September 1, 2026 City Council Meeting 20

September 1st, 2026
To:
Mayor Truman & Council Members
From: Kyle Fiedler, Community Development Director
Subject: Fence in Right-of-Way

BACKGROUND
Community Development staff received a permit application to replace a fence at 524 S.
Dexter Ave. The application was received on July 12th. Staff performed a pre-inspection
that day and left the permit for Community Development Director Fiedler to review upon
his return from vacation, as there were questions about the site plan. July 20th, Director
Fiedler noticed that the fence was proposed to be wider than the property, the property
is 90’ wide and 150’ deep, the fence in the permit was proposed 95’ wide.
Director Fiedler called the contractor shortly after 8 am on the 20th to let them know of
the discrepancy, then went to City Hall to look for a previous permit file. Director Fiedler
determined that the existing fence was permitted in 2012 under the previous owner, but
the permit did not have a site plan attached, to determine what staff reviewed/ approved
14 years ago. Director Fiedler then drove to the residence, where he met with the
contractor and homeowners around 9 am.
Director Fiedler explained the situation to the owners, they showed him where their
sprinklers are on both sides of the existing fence, where trees are planted inside the
fence as well as a play structure and turf area for grandkids. Pictures of the fence and
yard are included at the end of this report. Director Fiedler let them know that this really
isn’t a candidate for a variance, because it is in the right-of-way, but that he also doesn’t
have the authority to approve of replacing the fence in the right-of-way.
City Zoning Regulations 17.03.30.C. state the following: 4. A fence shall not obstruct
any public or private walkway or be within the public right-of-way (back from paved
street). 7. If a nonconforming fence is completely removed, the property owner must
comply with current fence regulations.

RECOMMENDATION
Staff do not have authority to permit a fence in the right-of-way. Staff need direction from
Council as to how they would like us to proceed as the fence in the right-of-way can cause
issues with utility locations, and repairs. Based on locate flags in the right-of-way there
are water, electricity and communication lines in the area.
Sincerely, Kyle Fiedler, Community Development Director

Doug,
Here are the quotes that Winwater sent me from their supplier for old & new prices of the 14” HDPE pipe.
I know it is not the same pipe manufacturer as what we are actually installing but let me know if this will
work for documentation. We changed over to WL Plastics trying to find the best price after the price
increase. Winwater also sent the following language within the email.
“When I spoke to them about reasons why the pipe was so much more, they stated
multiple different reasons. The per pound increase was for just the resin not for a finished pipe, the
price of other additives necessary to extrude the pipe increased, and increased trucking rate were
contributors. However, the main reasoning I was given was the issues of pipe manufacturers
having to buy above market price in order to keep their supply up as American chemical companies
were shipping resin overseas due to recent disruptions in global shipping routes.”

Jeff,
The letters of price increase that I have cover a cost increase of $7.89 / LF of 14” pipe. The price increase had an
effective date of April 1, 2026. The difference between the quotes is $13.65. Do you have additional price increase
announcements for the difference?
Thanks,

What would you be looking for (old quote & new quote)? The original price for the 14” HDPE was
$25.15/LF and went up to $38.80, but I assume you will need more backup than my word.
