As we convene for the Durham County Commissioners meeting, it's crucial to
recognize the painful truth of history. We stand on the stolen ancestral lands of the
Catawba, Eno, Occaneechi, Shakori, and Tuscarora peoples, whose deep connection to
this land predates our arrival. We acknowledge with humility the unjust displacement
and violence that occurred, leading to the dispossession of indigenous peoples from
their homelands. Their resilience in the face of such adversity is a testament to their

Sheriff’s Office Operating Budget, as well as appropriating $142,587.23 in PAYGO
funding to the Sheriff’s Office Operating Budget for a total of $1,076,051.72 to
support the first year of a five-year contract with Tritech Software Systems, a
CentralSquare Technologies Company (CentralSquare Technology) and upgraded
computer-aid dispatch and report management systems; and authorize the County
Manager to execute subsequent renewals, not to exceed $2,835,557.06.
This request will upgrade our current on-premises CAD system to a more secure,
cost effective, and flexible cloud-based solution. Moving CAD to the cloud will
provide our communicators and deputies with a more reliable system. In the event of
extreme weather or a catastrophic incident that prevents the need for staff to respond
to physical locations, communicators will have the ability to work remotely using a
secure vendor-provided connection. This upgrade also enhances cybersecurity

protections for the system, which is critical as attacks on CAD servers continue to
increase. Transitioning to the cloud will reduce the Sheriff's Office overhead costs
associated with hardware, power, and cooling. System maintenance and security
responsibilities will shift to the cloud provider, further lowering operational expenses.
Additionally, the cloud-based system will reduce capital investment requirements and
provide the flexibility needed as the Sheriff's Office footprint continues to grow.

to recognize $28,153 for LSTA Grant Funding Awarded by the State Library of
North Carolina to fund the “Learning Through Play” Initiative.
The grant will fund the “Learning Through Play” initiative which aims to develop
interactive early literacy kits, create cognitive toys tailored to diverse needs, offer
STEAM-infused early literacy programs, and hold workshops for early readers’
caregivers. This program is supported by grant funds from the Institute of Museum
and Library Services under the provisions of the federal Library Services and
Technology Act (LSTA) as administered by the Library of North Carolina, a division
of the Department of Natural and Cultural Resources (IMLS grant number
LS-260837-OLS-26).”

not to exceed $114,800 for construction oversight services for the
Whispering Pines Stream Restoration and Stormwater Improvement
Project

Agenda Text:

The Board is requested to authorize the County Manager to enter into a contract with
Ardurra not to exceed $114,800 for construction oversight services for the
Whispering Pines Stream Restoration and Stormwater Improvement Project.
The Whispering Pines Mobile Home Park Stream Restoration Project was identified
in the County Stormwater Nutrient Management Strategy as a potential project for
compliance with the Falls Lake Nutrient Management Rules. The project consists of
approximately 1,700 linear feet of stream restoration and a bioretention pond to treat
stormwater on the property. The stream restoration project will remove sources of
nitrogen and phosphorous from streambank erosion - helping the County meet the
nutrient requirements of the Falls Lake Rules - while also reducing flooding impacts to
residents of Whispering Pines Mobile Home Park.
Ardurra was selected following a qualification-based selection process. The County
has worked with WK Dickson (Ardura) on the design and permitting for the

Whispering Pines Project. WK Dickson was acquired by Ardurra in 2025, and the
same team of engineers will continue on the project.
The Whispering Pines Project will be funded by a combination of grant funding
(+80%) and County Stormwater Utility Fee dollars.
Alignment with Strategic Plan: This agenda item supports Strategic Plan Goal 4:
Environmental Stewardship and Community Prosperity. More specifically, it supports
the objective of improving water quality and reducing flooding hazards to residents.

Approval of the FY27 Durham Annual Transit Work Program Global
Operating and Capital Agreements

Agenda Text:

The Board is requested to approve the FY27 Durham Annual Transit Work Program
Global Operating and Capital Agreements.
The FY27 Durham Annual Transit Work Program (Work Program) serves as the
annual budget for the Durham County Transit Plan. It includes the projected revenues
and expenditures, along with a Multi-Year Operating Plan and Multi-Year Capital
Improvement Plan. The Work Program was approved by the BOCC on June 8,
2026, and by the GoTriangle Board of Trustees on June 24, 2026.
A Global Agreement is an operating or capital funding agreement covering a logical
grouping of capital projects, transit operations or studies. To receive reimbursement
for project expenditures identified in the Work Program, Durham County must enter
into Global Operating and Capital Agreements (Global Agreements) with GoTriangle,
the Administrator of the Triangle Tax District, and Triangle West TPO for projects
awarded federal funding.
The Global Agreements will allow the County to request up to $1,408,463 in FY27
for eligible operating and capital expenditures, as well as reimbursement for carryover
capital projects.
To qualify for reimbursement, GoTriangle must enter into Global Agreements with
Durham County and, when applicable, Triangle West TPO for federally funded

projects.
The Global Agreements will allow GoTriangle to request up to $16,785,562 in FY27

Temporary Agency, in the Amount of $255,747.66 to support the
Board of Elections for the upcoming General Election

Agenda Text:

The Board is requested to approve the Durham County Board of Elections request to
enter into a service contract with Roth Staffing, a temporary employee agency, in the
amount of $255,747.66. Roth Staffing will provide temporary employee services to
support election-related operations and other operational needs of the Department
throughout the contract term.
Temporary employees will provide pre-election, election, and post-election support
for the following election during the contract period:

County Board of Elections to operate efficiently and effectively, consistent with the
County’s Strategic Plan. Enabling the Board of Elections to acquire this service will

Interiors, Inc. for administrative office and miscellaneous furnishings
from the NC State Contract (5610A-Furniture) and/or Omnia Partners
buying programs in a total amount not to exceed $134,600 for the
new Sheriff’s Training Facility.

Agenda Text:

The Board is requested to authorize the County Manager to enter into contract with
PMC Commercial Interiors, Inc. for the purchase of administrative office and
miscellaneous furnishings from the NC State Contract (5610A-Furniture) and/or
Omnia Partners buying programs to furnish the new Sheriff’s Training Facility. The
total contract authorization will be in the amount not to exceed $134,600, which
includes a 10% owner’s contingency at $12,242.09.
G.S. 143-129(e) allows local governments to be exempted from competitive bidding
requirements in lieu of purchasing furnishings/equipment through group purchasing
programs. This provides Durham County with the deepest discount possible for
purchases under the respective purchasing programs. Purchases under this request
will be made in accordance with the NC Department of Administration (DOA)

Statewide Term Contract 5610A-Furniture and Omnia Partners collaborative buying
agreement (see attachments).
Construction of the New Sheriff’s Training Facility is currently underway and is
scheduled for substantial completion in November 2026, with anticipated occupancy
by staff the following month. This will require all furniture installations to be in place
prior to occupancy by staff. The Sheriff’s Office and Engineering Departments have
collaborated with RND Architects and agree with their recommendation that the
County proceed with the procurement of the items referenced in the attached
proposal.
Funding for this purchase is available in the Sheriff’s Training Facility project account.
Alignment with Strategic Plan: This aligns with the Strategic Plan Goal Sustainable Infrastructure and Environment - through the improvement of an existing
facility while repurposing land that is the site of a closed landfill and by providing
consolidated Basic Law Enforcement Training (BLET) services into one facility,
providing more efficient training/service delivery.

Durham Sports Commission Interlocal Agreements (ILA) Renewal

The Board is requested to consider the renewal of two Interlocal Agreements (ILA)
with the Durham Sports Commission (DSC). The first pertains to the operations of
the Commission while the second ILA addresses annual funding. The Commission
operates under an agreement between the City of Durham, Durham County, the
Greater Durham Chamber of Commerce, and Discover Durham. Established in 2016,
this agreement formally defined the DSC as a 501(c)(3) nonprofit managed by
Discover Durham.
The Commission is governed by a nine-member Board of Directors, with three seats
appointed by each of the three participating governmental and business entities. Under
the ILA, the commission is tasked with generating positive economic and social
impact by recruiting and managing youth, amateur, collegiate, and professional
sporting events in the Durham area. The DSC works alongside Discover Durham to
enhance the city's sports tourism infrastructure, which features venues like the Durham
County Memorial Stadium and the Durham Bulls Athletic Park.
There are several suggested changes for the Operations ILA including a proposed
increase in the Commission’s Board of Directors from nine members to twelve. The
Funding ILA takes into consideration the recent creation of Durham Next and
proposes a significant reduction in the County’s financial obligation from $201,250 in
FY 2026 to $79,972 in FY ’27 (approved by the Durham BOCC in the FY
2026-2027 Adopted Budget), and a final reduction to $25,000 per year from FY
’28 to FY ’30.

Based on the two responses Durham County received regarding RFP 26-036R,
Carolina Civilworks Inc. and Axis Utility Inc. were both determined to be qualified
contractors. Carolina Civilworks Inc. and Axis Utility Inc. have provided the services
requested for Durham County with outstanding results.
Durham County issued a Request for Proposal (RFP 26-036R) on June 8, 2026.
RFP 26-036R was advertised in local newspapers and on the Durham County
website. Two proposals were received on July 9, 2026. The proposal bid tabulation
and evaluation summary are attached.

while Durham County will hold the easement, which will permanently prohibit future

Data Center Moratorium Discussion (60min)

The Board is being asked to provide staff with guidance on a draft moratorium
regarding data centers. A public hearing on the moratorium has tentatively been
scheduled for August 24, 2026. As data centers have expanded across the state and
nation, some jurisdictions have enacted temporary moratoria on new facilities, citing
concerns about rising utility costs and environmental effects.
Large-scale data centers, data processing facilities, cryptocurrency mining operations,
and similar uses can require significant electricity and water resources and may have
impacts on infrastructure, the environment, and surrounding communities.
The table of permitted uses in the current Unified Development Ordinance does not
define “data centers,” “data processing facilities,” “cryptocurrency mining operations,”
or any other uses associated with data processing facilities. The County needs time to
develop appropriate, comprehensive standards to ensure that any future development,
and expansion of any such facilities, is consistent with the County's long-term land use
plan and protects the public’s health and interests.
Additionally, the Durham Code of Ordinances does not consider the impact of the
aforementioned uses on existing County infrastructure. Some data centers are already
located in Durham, but the impact of their continued development and expansion is
not yet regulated. A temporary moratorium on accepting and processing new
applications for such facilities, with possible exemptions, is a reasonable and
necessary measure to allow County staff and the Planning & Development
Department sufficient time to study the issues, engage with stakeholders, draft

should have a 100-county impact. Staff have received a few proposals from County
Departments which are included in this packet. During this discussion, the Board is
also asked to share any other proposed items to include so that staff may prepare
them for final review and approval at the next regular meeting.
All items submitted must be approved by the Board and forwarded to NCACC via
their portal. The organization has set August 14th as the deadline for receiving items.
Following a period of vetting with the various committees and the NCACC Board of
Directors, the membership will adopt final goals at the NCACC Legislative Goals
Conference later this year.
Goals must be submitted by: Adopted resolutions from full boards; A letter from
board chairs on behalf of the full boards; or A letter from the resident of an affiliate
and/or related county organization.
Alignment with Strategic Plan: This item aligns with all of Durham County’s
Strategic Goals
Resource Persons: Deborah Craig-Ray, Chief Communications Officer and other
departments that have submitted items.
County Manager’s Recommendation: The County Manager recommends that the
Board discuss any proposed statewide legislative items, submit additional ones and
instruct staff to bring back a final listing for approval at the August 10th meeting so
that Durham County may submit its legislative goals to NCACC by the August 14th
deadline as required.

The Board is requested to suspend the rules and vote to appoint the following
Commissioners for the 2026 NCACC 119th Annual Conference held on August
20-22, 2026, in Durham, NC.
The Board is requested to appoint Commissioner Michelle Burton as the voting
delegate and Commissioner Wendy Jacobs as the voting alternate for the NCACC
Annual Conference.
Alignment with Strategic Plan: This item aligns with Strategic Goal: High
Performing Organization
Resource Persons: Dr. Mike Lee, Chair
County Manager’s Recommendation: The County Manager recommends that the
Board vote to appoint Commissioner Michelle Burton as voting delegate and
