Staff Report by Jess Brooks (PDS Assistant Planner)
REZ26-6 of Richard Loan
October 12, 2026, Johnson County Planning and Zoning Commission
The applicant is requesting to rezone 1.82 acres from A-Agricultural to R-Residential.
The property is located at 2237 Rohret Rd SW, in the NW ¼ of the NW ¼ of Section 30, Township 79
North, Range 7 West of the 5th P.M. in Union Township, Johnson County, Iowa.
Exhibit 1: Location Map

Property Context
Based on aerial photography, the property appears to have been a farmstead with associated agricultural
buildings since at least the 1930s, with cropland surrounding the site. The current house was constructed
in 1913, according to County records. The property has been zoned as A-Agricultural since the 1960s
when zoning was adopted countywide and has never been formally platted.

Request
The applicant is requesting to rezone 1.82 acres from A-Agricultural to R-Residential to facilitate a
future subdivision.
Exhibit 2: Site Details

Land Use Policies and Plans
According to the Johnson County 2018 Comprehensive Plan, the property is located in the Agricultural
Future Land Use Category, where rezoning to R-Residential is potentially compatible, based on the
historic use of the property.
The following development elements are identified in the 2018 Comprehensive Plan. A thorough
examination of each element should be completed to appropriately analyze rezoning requests. Elements
identified as required must be met in order to be in compliance with the Comprehensive Plan.
Future Land Use Development Guidelines
1. Future Land Use Plan (required element)
Staff Analysis: Met.
The property in question is located in the Agricultural Future Land Use Category, where
rezoning to R-Residential is potentially compatible, based on the historic use of the
property. The existing house was built prior to December 1, 2000, so the historic
residential use is considered established.
2. Development Regulations (required element)
Staff Analysis: Met.
This request would facilitate future subdivision to create a buildable lot around the existing
dwelling. Staff see no impediments to meeting the development regulations of the Johnson
County Unified Development Ordinance (UDO).

Page 2

3. Road Standard (required element)
Staff Analysis: Met.
The site will use an existing access off of a gravel road (Rohret Rd SW) with 40 average
annual daily trips (IA DOT, 2018). Staff see no impediments to meeting the Road
Performance Standards of the Johnson County Unified Development Ordinance (UDO).
County Engineer had no objections.
4. Public Health Regulations (required element)
Staff Analysis: Met.
Staff see no impediment to meeting the requirements of Johnson County Public Health (see
Public Health Staff Report in Appendix A).
5. Emergency Services (recommended element)
Staff Analysis: Met.
The property is serviced by the Tiffin Fire Department, the Johnson County Sheriff, and
Johnson County Ambulance Service. Staff believes this property can be adequately
serviced by all three departments.
6. Environmental Impact (required element)
Staff Analysis: Met.
Future development, including subdivisions and certain Conditional Uses, would be
required to conform with UDO’s the Environmental Standards (chapter 8:3 of the UDO).
Approval of this rezoning should have minimal environmental impacts.
7. Negative Impact (recommended element)
Staff Analysis: Met.
The site is surrounded by agricultural uses. The farmstead has existed prior to the 1930s,
and continued residential use on this site should not, in staff opinion, create undue negative
impacts to the neighboring property.
8. Agricultural Impact (required element)
Staff Analysis: Met.
As the site has historically been used residentially and for agricultural outbuildings,
approval of the rezoning would minimize high-quality land removed from production and
should not create conflict with nearby agricultural operations.

External Jurisdictions
This site is not within a fringe area.

Conclusion
The applicant is requesting to rezone 1.82 acres from A-Agricultural to R-Residential to facilitate a
future subdivision to split the existing dwelling from the larger farm. The request appears to comply
with the goals and criteria of the Johnson County 2018 Comprehensive Plan.
Staff recommend approval of application SD26-06.

RE: 2237 Rohret Road SW, Oxford – Loan Subdivision
Dear Josh,
On behalf of Rose Ann Loan Revocable Trust c/o Richard Loan, we are submitting a 1lot, 1-outlot subdivision totaling 5.35 acres. A rezoning application is also being
submitted in conjunction to rezone the proposed boundary of Lot 1 from A to R. The
existing home was constructed prior to December 1, 2000, meeting the requirements of
an established historic residential use within the A – Agricultural Future Land Use
Category.
The existing home on proposed Lot 1 will remain. The well serving the home will also
remain. The applicant is planning to install a new septic system within the bounds of
Lot 1 to serve the existing home. The existing access point and driveway onto Rohret
Road SW will continue to be utilized. A 25.00 foot wide access easement has been
provided across Lot 1 to provide continued access to Outlot “A”.
Stormwater management has been deferred until building permit review and a full
sensitive areas waiver has been submitted on the subdivision.
Please let us know if you have any questions, concerns, or require any additional
information.
Respectfully submitted,

Land Use Policies and Plans
According to the Johnson County 2018 Comprehensive Plan, the property is located in the Residential
Future Land Use Category, and the AR – Agricultural Residential zoning district where subdivision for
residential use is compatible. The application must comply with Chapter 8:2 of the Johnson County
Unified Development Ordinance.

Staff Analysis: Met.
The subdivision plat complies with the standards set in the Preliminary and Final Plat
Specifications of the UDO.
8:2.7 Subdivision Principles.
Staff Analysis: Met.
The application complies with subdivision principles, including the Comprehensive Plan,
zoning regulations, Board of Health, other County regulations, Environmental Standards (see
below), land suitability, Right-of-Way dedication, outlot classifications, and Road Performance
Standards (see below).
8:2.8 Subdivision Design Standards.
Staff Analysis: Met.
The application complies with subdivision design standards, including naming requirements,
lot standards, road design, and potable water. No multi-family dwellings, density bonuses, or
cluster subdivision are proposed.
8:2.9 Other Requirements and Legal Documentation
Staff Analysis: Met.
All required legal documents are correct and signed.
UDO Chapter 8:3: Environmental Regulations
The applicant submitted a Sensitive Areas report for the subdivision, which has been approved by PDS
staff and identified onsite sensitive areas will be protected via Conservation Easement.
Stormwater management will be required prior to approval of any future building permits on the
property.

Infrastructure
The site will use two accesses (one existing, one newly approved) off of a public chip seal road with
1,170 trips per day (Iowa DOT, 2022). Per the Unified Development Ordinance (UDO), analysis must
be provided to determine if the secondary road system (i.e., the public roads) is sufficient for the
proposed development.
The site is within the 3-acre septic density areas of Johnson County. Johnson County Public Health
Department notes an existing septic and well for the property and recommend approval (see Appendix
A).

Road Performance Standards
Projected traffic volume is calculated by adding the current AADT count from IA DOT, the projected
number of trips if all existing platted and vacant lots along those roads would use Lake Manor Road and

Page 3

Sandy Beach Rd NE, and the number of vehicle trips projected for the additional buildable lots proposed
in this request. Per subsection 8:2.7.J.5.d each new dwelling unit is estimated to generate 10 vehicle trips
per day.
As shown in Table 1, there is sufficient excess trip capacity on Sandy Beach Rd NE and Lake Manor
Road NE to accommodate limited additional development, including the proposed subdivision.
The County Engineer has no objections to this application.

CAUTION: This email originated from outside of Johnson County! Do not click links, open attachments

Mr Wilensky, I am writing you today about concern over an application for the rezoning of property at
3212 Sandy Beach Road NE (SD26-000010). When we bought our property in 1992, within the plot
agreement of Sandy Beach Farms original subdivide, it states, “no lots within Sandy Beach Farms
Addition to Johnson County, Iowa, will be further subdivided”. That plotting document references
Johnson County Cause #44647. This cause should be something the Planning and Zoning Board
further research as they look to make changes to the original subdivision of Sandy Beach Farms.

A change for my neighbor at 3212 Sandy Beach Road NE could lead to other neighbors doing
something similar and this area becoming more populated. Further subdivision of any lot would lead
to more traffic on Sandy Beach Road. Traffic in the summer is vastly different than traffic in the winter
due to Sandy Beach Campground and boat ramp. I would suggest a new road study to see current
traffic congestion both in the summer and the winter prior to approving this.

Sandy Beach Farms was originally subdivided into 10 lots, all with around 10 acres. More than half
of the neighbors living on these lots, met recently to discuss this subdivision and are not in favor of
this new subdivision.

I also see on the original planning application for subdivision of the 3212 Sandy Beach Road NE, that
the property has access to Sugar Bottom Road, listed on the map included with the
application. Sugar Bottom Road is several miles away from this area which makes the application
inaccurate.

Thank you for your time in reviewing my concerns on this matter and seeking more information as
you decide the next steps for the properties of Sandy Beach Farms, located on Sandy Beach Road
NE, Solon.

Request
The applicant is requesting a two-lot subdivision consisting of one buildable lot (Lot 1: 1.98 acres) and
one general outlot (Outlot A: 1.27 acres) to split the existing dwelling from the larger farm. A 30-footwide access easement serves Lot 1 and Outlot A, with sufficient frontage for both lots to allow for this
width of easement.
Exhibit 2: Site Details

The property is located within the Windham Village boundary. The proposed subdivision complies with
the Windham Vision Statement (“Agricultural land and the existing residential development pattern will
be maintained, while limited single-family residential… may occur in a managed way”), as the request
is to split the existing home from the larger farm. The proposed two-lot subdivision would be located on
land historically zoned as RUA, and the buildable lot of 1.98 acres would be comparable to existing

residential lots in Windham, which the Windham Village Plan calls out in its Land Use and Growth
Goals to be “no larger than 2 acres.”
Exhibit 3: Windham Village Boundary

Land Use Policies and Plans
According to the Johnson County 2018 Comprehensive Plan, the property is located in the Windham
Village boundary and the Agricultural Future Land Use Category, where residential development is
potentially compatible. The application must comply with Chapter 8:2 of the Johnson County Unified
Development Ordinance.

cluster subdivision are proposed.
8:2.9 Other Requirements and Legal Documentation
Staff Analysis: Met.
All required legal documents are correct and signed.
UDO Chapter 8:3: Environmental Regulations
Sensitive Areas requirements were waived by PDS staff. Stormwater management will be required prior
to approval of any future building permits on the property.

Infrastructure
The site will use an existing access off of a paved road (Black Diamond Rd SW) with 970 average
annual daily trips (IA DOT, 2022). Per the UDO, subdivisions that do not create additional buildable
lots are exempt from the County’s Road Performance Standards. There is sufficient Right-of-Way being
dedicated along the road. Johnson County Engineer had no objections.
There is an existing well and septic system. Johnson County Public Health Department recommend
approval (see Appendix A).
