Approval of Minutes for the January 27, 2026, Meeting
Member Owens moved to approve the minutes of January 27, 2026, Planning Commission
Meeting. The vote was unanimous, and Chairperson Plain declared the motion carried.
General Business
1. Comprehensive Plan Update Presentation.
Marc Kurbansade, Community Development Director introduced Keith Walzak, with DTJ
Design and Keith presented the updated Comprehensive Plan.
A discussion ensued; no formal action was taken.
Staff reports: Marc Kurbansade stated that the next Planning Commission meeting will include
one agenda item, followed by a training session for new members. A handout will be provided to
help members better understand the overall development process.

With no further business, the meeting adjourned at 6:41 p.m.

Request
The purpose of the public hearing is to consider a request for initial zoning of property proposed
to be annexed to the City known as the Front Range Farms Annexation. The requested zoning
for the Front Range Farms Annexation is Planned Unit Development (PUD).
The role of the Planning and Zoning Commission is to recommend initial zoning for the
petitioned annexation location; the Planning and Zoning Commission does not recommend if the
land should be annexed. The City Council is tasked with the legislative authority to review and
determine the eligibility of a voluntary annexation petition.

Background
Front Range Farms, Inc. owned the property from 1988 to 2026. TBRB, LLC bought the
property on January 22, 2026 The site is currently zoned Agricultural (A) in unincorporated Weld
County. The site remains largely undeveloped, aside from limited oil and gas extraction
activities.

Proposed Zoning Designation
The Petitioner has requested an initial zoning designation of Planned Unit Development (PUD).
The purpose of the PUD zoning district is to provide an alternative to conventional land use
regulations by allowing more flexible development, based on a comprehensive, integrated plan,
without in any way jeopardizing or reducing zoning standards, which promote the public safety,
convenience, health and general welfare, while preserving personal and property rights. The
PUD zoning district also seeks to provide well-located, clean, safe and pleasant industrial sites
involving a minimum strain on transportation systems, while improving the design, character,
and quality of new development.
Relation to Comprehensive Plan
The petitioned site is located within the Commerce District as identified in the City of Dacono’s
Comprehensive Plan, Dacono Forward. The district envisions this area as a gateway to the
community, emphasizing high development standards, quality building materials, and visually
appealing site design. The proposed PUD zoning and data center development directly support
this vision by committing to modern, high-quality construction and incorporating site design
elements that ensure compatibility with existing and future surrounding land uses.
The Commerce District is intended to accommodate businesses and industries as dominant
land uses, consistent with the data center proposed for the site. The PUD zoning advances the
district’s guiding principles by fostering economic growth, supporting business diversification,
and promoting efficient development patterns. Additionally, the flexibility inherent in PUD zoning
allows for strategic site planning, ensuring that infrastructure investments – such as road
improvements and utility expansions – are made in a manner that benefits both this
development and future growth in the area.
Key goals of the Commerce District include strengthening the city’s tax base, ensuring highquality development, and creating a business-friendly environment near both residential and
non-residential uses. The proposed data center aligns with these objectives by bringing a longterm, tax-generating use to the area while maintaining design and operational standards that
minimize potential land-use conflicts. Measures such as buffering, strategic site layout, and
architectural design standards will ensure consistency with the surrounding built environment.
Moreover, the Dacono Forward Comprehensive Plan identifies a strategic initiative to complete
the city’s economic development infrastructure – such as transportation, utilities, and community
amenities – to attract and sustain business investment. The proposed PUD zoning supports this
goal by enabling a land-use framework that accommodates light industrial and technologybased industries, ensuring the site and its surrounding area remain viable for long-term
economic development.
Overall, the proposed PUD zoning and data center development are well-aligned with the city’s
long-term vision for the Commerce District, balancing economic growth, high-quality
development, and infrastructure investment in a way that supports Dacono’s continued
prosperity.

Staff Recommendation
Staff recommends approval of PC Resolution 26-02, recommending an initial zoning request of
Planned Unit Development (PUD) for the Front Range Farms Annexation, finding:
1. Land zoned PUD will not have a negative impact on adjacent residents as this zone
provides an alternative to conventional land use regulations by allowing more flexible
development, based on a comprehensive, integrated plan, without in any way
jeopardizing or reducing zoning standards, which promote the public safety,
convenience, health and general welfare, while preserving personal and property rights.
2. The requested PUD zoning is consistent with the City of Dacono’s adopted
Comprehensive Plan and advances the goals of strengthening the city’s tax base,
ensuring high-quality development, and creating a business-friendly environment near
both residential and non-residential uses.

A RESOLUTION RECOMMENDING APPROVAL OF INITIAL ZONING OF PROPERTY
PROPOSED TO BE ANNEXED TO THE CITY OF DACONO AND KNOWN AS THE
FRONT RANGE FARMS ANNEXATION
WHEREAS, a petition for annexation of the property known as the Front Range
Farms Annexation to the City of Dacono, has been filed with the City Council of the City
of Dacono; and
WHEREAS, the petition requests the City concurrently zone the property
Planned Unit Development (PUD) in accordance with Chapter 16 of the Dacono
Municipal Code; and
WHEREAS, Section 31-12-115 of the Colorado Revised Statutes provides an
annexing municipality may institute procedures to zone land proposed to be annexed at
any time after the City Council has found the petition for such annexation is in
substantial compliance with C.R.S. §§ 31-12-104 and -105 and Section 30 of Article II of
the Colorado Constitution; and
WHEREAS, by Resolution No. 26-07 adopted on January 26, 2026, the Dacono
City Council made such finding that the annexation petition was in substantial
compliance and expressed its desire to permit simultaneous consideration of the subject
property for annexation and zoning, as requested in the petition; and
WHEREAS, a draft zoning ordinance has been prepared for consideration by the
City Council, a copy of which draft ordinance accompanies this resolution and has been
reviewed by the Planning Commission; and
WHEREAS, after a duly-noticed public hearing, at which evidence and testimony
were entered into the record, the Planning and Zoning Commission finds the PUD zoning
of the property should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF DACONO, COLORADO:
Section 1. The Planning and Zoning Commission hereby recommends approval
of the initial zoning of the property proposed to be annexed to the City known as the Front
Range Farms Annexation as Planned Unit Development (PUD), as set forth in the draft
ordinance that has been prepared for consideration by the City Council.

AN ORDINANCE ZONING PROPERTY ANNEXED TO THE CITY OF
DACONO AND KNOWN AS THE FRONT RANGE FARMS ANNEXATION
WHEREAS, a petition for annexation of certain property, described in Exhibit A
attached hereto and made a part hereof, and known as the Front Range Farms
Annexation, was filed with the City Council of the City of Dacono; and
WHEREAS, the property was annexed to the City by Ordinance No. ____; and
WHEREAS, the City Council must provide for the zoning of the property; and
WHEREAS, the City Council provided notice of the public hearing on said zoning by
publication as provided by law; and
and

WHEREAS, no protests were received by the City pursuant to C.R.S. § 31-23-305;

WHEREAS, the landowner of the property requested Planned Unit Development
(PUD) zoning for the property described in Exhibit A; and
WHEREAS, the PUD zoning classification sought by the landowner is consistent
with the City’s plan for the area encompassed by the Front Range Farms Annexation; and
WHEREAS, the Dacono Planning Commission has held a public hearing on the
landowner’s zoning request and forwarded its recommendation to the City Council, and the
City Council has duly considered that recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DACONO, COLORADO:
Section 1. The property known as the Front Range Farms Annexation, the legal
description of which is set forth in Exhibit A and which property is depicted in Exhibit B,
both of which are attached hereto and made a part hereof, is hereby zoned Planned Unit
Development (PUD) pursuant to the zoning ordinances of the City, and the City zoning map
shall be amended accordingly.
Section 2.

Ordinance No. 1001 is hereby repealed.

PUBLISHED AND POSTED IN FULL this 9th day of March, 2026.
