evening. The application submitted by Main Street Development Group reviews

ACTION: The City Commission opened the public hearing regarding the establishment

Eric Hyde from Lawrence, Kansas, commented that he has seen incentive districts
become more prevalent over the years and believes they are an overall detriment to
the City. He expressed concern that the developer is from outside the City limits. He
appreciates Eudora for its differences from Lawrence and sees the incentive as a
similarity between the two communities.
The public hearing was closed at 7:09pm.
Vice Mayor Curnes commented that if development were to come to Eudora naturally,
without the use of incentives, it would have done so already. He also cited the projected
sales tax revenue from residential growth.
Commissioner Lehmann also clarified that one of the developers on the project is a
native of Eudora, which promotes local development.
ii. Consider Ordinance 1189 regarding the same
ACTION: The City Commission adopted Ordinance No. 1189, making findings and
establishing a redevelopment district pursuant to KSA 12-1770. Moved by
Commissioner Lehmann, seconded by Vice Mayor Curnes.
Approved: 5 | Denied: 0 | Abstained: 0 | MOTION CARRIED
B. Consider ordinance 1190 updating approved uses in the Commercial zoning district
City Planner Kyle Kobe reviewed the update to the City Code, which would update the permitted
uses in the Commercial Zoning District. The proposal has already been approved by the Eudora
Planning Commission, which recommends approval to the Eudora City Commission. The updates
would increase the number of approved uses and the number of uses permitted upon review.
ACTION: The City Commission approved the proposed code amendment and adopted
Ordinance No 1190, updating uses listed in Section 16-306 and adding definitions for uses in
Section 16-202 of the Eudora City Code. Moved by Commissioner Lehmann, seconded by Vice
Mayor Curnes.
Approved: 5 | Denied: 0 | Abstained: 0 | MOTION CARRIED
C. Consider approving 2026 Wastewater CIP projects related to the replacement/conversion for
the Hunters’ Ridge and Meadowlark Lift Stations
Director of Public Works Branden Boyd commented that improvements to the lift stations for
Hunters’ Ridge and Meadowlark are past due but were budgeted for in the 2025 budgeting
process for FY2026. The department seeks approval for the final purchase after obtaining quotes
for the required replacements and upgrades.
ACTION: The City Commission authorized the City Manager to enter into a purchase agreement
with Environmental & Process Systems, Inc., in an amount not to exceed $383,510 to replace

existing Meadowlark and Hunters’ Ridge lift stations. Moved by Vice Mayor Curnes, seconded
by Commissioner High.
Approved: 5| Denied: 0 | Abstained: 0 | MOTION CARRIED
D. Consider Resolution 2026-14 updating the Master Fee Schedule
City Clerk Delay presented the updated Master Fee Schedule, noting that the major changes to
the schedule concerned its formatting rather than the fees. The format was updated to include
a “units” portion, which would allow residents to have a clearer understanding of what they
were being charged and when. The update also included reorganizing the document, no longer
relying on departments, and instead using categories based on the customer’s use.
Development fees were reorganized to be used chronologically based on the development
processes the City has in place, which was an additional user-minded approach to the updates.
Major fee updates submitted by departments included reworking of development fees, as the
City now has a City Planner to conduct plan reviews. While the fees in the schedule appear
higher, the secondary fee for third-party reviews has been removed, reducing the overall cost
to developers compared to before the update. Other significant updates included the City’s
power cost adjustment, the reduction of mobile food vending licenses from $100/year to
$20/year, the addition of a technology fee to Municipal Court docket fees, and the alignment of
Municipal Court fees already in practice with those documented in the Master Fee Schedule.
ACTION: The City Commission adopted Resolution 2026-14, updating the fees reflected in the
Master Fee Schedule as presented, effective July 28, 2026. Moved by Commissioner Lehmann,
seconded by Vice Mayor Curnes.
Approved: 5 | Denied: 0 | Abstained: 0 | MOTION CARRIED
E. Receive a budget presentation regarding FY2027 utility funds
City Manager Zack Daniel reviewed the status of the utility funds in 2026, which remain in
healthy condition. Although the 2026 budget remains in good standing, various utility divisions
need infrastructure upgrades in 2027 and are facing price increases. Due to these increases in
expenditures, utility fees are forecast to increase in 2027. The exact figures remain unknown;
however, the current projected increases are lower than in previous years.
ACTION: No action taken or requested.
VI.

MAYOR AND CITY COMMISSION COMMENTS
Mayor Tim Bruce commented that he’d like to ensure that a premium product is provided at the
premium prices residents in Eudora pay, with reference to the electric service the City provides.
He understands that the price of goods increases over time, but wants to ensure that the quality
of the service remains reliable. Bruce also noted that Eudora was named the 4th best city in Kansas
to live in.
Vice Mayor Alex Curnes commented that more solicitors are being spotted around town, which
has gained a lot of commentary on social media. Curnes asked whether the revenue generated

from solicitors’ licenses was worth the trouble it caused in the City, or whether we should consider
restricting it.
Commissioner Grant High asked about the timeframe for striping on Main Street. Boyd replied
that the striping should be addressed in a KDOT Cost-Share grant project anticipated,
Commissioner Roberta Lehmann commented that, after traveling recently, she noticed beauty
standards and branding efforts in other towns and thought our newly painted water tower stands
out among the rest for its visual aesthetics.
Commissioner Jason Musick commented that he agreed with Mayor Bruce that the City needs a
great product for its cost, as well as great customer service.
VII.

CITY MANAGER AND STAFF COMMENTS
City Manager Zack Daniel commented that there would be a groundbreaking for Pilla Park on
August 10 at 6pm. The City Manager’s Office has started its tour regarding the public safety sales
tax. Daniel commented that just in 2026, the City received $8,000 in Economic Development fees,
which is a new source of revenue for the City.
Assistant to the City Manager Michael Gentry commented that the City Manager’s Office had
researched the process for implementing a transient guest tax and explained that it would require
a charter ordinance. Due to petition periods, publication requirements, and meeting
requirements, enacting the tax would require a 3–5-month processing time.
Fire Chief Justin Lee commented that the department has received some initial drawings for the
redesign of their badges.
Police Chief Wes Lovett – No comment.
Director of Public Works Branden Boyd commented that he attended a conference that gave great
information and a review of data centers and their effects on communities. He also commented
that the department is looking into ways to reduce the power blips the community is experiencing.
Parks and Recreation Director Sally Pennington commented that progress is being made on ADA
doors. They had 175 participants at the last Dive In Movie. They will be holding another Dive In
Movie on August 7, as well as the CVB Main Street Market event. Commissioner Lehmann asked
for clarification on the protocol for handling vomit or fecal matter in the pool. If the department
could announce that the pool is temporarily closed so customers can reconfigure their plans in
advance, it would be appreciated by potential visitors.
Human Resources Manager Susie Yuran – No comment.
City Clerk/Administrative Services Manager Kelly Delay commented that the City has recently
issued multiple solicitor licenses—six total across two companies—so citizens may be seeing more
door-to-door sales. If they would like to opt out, please post a “no soliciting” sign and report those
who violate it. She also noted that the Utility Billing Department has been successfully handling
customer complaints; they are working to bridge the communication gap by obtaining up-to-date
contact information and encouraging customers to reach out when issues arise.

Mayor and City Commission
Zack Daniel, City Manager
Consider Resolution 2026-15 calling for a public hearing on the proposed Project Plan for
the Project Area 1 as part of the K-10 Corridor TIF District

BACKGROUND:
The City of Eudora previously established the K-10 Corridor Tax Increment Financing (TIF) via Ordinance
No. 1189, adopted on July 27, 2026. Before the development project can move forward utilizing the TIF
mechanism, project plans must be put together that provide the high-level blueprint for the project and
its component pieces. This involves a financial feasibility study performed by the City’s third-party financial
advisors at Baker Tilly.
The project plan being considered incorporates approximately 36.2 acres of the site, located in recently
annexed area in NE Eudora. Project Area 1 incorporates the southernmost portion of the TIF District
boundaries. This phase of the overall District involves commercial and retail uses which is conceptualized
to include a hotel, convenience store/travel plaza, and other commercial uses.
Resolution 2026-15 notices a public hearing for the adoption of the Project Plan for Project Area 1 to take
place on September 28, 2026.
STAFF RECOMMEN DATION:
Staff recommends adoption of the resolution
BUDGET IMPACT:
All third party review costs associated with this project are being paid using funding from a previously
executed Funding Agreement which included a $30,000 deposit paid to the City from the project
developers.
CITY MANAGER APPROVAL:
City Manager recommends adoption of the resolution as presented.

CITY MANAGER’S OFFICE
AGENDA STATEMENT
DATE:
TO:
FROM:
RE:

August 10, 2026
Mayor and City Commission
Michael Gentry, Assistant to the City Manager
Quarterly Budget Review (FY26, Quarter 2)

BACKGROUND:

As of Quarter 2 of 2026, the City remains in a healthy financial position. Staff continues to monitor and
revise estimates as the 2027 budget is being prepared. The majority of the City’s key revenue line items
continue to have a strong performance, including parks and recreation fees and licenses & permits.
While City Sales Tax line items are performing strongly and slightly above budget, the County Sales Tax
line continues to be depressed, as noted in Quarter 1 analysis. Despite this continued low performance,
the strong performance of City Sales Taxes are helping to make up some of the deficit.
The other item of concern that staff had identified in the Quarter 1 analysis was the Water Fund’s
estimated ending fund balance. This was caused by a combination of lower-than-expected customer
sales revenues and the amended water treatment plant design costs. However, customer sales receipts
appear to be performing much more strongly than previously thought as of Quarter 2, helping to make
up a large portion of the deficit identified in Quarter 1.

As of Quarter 2 of 2026, all of the City’s utility funds’ estimated ending balances are in a strong position
to move into the 2027 budget.

Ordinance No. 1191, to Revise the Mobile Food Vendor Regulations

BACKGROUND:
Over the past few months, staff has received feedback from prospective Farmer’s Market vendors that
Eudora’s mobile food vendor licensing process is overly burdensome on the end user compared to other
cities. After performing peer comparisons and internal analysis, staff recommends the following changes
to the regulations:

Allowing inspection documentation accepted by the Fire Chief in lieu of an in-house fire
inspection.
Removal of the background check.
Clarification of types of food vendors covered by the code.
Removing unnecessary information from the application.

In addition to these changes, the annual fee for the Mobile Food Vending license was reduced from $100
to $20 in the previous meeting’s master fee schedule update. With the lower-fee option, the annual and
short-term licenses were combined into a more cost-efficient annual license. These changes should make
the process less burdensome and more streamlined for both applicants and staff.
STAFF RECOMMEN DATION:
Staff recommends the adoption of Ordinance No. 1191 to amend the mobile food vending regulations.

Mayor and City Commission
Renee Davis, Budget Manager
Consider Ordinance No. 1192 regarding the creation of a dedicated Technology Fund

BACKGROUND:
Technology is no longer a one-time purchase but an ongoing operational necessity. Computers, servers,
networking equipment, security systems, software licenses, and cloud-based applications all require
regular replacement, upgrades, and maintenance to ensure reliable municipal services, protect sensitive
information, and reduce cybersecurity risks.
Staff recommends that the City Commission establish a dedicated Technology Fund to provide a
sustainable funding source for the replacement of technology hardware, software, cybersecurity
initiatives, and other technology-related infrastructure necessary to support City operations.
Creating a dedicated Technology Fund will allow the City to proactively plan for these recurring costs
rather than relying on large, unplanned expenditures within the annual operating budget.
STAFF RECOMMEN DATION:
Staff recommends approval.
BUDGET IMPACT:
The Technology Fund would initially be supported by revenues generated from the Technology Fee
adopted by the City Commission as part of the fee schedule update that occurred July 27, 2026. This added
a $5.00 charge to each case processed by Eudora Municipal Court. Based on recent court activity, this is
expected approximately $6,000 annually. The Technology Fund is not a budgeted fund in 2027.
CITY MANAGER APPROVAL:
City Manager recommends adoption of the ordinance as presented.

Mayor and City Commission
Branden Boyd, Director of Public Works
Consider approval of the 2026 Wastewater CIP purchase related to UV light technology at
the Wastewater Treatment Plant

BACKGROUND:
In 2023, Commission approved the installation and replacement of the existing UV treatment system at
the wastewater treatment plant (WWTP). The UV system is the final step in the treatment process before
the treated wastewater is discharged into the Wakarusa River. The process uses high-intensity UV-C light
to penetrate the cell walls of harmful bacteria, viruses, and parasites, such as E. coli, and destroy their
DNA so they cannot reproduce or cause disease before the water is discharged.
As part of the routine maintenance of the UV system, the UV bulbs must be replaced every 9,000 to 12,000
hours of operation, or roughly 12 to 18 months (due to degradation of the bulbs). The City currently has
more than one UV channel, which allows alternating between the channels and doubles the life cycle of
the UV lights. The current 10-year CIP includes UV bulb replacement every three years.
STAFF RECOMMEN DATION:
To remain compliant with KDHE requirements and prevent harmful bacteria from entering public streams,
staff recommend replacing the UV bulbs and adhering to the regularly scheduled replacement routine.
BUDGET IMPACT: N/A
In the 2026 budget, $25,000 was allocated to the WWTP to replace the UV bulbs. Trojan Technologies
provided a quote for $24,989.70, which falls within the allocated budget.
CITY MANAGER APPROVAL:
City Manager recommends approval the purchase of the UV bulbs.
ADDITIONAL DOCUMENTS ATTACHED:
 Quote from Trojan Technologies
 Sole Source Purchase
STRATEGIC PLAN FOCUS AREA(S):
 Fiscally Responsible Stewardship
 Fiscally Sustainable Infrastructure & Amenities
RECOMMENDED ACTION:
Suggested motion: I move the City Commission to authorize the City Manager to enter into a purchase
agreement with Trojan Technologies, in an amount not to exceed $24,989.70, to replace the existing UV
lamps at the wastewater treatment plant.
