LOT SPLIT REQUEST - SCHOENCHEN
Environmental Services Director Justin Craig asked the Commission to approve or deny a proposed
substandard size lot split and use. Kyle Zimmerman inquired about a possible 1-acre lot split in a
Transitional Agriculture zoned district. This district requires a 3-acre minimum parcel size (2 if served by
a public water supply). The Planning & Zoning Administrator advised that this split would be denied due
to lot size, and the applicant could appeal to the Ellis County Commission for a final determination. Mr.
Zimmerman is proposing a 1-acre parcel with a small structure on the lot to house two to three 4-H beef
animals. He stated there will be no septic system needed and the parcel would be on a public water
supply. The proposed use of the land is allowed per section 3.04 Agricultural Land Exempted & 4.05
Land Use Matrix of the adopted Ellis County Zoning Regulations. Should the appeal be approved, the
Zoning Administrator requests the following: Parcel be surveyed, Ag lot split form completed, and
recorded with the Register of Deeds. Completed Zoning certificate for the structure prior to
commencement of construction. No septic system is allowed. Should a water well be drilled, it shall be
permitted and meet all required setbacks including: 25’ property line, 50’ from barnyard, stable, manure
piles, animal pens, etc., 100’ from any septic tank or subsurface absorption field for septic tank effluent
per the Ellis County Environmental Code. It could not be approved because of the size of the lot. Leiker
asked Zimmerman for any comments. Zimmerman said this lot is right across from his residence. It is as
close to his house without being within the city limits. He said the City is fine with him putting water on
the property.
Motion:

Younger
I move to approve the proposed substandard parcel size agricultural lot split request and proposed use.
There is a restriction on septic.

FINAL 2027 BUDGET REVIEW – 4 DRAFT
Throughout the budget process, the commission has worked to find budget savings, create budget cuts,
and try the best to maintain services to reduce the budget and keep the mill levy at approximately 38
mills. In that effort over the last 5 months, the commission has met those goals by having a 2027
budget that is less than the 2026 budget, and a mill levy of 38.968 mills. Attached are the final
2027draft budgets for review along with the information of the main changes to the budgets which have
been discussed over the last couple of meetings. General Fund Budget Comparisons:

The mill levy increased because of the valuation decrease. The final steps in the budget process after
this review is for the commission to authorize the final draft of the budget to be published at the August
18th meeting. The Revenue Neutral Rate and budget hearing and adopt the budget will be at the
September 8th commission meeting. Leiker said he has no more comments or changes to be made.
Younger agreed.

*Note: Donated time by the volunteer firefighters in 2024 when compared to full-time positions to cover only during
times of training or responding to a call, total $483,520 (with benefits.). If the 2024 average of 13 firefighters who
responded per call were paid all year as a full-time department, salaries and benefits would cost over $4.7 million.
Having a highly trained, and well-staffed paid-per-call department saves the Ellis County taxpayers over $3.9 million
each year in taxes. (2022 totaled 12,362 hours = $494,499 and 2023 totaled 9,472 hours = $378,250)

ELLIS COUNTY
AGENDA ITEM COVER SHEET
COMMISSION AGENDA DATE: August 18th, 2026
TOPIC: Landfill hours change
ACTION REQUESTED: Approve Saturday Landfill winter hours and/or Saturday hours of operation adjustment.
MOTION NEEDED:
☒Yes ☐No
SUGGESTED MOTION LANGUAGE:
1. I move to (approve/disapprove) the adjustment of Saturday hours of operation to 8am-3pm at the Ellis
County Landfill effective October 1st, 2026.
2. I move to (approve/disapprove) annual winter hours of operation, on Saturdays only, of (8am-12pm OR
9am-1pm) from the first Saturday in November through the last Saturday in February at the Ellis County
Landfill effective October 1st, 2026.
DISCUSSION: Staff are proposing to adjust the operating hours at the Ellis County landfill as follows:
• Change the standard Saturday hours of operation to 8am-3pm, a change from 9am–4pm. This will align
with our standard opening time throughout the week of 8am.
• Staff are also proposing to institute specified Winter Hours on Saturdays only from 8am-12pm. These
hours would be in effect yearly from the first Saturday in November through the last Saturday in
February.
*Note*- Should winter hours be approved, but not the Saturday hours of operation adjustment,
Saturday winter hours would be from 9am-1pm.
After the completion of the City of Hays and Ellis’ Fall Cleanups, traffic decreases significantly through the
colder months, and the landfill is staffed minimally on Saturdays. A portion of the working hours committed to
staffing low traffic days could be more efficiently used on group tasks and projects throughout the landfill
during the week.
Minimal staffing can present safety issues as well when winter conditions are present. With one person in the
scale house and one operating machinery, it can be difficult to monitor each other should an incident occur
which is exacerbated by freezing temperatures and inclement weather.
FINANCIAL IMPACT:
No financial impact to the county is anticipated.

ELLIS COUNTY
AGENDA ITEM COVER SHEET
COMMISSION AGENDA DATE: August 18th, 2026
TOPIC: Final Draft of the 2027 Ellis County Budgets
ACTION REQUESTED: Approve the final draft of the 2027 budgets and authorize the county clerk to publish for
the public hearings scheduled on September 8th, 2025, at 8:30 am.
MOTION NEEDED:
☒Yes ☐No
SUGGESTED MOTION LANGUAGE: I move to allow the county clerk to publish the 2027 Ellis County General
Fund and Fire District budgets in preparation of the September 8th budget hearings.
DISCUSSION:
As the 2027 budget development has progressed, it is now time for the final steps of the process. During the
August Commission meetings, the commissioners made the final changes to the 2027 budget. The final draft
of the operating and capital budgets for all departments are included. Upon approval, the commission can
direct staff to publish the budget not less than ten days prior to the September 8th budget and Revenue Neutral
Rate hearings. Those hearings will be at the regularly scheduled September 8th Ellis County Commission
meeting at 8:30am in the Ellis County Commission Chambers.
The completed required state budget documents show the 2027 General Fund expenditures will be no higher
than $34,696,835. The Solid Waste Enterprise fund is set at $2,220,461, and the Fire District’s Operating
fund is $893,477. For the General Fund, the mill levy will increase in the amount of .85 mill. The Fire District
Mill levy will increase by 0.531 mill. However, final mill levy rates will be determined after the final abstract
numbers are completed by the county clerk in November.
FINANCIAL IMPACT: Approving the final version of the budget for publication will have minimal budget impact
to the commissioner’s budget for publication fees.
