An Ordinance Amending Chapter 27 of the Code of City Ordinances of the City of
Warrensburg, Missouri, Data Warehousing Facilities
Carroll stated at the previous meeting the Planning and Zoning Commission voted to
continue the ordinance and have staff revisit the definition for data warehousing facilities
and the minimum usable floor area, noise impacts, water consumption, and a licensing
ordinance. Carroll summarized the changes in the revised ordinance including ambient
noise samples staff collected from around the community.
Carroll stated the City Attorney is working on the licensing ordinance, and the zoning
ordinance and licensing ordinance would be on the agenda of the March 23 City Council
meeting. Jones asked if the ordinance needed to include requirements about
discharging water into the environment. Carroll stated existing ordinances in the City
already regulate discharging into the City’s wastewater system and stormwater systems.
Ridenhour asked about the City’s requirements if the federal or state governments enact
regulations for data centers. Carroll stated staff will monitor and bring forward an
ordinance amendment to the Planning and Zoning Commission and City Council if future
state or federal regulations impact the local ordinance. The Planning and Zoning
Commission and staff discussed non-conforming buildings, moratoriums, and noise
regulations.
Ridenhour moved to approve the ordinance as presented. Karscig seconded. Approved

PLANNING AND ZONING COMMISSION
AGENDA REPORT
March 27, 2026
ITEM 5.I: An Ordinance Amending Chapter 27 of the Code of City Ordinances of the City of
Warrensburg, Missouri, Regarding Setbacks for Flagpoles
BACKGROUND:
Jerry Franklin proposes to construct a Veterans Park in the northwest corner of the Westview
Shopping Center parking lot off E. Russell Avenue. The park will include ten or more flagpoles,
a water fountain, benches, and landscaping. Staff is bringing this ordinance forward to address
a situation with the park layout and placement of the flagpoles. Currently, flagpoles are
considered structures under Sec. 27-6 of the Code of City Ordinances.
Sec. 27-6 Definitions.
Structure. Anything constructed or erected. Among other things, structures include
buildings, walls, fences, canopies over gas pumps, towers and satellite antennas. Any
category of structure that is governed by its own specific section(s) in this chapter shall
be governed by those specific sections, and any supplemental requirements contained
elsewhere in this chapter.
Since there are no other sections of the zoning ordinance that govern flagpoles, and there are
no exceptions listed in the zoning district regulations, flagpoles are required to meet setback
requirements from the street right-of-way, which varies from 30 ft. to 40 ft. based on the street
classification. The setback from the E. Russell Ave. right-of-way is 35 ft. because it is classified
as a collector street. In the current design of the park, many of the flagpoles are in the 35 ft.
setback from Russell Ave.
Fences are one example of a type of structure that is governed by its own specific section of the
code in Sec. 27-332, Walls, fences, hedgerows. These regulations allow fences less than 7 ft. in
height to be placed adjacent to the side and rear property lines. Another example of a more
specific regulation is the General Business district regulation, Sec. 27-118 (g) (4) a that allows a
15 ft. setback for gas pumps, canopies over drive-through lanes and light standards for parking
lot lighting.
Staff has drafted a new ordinance that creates a specific setback requirement for flagpoles, like
the setback exception that allows a 15 ft. setback for gas pumps, canopies over drive-through
lanes, and light standards for parking lot lighting. The proposed ordinance modifies the setback
for flagpoles, including their bases, structures, supports, and lighting, to 15 ft. in commercial and
industrial zoning districts. The new section would be added to all commercial and industrial
districts except the Central Business District. The CB District already has a 10-foot setback for
structures from the street right-of-way that applies to flagpoles. If the ordinance is approved,
only a few of the flagpoles in the current design of the park would need to be moved to meet the
new requirement.
RECOMMENDATION:
Staff recommends approval of the attached ordinance amending Chapter 27.
