
NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the
Township of Franklin, in the County of Gloucester, State of New Jersey, that:
1. The Township Committee of the Township of Franklin shall hold a closed

RESOLUTION TO SUPPORT A PAVEMENT MORATORIUM ON THE 2026
GLOUCESTER COUNTY MILL AND OVERLAY PROGRAM AND ROADWAY
RECONSTRUCTION PROJECTS
WHEREAS, Gloucester County intends to bid and begin reconstruction on portions of
Porchtown Road (between Bridge 10-K-4 and Iona Lake) and Coles Mill Road (between Delsea
Drive and Fries Mill Road) in Franklin Township; and
WHEREAS, the county has requested the township review the list of projects and to
determine if there are any municipal utility repairs that need to be completed prior to the
commencement of the reconstruction projects; and
WHEREAS, following the completion of the road projects, the stated portions of
Porchtown Road and Coles Mill Road will be under a 5-year moratorium; and
WHEREAS, the moratorium will not permit pavement openings within the project limits
during the 5 year period of the moratorium.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Committee of the
Township of Franklin, County of Gloucester, State of New Jersey, that they support the paving
and paving moratorium on Porchtown Road and Coles Mill Road.

AS DEPUTY REGISTRAR OF VITAL STATISTICS FOR FRANKLIN TOWNSHIP,
GLOUCESTER COUNTY, NEW JERSEY

WHEREAS the term of Franklin Township Deputy Registrar of Vital Statistics will expire on
July 11, 2026; and
WHEREAS Christina Mulford has served as Franklin Township Deputy Registrar of Vital
Statistics and has the necessary qualifications to continue to serve; and
WHEREAS Barbara Freijomil, Franklin Township Registrar of Vital Statistics hereby
recommends the reappointment of Christina Mulford to the position of Franklin Township
Deputy Registrar of Vital Statistics; and
WHEREAS Christina Mulford desires to continue to serve as the Franklin Township Deputy
Registrar of Vital Statistics

RESOLUTION OF THE MAYOR AND COMMITTEE OF THE
TOWNSHIP OF FRANKLIN
SUPPORTING THE RESTRICTION OF BICYCLE TRAFFIC
ALONG STATE HIGHWAY ROUTE 55
WHEREAS, the New Jersey Department of Transportation (NJDOT) Division of Traffic Engineering
(DTE) has completed a comprehensive safety review of bicycle traffic along State Highway Route 55
within the Township of Franklin; and
WHEREAS, Route 55 is designed as a Rural Principal Arterial Freeway/Expressway with design
characteristics incompatible with safe bicycle operation; and
WHEREAS, posted speed limits of 50-65 MPH create unfavorable conditions when combined with
bicycle traffic; and
WHEREAS, the aforementioned roadway design and operational characteristics are comparable to
facilities where bicycle traffic is prohibited statewide; and
WHEREAS, it is in the best interest of the residents of the Township of Franklin to support a restriction
of bicycle traffic on State Highway Route 55 within the Township of Franklin.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Committee of the Township of
Franklin, County of Gloucester and State of New Jersey, that the Mayor and Committee support a
restriction on State Highway Route 55 that determines no pedestrians and bicycles, except in park areas,
rest areas, walks and crossings, specifically designated by the Commissioner of Transportation for that
purpose, animals led, ridden, or driven except on leash where pedestrians are permitted, or nonmotorized vehicle, both directions of traffic.
BE IT FURTHER RESOLVED, that the Mayor and Committee of the Township of Franklin concur
that any approved traffic regulations and conflict with or inconsistent with the provisions of this
Resolution be rescinded upon approval of the Traffic Regulation Order.
BE IT FURTHER RESOLVED, that a certified copy of this Resolution, bearing the raised seal of the
Township of Franklin, be submitted to the NJDOT.

RESOLUTION AUTHORIZING THE TAX COLLECTOR TO PRINT TAX SALE
CERTIFICATES PURSUANT TO CHAPTER 99 OF THE PUBLIC LAWS OF 1997
WHEREAS, the Tax Collector of the Township of Franklin, County of Gloucester,
State of New Jersey has notified the Township Committee to reprint tax sale certificates on a
property located within the Township of Franklin; and
WHEREAS, the purchaser of the aforesaid tax sale certificates has indicated to the
Tax Collector that the original tax sale certificates have been lost and is not able to locate the
tax sale certificates and has duly filed the appropriate affidavits of loss with the Tax Collector,
copies of which is attached hereto;
THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of
Franklin, County of Gloucester, State of New Jersey, that the following Tax Sale Certificates
need to be reprinted because of the loss of said certificates.

NOW, THEREFORE, BE IT RESOLVED, that the Tax Collector be and is hereby
authorized to reprint said certificates as required by law, to said purchaser covering the
certificates lost as previously described all in accordance with the requirements of Chapter 99
of Public Laws of 1997.
AND BE IT FURTHER RESOLVED that a properly executed copy of this Resolution
and the Loss Affidavits be forwarded to the Tax Collector and Chief Financial Officer for the
records.

RESOLUTION AUTHORIZING A FIREWORKS DISPLAY BY PYROTECHNICO
FOR FRANKLIN TOWNSHIP NATIONAL NIGHT OUT CELEBRATION
WHEREAS, the Township of Franklin is sponsoring a fireworks display for National Night
Out on Tuesday, August 4, 2026 and has contracted with Pyrotechnico Fireworks Inc,. (PO
Box 149; New Castle PA 16103) to perform the displays; and
WHEREAS, N.J.A.C. 5:70-3.2 provides that the Governing Body of a municipality may, upon
application in writing accompanied by proof of proper insurance coverage, grant permission by
resolution for the public display of fireworks approved by the Governing Body of such
municipality to whom the application is made; and
WHEREAS, Pyrotechnico has been contracted through the Township of Franklin and the
Township Fire Official to conduct a display on August 4, 2026 for National Night Out
celebration on lands owned and managed by Franklin Township, Gloucester County located at
500 Pennsylvania Avenue, Franklinville, NJ; and
WHEREAS, Pyrotechnico has provided the necessary proof of insurance; and
WHEREAS, all necessary insurance and other relevant documents have been approved by the
MEL JIF Insurance; and
WHEREAS, there is no cost to the Township of Franklin, as Newfield National Bank has
generously donated the full cost amount to cover the fireworks display; and
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of
Franklin, County of Gloucester, State of New Jersey that Pyrotechnico is authorized to display
fireworks at National Night Out Celebration in accordance with the applications on file with
the Township Fire Official and the Township Clerk, contingent upon receipt of the approval
letter from the Federal Aviation Administration (FAA).

TO THE POSITION OF POLICE OFFICER (1st Class) IN THE
FRANKLIN TOWNSHIP POLICE DEPARTMENT

WHEREAS, the Township of Franklin requires a Police Officer for the Franklin Township
Police Department; and
WHEREAS, the Township of Franklin, County of Gloucester, State of New Jersey finds
that SLEO II, Cole McNellis, is the most qualified candidate to serve as Police Officer 1st class (prorated) as per PBA 122 CBA, which was ratified on December 30, 2024 and runs from January
1, 2025 through December 31, 2029 and finds it appropriate to appoint SLEO II, Cole McNellis to
the position of Police Officer for the Franklin Township Police Department; and
NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the
Township of Franklin, County of Gloucester, State of New Jersey, hereby appoints Cole McNellis

WHEREAS, the Township of Franklin is sponsoring a bounce house entertainment for
National Night Out on Tuesday, August 4, 2026 and has contracted with American Bounce
(PO Box 28; Norma, NJ 08347) to setup and monitor a bounce house entertainment; and
WHEREAS, American Bounce has been contracted through the Township of Franklin to
conduct a bounce house entertainment on August 4, 2026 for National Night Out celebration
on lands owned and managed by Franklin Township, Gloucester County located at 500
Pennsylvania Avenue, Franklinville, NJ; and
WHEREAS, American Bounce has provided the necessary proof of insurance; and
WHEREAS, all necessary insurance and other relevant documents have been submitted to the
MEL JIF Insurance for review and approval;
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of
Franklin, County of Gloucester, State of New Jersey that American Bounce is authorized to
provide bounce house entertainment at National Night Out Celebration in accordance with the
applications on file with the Township Police Department and the Township Clerk, contingent

RESOLUTION APPOINTING TOWNSHIP WATER AND SEWER ENGINEER
WHEREAS, there exists a need for the appointment of an Engineer to perform
professional sewer and water engineering services in connection with the evaluation of
infrastructure, feasibility and appropriateness arising for the Township of Franklin, County
of Gloucester, for the purpose of providing the Township Committee with engineering
advice, reports and services for the year of 2026; and
WHEREAS, pursuant to the provisions of N.J.S.A. 19:44A-20.5, the Township
Committee has determined to award said contract as a fair and open contract; and
WHEREAS, the CFO has certified the availability of funds in an amount not to
exceed $20,000 which shall be charged against budget line items #6-01-20-165-299 entitled
Engineering-Professional Services.
WHEREAS, the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq. requires the
governing body of a contracting unit to publish a notice in a newspaper authorized by law to
publish its legal advertisements, setting forth the nature, duration, service and amount of the
contract where such contract is awarded for “professional services”.
NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the
Township of Franklin, County of Gloucester, State of New Jersey, that Artheon, 1 Market
Street, Suite 1F, Camden, NJ 08102, be and is hereby appointed as Water and Sewer
Engineer to provide advice, reports, inspections and related services to the Township
Committee.
AND BE IT FURTHER RESOLVED that the appropriate officers of the Township
of Franklin are hereby authorized to enter into a contract with for the engineering services
specified above.
AND BE IT FURTHER RESOLVED that said contract is awarded as a
“professional service” under the provision of the Local Public Contracts Law because of
the specialized training, education, experience and specialized knowledge needed for this
position and pursuant to a “fair and open process” as provided in N.J.S.A. 19:44a-20.4 et
seq.
AND BE IT FINALLY RESOLVED, that a copy of this resolution be forwarded
the Sentinel, an official newspaper of the Township of Franklin, authorized by law to
publish the legal notices of the Township Committee of the Township of Franklin, setting
forth the nature, duration, service and amount of the contract, and further stating that this
resolution and the annexed contract are on file and available for public inspection in the
office of the Clerk of the Township of Franklin.

AMENDING CHAPTER 373-34 MOVEMENT OF TRAFFIC ON MUNICIPAL
AND BOARD OF EDUCATION PROPERTY OF THE CODE BOOK OF THE
TOWNSHIP OF FRANKLIN
WHEREAS, the Township Committee of the Township of Franklin have determined that
certain amendments to Chapter 373-34 Movement of Traffic on Municipal and Board of Education
Property are necessary for the safety of the community of the Township of Franklin;
WHEREAS, the Township Committee of the Township of Franklin have reviewed and
approved the recommendations of the Franklin Police Department restrict parking on Joshua Court
during certain hours during the school year to prevent the risk caused by student parking on the
Court;
WHEREAS, the recommendations of the Franklin Police Department to restrict parking
on Joshua Court during school hours during the school year are based on the danger and risk when
students park in the Court and then attempt to cross Fries Mill Road outside of the designated
crosswalks in an attempt to avoid parking in the school parking lots;
NOW, THEREFORE, BE IT ORDAINED, by the Township Committee of the
Township of Franklin, in the County of Gloucester and State of New Jersey, and it is hereby
enacted and ordained by the authority of same as follows:
Section 1.

Purpose

The purpose of this Amendment is to restrict parking on Joshua Court during the school year and
school hours.
Section 2.
Chapter 373-34 of the Code Book of the Township of Franklin shall be
amended as follows (additions are underlined):
§ 373-34

Movement of traffic on municipal and Board of Education property.

In accordance with the provisions of this section, the municipal property and Board of Education
property indicated below shall have traffic regulated as described below, or shown in an attached

site plan, which is hereby made a part of this chapter:

COMPUTER CENTER AND TO DISTINGUISH THEM AND TO CONFIRM THAT
DATA CENTERS ARE PROHIBITED USES/STRUCTURES IN ALL ZONING
DISTRICTS
WHEREAS, the Franklin Township Committee is aware of facilities that are commonly
known as “data centers,” and sometimes referred to “internet data centers” or “cloud data centers,”
that are utilized to house computer systems and associated components such as telecommunication
and data storage systems, redundant or “backup” components, infrastructure for power supply,
data communication connections, environmental and safety controls for building climate,
equipment cooling, and fire suppression, and security devices, systems, and installations, for the
purpose of aggregating collective computing demands for cloud services, video streaming,
blockchain and crypto mining, artificial intelligence and machine learning, virtual reality, and
other data maintenance and transmission purposes; and
WHEREAS, the Franklin Township Committee is aware of growing public concerns about
data centers and their potential environmental and socioeconomic impacts, including but not
limited to high electricity and water consumption that can result in electrical grid overload and
outages, increased consumer energy prices, and aquifer depletion; heat generation; interference
with cellular and wireless communications; and disturbing, disruptive ambient noise; and
WHEREAS, neither data centers as described above, nor any similar types of
functionally-equivalent but differently-named facilities, have been recommended or otherwise
designated as permitted or conditionally-permitted uses or structures in the Franklin Township
Master Plan; nor are data centers or similar facilities listed as permitted or conditionally-permitted
uses or structures in any of Franklin Township’s zoning districts; nor are data centers or similar
facilities included within any current category or classification of permitted or conditionallypermitted uses or structures in any of Franklin Township’s zoning districts; and
WHEREAS, for the foregoing reasons “data centers” as described above are not and have
never been permitted or conditionally-permitted by right in any Franklin Township zoning district;
and
WHEREAS, §253-96 of Franklin Township Code Chapter 253 “Land Development,”
which is entitled “Prohibited Uses” provides that “No building may be erected, altered or used and
no lot or premises may be used in or within 50 feet of a residence district for any use which is
noxious or offensive by reason of odor, dust, vibration, illumination or noise or which constitutes
a public hazard, whether by fire, explosion or otherwise. In a commercial district, no noxious,
offensive or hazardous use shall be permitted;” and

WHEREAS, given the growing public concern about data centers and their potentially
detrimental environmental and socioeconomic impacts, and public nuisance and the need to learn
more about them before determining whether or subject to what conditions they might be permitted
in any of Franklin Township’s zoning districts, the Franklin Township Committee has deemed it
necessary and appropriate to state clearly in the Franklin Township Code that data centers are, and
shall continue to be, prohibited uses/structures in all of Franklin Township’s zoning districts unless
and until they can be recommended in Franklin Township’s Master Plan, and appropriately
designated as permitted or conditionally-permitted uses/structures in any one or more of Franklin
Township’s zoning districts; and
WHEREAS, to prevent future misunderstandings about the fact that “data centers” are not
“computer centers” for purposes of the Franklin Township Code, the Franklin Township
Committee has deemed it necessary and appropriate to define the term “computer center” in
Chapter 253 “Land Development” as set forth above;

NOW THEREFORE BE IT ORDAINED, by the Township Committee of the Township
of Franklin, in the County of Gloucester, State of New Jersey, as follows:
1. Section 253-3 Franklin Township Code Chapter 253 “Land Development,” entitled
“Definitions” is hereby amended to include the following definitions:

DATA CENTERS
A facility that houses computer systems and include associated components such as
telecommunication and data storage systems; redundant or “backup” power and data
storage components; electrical transformers, substations, and other power supply
infrastructure; data communication connections; environmental and safety controls for
building climate, equipment cooling, and fire suppression; and security devices, systems,
and installations, to serve as off-site or remote accessory facilities available and accessible
to users via telecommunication or internet utilities for the purpose of aggregating collective
computing demands for cloud services, video streaming, blockchain and crypto mining,
artificial intelligence and machine learning, virtual reality, and other internet,
telecommunication, computing, and data storage, maintenance, processing, and
transmission purposes. Sometimes referred to as “internet data centers” or “cloud data
centers” (and any and all functionally-equivalent but differently-named uses, structures and
facilities).
COMPUTER CENTER
A facility that houses individual computers and their associated components at which users
convene in-person to engage in on-site use of on-site workstations in an office or laboratory
(“computer lab”) setting for research and other endeavors of a business, professional,
scientific, or academic nature. The term “computer center” does not include “data centers”
as described and defined in this Chapter.

2. Section 253-96 of FranklinTownship Code Chapter 253 “Land Development,” entitled
“Prohibited Uses” is hereby amended to include the following additional specifically-listed
prohibited use as subsection G:
G. “Data centers,” “internet data centers” or “cloud data centers.”
3. The Franklin Township Deputy Clerk is directed to give notice of this Ordinance pursuant to
N.J.S.A. 40:55D-15 to the Clerks of all municipalities adjoining Franklin Township and to the
Gloucester County Planning Board at least ten (10) days prior to the date scheduled for hearing
on the adoption of this Ordinance.
4. If any section, paragraph, subsection, clause or provision of this Ordinance shall be adjudged
invalid by a court of competent jurisdiction, such adjudication shall apply only to the section,
paragraph subsection, clause or provision so adjudged, and the remainder of the Ordinance
shall be deemed valid and effective.
5. Any article, section, paragraph, subsection, clause, or other provision of the Franklin Township
Code that is inconsistent with the provisions of this Ordinance is hereby repealed to the extent
of such inconsistency.
6. This Ordinance shall, following adoption and publication in accordance with the laws of the
State of New Jersey, take effect immediately upon its filing with the Gloucester County
Planning Board pursuant to N.J.S.A. 40:55D-16.

MODEL ORDINANCE TO EXCEED THE MUNICIPAL BUDGET
APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK
(N.J.S.A. 40A: 4-45.14)
WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in
the preparation of its annual budget, a municipality shall limit any increase in said budget up to 2%
unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations,
subject to certain exceptions; and,
WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by
ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5%
percentage rate as an exception to its final appropriations in either of the next two succeeding years;
and,
WHEREAS, the Mayor and members of the Township Committee of the Township of Franklin
in the County of Gloucester finds it advisable and necessary to increase its CY 2026 budget by up to
3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and
welfare of the citizens; and,
WHEREAS, the Mayor and members of the Township Committee hereby determines that a
1.5% increase in the budget for said year, amounting to $205,534.38 in excess of the increase in final
appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary;
and,
WHEREAS the Mayor and members of the Township Committee hereby determines that any
amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as
an exception to final appropriation in either of the next two succeeding years.
NOW THEREFORE BE IT ORDAINED, by the Mayor and members of the Township
Committee of the Township of Franklin, in the County of Gloucester, a majority of the full authorized
membership of this governing body affirmatively concurring, that, in the CY 2026 budget year, the
final appropriations of the Township of Franklin shall, in accordance with this ordinance and N.J.S.A.
40A: 4-45.14, be increased by 3.5 %, amounting to $479,580.22, and that the CY 2026 municipal
budget for the Township of Franklin be approved and adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that is not
appropriated as part of the final budget shall be retained as an exception to final appropriation in either
of the next two succeeding years; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed
with the Director of the Division of Local Government Services within 5 days of introduction; and,
