Public Comment
Terry Hammond, Mosca, wanted to address the topic of data centers. She said that several other
neighboring counites were placing moratoriums on data centers and she would like to see Alamosa
County place a moratorium on them as well. She believes that they consume too much water and they
are huge monstrosities that contribute to noise pollution.
Vern Heersink asked County Attorney, Jason Kelly, to explain a little about the County’s current
position on data centers. Jason Kelly said that data centers can mean a lot of different things. The big
concern that a lot of people have, at least in this community, is around hyperscale data centers. There
is not currently anything in Alamosa County’s Land Use code, that would directly apply to a hyperscale
data center. If Alamosa County were to get an application for a hyperscale data center, Jason Kelly
would probably recommend to deny the application because it's not in the code and there is not
1|Page

anything even remotely like it. At that point, a moratorium could be enacted so regulations could be
developed within the land use code. For the time being, if an application came in for a small data
center that was smaller in scope for a small solar generation that was maybe one or two containers,
that may be different. But right now, Alamosa County does not have any way to regulate them.

Consent Agenda
Consent Agenda items are AVSAR General Volunteer MOU, Coopers Liquor License Renewal,
Treasurer’s July Fund Report, Local Impact Accelerator Grant, and IGA with Rio Grande Water
Conservation District for Revegetation Project.
Lori Laske asked to pull the Local Impact Accelerator Grant from the Consent Agenda.
motion/second, Laske/Van Ry motion to approve the remaining Consent Agenda items.
Motion passed unanimously
Richard Hubler explained that the Local Impact Accelerator Grant is the grant that is from the state of
Colorado Energy Office. They're passing through a fund that they got from the EPA, $5 million or so in
projects overall. That is where the funding will come from to fund the revegetation pilot project. That is
the IGA that the Rio Grande Water Conservation District is going to be performing on Alamosa County’s
behalf, and then Alamosa County will be spending the remainder of the money on policy consultants.
This grant is the final scope of work and the final budget was sent to the state's contracting office. This is
a 100% grant, with no match required.
motion/second, Laske/Van Ry motion to approve the Local Impact Accelerator Grant and Contract
once it is reviewed by legal counsel.
Motion passed unanimously

Public Hearings
See August 12, Public Hearing Minutes – Jeremiah Webb, Major Site Plan revocation, 6153 US Why 160
(parcel 528502300013)
Lori Laske said that she can understand the difficulties working with CDOT. A traffic study did need to
be done and she is disappointed that it wasn’t. She is leaning towards giving an extension as opposed
to revoking the permit because she knows how difficult it can be to work with CDOT. However, the
burden is on the property owner and they have to comply with CDOT and the conditions they require.
Jason Kelly suggested adding the extensions in increments so that the deadlines could be monitored.
Richard Hubler asked if the decision could be tabled instead for 90 days which would give the property
owner time to initiate the traffic study and start the application process with CDOT. At that time, the
Commissioners could reconsider the extension or revocation based on the amount of work completed.
motion/second, Laske/Van Ry motion to table the Site Plan 23-003 Revocation until the November 10

CDOT.

Minutes for the Public Hearing - Jeremiah Webb, Major Site Plan revocation,
6153 US Why 160 (parcel 528502300013)
August 12, 2026 9:00 am Commissioners Chambers
Alamosa County Services Center, 8900 Independence Way, Alamosa, CO 81101
Members Present:
Vern Heersink, Chair
Arlan Van Ry, Vice-Chair
Lori Laske, Commissioner
Roni Wisdom, County Administrator
Jason Kelly, County Attorney
Jamie Greeman, Deputy Clerk
Richard Hubler, Land Use Director, presented for consideration the revocation of a Major Site Plan
that was approved for Jeremiah Webb several years ago. The applicant was not able to meet the
conditions of approval. In this case, one of the requirements was to obtain an access permit from
CDOT, which he has failed to do. As a result, Richard Hubler is proposing to revoke the approval and
close down the operation.
Jeremiah Webb said that when they bought the property, they confirmed through their due diligence
process that they did have access to the property there. They have had numerous problems with
CDOT over the years and there has been a lot of staff turnover at CDOT and Jeremiah Webb claims
that CDOT has also had poor record keeping.
Richard Hubler asked if there ever had been a traffic study performed at that property.
Jeremiah Webb said that it was his understanding through his due diligence process of the land purchase that
they would not have to do a traffic study.
Richard Hubler clarified that this matter about the access permit is specifically to the access that was
proposed and accepted as part of the site plan. This development of approximately two acres on the highway
frontage does have access from the north. There's about 46 feet of existing County Road 5.6 that overlaps it.
The application to CDOT for an access permit initially began in 2021, which was prior to submitting the
application to Alamosa County, however it was not complete, so CDOT couldn't process it. CDOT had been
telling Jeremiah Webb since early in the process, that he would need to perform a traffic study. That is also
the Staff contention, is that is what's required to move forward with this from CDOT, and to meet the
condition of the County is to complete the traffic study, and to submit the complete application. As of this
meeting, neither of those things have taken place.
Richard Hubler added that if there is ever a change in use, an increase in traffic, a new development on a
vacant land which borders the state highway, that will require an updated access permit.
Public Comment:
Cindy New, Mosca, asked if anybody ever wanted to put in a new business, would they also have to do a
traffic study.
Page | 1

Richard Hubler said that it is usually required for a change in use or an expected increase in traffic. It can vary a
little bit between cases.

II.

Project Description
This project serves to address the public health need of maintaining immunization
awareness and vaccination rates in Colorado. Local public health agencies shall
support core immunization services, according to established best practices and
standards, to improve the health of individuals and communities.
The Colorado Department of Public Health and Environment (CDPHE) is funded by
the Centers for Disease Control and Prevention (CDC) to address vaccinepreventable and other serious communicable diseases and to reduce the risk of
disease transmission, severe illness, and death. The project supports Local Public
Health Agencies (LPHAs) through the Vaccines for Children (VFC) program and
creates a coordinated infrastructure to align with national immunization standards.
The project supplies Section 317 Program vaccines at no cost to remove the
financial barrier for adults without insurance. The project counters vaccine
hesitant attitudes and beliefs by engaging the community and delivering education
in the service area. The project encourages healthcare providers and school-based
settings to use the Colorado Immunization Information System (CIIS), and to
contribute to the centralized system by entering data. The project engages public
health and healthcare professionals to develop and implement local activities and
evidence-based strategies to reduce mortality and morbidity rates caused by
vaccine-preventable diseases, and protect the health of Coloradans.

Case Memorandum
County Commission Meeting
Date:
August 12, 2026
Case Number:
SP 26-02
Applicant:
John Turner
Prepared By:
Darcy Barraclough, Planner & Richard Hubler, Director
Subject:
John Turner, Applicant, is requesting approval of a Major Site Plan to operate a shipping and
packing facility similar to warehouse and freight movement described in Section 2.4.4.P of the
LUDC on property currently addressed as 2528 S County Rd 100 (Parcel 528718200021).
This property is in the Industrial (I) zone district.
The legal description of the property is: Tract 2, Pure Water Division of Land, according to the
plat recorded July 29, 2013 under Reception No. 353546, County of Alamosa, State of
Colorado.
Public Notice Process:
Public Notice was published in the Valley Courier on July 1, 2026. Neighbor notification letters
for 34 property owners were mailed on July 8, 2026.
Background:
The subject property is an undeveloped lot zoned as Industrial. The Applicant recently sold an
adjacent parcel to the south where he had been operating his shipping and packing business,
County Line Pack & Ship. The Applicant desires to build a new office on the subject parcel,
and proposes a temporary portable building to operate as the office in the interim and while the
permanent structure is under construction.
Neighboring Zoning and Development:
The subject property is located ~610 ft north of the intersection of S County Rd 100 and US
Highway 160, near the west county boundary. To the south of the subject parcel lies a
commercial building that previously housed the County Line Pack & Ship, Truck Rack, and
Best Go Bag, in addition to strip of industrial zoned properties developed as the recycle facility
for Mountain Disposal and an RV and vehicle storage facility. Further to the east along that
highway are commercial zoned lots comprising an RV park, the former Alta-Vista truck stop repermitted for self-storage, and the former High-Valley Healing dispensary and garden center.
Across the highway is Norcon fertilizer and the staging area for Hooper, an electric utility
services company. To the west across the county line are Valley Tractor Repair, Ecodynamics,
the Monte Vista Livestock Auction, and the Monte Vista municipal airport. Behind the highway
corridor developments, this area is zoned rural and is generally large lot agriculture uses,
including a number of active center-pivot farms and grazing lands.
Directly adjacent to the north is SLV Ice and to the north and east are irrigated fields. Adjacent
to the south lies the Applicant’s former location, and the recently permitted diesel repair, SLV
Church of Christ, and vehicle storage. Across Hwy 160 is a vacant 35 acre industrial lot and
600+ acre agricultural tract, both owned by Bryan and Brenda Malouff.

Comprehensive Plan Considerations:
The subject property is within the area along the corridor designated for Industrial
development, beyond which is prime agriculture.

Analysis of Relevant Regulations:
Section 2.4.4.P of the LUDC describes the warehouse and freight movement group of uses as,
“A facility involved in the storage or movement of goods for themselves or other firms. Goods
are delivered to other firms or the final consumer with little on-site sales activity to customers.
Warehouse and freight movement shall include the following: bulk storage, including
nonflammable liquids, feed and grain storage; cold storage plants, including frozen food
lockers; household moving and general freight storage; separate warehouse used by retail
store such as furniture or appliance store; bus barn; parcel services, mail order facility; transfer
and storage business where there are no individual storage areas or where employees are the
primary movers of the goods to be stored or transferred; or any similar use.” This commercial
use group is permitted in the industrial zone by right, and in the commercial zone by special
use permit.
Regarding specific development criteria, Section 4.2.3 requires one parking space per 1000 sf
of Gross Floor Area, of which one must be a van-accessible ADA space. The property
includes adequate area for parking and the site plan locates 5 parking spaces adjacent to the
roughly 800 square foot office building, including the ADA space. Staff feels the number of
parking spaces are adequate and will work with the Applicant on the installation of the required
ADA van-accessible space. Access is provided via an existing driveway to S County Road 100
that also serves as the easement to adjacent properties to the southeast.
During construction of the office and immediately following any county approval of this Major
Site Plan, the Applicant proposes to use a portable “construction shed” building to operate the
business. This custom shed is locally built and has been inspected by Department staff, but
does not contain any plumbing. The Applicant proposes to use the facilities in his former office
to the south, now owned by Eldon Detweiler.
The applicant has obtained an exempt commercial well permit #32407, and has contracted
with a county licensed OWTS company to install the septic, should the development be
approved by the county.
The proposed operation of County Line Pack & Ship on this subject property is consistent with
the prior operation over the last 4 years and is not expected to cause any noise, vibrations,
odors, or other nuisances to the surrounding area.
Regarding the Site Plan Approval Criteria in §8.7.9, Staff proposes the below findings:
A.

Consistency with the adopted plans; Staff believes that this industrial use is consistent
with the intent of the industrial zoning district and the future land use maps in the
Imagine Alamosa County comprehensive plan. This requirement has been met.

B.

Compliance with all applicable requirements of this LUDC; The subject property is in
an industrial/commercial corridor with recorded access to a county-maintained road
and the zone district allows for the proposed use. Staff proposes development related
conditions.

C.

Site design and development intensity is appropriate for and tailored to the unique
natural characteristics of the site, such as significant wooded areas, wetlands, and
floodplains; This is a developing area along the highway that lacks unique natural
characteristics. The proposed use is similar to nearby industrial and commercial uses.
This requirement has been met.

D.

For nonresidential and multifamily projects, the site plan displays the location of trash
handling, recycling, grease bins, and other waste-related facilities employed in the
normal operation of the use; Staff proposes a related condition.

E.

Adequacy and location of parking areas and pedestrian and vehicular access points;
The subject property has access to S County Rd 100 and the site plan identifies
customer parking spaces. Staff proposes related conditions.

F.

Compliance with site construction specifications; The applicant has provided a site
plan indicating parking spaces, but has not addressed signage or lighting. Staff
proposes related conditions.

G.

Adequacy of storm water facilities, water supply, sanitary sewer service, fire
protection, street signs, and street lighting as evidenced by conformance with
department standards, specifications, and guidelines; There are no storm water
facilities in this vicinity, and no history of stormwater management on this or
neighboring property. Like neighboring development, the subject property has limited
impervious area. The site plan identifies the proposed location of the septic system.
Well permit no. 342407 is adequate legal water supply for the proposed use. This
condition has been met.

H.

That the application will not substantially injure the value of adjoining or abutting
property, and will not be detrimental to the use or development of adjacent properties
or other neighborhood uses; This proposal continues the recent industrial utilization of
the general area. Staff does not believe this proposal will be detrimental to the use or
development of the neighboring properties, most of which are developed or actively
farmed. This requirement has been met.

I.

Compliance with requirements for easements or dedications; The deeded easement
that provides access to the neighboring tracts is known to the applicant and identified
on the site plan. No new easements or dedications are required. This requirement has
been met.

J.

Compliance with any applicable subdivision improvements; and This is not applicable.

K.

If applicable, compliance with the approved planned unit development master plan.
This is not applicable.

L.

Building design and materials uphold and promote high quality development in the
county and are compatible with other uses in the surrounding neighborhood. The
Applicant proposes to construct a new building similar to his prior office to the south.
This style and scale of development are generally consistent with the surrounding
area. This requirement has been met.

Comments from Review Agencies:
Agency Review letters were sent to the Sheriff and Road & Bridge, Alamosa County Fire
Protection District, SLV Water Conservancy District, Mosca-Hooper Conservation District,
Colorado Division of Water Resources, and the Colorado Department of Transportation.
There were no concerns from ACFPD. CDOT stated that a Level 2 Traffic study is required for
the US 160-County Rd 100 intersection to determine traffic volumes and further recommended
a combined access with the parcel to the south. Discussions with Road & Bridge indicated
minimal concern with this proposal impacting traffic in this area and limited expectation of
signalization. Staff does not believe that the proposed development increases traffic at the
Page 4 of 5

highway intersection by 20% and is discussing this requirement with CDOT. Road & Bridge
does require that the existing driveway/easement road connection with County Rd 100 be
upgraded to have an asphalt or concrete apron.
Kevin Boyle with DWR replied that the existing well is a legal water supply for the proposed
use. Heather Dutton with SLVWCD stated that augmentation is available only in the
unconfined aquifer. We did not receive any other responses.
Planning Commission Hearing and Recommendation:
The Planning Commission heard this case on August 12, 2026. There was discussion
regarding the business details, access and internal site circulation, signage, lighting and the
CDOT comments. There were no comments from the public and the Planning Commission
voted unanimously to Recommend Approval with the following conditions:
1. Prior to the hearing before the BOCC, the Applicant shall update the site plan to locate
pedestrian pathways and waste handling facilities.
2. If CDOT requires a new access permit for the Rd 100/Hwy 160 intersection, the
Applicant shall perform the traffic study prior to recording of the authorizing resolution or
the issuance of a building permit for the office. If CDOT requires changes to the
intersection or other measures not acceptable to the Applicant, the BOCC shall
reconsider the approval of this application.
3. The Applicant shall obtain all necessary permits from Alamosa County or the State prior
to performing any work, including signage, OWTS, building, plumbing, electric, and
stormwater.
4. Prior to operation, the Applicant shall install a concrete or asphalt apron for the existing
access to Rd 100 as specified by Road and Bridge.
5. Prior to operation, the Applicant shall install one concrete or asphalt vanaccessible/ADA parking space.
6. Any exterior lighting on the property shall comply with section 4.5 of the Land Use
Development Code as it relates to Dark Sky guidelines.
7. The site plan approval shall expire one year from the date of approval unless the
proposed development is pursued, as documented by obtaining a Certificate of
Occupancy for the office building.

Ms. Barraclough,
Thank you for providing us with the applications in front of the Alamosa County Planning Commission.
Below are our comments. Please let me know if you have any questions. Thank You
Turner: As stated in the application the water supply for this proposal is well permit no. 342407, an
exempt commercial well. Well permit no. 342407 allows up to 1/3 of an acre-foot of water to be
withdrawn annually for drinking/sanitary use in a business. Well permit no. 342407 is a legal water supply
for this proposal. If Tract 2 of the Pure Water Division of Land is changed the applicant should apply to
DWR to modify the well permit consistent with the parcel description.
Herrera: Our review showed no existing water sources on the subject property. If this application is
granted as an exempt subdivision by the BOCC each lot will qualify for an exempt well permit consistent
with parcel size.
Strata: This application proposes to use no water and to have no well. The application references that
there will be no permanent staff. If temporary staff require a restroom on site the applicant can pursue
an exempt commercial well permit to fulfill those needs.

Re: Agency review request

Hi Darcy,
Please see my comments regarding the latest round of landuse applications.
John Turner (Parcel 528718200021): This property is in the District's boundaries and can be
augmented if DWR determines augmentation is needed. Depletions from well pumping will be to the
alluvial aquifer. We cannot augment a deep or confined well in this location.
Ruben Herrera (Parcel 541124100354): This property is in the District's boundaries and can be
augmented if DWR determines augmentation is needed. Depletions from well pumping will be to the
Rock Creek drainage and require recharge. The District has an existing agreement with the Empire
Canal and a recharge facility within 3 miles of the property. As such, the agreements needed to
provide augmentation to the unconfined aquifer are in place. The District cannot augment the
confined aquifer in this location.
David Meyer of Strata, Inc. (Parcel 500714200257): This property is in the District's boundaries and
the District can provide augmentation at this location. However, the District is currently developing its
policies with regard to providing water for data centers. As such, I cannot provide a commitment of
water availability for this project at this time.
Please reach out if you have any questions about these comments.

Re: Agency review request

on behalf of Gallegos - CDOT, Kenneth

Darcy,
Thank you for the opportunity to review this proposed development.
Turner - There is no recorded Access Permit for Alamosa County Road 100. A CDOT Access Permit will be
required for the US 160-County Road 100 intersection with a minimum of a Level 2 Traffic Assessment
submitted for accurate traffic volumes. The proposed development will be a shipping and packing facility
and the traffic volumes and traffic types will need to be addressed. It is CDOT's recommendation that a
combined access at the proposed development's northern location be used including access to parcel
528736401033. Long term County Road 100 has the potential for signalization if it meets signal warrants.
If you have any questions please let me know.

considered noxious for the purposes of this article whether or not it appears on the noxious
weed list referenced above. No thistle or knapweed species contained on noxious weed list A, B,
or C may be considered ornamental vegetation.
(d) It is hereby declared to be a nuisance to fail to comply with the provisions of this section 14-51.
(Ord. No. 2-2015, § 1, 2-4-15; Ord. No. 4-2016, § 1, 2-17-16)
Sec. 14-52. - Failure to remove; notice; pre-abatement hearing, abatement.
(a) In the event of the failure of the owner, tenant or person in possession of any such real property
in the city to remove the weeds, noxious vegetation, trash and rubbish, as provided in section 1451, in addition to any citation that may issue pursuant to the provisions of section 14-56, the city
manager or the city manager's designee shall give written notice of violation upon the property
owner whose property is being kept contrary to the provisions of this article. Said notice shall
specifically describe the nature of the violation and shall include a statement that if the weeds,
noxious vegetation, trash or rubbish are not removed from the property within seven (7) days of
the date of service, if service is by personal delivery, or within ten (10) days, if service is by mail
and/or posting, the removal may be done by the city, and the whole cost thereof will be assessed
against the property. The notice shall also advise the property owner that the owner may appeal
the determination of a nuisance as contained in the notice of violation to the city manager by
filing with the city manager a written request for hearing stating the reason for the appeal within
that same time period provided for abatement.
(b) In the event a hearing is requested, the city manager shall set the hearing to be held within
fourteen (14) days of the date of the request. The owner may appeal in person and with counsel,
if so desired, and such hearing shall be duly recorded. After the hearing, the city manager shall

make a determination in writing of whether the nuisance exists, and mail such determination to the
property owner by regular mail at the owner's last known address, with a copy e-mailed in the event the
owner has provided an email address. If a nuisance is found to exist, the property owner shall abate it
within seven (7) days of the date of mailing of the city manager's written determination. The city manager's
determination of any such appeal shall have no probative value in any court proceeding on any citation that
may have been issued for the violation, except that, if the city manager determines a nuisance does not
exist, any such court proceeding shall be dismissed. If the owner is dissatisfied with the decision of the city
manager, the owner shall have the right to have the decision reviewed pursuant to Rule 106(a)(4) of the
Colorado Rules of Civil Procedure, provided that such a review is sought within the time and in the manner
provided by law. The decision of the city manager shall not be stayed pending any review except as
provided by Rule 106(a)(4) of the Colorado Rules of Civil Procedure.
(c) Service of the notice of violation may be obtained in one (1) or more of the following manners:
(1) By personally delivering a copy of the notice to the property owner, or the owner's agent, if
known.
(2) By mailing a copy of the notice by certified mail, postage pre-paid, to the property owner.
(3) By posting the property conspicuously with the notice. In the event the property is posted, a
copy of the notice shall also be mailed, by regular mail, postage pre-paid, to the property
owner at such owner's last known address as contained in the records of the county
assessor's office.
"Property owner" shall be defined, for the purposes of section 14-52, as the individual listed,
as of the date of the notice, in the records of the county assessor's office, as the current
owner of the property.
(d) The cost reimbursable to the city under subpart (a) shall be increased by an additional amount,
not to exceed one hundred dollars ($100.00), determined by the city manager or the city
manager's designee, for costs of inspection, documentation, service of notice, and other
incidental costs related to the enforcement of this section against an offending property owner.
This assessment shall be a lien against each lot or tract of land from which the weeds, noxious
vegetation, trash or rubbish were removed and shall have priority over all other liens, except
general taxes and prior special assessments.
(Ord. No. 2-2015, § 1, 2-4-15)
Sec. 14-53. - Notice of assessment for abatement; appeal.
(a) The city manager or the city manager's designee shall cause a written notice of the assessment
for costs of abatement to be mailed by certified mail to the owner of the property, at the owner's

fifteen (15) days from the date of the notice, request in writing a hearing before the city manager of the
owner's objections to the assessment.
(b) In the event such a hearing is requested, the city manager shall schedule the same to be held
within fourteen (14) days of the request for a hearing. The objector may appeal in person and
with counsel, if so desired, and such hearing shall be duly recorded. The city manger shall either
modify, affirm, or reverse such assessment after the hearing. Any owner of real estate dissatisfied
with the decision of city manager shall have the right to have the decision reviewed pursuant to
Rule 106(a)(4) of the Colorado Rules of Civil Procedure, provided that such a review is sought
within the time and in the manner provided by law.
(Ord. No. 2-2015, § 1, 2-4-15)
Sec. 14-54. - Failure to pay final assessment; collection.
In case such final assessment is not paid within thirty (30) days after the same has been assessed, or
within thirty (30) days after the final decision by the city manager after the hearing referenced above,
whichever occurs later, the city finance director shall certify the amount of the assessment to the county
officer having custody of the tax list, for placement of the assessment upon the tax list for the current or
next upcoming year, and such officer shall thereafter collect the same in the same manner as other taxes
are collected, with an additional ten (10) percent administrative processing fee thereon; and all the laws of
the state for the assessment and collection of the general taxes, including the laws for the sale of property
for taxes and redemption thereof, apply to and have full force and effect for the collection of all such
assessments. Any amount so collected shall be remitted to the city finance director by the county officer

Sec. 11-53. - Unauthorized camping on public property prohibited.
(a) It shall be unlawful for any person to camp upon any public property except in any location where
such camping has been expressly allowed by the officer or agency having the control,
management and supervision of the public property in question.
(b) No law enforcement officer shall issue a citation, make an arrest or otherwise enforce this section
against any person unless the officer orally requests or orders the person to refrain from the
alleged violation of this section and the person fails to comply after being given reasonable time
to do so.
(1) The officer has fist determined that there is space available in a publicly or privately operated
shelter within city limits, and such shelter will accept such person, or there is space available
in a campground or other public space within city limits, or within one mile of city limits,
expressly allowing camping; and
(2) The officer orally requests or orders the person to refrain from the alleged violation of this
section and the person fails to comply after being given reasonable time to do so.
(c) For purposes of this section:
(1) "Camp" means to reside or dwell temporarily in a place, with shelter. The term "shelter"

living such as eating, sleeping, bathing, or the storage of personal possessions. But the term
does not include napping during the day (from one hour after sunrise until sunset as

Atmospheric Administration) or picnicking. "Camp" does not include temporary residence
associated with the performance of a governmental service by emergency responders or
relief workers during a disaster emergency.
(2) "Public property" means, by way of illustration, any street, alley, sidewalk, pedestrian or
transit mall, bike path, park, open space, or any other structure or area encompassed within
the public right-of-way; or any other grounds, buildings, or other facilities owned or leased by
the city or by any other public owner, regardless of whether such public property is vacant or
occupied and actively used for any public purpose.
(3) Testimony by an officer or agent of the city of Alamosa that such officer or agent is the person
who grants permission to camp or lodge upon such property, or that in the course of such
officer's or agent's duties such officer or agent would be aware of permission and that no
such permission was given, is prima facie evidence of that fact.
