a Paving 5,700 feet from Highway 9 costs $700,000.00; adding an extra 4,600 feet

11:15 a.m. Public Hearing - Tabernash Construction dba Good to Go Portable Toilet
Storage Special Use Permit

e Exhibits Entered: Exhibits A through J were formally entered into the record by County
Attorney Maxine LaBarre-Krostue.
e Staff Presentation: Hannah Mahorney, Community Development Planner.

o Request for a Special Use Permit (SUP) for dry storage of portable toilets by Good to
Go on a 30-acre property (Bergquist Outright Exemption) along County Road 5.

o Storage began in 2022; a neighbor complaint received in early 2026 prompted the SUP
requirement.

o Blight Cleanup & Relocation:

a The Planning Commission initially tabled the item due to site blight. The applicant
subsequently removed 3 to 4 40-yard dumpsters of debris, abandoned vehicles,
and old logging equipment.

m= To resolve neighbor visibility concerns from two homes in Fairways at Pole
Creek, a revised site plan moves the storage area southward into a natural
terrain depression screened by trees, making it invisible from CR 5 and adjacent
residences.

o Key Operational Conditions:

= Toilets must be stored clean and dry; no on-site washing, pumping, or
chemical/odor discharge permitted. The main pumping hub remains in
Tabernash.

= Storage is restricted strictly to portable toilets (no company service trucks/heavy
equipment stored long-term, except 1-2 pieces used for site cleanup and moving
units).

= No new timber/logs allowed to be brought onto the property.

= Full site cleanup deadline set for August 12, 2027.

e Public Comment:

o Bryce McCallum (Online): Raised concerns regarding unpermitted historical use, lack
of physical screening fences, and delayed cleanup timelines.

o Scott Gessler (18 Ridge Court / Pole Creek): Expressed appreciation for the cleanup
efforts and urged complete site cleanup as quickly as possible.

o Applicant & Staff Response: Hannah Mahorney noted that over 20 neighbors
attended initial Planning Commission meetings, and applicant outreach successfully
resolved neighbor concerns, resulting in low public attendance.

e Board Deliberations:

o Commissioners reviewed site photos and commended the significant blight removal
progress.

© Confirmed that natural topographical/vegetative screening is sufficient, noting that
screening requirements can be re-evaluated during the annual permit renewal if tree
cover changes.

e Motion 1 (Approval): Commissioner Merrit Linke moved to approve the Good to Go Inc.
Portable Toilet Dry Storage Special Use Permit with the 15 conditions presented by the

Planning Department (including the unnumbered condition) for a term of one year expiring
August 12, 2027, and authorize the Chair to sign all applicable documents.

e Decision: Motion passed unanimously (3-0).

e Motion 2 (Close Public Hearing): Commissioner Merrit Linke moved to close the public
hearing.

11:35 a.m. Lunch with Attorney, County Manager, and Grand County Housing Authority

1:00 p.m. Workshop - Solar, Wind, Oil and Gas, and Data Center Regulations;
Community Development

e Data Centers:

© Discussion: Community Development Director Kris Manguso reviewed national trends
(moratoriums in 500+ communities, state bans/pauses due to immense water/power
draw and noise).

o Board Consensus: Directed staff to maintain the current moratorium while drafting a
comprehensive Special Use Permit (SUP) regulatory framework modeled after Logan
County, CO. Guardrails will mandate rigorous impact analyses covering water
source/recycling, grid power capacity, road/dust impacts, noise, aesthetics, and wildlife
mitigation.

e Wind Energy Regulations:

© Discussion: Reviewed large utility-scale wind turbines (100--200+ ft tall) versus small
residential systems ($\le 35$ ft). Large turbines carry heavy environmental footprints
(blade disposal, 80-150 gallons of gear oil changed every 9-30 months, wildlife/eagle
impacts, visual corridor impacts, massive concrete foundations).

o Board Consensus: Maintain existing small-scale residential wind regulations ($35$ ft
or under). Draft strict SUP regulations for commercial/utility-scale wind to protect scenic
views, wildlife corridors, and local infrastructure, while keepirig options open for local
utility partners (Mountain Parks Electric).

e Solar Energy Regulations:

o Discussion: Identified solar as the most viable renewable technology for Grand
County. Rooftop and small residential systems ($\le 25$ kW) are heavily permitted and
supported.

o Board Consensus: Develop distinct SUP regulations for commercial/utility-scale solar
farms exporting power. Focus guardrails on visual screening, avoiding prime
agricultural/meadow lands, battery storage safety, and land reclamation.

e Battery Energy Storage Systems (BESS) & Emerging Technologies:

o Board Consensus: Draft separate SUP regulations for commercial battery storage
units (focusing on fire suppression, footprint, and containment), recognizing advancing
solid-state battery technology.

e Oil & Gas Regulations:

o Discussion: Existing regulations date back to 2005/2006. While Grand County has
Zero producing wells, regional exploration exists near Jackson County.

o Board Consensus: Update local oil and gas SUP regulations to align with or exceed
current Energy and Carbon Management Commission (ECMC) state standards.
Increase the county financial assurance/bonding minimum significantly above the
current $500,000.00 level, mandate horizontal/directional drilling techniques, enforce
strict riverAwaterway setbacks, protect surface owners, and cover exploration activities.

e Master Plan & Zoning Code Update:

o Kris Manguso provided a brief update on the ongoing Master Plan process. The Board
requested periodic progress check-ins at 25%, 50%, and 75% milestones prior to final
tegulatory drafting.

2:30 p.m. Public Hearing - Colorado Skijoring / dba Grand Lake Skijoring Temporary
Use Permit

Official Meeting Minutes

o Request for a Temporary Use Permit (TUP) for the Grand Lake Skijoring event on
January 29-31, 2026, relocated from the Town of Grand Lake to Winding River Ranch
(County Road 49).

o Event parameters: Daily spectator cap of 5,000; on-site parking cap of 600 vehicles; 15
acres cleared for parking/contestants; 30-45 portable toilets (65 ADA); Waste Ranch
Creek trash services (bear-proof containers); 24-hour security; quiet hours (7:00 p.m. —
7:00 a.m.).

© Transportation plan: Two dedicated "The Lift" transit buses running continuous 16-
minute round-trip routes from Grand Lake stops (Mountain Market, Sagebrush,
Gateway Inn, Grand Lake Lodge); free parking incentive for carpools of 5+; on-site tow
trucks for unauthorized parking on CR 49.

o Emergency services letters received from Sheriff, EMS, and Grand Lake Fire approving
on-site ambulance/fire staging at the track and bridge transfer protocols.

e Public Comment:

o Skylar (Resident): Raised concerns regarding overlapping emergency service
demands with the concurrent 39th Annual Three Lakes Ice Fishing Contest (950—1,200
anglers) and the lack of a formal traffic egress/contingency plan.

o Jana Sampson (CR 494 / Columbine Lake): Spoke regarding winter hazards on CR
49 S-curves, math/shuttle capacity mismatches, and risk of spectator overflow onto
Columbine Lake private roads.

° Katie Ellis (President, Columbine Lake HOA): Requested a full traffic management
plan, realistic ticket caps matching transit capacity, mandatory "Local Traffic Only"
barricades/signage at all 6 Columbine Lake access points, and prohibition of private
road usage. Submitted two written letters into the record (Exhibit O: Mark & Suzanne
Silverthorne; Exhibit P: Eric Smaldone).

o Todd Holzwarth (CR 424 / Columbine Lake): Spoke in support of the event organizers
and noted CR 49’s historical commercial use for gravel hauling.

o Jonas Pearson (Manager, Columbine Lake HOA): Expressed support for skijoring
generally but opposed the venue location, citing lack of advance HOA communication,
ticket pre-sales prior to permit approval, and traffic safety impacts.

o Morgan Hale (Resident / Participant): Supported skijoring but expressed concerns
over town economic benefit, emergency service strain, and event egress.

o Donald Stern (124 Mustang Trail): Expressed concerns regarding narrow winter road
width, shuttle turnaround math, and vehicle backups.

o Josh Sewell (Columbine Lake Owner - Online): Requested a hearing continuance
due to receiving staff reports late over the holiday weekend and raised private road
access concerns.

o Eric Smaldone (CR 49 Owner - Online): Highlighted the lack of an independent
traffic/environmental impact study for CR 49 and questioned shuttle throughput math.

e Applicant Response (Matt & Travis):

o Clarified ticket sales have not launched.

o Explained parking/shuttle logistics: 600 cars on-site plus continuous shuttles can move
2,100+ attendees gradually between 8:00 a.m. and 1:00 p.m. Offered to purchase/staff
additional "Local Traffic Only" barricades for all Columbine Lake entrances and
coordinate directly with the HOA.

o Confirmed backup heavy equipment (loaders/graders) and tow trucks on-site to handle
snow clearing or vehicle clearance.

e Board Deliberations:

o Commissioners expressed strong concerns regarding unaddressed traffic egress,
potential CR 49 gridlock, shuttle capacity math, concurrent event impacts (Three Lakes
Ice Fishing), and lack of direct coordination with the Columbine Lake HOA.

Official Meeting Minutes
