Board of Supervisors Meeting – September 2, 2026

The Gage County Board of Supervisors met on September 2, 2026, at 8:45 a.m. as per public
notice given on the county website and in the Beatrice Daily Sun on August 20, 2026, copy of the
proof of publication being on file in the County Clerk’s Office. The agenda for all meetings is
kept continually current and is available for public inspection at the County Clerk’s Office during
normal business hours and was communicated in the advance notice of the meeting. The Board of
Supervisors has the right to modify the agenda to include items of an emergency nature only, at
such public meeting. All of the proceedings shown hereafter were taken while in the convened
meeting which was open to the attendance of the public.
Supervisors Rex Adams, Rick Clabaugh, Emily Haxby, Erich Tiemann, Gary Lytle and Eddie
Dorn present, Terry Jurgens absent.
Let the record show that all proceedings are electronically recorded.
Pledge of Allegiance recited.
Chairman Tiemann announced that a complete copy of the Open Meetings Act is posted at the
back of the Board of Supervisors Room.
Consent Agenda included the following items: 1. General Agenda; 2. Minutes from previous
meeting and committee meetings; 3. claims audit in the amount of $1,699,683.49 which does not
include claim #2609000055 to Hard Rock Quarries LLC in the amount of $676.94 and claim
#2609000057 to Johnny’s Welding in the amount of $122.64 to be voted on separately; 4.
approve correspondence received and place on file; 5. Approve paying warrants/claims by ACH.
6. Approve declaring 2017 Black Dodge Charger AWD, 176,346 miles –
#2C3CDXKT7HH533847, 2020 White Ford Explorer 4x4, 94,875 miles –
#1FM5K8AB2LGD01780, 2011 Dodge Nitro Heat SUV #1D4PU4GX6BW607584, 135,000

Motion made by Dorn, seconded by Lytle to approve the consent agenda. Motion carried 6-0.
Motion by Dorn, seconded by Lytle to approve claim #2609000055 to Hard Rock Quarries LLC
in the amount of $676.94. Motion carried 5-0-1 with Tiemann abstaining due to conflict of
interest.
Motion by Dorn, seconded by Lytle to approve claim #2609000057 to Johnny’s Welding in the
amount of $122.64, bringing the total amount of claims paid through September 2, 2026, to
$1,700,483.07. Motion carried 6-0.

Committee reports were given by Dorn & Dave Jones on Building & Grounds; Tiemann on
Equalization, Finance & Human Resources; Lytle on Law Enf & Emg Mgmt. & Haxby on Road
& Bridge.
Discussed previously disapproved utility permit #1300 to Pinpoint Comm. Haxby shared
concerns about what was stated by Pinpoint during the past board meeting and then they did not
follow through with what was stated. Also speaking was Andrew Pollard, attorney for Pinpoint.
Motion by Adams, seconded by Clabaugh to approve reconsidering permit #1300. Motion
carried 6-0.
Motion by Lytle, seconded by Dorn to approve agreement between Gage County and NAI FMA
Realty up to $30,000 to locate real property for purposes of construction of new facilities.
Discussion on the agreement was paused for a timed public hearing agenda item.
Motion by Adams, seconded by Lytle to approve opening public hearing @ 9:30 a.m. to hear
support &/or opposition for Livestock Regulation changes. Motion carried 6-0.
Speaking during the public hearing were: Vicky White, Marcella Rademacher, Steve Martin,
Austin Zimmerman, Margaret Haith, Roy Mulder, Max Larsen, Patty Barnard & Terry Acton.
Motion by Clabaugh, seconded by Lytle to approve closing the public hearing at 11:02 a.m.
Motion carried 6-0.
Short break at 11:03 a.m.
Back in session at 11:17 a.m.
Back to discussion on the NAI FMA Realty agreement. Clabaugh and Adams feel that the board
should wait 1 or 2 months until discussion with the City can continue and then determine how to
move forward. Vote on motion, carried 4-2 with Adams & Clabaugh voting nay.
Chairman Tiemann read the Proclamation declaring September 10, 2026 as Big Give Gage Day.
Dee Enevoldsen, Gage Co Foundation was present to receive the proclamation.
Motion by Haxby, seconded by Clabaugh to move into closed session at 11:33 a.m. for possible
litigation. Motion carried 6-0.
Motion by Adams, seconded by Clabaugh to come out of closed session at 11:57 a.m. Motion
carried 6-0.
Motion by Adams, seconded by Dorn to approve affirming the sheriff’s decision on the grievance
filed on comp time and have Atty Jerry Pigsley to prepare response and authorizing the chairman
to sign the response. Motion carried 6-0.
Adams out at 12:06 a.m.
Discussion took place on percent of the budget increase the county should request.
Recessed meeting at 12:25 a.m. until 4:00 p.m. public hearing at the Hevelone Center for Data
Center Moratorium.
Reconvened board of supervisors meeting at 4:06 p.m. with Adams, Clabaugh, Haxby, Tiemann
& Dorn Present. Lytle and Jurgens absent.
Motion by Dorn, seconded by Clabaugh to open Public Hearing at 4:12 p.m. to hear support &/or
opposition on a data center moratorium as recommended by the P&Z Commission. Motion
carried 5-0.
Lytle present in meeting at 4:17 p.m.
Speaking during the public hearing were: Denise Schlake-Ideus, Katie Wilkem, Tatiana Bargen,
Brian Koenig, Loren Ruskamp, Myron Dorn, Kevin Keller, Jim Nelson, Diane Mulder, Calleen
Ideus, Jeff Beuchler, Brad Wilken, Bryce Nielson, Anna Wolken, Duane Parde, Tracy Riensche,

Motion by Dorn, seconded by Clabaugh to close public hearing at 6:04 p.m. Motion carried 5-1
with Dorn voting nay.
Chairman declared Board of Supervisors meeting adjourned at 6:07 a.m. until September 16,
2026.
