I move that Ordinance No. 09142026-222 be referred for further study and consideration and returned
to the City Council for consideration at its regular meeting on March 8, 2027.
In conducting this review, the Council recognizes that the proposed ordinance addresses two distinct
matters: the proposed expansion of Sunday alcohol-sale hours and the proposed reduction of late-night
on-premises alcohol-sale hours. These matters shall be considered independently based upon the facts,
applicable law, and policy considerations relevant to each.
With respect to the proposed reduction of late-night on-premises alcohol-sale hours, during the review

and any additional relevant incidents occurring during the review period.
The affected establishment shall be requested to submit to the City, within thirty (30) days of this action,
a written safety and security plan addressing the public-safety concerns associated with its late-night
operations and identifying measures implemented or proposed to address those concerns. The plan
should address, as applicable, security staffing and procedures; employee training; management of

the Montevallo Police Department.

the applicable state and local authority governing Sunday alcohol sales, and any other information
Council determines relevant to consideration of the proposed change.
Ordinance No. 09142026-222 shall return to the City Council for consideration at its regular meeting on
March 8, 2027.
Nothing in this referral shall prevent the City Council from considering either matter at an earlier
meeting should circumstances warrant earlier consideration. In particular, significant additional publicsafety incidents or circumstances associated with late-night operations may warrant earlier
consideration of the proposed late-night alcohol-sale restrictions.

Public Comment to Montevallo City Council Meeting (English)
ICE / Immigration Enforcement Activity in Montevallo

Monday, September 28th, 2026

My name is Chris Nelson, and I own property at 8775 County Road 73, Montevallo, Alabama.
I am here again tonight to speak up about and provide evidence for Immigration and Customs Enforcement (ICE)
activity in Montevallo.
On Thursday, September 17th, at around 8:00 am, I was made aware of an ICE agent present in the Pic 'n Say
grocery store parking lot, along Highway 25 in Montevallo. By 8:25 am, I had arrived at the location, and soon
found the ICE agent in his vehicle, parked in the front lot of Montevallo Shell! Cantina Grill, at 4640 Highway 25. I
took several photographs, which I have shared with you, and passed around the audience here.
In one of the photographs, you can see the Shell gas station and Sneaky Pete's sign reflected on the vehicle's
surface. The Pic 'n Say grocery store sign is in the background. The ICE agent is sitting behind the steering
wheel, wearing a vest that reads "POLICE ICE" in large yellow letters.
The other photograph shows the vehicle as an unmarked black Chevrolet Tahoe, with heavily tinted windows, and
Alabama license plate AOEH9U0. You can see that he had backed into a parking space, facing the gas pumps,
ten to fifteen yards away. He has what appears to be a mobile phone, with the camera exposed, pointing forward
towards the gas pumps.
Montevallo Shell! Cantina Grill is frequented by working-class members of the Latino community, where they
purchase fuel for their trucks and vans, as well as supplies and food for themselves. I can't think of a reason why
an ICE agent would be parked in that location, unless he was intentionally surveilling people coming and going
from the gas station. There are ample spots, outside of the public view, where he could park otherwise.
After photographing the agent, I first sent the images to Birmingham Migra Watch, a volunteer project that verifies
and reports ICE and DHS activity in the Central Alabama area. Bham Migra Watch has over 44,000 followers on
Facebook, and almost 10,000 followers on Instagram. There are many others like me who know how to document
and report ICE activity.
Within ten minutes, Bham Migra Watch had posted the confirmed sighting, to alert the community. That post has
been reshared 76 times. I then went inside Montevallo Shell I Cantina Grill, and told the staff about the agent.
They didn't seem aware that he was there. I advised them what to do if he entered the establishment, to exercise
their 4th Amendment rights against unreasonable search and seizure.
ICE has gained a national reputation for not following proper procedure and using excessive force when
attempting to detain people. I would advise people not to expect local authorities to intervene in those
circumstances, and to exercise their own best judgement to protect themselves and their families.
The First Amendment gives you the right to photograph and video law enforcement, including ICE agents, in
public spaces. If you see suspected ICE activity, please document as you are able, and report it to Bham Migra
Watch, either by phone at 1-888-664-2325, or online via Facebook or Instagram: @bhammigrawatch
I'll be in the lobby as tonight's meeting concludes, if anyone has any questions.

Public Comment to Montevallo City Council Meeting (Spanish)
ICE/ Immigration Enforcement Activity in Montevallo

Monday, September 28th, 2026

City Council Meeting: September 28, 2026
Ms. Sarah Hogan Shaw, program director provided the following report:
LOT Leadership Retreat: Impact and the MJCC will host the Leaders of Tomorrow here at
City Hall for a day-long Leadership Retreat. I'll let Natalie tell you more about that. You are
welcome to stop by anytime to greet and interact with these students.
Substance Related Deaths: As you may have seen in the news, two Ole Miss students, an 18
yr old and an 20 yr old lost their lives and the substance Kratom was found at both scenes.
I've talked with you before about this substance, it is illegal in the State of Alabama, but
available in our surrounding states, and as we see with this tragedy is still being sold under
the counter by businesses where it is illegal. Kratom, often referred to as the Gas Station
Heroin, originates from a South Asia Tree where the leaves contain two major psychoactive
ingredients (mitragynine (Ma-tra-gy-nine) and 7-hydroxymytragynine (hydroxy-ma-tra-gynine). At low doses, kratom produces stimulant effects with users reporting increased
alertness, physical energy, and talkativeness. At high doses, users experience sedative
effects. Kratom consumption can lead to addiction. Those two active ingredients, are now
being isolated and sold as single compounds. Again, this is how manufacturers find loopholes and continue to pressure the system to keep up with laws. The substance is marketed
as a natural supplement but is highly addictive with opioid like effects' it is very dangerous.
Please have conversations with teens and loved ones about not blindly trusting "natural"
substances from our gas stations.
~. October Celebrations: October is a very busy month, and National Go Sober for October and
Anti-Bullying Month. These are the themes, Impact will using for our education and
community outreach.
Fire Prevention Parade: We look forward to being a part of this weekend's Fire Prevention
Parade, and will be set up in the park following the parade.
,b Flock Party: The City is happy to partner with the University and the County to host a FREE
Street concert, The Flock Party, next week, Thursday, October 8 from 6:30-9:00 at the
intersection of Oak and N. Boundary Street to celebrate the Inauguration of Dr. Michelle
Johnston as the University's 16th President. Please plan to join us and help spread the word,
bring your chair, and let's all flock together for this momentous celebration.
ik Red Ribbon Week: Red Ribbon Week is fast approaching and will be held the last week in
October, the 26c" thru the 30~". This year's theme is Be A Hero, Live Drug-Free. I've had great
meetings with our partners at our local schools and the university. The week will be full of
engaging activities for our youth and community. Although, we are disappointed that our

1

first responders chose not to participate in the Annual Chief's Challenge this year, with the
help of our youth, we are revamping the event to more of a Community Relay Challenge.
Information about the Challenge will be released by the end of the week and we hope some
of you will be interested in signing up to interact with our youth in a fun way to celebrate
living a drug-free life style.
d. Coalition Meeting: The Impact Coalition will meet on Tuesday, October 6, please join us on
zoom for impactful discussions and planning.
