Public Comment during the Commission Meeting on July 7, 2026 will be for all matters off the agenda, and be limited to up to
three minutes per person. Additionally, public comment of up to three minutes per person may be heard during individual action
items. The Commission reserves the right to reduce the time allowed for public comment. The Commission may prohibit comment
if the content of the comments is a topic that is not relevant to, or within the authority of, the Commission, or if the content of the
comments is willfully disruptive of the meeting by being irrelevant, repetitious, slanderous, offensive, inflammatory, irrational or
amounting to personal attacks or interfering with the rights of other speakers. Persons are invited to submit comments in writing
on the agenda items and/or attend and make comment on that item at the Commission meeting. Decorum during the meeting must
be upheld pursuant to the BOCC Rules of Procedure sections 7.5.3 and 7.5.4 whereby no person in the audience shall engage in
disorderly conduct such as hand clapping, stamping of feet, whistling, using profane language, yelling, and similar demonstrations,
which conduct disturbs the peace and good order of the meeting. Any person who becomes disruptive or interferes with the orderly
business of the Board may be removed from the Board Chambers or other meeting room for the remainder of the meeting.

Valley Public Transportation (PVPT) regarding program results pursuant to the Nye County
ARPA Recovery Plan and Policy: Public Health Assistance-Mental Health.
16.3 For Possible Action – Approval to issue a Consumer and Display Fireworks Permit to Outlaw
Pyrotechnics for the 2026 season. Moe Law is the Applicant.
16.4 For Possible Action – Approval of SW-26-2: An application for the annual renewal of the Solid
Waste Permit for US Ecology Nevada Inc. Hazardous Waste, Treatment, Storage and Disposal
Facility, located at 11455 and 11457 S. US Highway 95, Beatty, NV. Assessor's Parcel Numbers
018-611-02 (80 acres) and 018-611-04 (400 acres). Nevada Division of State Lands – Property

BOARD OF COMMISSIONERS
17. For Possible Action – Direct the appropriate staff to move forward on the statutory approval process
of bringing two bills up for a vote before County Commissioners regarding Data Centers.
18. For Possible Action – Discussion and deliberation regarding a request to set a date, time and location
for a Public Hearing on Nye County Bill No. 2026-11: A Bill amending Nye County Code Title 17,
titled Comprehensive Land Use Planning and Zoning, by creating Chapter 13, titled Data Centers, to
provide for a prohibition; effective date hereof, and other matters properly relating thereto.
DISTRICT ATTORNEY
19. For Possible Action – Discussion and deliberation to:
a. Approve a contract with Frank Coumou, Esq. to serve as special prosecutor to investigate and take
appropriate legal action, to include criminal prosecution or other civil action, on a DUI case and any
related charges due to a conflict with the Nye County District Attorney's Office; and
b. Approve funding the contract in an amount not to exceed $30,000.00 from 10101 General Fund.
SHERIFF
20. For Possible Action – Discussion and deliberation to approve, amend and approve, or reject filling four
vacant dispatcher positions, seven vacant patrol deputy positions (two from detention transfer) and two
vacant detention deputy positions (created from the detention transfers) for the Sheriff's office.
FINANCE
21. For Possible Action – Discuss, deliberate and unanimously override the Comptroller's demand refusal
for hiring/paying unbudgeted Sheriff headcount for Fiscal Year 2027 per NRS 244.215.

a. Approve, amend and approve, or reject an agreement between Nye County and Inyo County
California for the purpose of utilizing the site and tower located at 3650 Kellogg Rd, Pahrump NV,
for purposes of two new VHF Public Safety Communications relays to support First Responder
communication in the area of the Tecopa highway with an initial term, ending April 1, 2031, and
may be renewed for an additional three (3) successive five (5) year terms; and
b. Execute the agreement.
NATURAL RESOURCES
24. For Possible Action – Discussion and deliberation to approve, amend and approve, or reject a letter to
the Bureau of Land Management, protesting the Final Environmental Impact Statement for the Purple
Sage Energy Center (FKA, Golden Currant), published on June 12, 2026. Protest letters are due by
July 13, 2026.
PUBLIC WORKS
25. For Possible Action – Discussion and deliberation to:
a.

Approve, amend and approve, or reject Amendment No. 1 to Task Order No. 9 between
AtkinsRealis USA, Inc and Nye County to provide construction support and management
services for the reconstruction of the apron at the Tonopah Airport in a not to exceed amount of
$153,134.00;

b.

Execute the amendment; and

c.

Fund from 10340 (Grants/LATCF).

PUBLIC PETITIONER
26. For Possible Action – Discussion and deliberation to consider a letter of support for The Vine Church's
MLS GO youth soccer initiative and related grant applications. The letter would support efforts to
expand affordable youth recreation opportunities, increase access to organized soccer programming,
and pursue grant funding for youth soccer equipment, participant scholarships, and future soccer field
development within the Pahrump community.
