CNST-10 APPROVAL OF MAINTENANCE MAPS FOR A PORTION OF SE
PETTWAY STREET AND A PORTION OF SE DIXIE HIGHWAY IN HOBE
SOUND
Pursuant to the provisions of Section 95.361, Florida Statutes, staff requests approval of
two Maintenance Maps, one for a portion of SE Pettway Street for a maintained length of
1,040 linear feet, and one for a portion of SE Dixie Highway for a maintained length of
2,293 linear feet. Approval will establish prima facie evidence of ownership of the land by
the County to the extent and width that it has been maintained for the prescribed period.

At the August 25, 2026 meeting, the Board of County Commissioners (Board) directed
staff to bring an ordinance imposing a moratorium on large-scale data centers in
unincorporated Martin County. The proposed ordinance establishes a temporary interim
planning period and suspends the submission and acceptance of applications related to
large-scale data centers.

This is a second request by Kanner/96th Street Investments, LLC for certification of
property as an “agricultural enclave” pursuant to Sections 163.3162 and 163.3164, Florida
Statutes. Section 163.3162(4)(a), Florida Statutes, outlines the process for a property
owner to request that property be certified as an agricultural enclave. The criteria for
defining what qualifies as an agricultural enclave is found in Section 163.3164(4), Florida
Statutes.
