A. Mayor's Announcements:
Mayor Sutton reported on his attendance at the Arizona League of Cities and Towns annual
conference in Phoenix, held the previous week. He stated the conference provided valuable
information to bring back to the community and highlighted a conversation regarding water use and
data centers, reporting that:
A farm field with crops may use, depending on the crop, between five and ten times the amount of
water used by a modern data center operating a closed-loop system.
A residential neighborhood may use approximately three-quarters of the water used by such a data
center.
Modern closed-loop, recycled-water data centers use substantially more power than older data centers
with water chillers, resulting in a trade-off between water use and power use depending on the
technology employed.
Mayor Sutton further noted that the conference included informative sessions regarding the water
situation in Arizona and the Colorado River, and encouraged the Council to keep the water-andpower trade-off in mind as new data center proposals are presented.
Mayor Sutton also thanked the Council for its ongoing efforts to educate itself and for its attendance
at recent conferences.
B. Council Members' Announcements
Vice-Mayor Tarango reported that she attended the League conference and that the week prior, she
and Councilmember Galindo attended the ASU 2026 Summer Policy Retreat, which addressed the
state of water and housing, and included a panel on data centers. Key points she shared included:
The importance of ensuring that growth pays for itself.
A statement attributed to APS that data centers should pay for their own power rather than shifting
costs to residential ratepayers.
Attendance at League sessions on water, housing, elected official development, and data centers.
Recognition of Eloy by panelists as one of the few communities that has already addressed data
centers in its city code, and her observation that the City was ahead of the issue, in contrast to its
earlier experience with solar development.
Councilmember Galindo reported that housing, water, and data centers were the leading topics at the
ASU summit. She noted that data centers were originally viewed as an efficient means of repurposing
abandoned big-box retail buildings, but that the industry has since expanded to large-scale facilities.
She emphasized the need for the City to maintain control over such development, similar to its
approach with solar, and stated that Eloy is fortunate to have adequate water for now. She reported
that a discussion with a Central Arizona Project representative underscored the need for greater
advocacy at the State legislative level regarding Colorado River allocations and the upper basin states.
She also reported that the League conference provided valuable discussion on communicating with
constituents, including the limits of responding to social media and the importance of assuring
constituents that non-engagement does not signal a lack of listening.
Councilmember Snyder reported that he found the conference to be time well spent and

that discussions with officials from other communities indicated Eloy is comparatively stable.
He summarized discussions regarding:
A council member from Benson addressed an aluminum facility and pollution concerns,
where the planning and zoning commission could approve matters without Council review.
A council member from Oro Valley addressed the use of non-disclosure agreements by city staff
and whether the Council should approve such agreements.
A council member from Florence stated that an outgoing City Manager's personnel actions
were questionable, regarding the firing of their Fire Chief.
He further reported on a discussion with a vice president of finance for APS regarding the 20- to
25- year timeline required to plan, permit, and construct new generation capacity, and on the
history of data centers in Arizona. He explained that Utilities Built infrastructure to serve the
pre- recession housing boom, and after that growth collapsed, actively recruited data centers to
utilize the surplus capacity. He noted that subsequent demand from electric vehicles,
artificial intelligence, semiconductor manufacturers, and aerospace users has outpaced
generation capacity. He also reported that panelists indicated many land acquisitions and
rezonings for data centers are speculative and that most such projects will never be built.
C. City Manager's Announcements
City Manager Mackenzie Letcher announced:
A free Movie Under the Stars event on Saturday, August 29, 2026, at 7:30 pm at Jones Park
featuring a film on the life of Michael Jackson. Attendees were encouraged to bring chairs,
blankets, and snacks.
A community yard sale on Saturday, September 5, 2026, from 6:00 am to 12:00 pm at Main
Street Park. Vendor spaces remained available and may be reserved online through the
community services portal on the City's website.
Monsoon season sandbag availability. Following recent storm activity, the Streets Division
has sandbags available to residents, limited to six filled sandbags per household, available at
the Public Works facility, 1137 West Houser Road. Residents were directed to call Public
Works at (520) 466-3082 for additional information.
VII. Consent Agenda
Mayor Sutton asked if any items were to be removed for discussion. No items were removed.

B. A Resolution correcting a scrivener's error in Resolution No. 25-1616 regarding a Notice to
Increase Rates and Charges of the Wastewater System for the City of Eloy, and Renumbering said

Intention to Increase Rates and Charges of the Potable Water System for the City of Eloy and

for Proposition 202 Grant Funds for Purchasing one (1) SCBA/Equipment Washer for the Eloy Fire

F. Adopt Ordinance No. 26-1005 of the Mayor and City Council of the City of Eloy, Pinal County,
Arizona, Adding Section 12-2(D) to the Eloy City Code Authorizing the City Attorney and City
Clerk to correct scrivener's errors in the City Code, ordinances, resolutions, and minutes.
Motion: Councilmember Garcia moved to approve the Consent Agenda as presented.
Second: Vice-Mayor Tarango seconded the motion.
Vote: Motion passed 6–0 by roll call vote.
VIII. Business: Discussion and/or Action Items
A. Presentation by Annette Gaston, PFM Asset Management, LLC, on the City's Investment
Portfolio as of June 30, 2026.
Ms. Gaston advised that PFM Asset Management present to the Council approximately twice each
year, covering the second quarter and the end of the fiscal year. Ms. Gaston presented the portfolio
summary as of June 30, 2026, and provided an economic update. Key points included:
The portfolio market value at the end of June exceeded $35 million, reflecting growth of
approximately $163,000 from the first quarter to the second quarter.
The unrealized loss of approximately $203,000 at quarter-end was attributable to point-in-time
market movements, as the market yield rose from 3.82% at the end of March to 4.16% at the end of
June.
The realized gain for the second quarter was approximately $15,500; the portfolio experienced no
realized losses.
The yield at cost at quarter end was 3.91%.
The portfolio is invested 100% in U.S. Treasuries allocated over a one- to three-year duration, and
all holdings are within the City's investment policy parameters.
Accrual basis earnings for the period April 1 through June 30, 2026, totaled approximately
$359,000.
Ms. Gaston reported that trades placed on the date of the meeting were at approximately 4.5%,
which would be reflected in the third quarter report.
Economic Update: Ms. Gaston reported that domestic growth has been strong, with potential
headwinds from energy shocks — noting duration rather than magnitude as the greater concern —
and geopolitical uncertainty. She reported the labor market remains in good balance, that investment
in artificial intelligence has recently displaced consumer spending as the primary driver of growth,
and that corporate fundamentals remain strong. She noted the Federal Reserve left policy rates
unchanged, with the front-end target range anchored between 3.50% and 3.75%, and that no change
was expected at the September meeting. Inflation has hovered near 3% against the Federal Reserve's

2% target, with the most recent Consumer Price Index reading declining approximately one-tenth of
one percent. She noted that Treasury yields moved higher during the quarter and that the steepening
yield curve provides additional reinvestment value for the City's portfolio.
Council Discussion:
Councilmember Curtis asked whether the unrealized loss of approximately $203,000 was a
concern. Ms. Gaston responded that it was not, explaining that the figure represents a point-in-time
measure of market movement and that the City has realized only gains for the quarter and the prior
year.
Councilmember Snyder asked about the difference in rates between money market funds and
Treasuries. Ms. Gaston explained that money market funds are tied to durations of three months and
under and track the Federal Reserve target range of approximately 3.50% to 3.75%, while a twoyear Treasury was yielding approximately 4.17%. She noted the City targets the two- to five-year
portion of the curve, with five years as the maximum permitted maturity.
Councilmember Snyder also asked whether flattening inflation suggested future rate increases.
Ms. Gaston explained the Federal Reserve's dual mandate of price stability and full employment,
noted the Federal Reserve is data dependent and looks for trends rather than single readings, and
stated that a rate hike is not off the table. She reported markets had been pricing in one rate increase
of approximately 25 basis points in December, with a September increase now largely removed
from expectations following the most recent CPI reading, and characterized a near-term rate hike as
approximately a 50-50 possibility.

RECOMMENDATION:
Council consider and authorize the acceptance of proposals from MHQ of Arizona to
up-fit two (2) new 2026 Ford F-150 Responder Trucks with emergency equipment for
$44,139.01 and $50,408.64, respectively, for a total amount of $94,547.65, with pricing
per Arizona State Contract # CTR078487.
DISCUSSION:
The Eloy Police Department requests approval to accept two proposals from MHQ of
Arizona to up-fit two (2) new 2026 Ford F-150 Police Responder Trucks.
The two vehicles have been secured through Enterprise Leasing under the City's
existing vehicle leasing contract, with the lease arrangements reviewed and approved
by the Finance Department. Funding for two new police vehicles was included in the
City's adopted FY 2026-2027 Capital Improvement Plan (CIP) budget, as approved by
the Mayor and Council.
The comprehensive up-fit packages include emergency lighting and siren equipment,
push bars, ballistic door panels, center consoles, equipment mounting systems,
prisoner transport equipment, vehicle communications and electronics components,
and installation of Department-provided equipment necessary to place the vehicles into
service. The up-fit packages also include vehicle-specific equipment based upon the
intended operational use of each truck.
MHQ of Arizona will complete the up-fit of both vehicles with pricing per Arizona State
Contract # CTR078487, for a combined cost of $94,547.65, including applicable sales
tax.

FISCAL IMPACT:
The total fiscal impact for both proposals combined is $94,547.65. Funding for the
vehicle up-fits is included in the Capital Improvement Plan budget for FY 2026-2027,
which was approved and adopted by the City Council.

RECOMMENDATION:
Staff recommends that the Mayor and City Council adopt Resolution No. 26-1678,
acknowledging and accepting an award from the Gila River Indian Community StateShared Revenue Program in the amount of $87,100 for a one-year grant period, on
behalf of the Eloy Fire District. The grant funding will support the Eloy Fire District in
providing essential fire and emergency services to the community.
DISCUSSION:
The City of Eloy has received notification from the Gila River Indian Community (GRIC)
Office of Special Funding that the Eloy Fire District’s 2026 State-Shared Revenue
Program application for the Eloy Fire Cancer Prevention Project has been
recommended for funding in the amount of $87,100.
As part of the grant award process, the City of Eloy will serve as the governmental
pass-through agency on behalf of the Eloy Fire District. GRIC requires the City Council
to adopt a resolution formally acknowledging the grant award and the City’s willingness
to accept and administer the funds on behalf of the Fire District.
The $87,100 grant award will be used by the Eloy Fire District to purchase two SelfContained Breathing Apparatus (SCBA)/equipment washers. This specialized
equipment is designed to assist with the cleaning and decontamination of SCBA and
other firefighting equipment following emergency responses. Proper decontamination
helps reduce firefighters’ exposure to potentially harmful contaminants and carcinogens
that can accumulate on equipment during fire suppression activities.
Approval of Resolution No. 26-1678 will authorize the City to accept the grant funding
as the pass-through agency and facilitate the transfer of the funds to the Eloy Fire
District for the approved cancer prevention project.

FISCAL IMPACT:
The fiscal impact will be $87,100 as the City will act as the Fiscal Agent for the grant.
The Fire Department will purchase the equipment, then seek reimbursement from the
City for the purchase.

A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF ELOY, ARIZONA, APPROVING THE ACCEPTANCE OF A
GRANT FROM THE GILA RIVER INDIAN COMMUNITY OF $87,100
FOR THE USE OF FUNDS TOWARDS THE COST OF PURCHASING
TWO (2) SCBA/EQUIPMENT WASHERS FOR THE ELOY FIRE
DISTRICT
WHEREAS, firefighting and rescue services for the City of Eloy are provided by the
Eloy Fire District; and
WHEREAS, Eloy Fire District needs two (2) SCBA/Equipment Washers to comply with
cleaning standards; and
WHEREAS, in 2002, Arizona voters passed Proposition 202 which allowed for the
continuation of limited Indian gaming on tribal lands in Arizona, and under Proposition 202,
Arizona tribes agreed to share a portion of their revenues with the State of Arizona and, of the
revenues shared, twelve percent is made available to cities, towns, or counties for a purpose
benefiting the general public through either direct distribution to the local governments or in the
form of a deposit to the State of Arizona's Commerce and Economic Development Commission’s
Local Community Fund; and
WHEREAS, for its 2026 revenue sharing, the Gila River Indian Community chose to
contribute directly to local governments and is seeking requests for funding proposals from
Arizona cities, towns, and counties; and
WHEREAS, the Eloy Fire District desires to accept funds awarded by the Gila River
Indian Community for Proposition 202 grant funds to be used towards the costs of purchasing
two (2) SCBA/Equipment Washers; and
WHEREAS, the Mayor and City Council of the City of Eloy, Arizona believe it is in the
best interest of the citizens of the City of Eloy to accept funds awarded by the Gila River Indian
Community for Proposition 202 grant funds to be used by the Eloy Fire District towards the costs
of two (2) SCBA/Equipment Washers.
NOW, THEREFORE, BE IT RESOLVED THAT THE MAYOR AND CITY
COUNCIL OF THE CITY OF ELOY, ARIZONA, hereby approves the acceptance of
awarded funds in the amount of $87,100 from the Gila River Indian Community for Proposition
202 grant funds to be used by the Eloy Fire District towards the costs of purchasing two (2)
SCBA/Equipment Washers.

RECOMMENDATION:
Council authorize the purchase of one (1) 2024 Ford F-150 Police Responder
demonstration vehicle from San Tan Ford, fully equipped with an MHQ emergency
equipment upfit package, using Proposition 207 funds, in an amount not to exceed
$80,000.00.
DISCUSSION:
The Eloy Police Department is requesting authorization to purchase a 2024 Ford F-150
Police Responder demonstration vehicle from San Tan Ford. The vehicle was used by
Ford to showcase its emergency equipment upfit relationship with MHQ and currently
has approximately 1,600 miles.
The vehicle is already fully equipped with emergency lighting, siren, and related police
equipment installed by MHQ. The Department currently uses MHQ for emergency
equipment upfit services; therefore, the equipment and installation will be consistent
with and standardized to the Department's current patrol vehicle builds.
Although the vehicle is a 2024 model, it has very limited mileage and is being offered at
a substantial discount because it is an aged demonstration unit. San Tan Ford's
proposal includes a State contract discount and an additional dealer discount specific to
this vehicle. The total delivered price, including the vehicle, MHQ emergency
equipment upfit, and applicable sales tax, is $79,545.72.
Based on the Department's recent vehicle purchases and emergency equipment upfit
costs, acquiring a comparable new patrol vehicle and completing a separate upfit would
cost approximately $60,000.00 more than this fully equipped demonstration police

vehicle. This opportunity will allow the Department to acquire a low-mileage, fully
equipped patrol vehicle at a savings of more than 40 percent compared to purchasing
and equipping a comparable new vehicle. The vehicle will also be available for
operational use much sooner than a new vehicle requiring a separate emergency
equipment upfit.
This purchase was not included in the adopted FY 2026-2027 budget. However, the
opportunity has been reviewed by the City Manager and approved to move forward for
City Council consideration due to the significant cost savings and benefit to the
Department's operational readiness.
The vehicle being replaced in the Police Department's fleet will be transferred to
another City department, allowing the City to extend its useful service life.
The purchase of this vehicle includes pricing per Arizona State Contract # CTR059323,
Phase 2.
FISCAL IMPACT:
The total fiscal impact of the purchase of this police vehicle is $79,545.72. Although the
purchase was not included in the adopted FY 2026-2027 budget, sufficient Proposition
207 funds are available to complete the purchase.

RECOMMENDATION:
Staff recommends that the City Council adopt Ordinance No. 26-1006, approving an
amendment to Chapter 2 Administration, Article IV Commissions, Boards and Bureaus,
Division 6. Building Advisory and Board of Appeals, Section 2-111, and declare an
emergency.
DISCUSSION:
The proposed amendment to the Eloy Code’s Chapter 2 provisions pertaining to
Building Advisory and Board of Appeals, would establish a temporary mechanism to
address vacancies and ensure the Board has sufficient members to conduct its
business. The amendment would authorize the Mayor to appoint up to five (5) City
Council members to serve as voting members of the Building Advisory and Board of
Appeals when vacancies prevent the Board from maintaining a quorum. The appointed
Council members would possess the same rights, duties, and obligations as regular
Board members and would remain subject to all applicable provisions governing the
Board’s conduct, procedures, and jurisdiction.
The amendment is intended to provide continuity in the administration of the City’s
Building and Fire code appeals process while City staff and the City Council continue
efforts to recruit qualified individuals to serve on the Board. An appointed Council
member would serve for a one-year term unless the vacancy is filled sooner, at which
time the Council member’s appointment would terminate. The Mayor would also be
authorized to designate an appointed Councilmember as Chairperson or Vice

Chairperson when those positions are vacant and to revoke an appointment at any
time. The amendment would also allow the City to maintain a functioning Building
Advisory and Board of Appeals during periods when qualified appointments are
unavailable, thereby supporting the timely consideration of matters within the Board’s
jurisdiction and promoting the health, safety, and welfare of the community.
The proposed modifications to Chapter 2 Administration, Article IV Commissions,
Boards and Bureaus, Division 6. Building Advisory and Board of Appeals, Section 2111 are included as Exhibit 1 to Ordinance 26-1006 attached to this report.

FISCAL IMPACT:
No fiscal impacts are anticipated with the adoption of this ordinance.

WHEREAS, City Code currently states to be eligible for appointment to the Building
Advisory and Board of Appeals, a person shall have qualified experience and training in
building or infrastructure construction matters. Furthermore, a person must have resided in
Pinal County, Arizona, for a minimum of six (6) months and maintain residency within Pinal
County for the duration of the term to which he or she has been appointed; and
WHEREAS, the City of Eloy currently does not have a quorum of members to serve
on the Building Advisory and Board of Appeals despite City Staff and City Council trying to
recruit qualified individuals either resident or nonresident to serve on the Board; and
WHEREAS, the Ordinance is a necessary amendment to the City’s Building and Fire
Codes and is enacted for the preservation of the peace, health, and safety of the City of Eloy,
Arizona, an Emergency is declared to exist, and this Ordinance shall become immediately
operative and in force from and after the date of its adoption.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF ELOY, ARIZONA, AS FOLLOWS:
SECTION I. ELOY CODE AMENDMENT. That the Mayor and City Council of the City
of Eloy, Arizona, approve the amendment to the Eloy Code, hereby amending Chapter 2
Administration, Article IV Commissions, Boards and Bureaus, Division 6. Building Advisory
and Board of Appeals, as specified in Exhibit 1, attached hereto and incorporated herein by
reference.
SECTION II. SEVERABILITY. If any section, subdivision, clause, phrase, or portion of
this Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and

such holding shall not affect the validity of the remaining provisions of the Ordinance or parts
thereof.
Section No. III: The passage of this Ordinance is necessary for the immediate preservation
of the peace, health and safety of the City of Eloy and an emergency is declared to exist and
this Ordinance is effective immediately upon passage by the Eloy City Council.
SECTION III. EFFECTIVE DATE. This Ordinance shall become effective as provided
by law on September 14, 2026.

Section 1.: Amend Chapter 2 Administration, Article IV Commissions, Boards and

Members; Filling of Vacancies; and Removal of Members, to add subsection L, as follows:
2-111: APPOINTMENT OF MEMBERS; FILLING OF VACANCIES; AND REMOVAL OF
MEMBERS:
L. Mayoral Appointment of City Council Members to the Building Advisory and Board of
Appeals.
1. The Mayor shall have the authority to appoint up to five (5) members of the City Council
to serve as voting members of the Building Advisory and Board of Appeals from time
to time, for the purpose of filling vacancies on the aforementioned Board.
2. Members of the City Council appointed pursuant to this subsection shall serve on the
Building Advisory and Board of Appeals as voting members for the purpose of
presiding over matters as further described in this Division.
3. Term of Appointment.
a. Each City Council member appointed under this subsection shall serve as a
member of the Building Advisory and Board of Appeals for a term of one (1) year
from the date of appointment, unless sooner terminated as provided herein.
b. Notwithstanding subsection L.3.a, the term of an appointed City Council member
shall terminate prior to the expiration of the one-year term upon the City Council's
appointment of a person or persons to fill the vacancy in accordance with the
provisions of this Division.

Authority.

a. An appointed City Council member shall possess all rights, duties, and obligations
of a regular member of the Building Advisory and Board of Appeals during the term
of their appointment.
b. The appointment of a City Council member under this Section shall not affect their
duties, rights, or obligations as a member of the City Council.
5. No more than five (5) City Council members shall serve as voting members on the
Building Advisory and Board of Appeals at any one time pursuant to this Section.
6. The Mayor shall have the authority to designate one of the appointed City Council
members to serve as Chairperson or Vice Chairperson of the Board, provided that no
Chairperson or Vice Chairperson, respectively, has been appointed or is currently
serving in such capacity at the time of the Mayor's appointment.
7. The Mayor may revoke the appointment of any City Council member serving on the
Building Advisory and Board of Appeals under this Section at any time, with or without
cause, by providing written notice to the appointed member and the City Clerk.
8. All other provisions of this Division governing the conduct, procedures, and jurisdiction
of the Building Advisory and Board of Appeals shall apply to City Council members
appointed under this Section.
9. In the event of a conflict between subsection L and subsections C, D, E, or F of this
section, or Section 2-122.F., subsection F shall govern.
