Regular Session Minutes
April 1st, 2025 at 4:00 p.m.
The Spearfish Planning Commission met in regular session on Tuesday, April 1st, 2025, in the Council
Chambers of City Hall and via Zoom video conference. Tysdal called the meeting to order at 4:01 p.m. Roll call
was taken with the following members present: Rick Tysdal, Bill Moths, Meghan Byrum, Amy Davison, Scott
Duncan and Dylan Wilde, and Greg Kruskamp. Also present: Assistant Planning Director Jaymia Ecker, and
Planning Technician Vasiliki Pistoftzian.
Approval of Agenda
Davison moved to approve the agenda as presented, Moths seconded the motion, and the motion passed 60.
Approval of Minutes from March 4th Regular Session and March 11th Special Session
Davison moved to approve the minutes from March 4th regular session with a correction on the date
referenced for the next planning commission meeting, Byrum seconded, and the motion passed 6-0. Davison
moved to approve the March 11th special session minutes, Duncan seconded, and the motion passed 6-0.
Declaration of Conflicts of Interest
Tysdal called for any potential conflicts of interest to be identified. None were identified.

Ecker summarized the staff report of the request which includes a variance to
certain subdivision design standards. Staff recommended approval of the
request with a recommendation to establish a road maintenance agreement.
Tysdal opened the public hearing, and the applicant, Cathy Winchester, made a
comment that she was available for any questions the commission may have.
With no additional comments, the public hearing was closed. The Commission
discussed imposing requirements for improving the road to City Standards if
further subdivision was requested. The history of the parcel and its annexation
into city limits was also brought up, citing a difficulty developing the area due
to topographical challenges. Byrum reiterated that this annexation seems to
have been made before annexations were required to include a development
plan alongside. Moths questioned if a precedent was being set for developers
of other lots along Heritage Dr. to request variances to the design standards for
roads. The commission discussed the topographic challenges specific to the
site. Davison moved to approve the requested variances to Code Chapter 154,
Sections 068, 069, 076 and 079 with the understood hardships related to
topography and no intention to further develop lots 1 & 2. Byrum seconded
the motion. Following discussion, Davison amended the motion to include
physical challenges. The motion passed 6-0.
Wilde moved to approve the preliminary plat, Duncan seconded motion, and
the motion passed 6-0.

Ecker summarized the staff report. A variance to the dedication of public right of way
associated with this plat was previously approved by the commission. Moths
expressed concern that if the plat were approved as presented, the setbacks between
the resulting lot lines and outbuildings would not meet the County’s zoning
regulations. Ecker clarified that in discussions and written communication with
Lawrence County Planning and Zoning Department, there were no concerns about the
setbacks due to the conservation easement, and they would consider this legal nonconforming referencing Chapter 11 of their ordinance. Davison moved to approve the
sketch plat since the condition of the conservation easement associated with the
previously approved variance request had been met. Duncan seconded, and the
motion passed 5-1, with Moths voting nay.

telecommunications (cell) tower facility. The site location is zoned Development Review District
(DRD).

Project History and General Comments
Horvath is proposing a 120' monopole tower design telecommunications tower to be constructed,
operated, and maintained within a 50’ x 65’ fenced area. Verizon Wireless is the intended network
provider. The subject property is owned by Sodak Storage, LLC, and a lease agreement is in place
for this project. The property is approximately 10.3 acres, zoned DRD, and developed with indoor
storage facilities.
Preliminary construction plans have been submitted with the CUP application. If the CUP is
approved, the plans may be submitted to the Building Department for review and must be
approved by the City, and Federal Aviation Administration (F.A.A) prior to construction.
This application initially came before Planning Commission and had a public hearing on December
3rd, 2024. A motion to approve the CUP was made by Bordewyk and seconded by Tysdal. The
motion failed 4-3. Commissioners voting nay cited the staff report and the inability of the
application to meet both criteria 1 and 2 in 156.067 Telecommunications Facilities Ordinance. At
the December 17th, 2024, Planning Commission Meeting, the motion to approve was renewed and
tabled.
Following the tabling of the motion to approve this CUP, the telecommunications ordinance
section F was revised through Ordinance 1396 which was approved on March 3rd, published on
March 8th, and took effect on March 28th of 2025.
Section (F) Use permit criteria of the Telecommunication Facilities ordinance (156.067) to allow
the fulfillment of either criteria 1 or criteria 2, whereas before applicants were required to fulfill
both criteria 1 and 2. The Conditional Use Permits (CUP) ordinance (156.082) Section F was also
amended to allow for reapplication earlier than a year if any applicable ordinance has been
amended. No other changes were made.
Staff Review
Consideration and staff review of this application is governed by chapters 156.082 Conditional
Use Permits and 156.067 Telecommunication Facilities (amended March 3rd, 2025) of the City of
Spearfish, SD Code of Ordinances.
The telecommunication facilities chapter evaluates tower projects using a point system in which
different zoning districts/land uses have an established maximum point allowance. Various design
aspects add or subtract points to reach a total which must be equal to or less than the allowable
maximum location points.
Relevant tables and the evaluation criteria for telecommunication facilities and CUPs as adopted
in ordinance are copied below followed by staff responses.

Telecommunications Facilities Evaluation Criteria (156.067. F)
1. The sum of design points in Table A are less than the maximum location points in Table B;

visibility is significantly limited. Alternatively, if there are technical reasons that

1. The proposed use shall comply with other ordinances. A CUP may not be issued to allow a
use otherwise prohibited specifically identified as being eligible for a CUP;
Staff response: The proposed project complies with existing ordinances and
telecommunication facilities are not prohibited in DRD zoning.
2. The proposed use shall be eligible for a CUP based on the zoning district;
Staff response: Telecommunication facilities are an allowed land use in DRD zoning subject
to the regulations in chapter 156.067.
3. The proposed use shall comply with the setback, lot coverage, height and other
requirements of the zoning district, unless the subject property is currently legally
nonconforming or a request for a variance is simultaneously submitted with the
application for a CUP;
Staff response: The applicant is not requesting a variance to any DRD area regulations.
4. The proposed use shall be compatible with the location, physical character, and

Staff response: Given the existing light industrial type use of the subject property, and
proximity to the sportsplex, the proposed tower is generally compatible with the
immediate surrounding area. Visual impacts of this project extend a significant distance
beyond the subject property.
5. Buffering measures along parcel boundaries shall exist or be incorporated to mitigate any
visual impact of outdoor use areas onto adjacent property;
Staff response: The property is enclosed with a chain-link fence. Internally, the tower and
ground equipment will be fenced as well. Chapter 155.26 Landscaping Required requires
landscaping in all commercial districts.
6. If applicable, lighting from all sources shall be designed so that it does not unreasonably
affect adjacent property;
Staff response: Not applicable as no lighting is proposed.
7. The proposed use shall not create an unreasonable public safety issue relating to the
property or its surroundings, nor increase the risks of an existing public safety issue;
Staff response: The project does not create any known public safety issues and is subject to
additional federal regulations.

parking, including those related to bicycle transportation and transportation by persons

December 3rd, 2024: Notice of the public hearing was published in the Pioneer newspaper, posted
at the site location, and sent via certified mail to property owners (1) within 140 ft of the subject
property. In response to this public hearing, one public comment was received and is attached to
this report.
April 15th, 2025: Notice of the public hearing was published in the Pioneer newspaper, posted at
the site location, and sent via certified mail to property owners (1) within 140 ft of the subject
property. As of this hearing, no new public comment has been received.
Summary and Staff Recommendation
Based on staff’s review, the project meets the requirements of the Telecommunication Facilities
ordinance (156.067) and the Conditional Use Permit ordinance (156.082). Within 30 days of
today’s public hearing, the Planning Commission is required to issue an approval or denial of the
CUP including a signed written statement of the commission’s findings supporting the decision.

This letter is submitted on behalf of Horvath Communications ("Horvath"). Horvath is seeking approval of
a Conditional Use Permit to construct, operate and maintain a telecommunications tower facility at the
above-noted location. This letter is intended to provide a brief narrative for this project as well as an
analysis of how the project meets the points requirements per the city code.
Horvath is proposing a new tower to be built at 6775 East Colorado Blvd, Spearfish, SD 57783. Verizon
Wireless intends to install equipment on the proposed tower and at the base of the tower. As such, the
proposed new tower will provide additional service to the Verizon Network currently operating in Spearfish
and surrounding areas. Furthermore, this site will help offload capacity of other sites in the area. Verizon
Wireless’s Radio Frequency Engineering team has selected the proposed location after reviewing existing
network capacity needs, and consideration of other alternate locations. Currently, Verizon Wireless
provides coverage in and around the area of the proposed site. However, with increasing capabilities of
smart phones, tablets, and WiFi hotspot, wireless networks are under constant pressure to provide faster
data speeds for more devices and larger amounts of data. Thus, Verizon Wireless is working to increase
wireless network capacity within the existing network through capacity sites like the site being proposed
herein.
Not only is there a demand among private individuals for a more reliable network, but local businesses as
well. Businesses are increasingly dependent on Verizon’s network for mobile internet and enterprise
applications.
Lastly, many local and state public safety and emergency service providers rely on Verizon’s network daily
to ensure the safety of your community. Your approval of this project will enable Verizon Wireless to
continue to maintain the most reliable wireless service in your area. The proposed upgrade to the Verizon
network in this area will provide businesses and residential customers with the reliable wireless service on
which they have come to rely.

Tower Height and Design

operated and maintained within a 50’ x 65’ fenced and secure compound. The location of the proposed
tower is to be located at 6775 East Colorado Boulevard, Spearfish, SD 57783. The property is owned by
Sodak Storage, LLC, and is zoned DRD Development Review District. The property is currently used as a
public storage facility on a 10.3-acre property.
The proposed tower height and design complies with the current Spearfish, SD Telecommunications
Regulations. Horvath Communications will comply with all federal, state and local laws with respect to
construction, maintenance and operation of the facility.

This tower will be designed and constructed in accordance with the requirements of local and state
building codes.

Information on Painting
This tower will be galvanized steel and will not be painted.

Lighting of the Tower
Per FAA requirements, this tower will not be lit.

This tower will be designed to accommodate additional carriers.

Health
The proposed tower and the future antennae to be placed thereon will meet or exceed all federal
technical health and safety requirements. Additionally, radio frequency from the tower equipment will
operate at a fraction of the maximum allowable power levels set by the FCC.

Analysis of Points Requirements for Cell Towers
Per section 8 telecommunications facility approval matrix line 9, the proposed facility must be less than or
equal to 17 points in addition to being setback 660 feet from I-90. In table A – design points of section 8, a
facility height over 90 feet, up to 120 feet above existing grade starts the project with 20 points. Room for
co-location subtracts 4 points which gives us a total of 16 points and puts us below the required 17 points
or less maximum. To build a 120’ monopole in the DRD district, the project will require a Conditional Use
Permit.
Additional Supporting Application Information
•
Section G.7 requires a list of all existing structures and sites considered as alternatives to the proposed
location. Provide a written explanation why alternatives are unacceptable or unfeasible.
There are no existing towers within a two-mile radius of the proposed location. The closest tower,
2.25 miles east, is only 30’ tall and will not accommodate Verizon’s equipment or coverage needs. The next
closest tower is 40’ and will not accommodate Verizon’s equipment or coverage needs either.
Furthermore, there were only five different property owners within the area of interest. All properties
within the desired area were large and owned by the same entities.

All property owners aside from the parent parcel owner declined the opportunity to lease space for a cell
tower. Two of the five owners stated they were not interested in the tower height or the lease business
terms of the proposed agreement. The remaining three owners initially expressed mild interest but
ultimately ceased communication and opted not to move forward.
Potential options were also limited on the north side of I-90 as there is a 660' setback from the I-90 corridor.
Additionally, the terrain is hilly and mountainous which limits options from a construction standpoint.
Additionally, the I-90 setback eliminates large portions of property north and south of I-90 as potential
siting options.
The parent parcel for this tower project is the best option for a new site as he is an individual owner of a
small outdoor storage property. The property owner has entered into a lease agreement with Horvath
Communications.

Two mitigating factors applied to the installation, as described in Table A. Those mitigating factors include
(1) Special circumstance(s) exist that reduce the impact of the facility and (2) Ground equipment and
support structure color blends with the surrounding setting.
Locating a cell tower on a public storage property is a good fit for the commercial/light industrial use of the
property. There are numerous cell towers across the country that are located on public storage properties.
The base of the tower and ground equipment will be screened from most ground views by surrounding
storage units. Additionally, the color and materials fit in with the color and materials of the existing outdoor
storage units. This offers the best scenario for a cell tower location with respect to all other properties in
the area.

Dear Jaymia and Planning Staff,
I am a concerned property owner in Spearfish, although not a property owner within 140 feet of the proposed project at
6775 E. Colorado Blvd., all residents will be affected as we drive on Interstate 90 or Highway 85 South.
I am writing regarding the Letter of Intent and Application for a CUP from Primary Network Solutions LLC, Horvath
Communications and Verizon. All out-of-state entities. Let me preface that I have been a loyal Verizon customer for over
20 years and have no plans to switch carriers, even though it is not the most economical option, it has been the most
reliable. I tested this by driving to the corner of Hwy 85 South and E. Colorado Blvd (the proposed site of this CUP
applicant(s) tower). I had 3 bars of service, without the benefit of a new 120' tower.
I am not naive to think progress and infrastructure needs will have to change as more dependance on wireless services
grow, however there are ways for our rural haven not to be polluted with "galvanized, unpainted steel 120 foot
monopoles". It is very telling that the surrounding property owners "were not interested in the tower height or the lease
business terms".
I urge the planning commission to require the applicant(s) to incorporate architecturally integrated or camouflage
technologies to this monolith to disguise the eyesore that in the staff's own response to General CUP Evaluation Criteria
#4: "Visual impacts of this project extends a significant distance beyond the subject property". I have seen cell towers
that look like pine trees. We will have to look at this potential eyesore for decades to come. I urge the city to be long
range visionaries rather than in-the-moment developers.
