CITY COUNCIL PROCEEDINGS
AUGUST 24, 2026
Mayor Ladehoff called the meeting to order at 5:30 pm, August 24, 2026, at the City Hall
Council Chambers, 10 W State Street, and led the Pledge of Allegiance. Roll call-Present:
Cahill, Fonseca, Mitchell, Nichols, Schneider, Thompson, Yepez-Gomez. Public comments for
items not on the agenda were provided. Mayor, Council, and Administrator comments were
provided. Chief Jones presented years of service to Officer Adan Ortiz Diaz for 5 years and
Officer David Powell for 30 years. Chief Cross presented years of service to Maria Ramirez for 5
years along with a Meritorious Service Award.

CONSENT AGENDA
Motion by JVIarco Yepez-Gomez, second by Gary Thompson, to change the order of business to
move I. Ordinances, J. Discussion, and K. Closed Session to after the Consent Agenda. Motion
carried 6-0 (Fonseca absent). Motion by Jeff Schneider, seconded by Sue Cahill, to approve the

consent agenda less item 9: Approve Minutes 08/10/26 Meeting and Bill List $3,258,583.43;
Approve Alcohol License Renewals for American Legion at 1301 South 6th Street, Goldan Land

Asian Food at 11 East State Street, Kwik Star #394 at 2500 South Center Street; Approve Civil
Service List - Police Sergeant Promotional List; Approve June 2026 Monthly Financial
Statements; Resolution Transferring Funds for Fiscal Year 2026 Through June 30, 2026;
Resolution Declaring Certain Property Surplus Property and Authorizing Disposal Thereof from
the Police Department; Resolution Setting a Public Hearing on a Proposed Rezoning of 707 E
Linn Street and 205 S 8th Avenue; Resolution Allowing Open Containers on Designated Public
Ways for Oktemberfest on September 24-27, 2026; Resolution Approving Change Order 10 in

Motion by Sue Cahill, seconded by Marco Yepez-Gomez, to approve Resolution to Approve the

Code Building Upgrade Grant Application for St. Mary Catholic Church at 11 West Linn Street,
Marshalltown, Iowa. Councilor Thompson requested that the city conduct a review of the grant
requirements to clearly define the criteria for a commercial property. Public comment was
provided. Motion carried 6-0 (Fonseca absent).

ORDINANCES
Motion by Gary Thompson, seconded by Marco Yepez-Gomez, to adopt the second reading of
Ordinance 15123 on the Amendment to Chapter 156 of the Code of Ordinances of the City of
Marshalltown, Iowa, Establishing a Temporary Data Center Moratorium. Public comment was
provided. Motion carried 5-1, Jeff Schneider dissenting (Fonseca absent). Motion by Marco
Yepez-Gomez, seconded by Greg Nichols, to waive the third reading. Motion carried 6-0
(Fonseca absent).
Motion by Greg Nichols, seconded by Mark Mitchell, to adopt the second reading of Ordinance

15124 Amending the Code of Ordinances of the City of Marshalltown, Iowa, by Repealing

Section 73.050 Weapons. Motion carried 5-1, Sue Cahill dissenting (Fonseca absent). Motion by
Gary Thompson, seconded by Mark Mitchell, to waive third reading. Motion carried 6-0
(Fonseca absent).
Motion by Jeff Schneider, seconded by Greg Nichols, to adopt the second reading of Ordinance
15125 Amending the Code of Ordinances of the City of Marshalltown, Iowa, 70.009 Vehicle
Condition, Equipment and Load, by Adjusting the Percentage of Window Tint Allowed. Motion
carried 6-0 (Fonseca absent). Motion by Gary Thompson, seconded by Jeff Schneider, to waive
the third reading (Fonseca absent). Motion carried 6-0.
Motion by JeffSchneider, seconded by Mark M'itchell, to adopt the second reading of Ordinance
15126 Amending the Code of Ordinances of the City of Marshalltown, Iowa, 130.018 Fireworks,
to Add the Permitted Time Frames for Usage. Motion carried 6-0 (Fonseca absent). Motion by
Gary Thompson, seconded by Jeff Schneider, to waive the third reading. Motion carried 6-0
(Fonseca absent).
Motion by Jeff Schneider, seconded by Mark IVIitchell, to adopt the first reading of Ordinance

15127 to Amend the Official Zoning Map for 707 E Linn Street and 205 S 8th Avenue. Clayton
Ender, Assistant Housing and Community Development Director, advised Marshalltown
Company has requested rezoning of these parcels from Medium Density Residential to General
Industrial with conditions for off-street parking facilities. Motion carried 6-0 (Fonseca absent).
Motion by Gary Thompson, seconded by Mark Mitchell, to adopt the first reading of Ordinance
15128 Amending the Code of Ordinances of the City of Marshalltown, Iowa, by Repealing and
Replacing Section 50.027(B) Collection Vehicles. Carol Webb, City Administrator, advised this
amendment would allow haulers to utilize pickup trucks on routes as long as they have one
packer-style truck that is primarily used. Motion carried 5-1, Jeff Schneider dissenting (Fonseca
absent).

DISCUSSION
Cole O'Donnell, Finance Director, provided an overview of the changes to the capital
improvement plan and fiscal year budget process. The CIP and project-budgeting process will be
restructured so that projects are identified and reviewed earlier, financial resources are easier to
understand and track, and the Council and public have greater visibility into capital spending
decisions.

Clayton Ender, Assistant Director of Housing and Community Development, presented an
annexation request for 2342 Odessa Drive. The Marshalltown Water Works advised the new
owner would need to annex into the city limits or have the Council deny the request in order to
continue with water service. Staff recommended the Council deny the annexation. The owner,
Doug Bealls, requested the council deny the request. Motion by Jeff Schneider, seconded by
M.ark Mitchell, to approve the annexation of 2342 Odessa Drive. Motion failed 0-7, Cahill,
Fonseca (rejoined the meeting at 7:00 pm), Mitchell, Nichols, Schneider, Thompson, YepezGomez dissenting.
Amir Atefi, Swarm Systems, Inc., provided a presentation that outlined the company's proposal

to purchase approximately 30 acres of city-owned land in the Edgewood Industrial Park for a
potential private-enterprise data center. Swarm Systems asked the City to approve a land
purchase agreement so the company can conduct its due diligence while the City develops its
data-center zoning regulations. The full presentation is available in the agenda packet in the

CLOSED SESSION
Motion by Jeff Schneider, second by Greg Nichols, to go into closed session pursuant to Section
21.5, subsection 1, paragraph c, of the Code of Iowa, to discuss strategy with counsel in matters
where litigation is imminent where its disclosure would be likely to prejudice or disadvantage
the city in that litigation. The City of Marshalltown has an attorney-client relationship with
Lynch Dallas P.C., by Council Resolution 2022-161, approved 06/13/22. There may be council
action by motion following the closed session if directed by the city's attorney. Steve Leidinger,
City Attorney, was present and advised he is aware of the facts and circumstances around this
closed session and that, in his opinion, the council has the legal right to enter into closed session.
Motion failed 4-2, Mitchell and Thompson dissenting and Yepez-Gomez abstaining.
Motion by Jeff Schneider, second by Greg Nichols, to go into closed session pursuant to Section

21.5 subsection (1) paragraph (j) OF THE CODE OF IOWA to discuss the purchase or sale of
particular real estate only where premature disclosure could be reasonably expected to increase
the price the governmental body would have to pay for that property or reduce the price the
governmental body would receive for that property. The City of Marshalltown has an attomeyclient relationship with Lynch Dallas P.C., by Council Resolution 2022-161, approved 06/13/22.
There may be council action by motion following the closed session if directed by the city's
attorney. Steve Leidinger, City Attorney, was present and advised that he is aware of the facts
and circumstances around this closed session and that, in his opinion, the council has the legal
right to enter into closed session. Motion failed 4-3, Mitchell, Thompson, and Yepez-Gomez
dissenting.
Motion by Greg Nichols, second by Jeff Schneider, to discuss in open session the sale of real
estate with possible action to follow. Motion failed 2-5, Cahill, Fonseca, Mitchell, Thompson,
Yepez-Gomez dissenting.

MOTIONS
Motion by Jeff Schneider, seconded by Gary Thompson, to appoint IVIarty Wymore to the Plan
and Zoning Commission, term ending 03/31/2028 (replacing Matt Brodin). Motion carried 7-0.
Motion by Mark Mitchell, seconded by Gary Thompson, to appoint Robert Thomas to the Water

Works Board of Trustees, term ending 05/01/2028 (replacing Benjamin Fletcher). Motion carried
7-0.

Motion by Gary Thompson, seconded by Jeff Schneider, to approve a 5-day Class C Retail

Alcohol License for Midnight Ballroom LLC for a rodeo on 10/17 at the Central Iowa
Fairgrounds. Motion carried 7-0.
