MEMORANDUM FROM CITY ADMINISTRATOR

To:

Board of Aldermen

RE:

Tuesday, November 3rd, 2026 Board of Aldermen Meeting

1.

2244 Rose Ln, CUP Application was reviewed at the Planning and Zoning meeting on October 27.
The applicant has plans to operate a tow truck business from the existing gravel lot on the property.
The lot would be used for storage of vehicles and his company trucks. Planning and Zoning
recommended approval of the CUP with the condition that the applicant fix the fence before being
granted occupancy. A Planning and Zoning member asked how many cars would be on the lot at one
time and the applicant responded there could be up to 40-50. Planning and Zoning did not
recommend a maximum number of cars to be allowed but that could be a requirement by the Board
of Aldermen. This lot would not be used to do repairs or to sell parts from the vehicles.

2. Resolution 2026-19 Insurance renewal – There will be an increase in dental plan this year of $2.22 per
employee per month. For Group Life there is a .30 increase per employee per month and for Short
Term Disability there is a .50 increase per employee per month. New rates are reflected in the
resolution. Our broker has gone out for quotes and Lincoln Financial came back with the best quotes.
There is not an increase for Vision insurance.
3. The auditors are scheduled to be here the second week in November and staff is working with them
every day.
4. The draft for data center regulations should be ready to present to Planning and Zoning by the end of
November or first of December.
5. There will be a proposed Social Media policy ready to present to the Administrative Committee in
November.

c. By-laws – Administrator Litterell stated the by-laws were discussed at this meeting. They
voted to remove the secretary position from them, and add verbiage behind the regularly

Whereupon, Mayor Kelley declared the motion carried.
Planning & Zoning by-laws
Motion made by Alderman Cleeve, seconded by Alderman Gass to approve the
Planning & Zoning by-laws. Mayor Kelley asked for any discussion. Alderman Lesh stated
there were three recommendations and they were highlighted. One was the use of the word
“secretary” because we have it in ordinance that it is the city clerk or the designee, the second
one was they changed language of the frequency of minutes, and cancellation of meetings. He
did not believe the cancellation of meetings was consistent with what was in ordinance in
Chapter 100. He has been putting together a document to bring forth to the Board for all the
committees. He did not think it should move forward tonight. Alderman Cleeve stated on the
secretary position; Chapter 405.010 Item F of the code, states that we have a secretary in
Planning & Zoning; which appears to come out of State Statute 89.330 which also says that. He
did not think the position could be removed. Attorney Bond stated at the end of the day, the
custodian of the records is the city clerk. The secretary exists under 89; but did not know a lot of
3

4

communities that have it. Alderman Cleeve stated regarding cancellation; there was no notice
standards and no requirement to consult with staff or other members. There is also nothing that
reads it can be cancelled due to lack of agenda items, or emergency circumstances. He continued
that it references that the by-laws can be amended at any time by the zoning commission by the
majority of a quorum. He asked if the commission can amend their own by-laws without Board
approval? If they can’t then it should probably read “recommend” to the Board. Attorney Bond
stated the by-laws govern the operation of that Board. He agreed amending on the fly of a
quorum of the Board could be problematic. He also suggested it be approved by the Board of
Aldermen. They are a recommending body and suggested it be recommended all the way
through. Motion made by Alderman Lesh, seconded by Alderman Cleeve to table the bylaws. A voice vote was taken with an affirmative result. Nays: none. Abstain: none.
Whereupon, Mayor Kelley declared the motion carried.
Chief’s Report
Chief Huntington stated September is a busy month. There were:
445 – 911 calls
1,086 – CAD events
1,729 – Non emergency calls
128 – traffic enforcements in problem areas
Public Works Commissioner – Mayor Kelley stated he was excused this evening.
City Attorney Report – there were no updates tonight and did not recommend going into closed
session tonight under (1)(3) or (13) unless the Board chose to.
New Bills - none
Consideration of Bills Previously Introduced
a.

Bill No. 5332 An Ordinance amending several sections of Chapter 400 to eliminate the
use of “short term vacation rentals” as a conditional use in the NU “Nonurban” District
and all residential Zoning Districts. (2nd reading)

As posted pursuant to the ordinance, City Clerk Barfield read Bill No. 5332 by title only for the
second reading. Motion made by Alderman Lesh, seconded by Alderman Gass to approve
Bill No. 5332. Mayor Kelley asked for any discussion. Alderman Cleeve asked about current
ones becoming non-conforming and how it would end with an ownership transfer, but what
happens if it is through inheritance, trust transfer, LLC, or contract for deed? Are these covered?
He did not see a clear definition of ownership change. Attorney Bond stated CUPs are tied to
that specific entity. For example, the LLC, it could cause problems for those permits. Discussion
followed. Alderman Hoven suggested stipulations, but did not agree with doing away with them
in the entire city, as it restricts these people. Alderman Lesh stated the original ordinance was for
permitting them, and he thought it was substantial already. Discussion followed. A roll call vote
was taken with the following results: Ayes: Alderman Cleeve, Alderman Gass, Alderman
Bruns, Alderman Lesh. Nays: Alderman Nickelson, Alderman Hoven. Abstain: none.

$ 303,897.81. Mayor Kelley asked for any discussion. Administrator Litterell stated the project
is completed, and there was an estimated finish date provided. Alderman Bruns stated if there

5

Alderman Bruns – Stated she received an extremely nice “thank you” from Sue Reymer for the
Sand St. project. The paving looks very nice. She also inquired about the alley between Sand
and Bellevue and runs to Elm. Is the upper part of the alley closed off and we are working on
this. She thought First & Osage looked great. She received several complaints about Mr.
Overschmidt, Code Enforcement. They are things such as; a lady lives in apartments behind
Monroe Woods and he did not inspect the new shower unit, and there is no drywall behind it.
That should have been caught. She asked if he is still driving around, and can we get a more
detailed breakout of what he does in the city. She would like to know which ward he is in so
aldermen can go out and keep up on why it’s not been done.
Historical Society – They are working on a fund raiser.
The time capsule will be buried December 12th at 1:00 PM at Red Cedar.
Alderman Hoven – stated he also received complaints about Mr. Overschmidt, he wished Code
Enforcement wouldn’t pick and choose who they are going to be hard on. There needs to be
consistency and he hasn’t seen it in a long time. There were numerous violations in his home
when it was built.
Alderman Lesh – stated for Planning & Zoning report; two items were already covered.
Regarding the food truck, that is the property to the east of Pilot, and they were formally at the
Phillips 66 gas station. They are in process of building a restaurant type building. They are now
on the new property. After many years, the property changed hands, and hopefully they succeed.
He also heard they are looking into a food court. He thanked the Board for approving the permit.
By-laws – he will bring forward some items. If anyone had any input, please reach out to
him regarding committees in general.
Data Center Regulations – it has been about three months; was there an update? He
suggested staff start on it so Planning & Zoning can start reviewing. They need options to be able
to start thinking about. The public also needs to be able to have input.
Operations Meeting – we will be having a meeting, per a request, tentatively scheduled
for November. If anyone has anything please let him know. One item is the Fourth St. grant
project.
Social media policy – he asked if there was an update on that? Administrator Litterell
stated he will be getting back to that, along with data center.
Judge appointment – Alderman Lesh asked if a motion was needed so the court could
assign one to us. Mayor Kelley stated no, she would be bringing an appointment to them on
November 17th.
Alderman Nickelson – stated there was a Park Board meeting on October 12th. They discussed
the locks at Blackburn Park on the fence. The city keeps cutting them off, and they are looking
at doing an art project up there to pull them away from the fence. They discussed tree grants for
the parks. There were four bricks laid at ADAMS Garden. They did a walk thru of the pool
house and looked at the interior and the space. The pool rules sign also needs updated. They
discussed heavy duty wave fabric for the volleyball courts. The merry-go-round is a little larger
and discussed relocating the play area. The Eagle Scout project for the sign is progressing. They
also noticed that Hawthorne Pond is washing out near the retaining wall.

6

7

Alderman Cleeve – stated he looked at the budget, and thought we were covered for the expenses
under the professional services for zoning, contractual, and building commission position.
Administrative Committee – we have not had a meeting. The next possible date would
be the 26th. Unless there is a need, it probably won’t happen.
He thanked the Chamber of Commerce and Director of Tourism for the Harvest Festival.
Friday was rough with the rain, but a good event.
He had a couple residents ask about the Newsletter. Mayor Kelley stated this is due to go
out in December.
Red Cedar Merchandise for the gift shop – we are getting back down to where it is almost
out of money, and they have pulled in about $ 46K this year, we had projected $ 30K for the
whole year, and have exceeded that. He will be getting more details on this. He thought not
doing that, was leaving money on the table. Alderman Gass suggested purchasing a deep freeze
so we could purchase some treats. A lot of the people are asking for these items, and he thought
it would go over well. Mayor Kelley stated the Director has been in contact with the City
Administrator and working closely with all the departments.
Administrator Litterell stated in the future, if there are issues with staffs’ performance,
please call him at the office instead of discussing here in public He didn’t think it was proper, or
fair to discuss here if we don’t know all the details. Please let him address it in house.

SUBJECT:

Staff Report – 2244 Rose Lane.
Conditional Use Permit Application

PZ-2025-XX: Conditional Use Permit – 2244 Rose Lane.
Existing Zoning: M-1 Light Industrial District
Existing Use: Gravel Lot Storage
Proposed Use: Vehicle Storage and Towing Facility
Comprehensive Plan Future Land Use: Industrial
This is the proposed conditional use permit for the parcel located at 2244 Rose Lane (19-1-11.0-3-010002.110) and currently located inside the limits of the City of Pacific. The applicant has applied for a
conditional use permit of the parcel for a vehicle storage and towing facility in an M-1 Light Industrial
District.
This property lies on Rose Lane in an area of light industrial use. The requested use for vehicle
storage and towing facility is allowed within the M-1 district as a conditional use. The existing use is a
gravel storage lot so the use would not change. This use is consistent with the intent of the zoning
district and existing uses on the lot and in the area. With the existing use being the requested use and
no exceptions being known we would recommend approval of the conditional use for the parcel at 2244
Rose Lane (Franklin County Parcel ID 19-1-11.0-3-010-002.110) in an M-1 Light Industrial District.
Please let us know if you have any questions or comments regarding this report.
