2.8 Public Participation in the Board Meetings
2.8.1 Each person desiring to speak during public comment shall state his name,
street and if not a Goffstown resident, his/her town and shall fill out the roster
provided by the Town Administrator.
2.8.2 The Presiding Officer shall schedule appropriate public comment time for
Goffstown residents at the beginning and end of each regular meeting. The
Presiding Officer, at his/her discretion, may allow other speakers for a germane
topic. Public comment speakers are limited to three minutes each.
2.8.3 Agenda appointments with the Board may be made for a regular meeting
through the Town Administrator, for Town-related business. The Presiding
Officer has the discretion to schedule a different date and time.
2.8.4 Unless a concern expressed at the public comment period or an agenda
appointment is an urgent matter, the Board may take up the concern at the next
regular meeting under Old Business.
2.8.5 Special Board meetings shall not have public comment nor agenda
appointments unless the appointment is the purpose of the special meeting.

ISSUE:
The Select Board needs to consider adoption of the Proposed Water Quality Standards, as
dictated by the Goffstown Water Quality Management Ordinance and to remain compliant with
Goffstown’s MS4 (Municipal Separate Storm Sewer System) permit under the EPA’s Clean
Water Act.
BACKGROUND:

07/26/2021 - The Goffstown Select Board adopted the Water Quality Management
Ordinance.
o The purpose of the Water Quality Management Ordinance and the Water Quality
Standards is to provide reasonable guidance for the regulation of stormwater runoff
during planning, design, construction, and post-construction phases in order to protect
local natural resources from degradation and prevent adverse impacts to adjacent and
downstream land, property, facilities, and infrastructure.
o At the time of adoption, staff indicated water quality standards would be brought forward
for adoption when they were removed from the development regulations.

07/23/2026 - The Goffstown Planning Board voted to revise the Town’s Development
Regulations.
o Water quality standards were previously included in the development regulations.

o The 2026 development regulation revision removed water quality standards, allowing for
these to be included as a standalone set of standards, adopted by the Select Board.

These standards were developed to closely follow the State of NH Stormwater Coalition
of MS4 Communities and DES model guidance, ensuring full compliance with the
current MS4 requirements.

RECOMMENDATION:
If the Board concurs with the proposed standards:
Motion to adopt the proposed Water Quality Standards as presented, with an effective date
of August 10, 2026.

Town of Goffstown
ORDINANCE OF THE SELECT BOARD
The Select Board of Goffstown New Hampshire, ordain as follows:

I. TITLE: This ordinance shall be known and may be cited as the WATER QUALITY
ORDINANCE of the Town of Goffstown.

AIITH ORITY: RSA 4l:14-b Adoption and Amendment of Town Codes and Ordinances;
RSA 149-l:6; EPA Municipal Separate Storm Sewer Systems (MS4) Permit Section 2.3;
RSA 676:15, 17, 17-a and 17-b.

III.

DECLARATION OF PURPOSE: The purpose of this ordinance and the Water Quality
Standards is to provide reasonable guidance for the regulation of stormwater runoff during
planning, design, construction, and post-construction phases in order to protect local natural
resources from degradation and prevent adverse impacts to adjacent and downstream land,
property, faci I ities, and infrastructure.
These standards regulate discharges from stormwater and runoff from land development projects
and other construction activities to control and minimize increases in stormwater runoff rates and

volumes, soil erosion, stream channel erosion, and nonpoint source pollution associated with
stormwater runoff; as well as prohibit illicit discharges that often contain pathogens, nutrients,
surfactants, and various toxic pollutants by establishing and enforcing an Illicit Discharge and
Detection Elimination program.
The goal of this ordinance and these standards is to establish minimum stormwater management
requirements and controls to protect and safeguard the general health, safety, and welfare of the
public in the Town of Goffstown. This regulation seeks to meet that goal through the following
objectives:

A. Minimize increases in stormwater runoff from any development to reduce flooding,
siltation, streambank erosion, and maintain the integrity of stream channels.

B. Minimize increases in nonpoint source pollution caused by stormwater runoff from
development which would otherwise degrade local water quality.

C. Manage total volume of surface water runoff to ensure flows from any specific site
during and following development do not exceed the pre-development hydrologic
condition.

D. Reduce stormwater runoff rates and volumes, soil erosion, and nonpoint source
pollution through stormwater management controls, and to ensure that these
management controls are properly maintained and pose no threat to public safety or
cause excessive municipal expenditures.

E. Protect the quality of groundwater resources, surface water bodies, and wetlands.
The Water Quality Standards will be developed based on compliance with applicable
RSA, current engineering principles and best practices, and compliance with the EPA
MS4 permit. The standards shall apply to all parcels located within the Town of
Goffstown.

IV.

ENF'ORCING AUTHORITY:

A. This ordinance shall give the Town adequate legal authority to:
L Prohibit illicit discharges;
2. Investigate suspected illicit discharges;
3. Eliminate illicit discharges, including discharges from properties not owned by
or controlled by the MS4 that discharge into the MS4 system; and

4. Implement appropriate enforcement procedures and actions.

B. The Department of Public Works, with the approval of the Select Board, shall develop
and maintain Water Quality Standards which will specifl, the applicability,
requirements, and fees associated with stormwater control and illicit discharge

detection and elimination within the Town of Goffstown.

C. The ordinance and the corresponding Water Quality Standards, once adopted, shall be
enforced by the Goffstown Department of Public Works and the Police Department.

V.

NOTIFICATION: As soon as any person responsible for a facility, site activity, or
operation has information of any known or suspected release of pollutants or non-stormwater
discharges which are resulting or may result in illicit discharges or pollutants discharging into the
Town of Goffstown municipal storm system, state waters or waters of the United States, said
person shall take all necessary steps to ensure the discovery, containment and cleanup of such
release so as to minimize the effects of the discharge.
If the substance poses an immediate health or safety concern the Town of Goffstown and the State
of New Hampshire, Emergency Services shall be immediately notified.
Ifthe substance does not pose an immediate health or safety concern, the Town of Goffstown Code
Enforcement Officer and Department of Public Works should be notified as soon as possible,
however no later than twenty-four (24) hours post event.

VI.

PENALTIES: Unless otherwise stated, any person or unnaturalperson within the meaning
of the Criminal Code, who violates an ordinance shall be guilt of a violation. Pursuant to RSA
502-A:l l-a, RSA 676,the District Court shall have jurisdiction ofthe prosecution of any violation
of the Town of Goffstown Ordinances. All fines collected shall be forthe use of the Town. The
Town may enforce to the maximum penalty allowed by law. The enforcement authority may issue
a summons and complaint along with a notice of fine pursuant to the procedures for pleas by mail
in RSA 502-,4:19-b.

General Provisions
A. Purpose and Goals
The purpose of stormwater management standards is to provide reasonable guidance for
the regulation of stormwater runoff during planning, design, construction, and postconstruction phases in order to protect local natural resources from degradation and prevent
adverse impacts to adjacent and downstream land, property, facilities, and infrastructure.
These standards regulate discharges from stormwater and runoff from land development
projects and other construction activities to control and minimize increases in stormwater
runoff rates and volumes, soil erosion, stream channel erosion, and nonpoint source
pollution associated with stormwater runoff.
The goal of these standards is to establish minimum stormwater management requirements
and controls to protect and safeguard the general health, safety, and welfare of the public
in the Town of Goffstown. This regulation seeks to meet that goal through the following
objectives:
1. Minimize increases in stormwater runoff from any development to reduce flooding,
siltation, streambank erosion, and maintain the integrity of stream channels.
2. Minimize increases in nonpoint source pollution caused by stormwater runoff from
development which would otherwise degrade local water quality.
3. Minimize the total volume of surface water runoff which flows from any specific
site during and following development, improving upon the pre-development
hydrologic conditions to the maximum extent practicable for the given site
conditions.
4. Reduce stormwater runoff rates and volumes, soil erosion, and nonpoint source
pollution, wherever possible through stormwater management controls, and to
ensure that these management controls are properly maintained and pose no threat
to public safety or cause excessive municipal expenditures.
5. Protect the quality of groundwater resources, surface water bodies, and wetlands.
B. Administration
The Director of the Department of Public Works or their designee shall administer the
provisions of these Regulations.
The Department of Public Works (DPW) reserves the right to revise, supplement, or
rescind any regulations or portion of this document as it deems appropriate. Suggested
changes will be submitted to the Select Board for approval.
C. Applicability
1. The stormwater management standards apply

a subsurface filtration and/or infiltration device or properly discharged to a
naturally occurring or fully replanted and vegetated area with slopes of 15
percent or less and with adequate controls to prevent soil erosion and
concentrated flow.
b) Impervious surfaces for parking areas and roads shall be minimized to the
extent possible (including minimum parking requirements for proposed
uses).
2. Required Permits
a) All subdivisions and site plans shall conform with the Goffstown
Development Regulations and require approval by the Goffstown Planning
Board. Any site plan violations not pertaining to these Water Quality
Standards will be addressed in accordance with the procedures listed in the
Development Regulations.
b) In addition to local approval, copies of the following permits shall be
required if applicable:
(1) RSA 485-A:17 requires a permit from the New Hampshire
Department of Environmental Services (NHDES) Water Supply and
Pollution Control Division for “…any person proposing to
significantly alter the characteristic of the terrain, in such a manner
as to impede natural runoff or create an unnatural runoff …”
Regulations require this permit for any project involving more than
100,000 contiguous square feet of disturbance or if such activity
occurs in or on the border of the surface waters of the state.
(2) National Pollutant Discharge Elimination System (NPDES)
Stormwater Discharge Permit. A permit issued by the EPA or by the
State under authority delegated pursuant to 33 USC, section 1342
(b) that authorizes the discharge of pollutants to waters of the United
States. For a cumulative disturbance of one (1) acre of land that EPA
considers “construction activity,” which includes, but is not limited
to clearing, grading, excavation, and other activities that expose soil
typically related to landscaping, demolition, and construction of
structures and roads, a federal permit will be required. Consult EPA
for specific rules. This EPA permit is in addition to any state or local
permit required.

Prohibited Discharges
No person shall introduce or cause to be introduced into the Municipal Separate Storm
Sewer System (MS4) any discharge that causes or contributes to causing the Town to
violate a water quality standard, the Town’s NPDES permit, any state-issued discharge
permit for discharges from its MS4, or to the impairment of a water body.

The Town of Goffstown has developed a comprehensive Illicit Discharge Detection and
Elimination Plan as part of the MS4 Permit requirements (Appendix A).
A. Prohibited Substances
No person shall dump, spill, leak, pump, pour, emit, empty discharge, leach, dispose, or
otherwise introduce or cause, allow, or permit to be introduced any of the following
substances into the MS4:
1. New or used motor oil, antifreeze, or other motor vehicle fluid
2. Industrial wastes
3. Hazardous waste, including hazardous household waste
4. Domestic sewage or septic tank waste, grease trap waste, or grit trap waste
5. Garbage, trash, rubbish, or yard waste
6. Wastewater from a commercial car wash facility; from any vehicle washing,
cleaning or maintenance at any new or used automobile, or other vehicle dealership,
rental agency, body shop, repair shop, or maintenance facility; or from any
washing, cleaning, or maintenance of any business or commercial or public service
vehicle, including truck, bus, or heavy equipment, by a business or public entity
that operates more than two such vehicles
7. Wastewater from the washing, cleaning, de-icing, or other maintenance of aircraft
8. Wastewater from commercial mobile power washer or from the washing or other
cleaning of a building exterior that contains any soap, detergent, degreaser, solvent,
or any other harmful cleaning substance
9. Wastewater from any floor, rug, or carpet cleaning
10. Wastewater from the wash down or other cleaning of pavement that contains any
harmful quantity of soap, detergent, solvent, degreaser, emulsifier, dispersant, or
any other harmful cleaning substance; or any wastewater from the wash down or
other cleaning of any pavement where any spill, leak, or other release of oil, motor
fuel, or other petroleum or hazardous substance has occurred, unless all harmful
quantities of such released material have been previously removed
11. Effluent from a cooling tower, condenser, compressor, emissions scrubber,
emissions filter, or the blow-down from a boiler
12. Ready-mixed concrete, mortar, ceramic, or asphalt base material or hydro mulch
material, or from the cleaning of commercial vehicles or equipment containing, or
used in transporting or applying, such material
13. Runoff or wash down water from any animal pen, kennel, or foul or livestock
containment area
14. Filter backwash from a swimming pool, fountain, hot-tub, or spa

15. Swimming pool water containing any harmful quantity of chlorine, muriatic acid
or other chemical used in the treatment or disinfection of the swimming pool water
or in the pool cleaning
16. Water from a water curtain in a spray room used for painting vehicles or equipment
17. Contaminated runoff from a vehicle wrecking yard
18. Any substance or material that will damage, block, or clog the MS4
19. Any release from a petroleum storage tank, or any leachate or runoff from soil
contaminated by a leaking petroleum storage tank, or any discharge of pumped,
confined, or treated wastewater from the remediation of any such petroleum storage
tank release, unless it complies with state and federal standards and does not contain
any harmful quantity of any pollutant
20. Any discharge not in compliance with an applicable NPDES permit (e.g., noncontact cooling water, storm water)
B. Earth-type Materials
No person shall introduce or cause to be introduced into the MS4 any harmful quantity of
sediment, silt, earth, soil, or other material associated with cleaning, grading, excavation,
or other construction activities (or associated with landfilling or other placement or
disposal of soil, rock, or other earth materials) in excess of what could be captured by
employing sediment and erosion control measures to the maximum extent practicable
under the prevailing circumstances.
C. Sewage, Gray water, and Other Household Discharges
No person shall connect a pipe, or allow such connection to continue, which could convey
sanitary sewage, domestic or industrial, to the MS4. This includes gray water discharge
such as washing machine discharge, sink drains, and floor drains.
No hoses, including sump pump discharge hoses, shall be inserted into a catch basin unless
specific approval has been given by the DPW. Private temporary drain connection licenses
shall be considered by the DPW on a case-by-case basis.
D. Pesticide and Herbicide
No person shall use, or cause to be used, any pesticide or herbicide contrary to any
directions for use on any labeling required by state or federal statute or regulation. Any use
of any pesticide, herbicide, or fertilizer in any manner that the person knows, or reasonably
should know, is likely to cause, or does cause, a harmful quantity of the pesticide, herbicide,
or fertilizer to enter the MS4 or Waters of the United States, as defined by Section 502(7)
of the Clean Water Act, is prohibited.
No person shall dispose of, discard, store, or transport a pesticide, herbicide, or fertilizer,
or related container in a manner that the person knows, or reasonably should know, is likely

to cause, or does cause, a harmful quantity of the pesticide, herbicide, or fertilizer to enter
the MS4 or Waters of the United States.
E. Storage of Trash, Toxic Substances and Hazardous Wastes
No person shall store toxic or hazardous substances or allow trash and debris to stand or
collect on a property in a manner allowing exposure to precipitation and storm water runoff,
which can affect storm water discharge to the MS4 or the adjacent water table. Any toxic
or hazardous substances stored onsite must be in accordance with EPA and state
regulations.

Notification of Discharges and Spills
A. Notification
As soon as any person responsible for a facility (to include activity or operation), or
responsible for emergency response for a facility has information of any known or
suspected release of pollutants or non-storm water discharges from that facility which are
resulting or may result in illicit discharges or pollutants discharging into storm water, the
Town MS4, State Waters, or Waters of the United States, said person shall take all
necessary steps to ensure the discovery, containment, and cleanup of such release so as to
minimize the effects of the discharge.
B. Release Notification and Reporting
Any person in charge of any facility, vehicle, or other source of any spilling, leaking,
pumping, pouring, emitting, emptying, discharging, escaping, leaching, dumping,
disposing or any other release of any substances that may flow, leach, enter, or otherwise
be introduced into the MS4 or Waters of the United States, shall immediately notify DPW
and the Town of Goffstown Fire Department by telephone of nature, quantity, and time of
occurrence of the event. Such events include all spills of any size that enters a catch basin,
culvert, or structure that conveys runoff from the site. Such events also include any material
that spills outside the limits of the approved work area of the site and any spill that breaches
a silt fence or other BMP control structure. Spills that reach a wetland or surface water,
whether within or outside the work site, also are to be reported.
In this section, “substances” include any reportable quantity as outlined in 40 CFR Part
302; any extremely hazardous substance as established under 40 CFR Part 355; and any oil
that causes a film or sheen or discolors the surface of the water or causes a sludge emulsion
to be deposited beneath the surface of the water or any harmful quantity of pollutant.
All spills other than those described above are to be recorded within the daily activity log
of the site contractor or industrial operator. Spill log entries shall include the remediation
taken and the extent and quantity of the spill.

Following the initial phone notification above, written notice addressed and mailed to the
Director or his duly authorized agent shall be provided within three (3) business days of
the discharge/spill notice and shall include the chemical or substance name, exact location
of release, time and duration of release, estimated quantity and concentration of release,
source of release, precautions that should be taken in regards to release, steps taken to
contain and/or clean up release and the telephone numbers of the point of contact for further
information.
The notification should be mailed to: Department of Public Works, Attn: Director of Public
Works, 404 Elm Street, Goffstown, NH 03045
If the discharge of prohibited materials originates from a commercial or industrial
establishment, the owner or operator of such establishment shall also retain an on-site
written record of the discharge and the actions taken to prevent its recurrence. Such records
shall be retained for at least three (3) years. Said person shall also take immediate steps to
ensure no recurrence of the discharge or spill. Information regarding the steps taken to
ensure no recurrence shall be submitted to DPW in writing within three (3) days of the
incident.
D. Liability for Damage and Loss
The discharge/spill notifications required above shall not relieve the responsible person of
any expense, loss, damage, or other liability which may be incurred as a result of the
release.
Such liability includes damage to the Town, to natural resources, or to any other person or
property; nor shall such notification relieve the responsible person of any fine, penalty, or
other liability which may be imposed pursuant to the Water Quality Ordinance, these Water
Quality Standards, or State or Federal law. Any person responsible for a release shall
comply with all State, Federal, and any other local order requiring reporting, cleanup,
containment, and any other appropriate remedial action in response to the release. The
responsible person shall reimburse the Town for any cost incurred by the Town in
responding to the release. Failure to provide notification of a release as provided above is
a violation of the Water Quality Ordinance.

Violations, Enforcement, and Penalties
It shall be unlawful for any person to violate any provision or fail to comply with any of the
requirements of the Town of Goffstown Water Quality Ordinance or Water Quality Standards.
Any person who has violated or continues to violate these provisions may be subject to the
enforcement actions outlined in this section or may be restrained by injunction or otherwise abated
in a manner provided by law. In the event the violation constitutes an immediate danger to public
health or public safety, DPW is authorized to enter upon the subject private property without giving

prior notice, to take any and all measures necessary to abate the violation and/or restore the
property. DPW is authorized to seek costs of the abatement as outlined below.
A. Notice of Violation
Whenever DPW finds that a violation of this ordinance has occurred, the Director or Town
Engineer may order compliance by written notice of violation (NOV). The NOV shall
contain:
1. The name and address of the alleged violator, if known
2. The address, or a description of the building, structure, or land upon which the
violation is occurring, or has occurred
3. A statement specifying the nature of the violation
4. A description of the remedial measures necessary to restore compliance with this
ordinance and a time schedule for the completion of such remedial action
5. A statement of the penalty or penalties under the Water Quality Ordinance that may be
assessed as a result of the violation
6. A statement that the determination of violation may be appealed to the Director of
Public Works by filing a written notice of appeal within three (3) calendar days of
service of notice of violation
B. Optional NOV components
1. Performance of monitoring, analyses, and reporting
2. Elimination of illicit discharges and illegal connections
3. Violating discharges, practices, or operations shall cease and desist
4. Abatement or remediation of storm water pollution or contamination hazards and
the restoration of any affected property
5. Payment of costs to cover administrative and abatement costs
6. Implementation of pollution prevention practices
C. Appeal of Notice of Violation
Any person receiving a NOV may appeal the determination of the DPW. The appeal must
be received by end of the business day at the office of the Director of Public Works within
three (3) calendar days from the date of the NOV. Filing an appeal does not relieve the
owner from full compliance with remedial actions outlined in the NOV. The appeal will be
presented to the Select Board. The decision of the Select Board and Director of Public
Works shall be final.
D. Enforcement Measures After Appeal
If the violation has not been corrected pursuant to the requirements set forth in the NOV,
DPW representatives may enter upon the subject private property and are authorized to

take any and all measures necessary to abate the violation and/or restore the property. It
shall be unlawful for any person, owner, agent, or person in possession of any premises to
refuse to allow DPW or its designee to enter upon the premises for the purposes set forth
above.
The owner of the property will be responsible for any costs incurred during the remedial
action.
E. Costs of Abatement of the Violation
Within ten (10) days after abatement of the violation, the owner of the property will be
notified of the cost of abatement, including administrative costs. If the amount due is not
paid within thirty (30) days after receipt of the notice the charges, the Town shall take action
as outlined in NH RSA 676:17.
F. Civil Penalties
In the event the alleged violator fails to take the remedial measures set forth in a NOV or
otherwise fails to cure the violations described therein within three (3) days, or such greater
period as DPW shall deem appropriate, after the Director or the Director’s designee has
taken one or more of the actions described above, the Director of Public Works and/or
Goffstown Police Department may impose a penalty, in accordance with NH RSA 149-I:6,
not to exceed $10,000 (depending on the severity of the violation) for each day the violation
remains unremedied after receipt of the NOV. The Director or the Director’s designee shall
give notice of the violation within 10 days of commencement of any action taken.
G. Violations Deemed a Public Nuisance
In addition to the enforcement process and penalties provided in the Water Quality
Ordinance and these Water Quality Standards, any threat to public health, safety, welfare
and environment is declared and deemed a nuisance, which may be abated by injunctive or
other equitable relief as provided by law.
H. Remedies Not Exclusive
The remedies listed in Water Quality Ordinance and these Water Quality Standards are not
exclusive of any other remedies available under any applicable federal, state or local law
and the Town may seek cumulative remedies.
I. Town Reimbursement of Fees
The Town may recover attorney’s fees, court costs, engineering fees and other expenses
associated with enforcement of the Water Quality Ordinance and these Water Quality
Standards, including sampling and monitoring expenses.

Chloride Usage for Winter Maintenance
The owners and operators of private streets and private parking lots with 10 or more parking
spaces that are draining to MS4 located within any watershed that is impaired for Chlorides
shall be required to comply with the following provisions:
A. Any commercial salt applicators hired to treat parking lots or streets be trained and
certified in accordance with NHDES Env-Wq 2203 and/or RSA 489-C; and
B. Report annual salt usage within the municipal boundaries using the UNH
Technology Transfer Center online tool (http://roadsalt.unh.edu/Salt).

Permit Procedures and Requirements for New Development Projects
A. Town Process
1. The project shall be submitted to the Planning Board for approval. The following
items shall be submitted:
a) An electronic copy of the project’s Storm Water Pollution Protection Plan
(SWPPP) shall be submitted to DPW. The SWPPP shall include an
operation and maintenance program for the project including a maintenance
agreement signed by the property owner.
b) Project design drawings (Site plan or Subdivision application) in
accordance with the Town’s development regulations.
c) A Stormwater Drainage report in accordance with the Town’s development
regulations. The drainage report shall include analysis of the 25-, 50-, and
100-year storm events.
2. Upon receiving approval from the Planning Board, the Applicant is required to
provide to DPW the following:
a) Evidence of the EPA’s receipt of the Applicant’s project Notice of Intent
(NOI) submittal.
b) A copy of the NOI submitted to EPA.
c) A copy of the approved SWPPP including maintenance agreement signed
by the property owner.
d) A Drainage Maintenance Agreement signed by the owner. A drainage
maintenance agreement is required for any site proposing private drainage.
3. The applicant must notify DPW at least ten (10) working days in advance of the
commencement of construction.
a) The Owner/Operator/Contractor shall conduct regular inspections of the
storm water management system during construction. Inspections shall be
performed by a “qualified person” as defined in the EPA Construction

General Permit (CGP). Inspections shall be performed on all areas that have
not had final stabilization, areas used for storage of materials that are
exposed to precipitation, structural control measures, locations where
vehicles enter and exit the construction site, open manholes and piping that
could collect sediment and other controls as outlined in the SWPPP. All
inspections shall take place within 24-hours after any rainstorm of 0.5
inches or more of rain and once every seven days. These inspections must
be documented by written reports that include the following information:
(1) The date and location of the inspection
(2) Whether construction is in compliance with the approved SWPPP
(3) Variations from the approved construction specifications
(4) Any violations that exist
4. Final Stabilization
When a site has reached final stabilization and all storm water discharges from
construction activities that are authorized by these Regulations and by the NPDES
permit for those construction activities are eliminated, or where the operator of all
storm water discharges at a facility changes, the operator of the construction site
shall submit to DPW a copy of the NPDES Notice of Termination (“NOT”), or EPA
reference tracking number, of coverage under a NPDES General Permit for Storm
Water Discharges.
Upon final stabilization of the construction site, the owner (or duly authorized
representative thereof) by submission of the NOT to the EPA is certifying that the
site has been finally stabilized. The Town may withhold an occupancy or use permit
for any premises constructed on the site until such certification of final stabilization
has been filed and DPW has determined, following any appropriate inspection, that
final stabilization has, in fact, occurred and that any required permanent structural
controls have been completed.
The operator shall retain copies of any SWPPP, certifications, all reports required
by these Regulations or by the NPDES permit for the site, and records of all data
used to complete the NOT, for a period of at least three years from the date that the
site is finally stabilized.
The operator shall assure that DPW is provided with two full sets of as-built plans
and electronic files (.pdf and .dwg formats, to include at a minimum: sewers, drains,
storm water structures, swales, roads, curb lines, sidewalks, and vertical
information on structures via profile or plan invert notes) of the completed project.
These must be received within one hundred twenty (120) days of the submission of
the NOT. If these as-builts are not received by the Town, then the Town may draw
funds from any retainage or financial guarantees to have an engineer complete the
as-builts with all costs being borne by the operator.

Within thirty (30) days of the submission of the NOT, the operator’s construction
site must be cleaned and free of any residual stockpiles of materials, hay bales, silt
fences or any such BMPs that were used for site erosion and sediment controls. If
these are not completed to the satisfaction of the Director or their designee, the
Town may draw funds from any retainage, performance, or security bonds to have
a contractor complete the clean-up and close out any remaining site stabilization.
5. Upon completion of construction for the project, the property Owner shall provide
DPW with a notarized affidavit acknowledging their understanding of and
implementation of the Storm Water Operations and Maintenance portion of the
Storm Water Pollution Protection Plan (SWPPP) for the site.
B. Stormwater System Design and Management Standards
The Town adopts as its stormwater design and BMP manual the following publications,
which are incorporated by reference in these Regulations as if fully set out herein:
1. New Hampshire Department of Environmental Services Stormwater Manual
dated February 2025 and any amendments and updates.
2. The Town of Goffstown Development Regulations
3. “New Hampshire DOT Guidelines for Temporary Erosion and Sediment Control
and Storm Water Management” - NHDOT Bureau of Construction.
C. Stormwater Management for New Development
1. All proposed stormwater management practices and treatment systems shall meet
the following performance standards:
a) Stormwater management and erosion and sediment control practices shall
be located outside any specified buffer zones unless otherwise approved by
the Planning Board.
b) Low Impact Development (LID) site planning and design strategies shall be
used to the maximum extent practicable (MEP) to reduce stormwater runoff
volumes, protect water quality, and maintain predevelopment site
hydrology. LID techniques with the goals of protecting water quality,
maintaining predevelopment site hydrology, LID techniques that preserve
existing vegetation, reduce the development footprint, minimize, or
disconnect impervious area, and use of enhanced stormwater BMP (such as
rain gardens, bioretention systems, tree box filters, and similar stormwater
management landscaping techniques) shall be incorporated into landscaped
areas. Capture and reuse of stormwater is strongly encouraged.
c) All stormwater treatment areas shall be planted with plantings appropriate
for the site conditions: trees, grasses, shrubs and/or other plants in sufficient
numbers and density to prevent soil erosion and to achieve the water quality
treatment requirements of this section. Preference should be given to native

plant materials or improved cultivars of native plants.
d) All stormwater installations and areas that receive rainfall runoff must be
designed to drain within a maximum of 72 hours for vector control.
e) Salt storage areas shall be fully covered with permanent or semi-permanent
measures and loading/offloading areas shall be located and designed to not
drain directly to receiving waters and maintained with good housekeeping
measures in accordance with NHDES published guidance. Runoff from
snow and salt storage areas shall enter treatment areas before being
discharged to receiving waters or allowed to infiltrate into the groundwater.
f) Surface runoff shall be directed into appropriate stormwater control
measures designed for treatment and/or filtration to the maximum extent
practicable and/or captured and reused onsite.
g) All newly generated stormwater from new development shall be treated on
the development site. A development plan shall include provisions to retain
stormwater on the site by using the natural flow patterns.
2. Runoff from impervious surfaces shall be treated to achieve at least 80% removal
of Total Suspended Solids (TSS) and at least 60% removal of both total nitrogen
and total phosphorus using appropriate treatment measures, as specified in the NH
Stormwater Manual February 2025 as amended or other equivalent means. Where
practical, the use of natural, vegetated filtration and/or infiltration practices or
subsurface gravel wetlands for water quality treatment is preferred given its
relatively high nitrogen removal efficiency. All new impervious area draining to
surface waters impaired by nitrogen, phosphorus or nutrients shall be treated with
stormwater BMP designed to optimize pollutant removal efficiencies based on
design standards and performance data published by the UNH Stormwater Center
and/or included in the latest version of the NH Stormwater Manual.
a) Measures shall be taken to control the post-development peak runoff rate so
that it does not exceed pre-development runoff rate. Drainage analyses shall
include calculations comparing pre- and post-development stormwater
runoff rates (cubic feet/second) for the 25-year, 50-year, and 100-year 24hour storm events. Similar measures shall be taken to control the postdevelopment runoff volume to infiltrate the groundwater recharge volume
(GRV) in accordance with NHDES Alteration of Terrain requirements. For
sites where infiltration is limited or not practicable, the applicant must
demonstrate that the project will not create or contribute to water quality
impairment.
b) The design of the stormwater drainage systems shall provide for the disposal
of stormwater without flooding or functional impairment to streets, adjacent
properties, downstream properties, soils, or vegetation.

c) The design of the stormwater management systems shall account for
existing site hydrology, including flows originating from off-site.
d) Whenever practicable, native site vegetation shall be retained, protected, or
supplemented. Any stripping of vegetation shall be done in a manner that
minimizes soil erosion.
D. Stormwater Management for Redevelopment
1. Redevelopment (as applicable to this stormwater regulation) means: Construction,
alteration, or improvement that disturbs existing impervious area (including
demolition and removal of road/parking lot materials down to the erodible subbase)
or expands existing impervious cover, where the existing land use is commercial,
industrial, institutional, governmental, recreational, or multifamily residential, and
the area being disturbed or added reaches the threshold of the areas indicated in
Section I.C.
2. The following activities are not considered redevelopment:
a) Interior and exterior building renovation.
b) Resurfacing of an existing paved surface (e.g. parking lot, walkway or
roadway).
c) Pavement excavation and patching that is incidental to the primary project
purpose, such as replacement of a collapsed storm drain.
d) Landscaping installation and maintenance.
3. All applications shall comply with the requirements of the Goffstown Development
Regulations and these standards.
4. For sites meeting the definition of a redevelopment project and having less than
60% existing impervious surface coverage, the stormwater management
requirements will be the same as other new development projects. The applicant
must satisfactorily demonstrate that impervious area is minimized, and LID
practices have been implemented on-site to the maximum extent practicable.
5. For sites meeting the definition of a redevelopment project and having more than
60% existing impervious surface area, stormwater shall be managed for water
quality in accordance with one or more of the following techniques, listed in order
of preference:
a) Implement measures onsite that result in disconnection or treatment of
100% of the additional proposed impervious surface area and at least 30%
of the existing impervious area and pavement areas, preferably using
filtration and/or infiltration practices.
b) If resulting in greater overall water quality improvement on the site,
implement LID practices to the maximum extent practicable to provide
treatment of runoff generated from at least 60% of the entire developed site

area.
6. Runoff from impervious surfaces shall be treated to achieve at least 80% removal
of Total Suspended Solids and at least 60% removal of both total nitrogen and total
phosphorus using appropriate treatment measures, as specified in the NH
Stormwater Manual. Volumes 1 and 2, December 2008, as amended, or other
equivalent means. All new impervious area draining to surface waters impaired by
nitrogen, phosphorus or nutrients shall be treated with stormwater BMP designed
to optimize pollutant removal efficiencies based on design standards and
performance data published by the UNH Stormwater Center and/or included in the
latest version of the NH Stormwater Manual.
7. All newly generated stormwater from redevelopment shall be treated on the
development site.
E. Stormwater Management Report and Plan Requirements
1. All applications to the Planning Board shall include a comprehensive Stormwater
Management Plan (SMP). The SMP shall include:
a) A narrative description and an Existing Conditions Site Plan showing all
pre-development impervious surfaces, buildings and structures; surface
water bodies and wetlands; drainage patterns, sub-catchment and watershed
boundaries; building setbacks and buffers, locations of various hydrologic
group soil types, mature vegetation, land topographic contours with
minimum 2-foot intervals and spot grades where necessary for sites that are
flat.
b) A narrative description and a Proposed Conditions Site Plan showing all
post-development proposed impervious surfaces, buildings and structures;
temporary and permanent stormwater management elements and best
management practices (BMP), including BMP GIS coordinates and GIS
files; important hydrologic features created or preserved on the site;
drainage patterns, sub-catchment and watershed boundaries; building
setbacks and buffers; proposed tree clearing and topographic contours with
minimum 2-foot intervals.
(1) The plans shall provide calculations and identification of the total
area of disturbance proposed on the site (and off site if applicable)
and total area of new impervious surface created.
(2) A summary of the drainage analysis showing a comparison of the
estimated peak flow and volumes for various design storms at each
of the outlet locations shall be included.
c) The SMP shall describe the general approach and strategies implemented,
and the facts relied upon, to meet the goals mentioned above. The SMP shall
include design plans and/or graphical sketch(es) of all proposed above

ground LID practices.
d) The SMP shall include calculations of the change in impervious area,
removal rates for each best management practice, and GIS files containing
the coordinates of all stormwater infrastructure elements (e.g. catch basins,
swales, detention/bioretention areas, piping)
e) The SMP shall include a description and a proposed Site Plan showing
proposed erosion and sediment control measures, limits of disturbance,
temporary and permanent soil stabilization measures in accordance with the
NHDES Stormwater Manual as well as a construction site inspection plan
including temporary water quality measures, phased installation of best
management practices and final inspection upon completion of
construction.
f) The SMP shall include a long-term stormwater management BMP
Inspection and Management Plan that describes the responsible parties and
contact information for the qualified individuals who will perform future
BMP inspections. Required inspections, inspection frequency, maintenance
schedule and reporting protocols shall be included.
g) The SMP shall describe and identify locations of any proposed deicing
chemical and/or snow storage areas. SMP will describe how deicing
chemical use will be minimized or used most efficiently.
h) In urbanized areas that are subject to the EPA MS4 Stormwater Permit and
will drain to chloride-impaired waters, any new developments and
redevelopment projects shall submit a description of measures that will be
used to minimize salt usage, and track and report amounts applied using the
UNH
Technology
Transfer
Center
online
tool
(http://www.roadsalt.unh.edu/Salt/) in accordance with Appendix H of the
NH MS4 Permit.
2. The following activities are considered exempt from preparing and submitting a
stormwater and land development management plan:
a) Agricultural and forestry practices in accordance with BMPs published by
the NH Department of Agriculture.
b) Resurfacing and routine maintenance of roads and parking lots.
c) Interior alterations and exterior maintenance to existing buildings and
structures.
F. SMP General Performance Criteria and Site Inspections
1. General Performance Criteria for Stormwater Management Plans:
a) All applications shall apply site design practices to reduce the generation of
stormwater during construction and in the post-developed condition, reduce

overall impervious surface coverage, seek opportunities to capture and
reuse and minimize and discharge of stormwater to the municipal
stormwater management system.
b) Water Quality Protection
(1) No stormwater runoff generated from new development or
redevelopment shall be discharged directly into a jurisdictional
wetland or surface water body without adequate treatment.
(2) All developments shall provide adequate management of
stormwater runoff and prevent discharge of stormwater runoff from
creating or contributing to water quality impairment.
c) Onsite groundwater recharge rates shall be maintained by promoting
infiltration through use of structural and non-structural methods. Capture
and reuse of stormwater runoff is encouraged in instances where
groundwater recharge is limited by site conditions. All stormwater
management practices shall be designed to convey stormwater to allow for
maximum groundwater recharge. This shall include, but not be limited to:
(1) Maximizing flow paths from collection points to outflow points.
(2) Use of multiple best management practices.
(3) Retention of and discharge to fully vegetated areas.
(4) Maximizing use of infiltration practices.
(5) Stormwater System Design Performance Standards.
2. Stormwater system design, performance standards and protection criteria shall be
provided as prescribed in the NHDES Alteration of Terrain program. Calculations
shall include sizing of all structures and best management practices, including
sizing of emergency overflow structures based on assessment of the 50-year 24hour frequency storm discharge rate.
3. The sizing and design of stormwater management practices shall utilize new
precipitation data from the Northeast Region Climate Center (NRCC), or the most
recent precipitation atlas published by the National Oceanic and Atmospheric
Administration (NOAA) for the sizing and design of all stormwater management
practices. See the NRCC website at http://precip.eas.cornell.edu/.
a) All stormwater management practices involving bioretention and vegetative
cover as a key functional component must have a landscape plan detailing
both the type and quantities of plants and vegetation to be in used in the
practice and how and who will manage and maintain this vegetation. The
use of native plantings appropriate for site conditions is strongly encouraged
for these types of stormwater treatment areas. The landscape plan must be
prepared by a licensed landscape architect, or another qualified

professional.
b) The applicant shall provide that all stormwater management and treatment
practices have an Inspection and Maintenance Plan in place and agreement
to ensure the system will continue to function as designed. This agreement
will include all maintenance easements required to access and inspect the
stormwater treatment practices, and to perform routine maintenance as
necessary to ensure proper functioning of the stormwater system. The
operations and maintenance plan shall specify the parties responsible for the
proper maintenance of all stormwater treatment practices and frequency of
inspections. The Operations and Maintenance Plan shall be provided to the
Planning Board as part of the application prior to issuance of any local
permits for land disturbance and construction activities.
4. The applicant shall provide legally binding documents for filing with the Registry
of Deeds, which demonstrate that the obligation for maintenance of stormwater best
management practices and infrastructure runs with the land and that the Town has
legal access to inspect the property to ensure their proper function or maintain
onsite stormwater infrastructure when necessary to address emergency situations
or conditions.
5. The property owner shall bear responsibility for the installation, construction,
inspection, and maintenance of all stormwater management and erosion control
measures required by the provisions of these regulations and as approved by the
Planning Board, including emergency repairs completed by the Town.
G. Stormwater Management Plan Recordation
1. Stormwater Management and Sediment and Erosion Control Plans shall be
incorporated as part of any approved site plan. A Notice of Decision acknowledging
the Planning Board approval of these plans shall be recorded at the Hillsborough
County Registry of Deeds. The Notice of Decision shall be referenced to the
property deed (title/book/page number) and apply to all persons that may acquire
any property subject to the approved stormwater management and sediment control
plans. The Notice of Decision shall reference the requirements for maintenance
pursuant to the stormwater management and erosion and sediment control plans as
approved by the Planning Board.
2. The applicant shall submit as-built drawings of the constructed stormwater
management system to the Planning and Economic Development office following
construction.
3. Easements
a) Where a development is traversed by or requires the construction of a
watercourse or a drainage way, an easement to the Town of adequate size
to enable construction, reconstruction and required maintenance shall be
provided for such purpose. Easements to the Town shall also be provided

for the purpose of periodic inspection of drainage facilities and BMP should
such inspections by the Town become necessary. All easements shall be
recorded at the Hillsborough County Registry of Deeds. Where stormwater
management or treatment facilities are constructed outside of public rights
of way, a permanent easement to the town shall be recorded to allow
construction, maintenance or inspection of the facility, as well as flowage
rights.
H. Stormwater Management During Construction
1. Applicant must implement erosion, sediment and good housekeeping controls as
prescribed in the comprehensive Stormwater Management Plan (SMP) (see Section
VI.E) and reduce potential pollutants during construction activities. Best
Management Practices (BMP) must be followed and shall include management of
non-stormwater discharges and materials, minimization of disturbed area, phased
construction activity, good housekeeping practices, containment of materials and
waste, perimeter controls, control for dust and particulate generating activities,
street sweeping and the protection of all storm drain inlets and slopes.
2. Controls must be regularly inspected and maintained per schedule established in
SMP but in case shall be less than every seven days and within 24 hours after a
storm of 0.25 inches or greater. Any deficiencies noted shall be corrected within
24 hours.
3. Records of inspections, any corrective actions, and construction activities must be
maintained on site and submitted electronically to the DPW as requested.
4. SMP shall be updated if necessary during construction.
5. Achieve final site stabilization.
I. Inspection and Maintenance Responsibility During and After Construction
1. Municipal staff or their designated agent shall be granted site access to complete
routine inspections to ensure compliance with the approved stormwater
management and sediment and erosion control plans. Such inspections shall be
performed at a time agreed upon with the landowner.
a) If permission to inspect is denied by the landowner, municipal staff or their
designated agent may secure an administrative inspection warrant from the
district or superior court under RSA 595-B Administrative Inspection
Warrants. Expenses associated with inspections shall be the responsibility
of the applicant/property owner.
b) If violations or non-compliance with a condition(s) of approval are found
on the site during routine inspections, the inspector shall provide a report
documenting these violations or non-compliance including recommend
corrective actions. The Town shall notify the property owner in writing of
these violations or non-compliance and corrective actions necessary to

bring the property into full compliance. The Planning Board, at their
discretion, may recommend to the Select Board to issue a stop work order
if corrective actions are not completed within 10 days.
c) If corrective actions are not completed within a period of 30 days from
notification by Town Staff, the Planning Board may exercise their
jurisdiction under RSA 676:4-a Revocation of Recorded Approval.
(1) The applicant shall bear final responsibility for the installation,
construction, inspection, and disposition of all stormwater
management and erosion control measures as required by this
regulation. Site development shall not begin before the Stormwater
Management Plan receives written approval by the Planning Board.
(2) The municipality retains the right, though accepts no responsibility,
to repair or maintain stormwater infrastructure if: a property is
abandoned or becomes vacant; and in the event a property owner
refuses to repair infrastructure that is damaged or is not functioning
properly.
(3) Landowners subject to an approved Stormwater Management Plan
shall be responsible for submitting an annual report to the Planning
Board by September 1 each year by a qualified professional that all
stormwater management and erosion control measures are
functioning per the approved stormwater management plan. The
annual report shall note if any stormwater infrastructure has needed
any repairs other than routine maintenance and the results of those
repairs. If the stormwater infrastructure is not functioning per the
approved stormwater management plan the landowner shall report
on the malfunction in their annual report and include detail
regarding when the infrastructure shall be repaired and functioning
as approved.
(4) If no report is filed by September 1, municipal staff or their
designated agent shall be granted site access to complete routine
inspections to ensure compliance with the approved stormwater
management and sediment and erosion control plans. Such
inspections shall be performed at a time agreed upon with the
landowner.

Appendix B – Stormwater Management and
Drainage Design
A.

Storm Water Management
1. Definitions:
a) Erosion: The wearing away of the land surface by the action of wind, water
or gravity.
b) Sediment: Solid material, both mineral and organic, that is in suspension,
is being transported, or has been moved from its site of origin by air, water
or gravity as a product of erosion.
c) Runoff: The portion of precipitation that makes its way overland toward
stream channels or lakes.
d) Measure: A specific procedure designed to control runoff, erosion or
sediment.
2. The developer shall control runoff, erosion and sediment during and after
construction through any measure approved by the Planning Board or Town
Engineer. In each instance, the measure or measures shall be suitable to the site
and subject to approval by the Planning Board and/or the Town Engineer.
3. All runoff, erosion and sediment control measures and the design of all drainage
structures and systems shall meet the design standards and specifications set forth
in these regulations or in the current "Manual on Drainage Design for Highways",
published by the New Hampshire Department of Transportation.
4. All submissions shall include a proposed schedule for inspection and maintenance
of all BMPs.

B. Drainage Study Requirements
1. The calculation of runoff is of prime importance to the overall scheme of drainage
design.
2. Drainage shall be designed by the use of the Rational Methods Formula, SCS-TR55
unless otherwise approved in writing by the Director of Public Works or Town
Engineer.
3. There shall be a net zero (0) increase in runoff from the site from pre-development
conditions to post-development conditions. This net zero increase in runoff shall
apply to and be evaluated for fifty-year storm (design storm) frequency events for
all areas.
a) Where an existing failed drainage situation is present, effort should be made
to improve upon the existing conditions.

4. Flood protection areas shall be evaluated for one-hundred-year storm frequency
events.
5. Storm water drainage calculations shall be submitted to the Town for all site plan
and subdivision review applications, unless otherwise approved in writing by the
Director of Public Works or Town Engineer.
6. The drainage calculations shall include, but not necessarily be limited to the
following sections:
a) Summary of drainage calculations (50- and 100-year storm events)
b) Pre-development conditions/calculations (50- and 100-year storm events)
c) Post-development conditions/calculations (50- and 100-year storm events)
d) Detention pond evaluation (if applicable) (50- and 100-year storm events)
e) Detailed hydraulic calculations (pipes, ditches, etc.)
f) Sedimentation swale/erosion control calculations
g) Existing off-site drainage inadequacies
C. Drainage Design Criteria
1. Roads
a) In proposed new roadways, drainage systems must be closed drainage
systems.
b) Water is to be channeled into the drainage system through curbing or berms.
In rural areas asphalt berms will be allowed. Adequate treatment of the
runoff must be provided before the runoff leaves the development site.
c) Closed drainage will be required for all new roadways, regardless of public
or private ownership.
2. Culverts and Pipes
a) Cross culverts pipes and Closed drain system: no surcharge 50-year storm
frequency.
b) Pipe culverts will be designed as open flow channels. They will either be
under inlet or outlet control. The exact control can be found by following
the procedure outlined in "Hydraulic Charts for the Selection of Highway
Culverts", published by the Bureau of Public Roads as H.E.C. No. 5. This
material can also be found in the NHDOT Drainage Manual.
c) All pipes shall be sized based on 50-year storm frequency with minimum
pipe sizes as follows:
(1) Roadway Closed Drainage - 15”
(2) Roadway Cross Culvert - 18"

(3) Driveways - 12"
d) Pipe culverts with a span of 10 feet or more shall be considered as bridges.
e) It is preferred that culverts be located to fit natural channels in lines and
grade.
f) The minimum grade of culverts shall be 0.5% or able to maintain a velocity
of 2 feet per second (fps) while flowing one-third full.
g) Collars will be designed for culverts whose grades exceed 20%.
h) When the computed outlet velocity is in the range beyond normal design of
10 fps, additional outlet protection shall be considered.
i) Pipe velocities in excess of 20 fps at the design flow shall not be allowed
unless special energy dissipation devices have been designed.
j) The maximum headwater depth of flow immediately upstream from a pipe
culvert shall be controlled by the following:
(1) Damage to adjacent property;
(2) Damage to culvert and the roadway;
(3) Traffic interruption;
(4) Hazard to human life; and,
(5) Damage to stream & floodplain environment.
k) As a guide, the following table may be used under "normal conditions":

l) Minimum cover for culverts, measured between the pipe crown and finished
grade, shall be as follows:

(2) Unpaved Roads - 3' for all type of pipe material.
(3) Under Drives -1' for all type of pipe material.
(4) Under Grass -2' for all type of pipe material.
m) Acceptable Pipe Materials for Roadway Culverts include: reinforced
concrete; and smooth interior corrugated HDPE (Hi-Q Sure Lok or equal).
HDPE must be bedded and covered in accordance with the Town’s standard
detail.

n) All culverts shall be constructed with end sections or headwalls. End
sections shall be permitted on all pipes less 48" diameter, except where there
is an active stream.
o) All computations for culvert pipes and drainage systems shall be
documented and included in the drainage report. These shall be performed
by a registered engineer who shall stamp and sign the drainage report.
p) All available records concerning rainfall and floods shall be used in the
design of culverts and storm sewers.
3. Drainage Structures
a) No surcharging in catch basins or drain manholes allowed for the 50-year
storm.
b) Storm water detention/retention facilities: 100-year storm frequency; 1-foot
freeboard for 50-year storm.
c) Storm water infiltration facilities: 100-year storm frequency; 1-foot
freeboard for 50-year storm.
d) Box culverts and bridges: 100-year storm frequency, with 1-foot freeboard.
e) The Board reserves the right to require that storm drainage systems be
designed for less frequent, more intense rainfalls.
4. Ditches: (if permitted by Board)
a) A maximum length of 400 feet for a ditch to a catch basin or drop inlet is
required. Local conditions may require variations. The DPW Director must
approve any variations.
b) In order to keep the ditch self-cleaning, a minimum grade of 0.5% shall be
required, except for "Site Specific Swales" as required by R.S.A.
c) Acceptable methods of treatment include matting for erosion control, stone
for erosion control, stone fill and rip rap.
d) All ditches steeper than 5% shall be adequately protected against soil
erosion. Matting for erosion control or stone linings shall be provided, as
determined by an engineering evaluation.
e) Ditches shall be used at the top of back-slopes only when excessive off site
runoff damages slopes and/or overtaxes on-site systems.
5. Subsurface Drainage (Under-drains):
a) Subsurface drainage systems (under-drainage pipe) shall be provided where
the seasonal high ground water table is within five feet (5’) of the finished
roadway grade. Test pits or borings in roadway cut sections shall be taken,
as required or ordered by the DPW, to locate the Seasonal High Water
(SHW) Table and determine the need for under-drain pipe. This pipe shall

be in accordance with NHDOT Standard Specification Section 605.
Alternate under-rain pipe material shall require specific approval by the
DPW. A professional engineer shall supervise this design.
6. Ponds
a) A 12’ wide gravel road, is required for detention pond maintenance and to
the last structure of a retention pond system.
b) A paved apron shall be provided where a gravel maintenance road meets a
paved Town or Private road or as required by the Department of Public
Works.
c) Alternatives to traditional gravel construction will be considered on a caseby-case basis. Proposals shall include a stamped memo from the design
engineer certifying that the proposed construction methods are able to
support a fully-loaded, 10-wheel dump truck.
d) The Owner, or Association, shall be responsible for the cost of extraction
services and repairs should the alternative road not be suitable for Town
vehicles.
e) Detention, retention, and infiltration ponds shall be designed to meet the
following requirements:
(1) 1 foot of freeboard shall be provided for a 50-year storm from the
top of berm.
(2) The ponds shall be designed to completely contain the 100-year
storm within the berm.
(3) All ponds shall be provided with an emergency overflow design that
shall not be activated during the 100-year storm.
(4) Detention ponds shall not intercept the seasonal high ground water
table.
(5) Retention and Infiltration ponds shall be 4 feet above the seasonal
high-water table (measured from the bottom of pond elevation).

f) Outlets:
(1) Detention ponds shall have an outlet designed to drain the bottom of
the pond. The preferred outlet is a “V” notch, in lieu of a pipe.
(2) Retention ponds shall be designed to have an overflow structure or
level spreader.
g) Underground Detention Systems require 2-4 feet of separation to seasonal
high water from bottom of infiltration chambers depending on soil type.

(1) Test pit data shall be submitted with the design to confirm the design
infiltration rate used is reasonable.
7.

Utility Access
a) All utility structures, including drainage, must be readily accessible by
Town forces or Utility Owner for emergency maintenance.
b) Readily accessible shall mean:
(1) Within five (5) feet of a public way; or
(2) Within five (5) feet of a gravel access road able to support large
trucks.
c) No proposed landscaping or other site features shall be proposed within
three (3) feet of a drainage structure, pipe, or access way.
d) The Owner, or Association, shall be responsible for the cost of any clearing
required to gain access.

8. Rain gardens, ponds, and other stormwater management features shall not be used
as snow storage areas.
9. A Drainage Maintenance agreement will be required for all projects with private
drainage. An association must be formed to provide for private maintenance of the
drainage facilities.

Appendix C – Erosion Control Standards
A. General
The purpose of this Regulation is to control runoff and soil erosion and sedimentation
resulting from site construction and development. Subdivision plans shall include
plans for managing stormwater and controlling erosion and sedimentation as provided
herein.
B. Definitions:
The following definitions apply to this Stormwater Management and Erosion Control
Regulation:
1. Best Management Practice (BMP): A proven or accepted structural, non-structural,
or vegetative measure the application of which reduces erosion, sediment, or peak
storm discharge, or improves the quality of stormwater runoff.
2. Critical Areas: Disturbed areas of any size located adjacent to Wetland
Conservation Districts; disturbed areas exceeding 2,000 square feet in highly
erodible soils; and disturbed areas containing slope lengths exceeding 25 feet on
slopes greater than 15 percent.
3. Development: Any construction or land alteration or grading activities other than
for agricultural or silvicultural practices.
4. Disturbed Area: An area where the natural vegetation has been removed exposing
the underlying soil.
5. Erosion: The detachment and movement of soil or rock fragments by water, wind,
ice, or gravity.
6. Highly Erodible Soils: Any soil with an erodibility class (K factor) greater than or
equal to 0.43 in any layer as found in the National Cooperative Soil Survey (NCSS).
7. Project Area: The area within the subdivision boundaries.
8. Sediment: Solid material, either mineral or organic that is in suspension is
transported or has been moved from its site of origin by erosion.
9. Stabilized: When the soil erosion rate approaches that of undisturbed soils. Soils
which are disturbed will be considered protected when covered with a healthy,
mature growth of grass or a good covering of hay or straw mulch (2 tons/acre).
Mulch is only a temporary measure; ultimately, the site needs vegetation.
10. Stormwater Runoff: The water from precipitation that is not absorbed, evaporated,
or otherwise stored within the contributing drainage area.
11. Stream: Areas of flowing water occurring for sufficient time to develop and
maintain defined channels but may not flow during dry portions of the year.

Includes, but is not limited to all perennial and intermittent streams located on U.S.
Geological Survey maps.
C. Applicability
1. The applicant shall submit a stormwater management and erosion control plan to
the Planning Board for any tract of land being developed or subdivided, where one
or more of the following conditions are proposed:
a) A cumulative disturbed area exceeding 10,000 square feet.
b) Construction or reconstruction of a street or road.
c) A subdivision of more than three building lots.
d) Disturbed critical areas in accordance with Section B.2 of this appendix.
e) Or otherwise requested by the Town Engineer.
2. The Planning Board may waive the requirement for all or part of a stormwater
management and erosion control plan if it determines that a plan is unnecessary
because of the size, character, or natural conditions of a site. All requests for
waivers and action thereon shall be made in writing by the applicant and shall be
accompanied with supporting technical documentation to demonstrate minimal
environmental impact.
D. Minimum Requirements
1. The following minimum requirements shall apply to all projects, regardless of size:
a) Site drawing of existing and proposed conditions:
b) Locus map showing property boundaries;
c) North arrow, scale, date;
d) Property lines;
e) Easements;
f) Structures, utilities, roads and other areas of development;
g) Topographic contours at 2’ intervals;
h) Critical areas;
i) Surface water and wetlands, drainage patterns, and watershed boundaries;
j) Existing and proposed vegetation;
k) Soils information for design purposes or for determining highly erodible
soils, shall be determined from a National Cooperative Soil Survey (NCSS)
soil series map;
l) Temporary and permanent stormwater management and erosion and
sediment control BMPs;

m) Areas and timing of soil disturbance; and
n) A schedule for the inspection and maintenance of all BMPs.
2. A sequence of construction of the development site, including stripping and
clearing; rough grading; construction of utilities, infrastructure, and buildings; and
final grading and landscaping. Sequencing shall identify the expected date on which
clearing will begin, the estimated duration of exposure of cleared areas, areas of
clearing, installation of temporary erosion and sediment control measures, and
establishment of permanent vegetation.
3. A narrative section including discussion of each measure, its purpose, construction
sequence, and installation timing as they apply to the site.
4. Field modifications of a minor nature do not require Planning Board approval but
should be administratively approved by the Planning Director before construction
and noted on the final As-Built Plans.
5. All measures in the plan shall meet as a minimum the Best Management Practices
(BMPs) and erosion and sediment controls set forth in the New Hampshire
Department of Environmental Services Stormwater Manual, February 2025 or as
updated.
E. Design Standards
The following standards shall be applied in planning for stormwater management and
erosion control:
1. All measures in the plan shall meet, as a minimum, the Best Management Practices
set forth in the National Cooperative Soil Survey (NCSS).
2. Whenever practical, natural vegetation shall be retained, protected, or
supplemented. The stripping of vegetation shall be done in a manner that
minimizes soil erosion.
3. Appropriate erosion and sediment control measures shall be installed prior to soil
disturbance.
4. Tree cutting activities may be allowed prior to the pre-construction meeting.
However, following the cutting, the site must be stabilized, and all work shall cease
until the pre-construction meeting is held. Following the pre-construction meeting,
all sediment and erosion control measures shall be installed before any soil
disturbance commences.
5. The area of disturbance shall be kept to a minimum. Temporarily disturbed areas
to remain idle for more than 30 days, and areas which have received final grading,
shall be stabilized within 72 hours.
6. Seeding shall occur from spring through to May 20th, or August 10th to September
1st. Seeding may be done from spring thaw to early October if mulch is applied to
the seeded areas.

7. Any alteration of the terrain disturbing over 100,000 square feet of area or 50,000
square feet if within a protected shoreline (R.S.A. 483-B) requires a permit from
the New Hampshire Department of Environmental Services under R.S.A. 485-A:

8. All graded areas shall be seeded, fertilized, and mulched in accordance with the
NCSS Manual.
9. Measures shall be taken to control erosion within the project area. Sediment in
runoff water shall be trapped and retained within the project area using approved
measures. Wetland areas and surface waters shall be protected from sediment.
Compost socks or check dams are appropriate for use in swales, while protecting
the perimeter of a property or wetlands would call for utilizing silt fence or compost
socks.
10. Off-site surface water and runoff from undisturbed areas shall be diverted away
from disturbed areas where feasible or carried non-erosively through the project
area. The integrity of downstream drainage systems shall be maintained.
11. Measures shall be taken to control the post-development peak rate of runoff so that
it does not exceed pre-development runoff for the 2-year 24-hour storm event and
for additional storm event frequencies as specified in the design criteria of the
National Cooperative Soil Survey (NCSS)."
12. Priority should be given to preserving natural drainage systems including perennial
and intermittent streams, wetlands, swales, and drainage ditches for conveyance of
runoff leaving the project area.
13. All temporary erosion and sediment control measures shall be removed after final
site stabilization. Trapped sediment and other disturbed soil areas resulting from
the removal of temporary measures shall be permanently stabilized within 72 hours.
F. Completed Application Requirements
The Planning Board shall require each of the following minimum requirements in the
final construction drawings.
1. Existing and proposed conditions;
2. Locus map showing property boundaries;
3. North arrow, scale and date;
4. Property lines;
5. Structures, roads, utilities, staging areas, equipment storage, and stump disposal;
6. Topographic contours at 2-foot intervals;
7. Critical areas and earth stockpiles;
8. Within the project area, and within 400 feet of the project boundary, surface waters,
wetlands, drainage patterns and watershed boundaries;

9. Vegetation;
10. Extent of the 100-year flood plain boundaries, if published or determined;
11. Soils information for design purposes shall be obtained from a National
Cooperative Soil Survey (NCSS) soil series map. Highly erodible soils shall be
determined by soil series;
12. Easements;
13. Areas of soil disturbance;
14. Areas of cut and fill;
15. Areas of poorly and very poorly drained soils, including any portion to be disturbed
or filled;
16. Location of all structural, non-structural, and vegetative stormwater management
and erosion control BMPs;
17. Identification of all permanent control BMPs;
18. Tabulated sequence of construction;
a) Construction schedule;
b) Earth movement schedule;
c) A proposed start schedule for the inspection and maintenance of all BMPs,
including responsible parties and documentation.
19. Description of temporary and permanent vegetative BMPs, including seeding
specifications.
20. Description of all structural and non-structural BMPs with detailed drawings of
each, as appropriate.
21. Report section, including:
a) Appropriate design calculations for all temporary and permanent structural
control BMP measures
b) A drainage report with calculations showing the volume, peak discharge,
and velocity of present and future runoff
c) When detention structures are planned to reduce future condition peak
discharge, the NRCS TR55 or TR26 Methodology shall be used to compute
the runoff volume and peak discharge for designing the structure. The
design will conform to the criteria outlined for those types of structures
given in the New Hampshire Department of Environmental Services
Stormwater Manual .

G. Responsibility For Installation/Construction
1. The applicant shall re-flag all wetland conservation districts, and other restricted
areas specified by the Town Engineer, prior to clearing and grubbing.
2. The applicant shall bear final responsibility for installation, inspection,
maintenance and disposition of all stormwater management and erosion control
measures required by the provisions of this Regulation.
3. The Planning Board may require a bond or other security in an amount determined
by the Board, providing for the actual construction and installation of such
measures in accordance with the approved plan.
H. Plan Review and Approval
1. Technical review of any stormwater management and erosion control plan prepared
under this Regulation shall be conducted by the Hillsborough County Conservation
District, the Town Engineer, or other qualified professional consultant, as
determined to be appropriate by the Planning Board, at the expense of the applicant.
2. The Planning Board shall indicate approval of the stormwater management and
erosion control plan, as filed, if it complies with the requirements and objectives of
this Regulation. Such approval shall be a condition of subdivision plan approval.
If disapproved, a list of plan deficiencies and the procedure for filing a revised plan
will be given to the applicant.
I. Maintenance and Inspection
1. Unless otherwise noted in the Notice of Decision, all projects will require
inspections by the Town or Town’s Representative, paid for by the applicant, for
erosion control, drainage and general site plan conformance.
2. The Planning Board may require routine inspections to verify on-going
maintenance of water quality protection measures. A consultant hired by the
Planning Board and paid for by the applicant, at reasonable times to the landowner
shall perform such inspections.
3. A Drainage Maintenance Agreement (DMA) shall be required for any project with
proposed drainage or Stormwater BMPs. The applicant shall utilize the Town’s
Standard language and the document shall be recorded before a pre-construction
meeting is scheduled.
4. On private sites the owner or homeowner’s association is responsible for all
maintenance in perpetuity. The DMA gives the Town the right to enter private
property and to perform emergency maintenance if there is a threat to public assets.
The DMA does not obligate the Town to do any maintenance on private property.
The owner will be responsible for the cost of any action taken by the Town.

Over the past several months, efforts have been underway to address and remove the
occupants of a homeless encampment located adjacent to Sarette Field, within the
water catchment area situated to the left of the field in the wood line. This area has
been the site of multiple encampments over recent years, each resulting in the
accumulation of significant refuse.
Debris originating from these encampments has migrated downstream into the culvert
system responsible for conveying water from the vicinity of the old landfill to the river.
The Department of Public Works has previously been required to clear trash from one
of these culverts to prevent obstructions that could compromise the integrity of the
landfill cap.
A site inspection conducted this week identified a substantial abandoned encampment
containing large quantities of trash, clothing, and other materials. Prompt removal of
this debris is warranted, as it presents a continued risk of entering the culvert system
and contributing to future blockages. Photographs documenting the current conditions,
along with historical images illustrating the progression of the issue over time, have
been included for reference.

Purpose
The intent of the policy as written below is to outline the expectations and requirements for the
collection and turnover of revenues collected both at centralized locations (Goffstown Town Hall)
and satellite offices where revenues are remitted periodically to the centralized location for
processing and deposit.
Applicability
This policy applies to all departments of the Town of Goffstown.

Definitions
“Revenue” is any amounts collected by employees of the Town for services rendered or programs
sponsored by the Town.
“Turnover” is the remittance of revenues from departments within the centralized location or from
satellite collection offices to the Finance department located at the centralized location for the purpose of
processing and depositing money(s) received.
“Cash Receipt” is any one transaction where cash or negotiable instruments are exchanged for goods or
services.
“Cash” is, for the purpose of this policy, any collection in the form of cash or legal coin tender, cashequivalent or negotiable instrument.
“Negotiable Instrument” is a form of payment that is not cash tender but it otherwise liquid, legal
tender. Common examples are personal checks, bank cashier’s/certified check, or money order.
“Money(s)” is any discrete sums of currency. (s) signifies the plural instance of any one discrete sum of
currency.

“CTF” is the internal abbreviation for Cash Transfer Form, the form used to document money(s) being
remitted from one department to the Finance Department at the centralized location.
“RSA” is the official abbreviation for Revised Statutes Annotated, the codified law established in the
State of New Hampshire. This abbreviation is generally followed with a string of numbers which identify
where in the codification the specific context is categorized and located (i.e. RSA 31:4 Appropriations,
where 31 represents the “Powers and Duties of Towns”)
“Centralized Location” is the location or site where most revenues are received and processed for
deposit.
“Satellite Location” is any location where revenue is collected outside of the centralized location.
“The Town” refers to the Town of Goffstown, representative of all departments and departmental
employees and officers.
“Secured Location” refers to any location where, in lieu of a formal safe, sensitive documents or monies
held for deposit can be maintained under lock and key, and where access is limited only to necessary
personnel for that function.

Administrative Policy and Procedures
Departments of the Town shall designate appropriate staff to handle the collection of revenues.
Some form of receipts shall be issued for all collection transactions. A copy, carbon copy, or
tear-off sheet shall be maintained by the Department to substantiate the collection of funds by the
Town. While the form of the receipt may not be standardized as to fit the needs of each across all
individual departments, the content of the receipt issued shall contain, at a minimum:

the form of payment received and accepted,
the source of the money(s) received, and
the purpose of money(s) received.

A ledger of all transactions, by date, shall be maintained at the department level, subject to
destruction in accordance with internal policy over record retention and superseded by both State
and Federal laws. Refer to the Grants Management Policy for the treatment of documentation
associated with State and Federal grant funds.
Upon request, any department shall furnish deposit records and ledgers maintained to the
supervisors and/or officers of the department or the Finance Department for the purpose of
internal review or external audit. All records held within the record retention period are subject
to internal review and/or external audit.
Prior to, or at the end of, public access hours each day, departments shall perform close-out
procedures of their cash drawers/registers. In the instance of multiple staff attending separate
cash drawers/registers, each staff member will be responsible for close-out procedures of their
own drawer, subject to review by another staff or supervisor. Any form of cash reserve held for
the purpose of making change to customers in the normal course of business shall be considered

a cash drawer/register. At a minimum, the following procedures shall be considered prudent cash
management:
1. counting of money(s) held in the cash drawer/register,
2. summing of money(s) collected from the ledger and receipts,
3. comparison, and if necessary, reconciliation of net drawer collections to money(s)
recorded in the ledger and receipts issued,
4. completion of a form substantiating the cash-out results,
5. compilation of daily ledger, receipts issued and associated money(s) for review and
remittance to the centralized location.
It is both an expectation and a requirement through this policy that the daily close-out
documentation is performed by the responsible staff and reviewed by a second party. The
position and/or hierarchy of review procedures shall be the purview of the departmental staff.
Appropriate documentation of acknowledgement and review shall be in the form of recognizable
and distinguishable initials or personal signature or stamp. A stamp shall only be considered
appropriate documentation of acknowledgement or review if it is both distinguishable and held
with appropriately restricted access.
At least weekly, departments shall remit daily revenues collected to the Finance Department
located at the centralized location. At no time shall any department hold more than $1,000 in
cash at any one location. All funds shall be secured in an approved safe or otherwise secured
location with limited access until turnover to the Finance Department. If the Finance Office is
closed, remittance to Finance shall occur on the next business day for processing. Approval of
safes or otherwise secured locations with limited access shall be the authority of the Treasurer or
their designee.
All funds collected, regardless of cash, check, or digital payment, unlesspayment, unless
otherwise instructed or agreed upon in consideration of funds treatment, shall be included on the
standardized Cash Transfer Forms (CTF) included with the remittance. Remittance of daily
revenues may be subject to more advanced deposit timelines depending on the amounts received,
in accordance with the applicable New Hampshire RSA:
1. NH RSA 41:29, VII – “The Treasurer shall ensure that all money(s) remitted shall be
deposited at least on a weekly basis, or daily whenever funds remitted from all
departments collectively totals $1,500 or more.”NH RSA 41:9, VIII. – “The selectman
shall be responsible for establishing procedures to ensure that all funds paid to the town
from any department shall be remitted to the treasurer at least on a weekly basis or daily
whenever such funds total $3,500 or more. Remittances to the treasurer from the tax
collector shall be in accordance with RSA 41:35 and remittances from the town clerk
shall be in accordance with RSA 261:165.”
1.2.NH RSA 41:29, VII – “The Treasurer shall ensure that all money(s) remitted shall be
deposited at least on a weekly basis, or daily whenever funds remitted from all
departments collectively totals $3,500 or more.”

3. NH RSA 41:9, VIII. – “The selectman shall be responsible for establishing procedures to
ensure that all funds paid to the town from any department shall be remitted to the
treasurer at least on a weekly basis or daily whenever such funds total $500 or more.
Remittances to the treasurer from the tax collector shall be in accordance with RSA
41:35 and remittances from the town clerk shall be in accordance with RSA 261:165.”
4. NH RSA 261:165 applies the laws as stated in RSA 41:29, VII.
CTFs are forms created by, and under the purview of, the Finance Department for the explicit
purpose of properly classifying and codifying departmental revenues. Unless otherwise
authorized, amendment or modification of these forms is prohibited to ensure the continued
effective financial operations of the centralized location.
Upon receipt of departmental funds in the Finance Department, those positions as designated by
the treasurer through the most recent Designation of Deposit Authority shall make ready the
funds for deposit and remit deposits to the bank at least weekly, or more regularly as applicable
RSA demand.
Deposit batches (i.e. one deposit containing any number of individual departments’ CTFs) shall
be compiled with all associated deposit support and maintained in physical or digital form, filed
by batch number, in accordance with the Town’s record retention policy, superseded by
applicable State and Federal law. Staff of the Finance Department shall furnish any and all
deposit documentation as requested by supervisors of the department or officers of the
centralized location for the purpose of internal review and/or external audit.
Deposit batches, as entered and released for posting in the Town’s financial software, shall be
reviewed and posted no less than weekly for the purpose of timely and accurate financial
reporting. At a minimum, a digital record of deposit batches posted shall be maintained, by batch
number, in a shared location reasonably accessible to those responsible for review and/or
reconciliation in the Finance and Administration departments.
No one person or position shall be responsible for any three or more, in sequence, of the
following duties:

For the purpose of maintaining proper internal controls and segregation of duties, no one person
or position shall perform all duties in relation to the collection, recognition, and reconciliation of
any one transaction where money(s) is(are) received.
Revenues received and deposited associated with general operations and recognized in the
general fund shall be reported to the Board and departments no less than monthly, generally in
the form of a comparison of the annual budget to year-to-date revenues in their respective
departments and lines. Distribution shall be considered successful upon upload to the Town’s

website in a reasonably accessible location no less than 15 days following the close of the
applicable month.

POLICY REVIEW AND AMENDMENTS
This policy shall be reviewed and re-affirmed on a regular basis, no less often than every five (5)
years, to ensure the accuracy and applicability of procedures, expectations and requirements as
they pertain to the collection of revenue and the turnover of revenues to the centralized location
for deposit, recognition and reporting.
EFFECTIVE DATE
This policy shall be effective upon a vote of the Select Board and shall replace any and all
revenue collection and cash turnover policies previously enacted by the Town.

specified below.
The full duration of the season starts on November 1, 2026 and continues through
April 30, 2027.

SNOW PLOWING & WINTER MAINTENANCE

1. SNOW CLEARING – PARKING LOTS AND WALKWAYS
The contractor shall provide all snow plow operators and equipment (of sufficient size)
to properly clear snow and mitigate ice from parking lots, throughways and parking
spaces for the properties listed above. In addition to clearing snow from the parking
lots, the Contractor shall provide all laborer(s), snow shovels, ice melt spreader(s)
and/or snow blower to clear snow and mitigate ice from all egress walkways, doorways,
steps, handicap ramps, fire doors and paths to allow safe egress access for facilities
listed above.
Contractor shall furnish all materials and labor to stake edges of parking lots and
walkways where needed throughout the season.
Due to times of occupation of buildings some parking spots may need to be plowed at a
later juncture in the storm. Treatments of parking lot and egress walkway areas to be
done as required during storms and following storms (ie: ice storms, freezing of
surfaces during or following storms) unless otherwise requested by Public Works
Superintendent, Facilities Manager or Designee. Parking lot and walkways shall be
maintained and treated proactively where water collects and refreezes over night to
maintain safe passage for public and staff.
Treatment of walkways and handicap ramps will be done following the shoveling and
prior to opening times listed below in coordination with the intensity and length of

storm (ie: ice storms, freezing of surfaces during or following storms). In the event that
multiple inches of accumulation occurs in a storm, treatment may be held off on to save
on materials unless otherwise requested.
The plowing of the lots and shoveling of egress paths, doorways and walkways will
begin at 2" and continue throughout the progression of the storm as close to 2"
increments as best as possible (especially during building occupied hours). Snow
storms ending with a lesser amount will be cleaned at storms end. When the
snowstorms end any parking lot areas and walks shall be looked over and cleaned up as
needed. In the event of a snowstorm which accumulates at large rates per hour,
properties shall be cared as best as possible. During ice/freezing rain conditions,
parking lots and all egress walkways shall be treated prior to opening building times.
All parking lots and egress walks are to be opened up in coordination with the
following schedule:





Goffstown Town Hall, 16 Main Street – By 6:30 am Monday through Friday.
Saturday, Sundays, and Town Holidays by 10:00 am.
Goffstown Public Library, 2 High Street – By 7:30 am Monday through Saturday.

Sand/salt mix and walkway ice melt shall be provided by the Town of Goffstown and

Superintendent or Storm Supervisor designee prior to snow/ice event. The contractor
shall provide the Town with an accurate amount of sand/salt mix and bags of ice melt
used per storm. Sand/salt mix and ice melt shall be used in appropriate amounts and
not used in excess. All excess materials shall be returned to the Town. Contractor
will be allowed to keep ice melt, salt/sand mix on truck overnight for early morning
retreatment of walkways and parking lots post storm for any retreatment needed due
to overnight melt and refreeze.

IV.

GENERAL REQUIREMENTS

1. FAMILIARITY WITH THE WORK
Each bidder is considered to have examined the work to fully acquaint himself with the
exact existing conditions relating to the work and has fully informed himself as to the
work involved and the difficulties and restrictions attending the performance of this
bid. Failure to do so will not relieve a bidder of his obligation to furnish all aspects of
the work as specified herein for the consideration set forth in this bid. The submission
of a bid will be considered as conclusive evidence that the bidder has made such
examination.
2. CARE AND PROTECTION OF PROPERTY
The Contractor shall take particular care to avoid damages to all private and public
property. He shall make good any damages to the satisfaction of the Town. There shall
be no additional compensation for the repair or restoration of private or public property
improvements.
3. COMPLIANCE WITH FEDERAL, STATE AND LOCAL CODES
The Contractor shall be responsible for full compliance with any Federal, State and/or
Local codes, laws, regulations and standards, as applicable.
4. INSURANCE
The Contractor shall be responsible for maintaining insurance coverage in force for the
life of the contract. The Contractor at his own cost and expense shall procure and
maintain all insurance required. Minimum insurance requirements are Workers
Compensation, Commercial General Liability and Business Automobile Insurance.
Contractor shall provide Owner with certificates of insurance that lists the Town of
Goffstown as an additional insured for coverages below and all endorsements affecting
coverage required by the Contract within ten (10) calendar days after the Owner issues
the Notice of Award. These shall include general liability, vehicle, pollution, liability,
workers comprehensive liability and property damage.
The Contractor shall purchase and maintain such insurance as will protect him from
claims set forth below which may arise out of or result from the Contractor's operations
under the Contract, whether such operations be by himself or by any sub-contractor or
by anyone directly or indirectly employed by any of them or by anyone for whose acts
any of them may be liable.
a. Claims under Workmen's Compensation disability benefit and other similar
employee benefit acts;
b. Claims for damages because of bodily injury, occupational sickness or disease, or
death of his employees, and claims insured by usual personal injury liability
coverage;
c. Claims for damage because of bodily injury, sickness or disease, or death of any
person other than his employees, and claims insured by usual personal injury
liability coverage; and

d. Claims for damage because of injury to or destruction of tangible property,
including loss of use resulting there from.
The insurance required by the above sub-paragraph shall be written for not less than the
following minimum limits of liability:

The insurer shall provide the Town of Goffstown with Certificates of Insurance
signed by an authorized representative of the insurance company. Such certificates
shall name the Town of Goffstown as an additional insured. The policies shall give
the Town of Goffstown written notice at least thirty (30) days in advance of any
termination, expiration, or any and all change in coverage.
5. REQUEST FOR PAYMENT
Request for payment shall be invoiced to the Town on a monthly basis at the end of
each of the months December 2026, through March 2027 in equal monthly
installments. Each property address shall be invoiced as an individual line item.
Request for payments for additional snow/ice storms in the months of November 2026
and April 2027 shall be invoiced on a per storm basis on actual hours worked. Each
property address shall be invoiced as an individual line item.
6. SITE INSPECTION
Each potential bidder shall inspect each site listed to determine for themselves the
nature of the work required. Failure of any contractor to inspect any or all sites shall
not exempt the contractor from fulfilling all the terms of this contract should they be
awarded the bid.

8. QUALITY ASSURANCE
The Owner reserves the right to inspect and require samples of material being applied.
Samples may be tested by the Owner for quality assurance. Should at any time a tested
sample result indicate that the products applied fail to meet the required specification
the Owner shall withhold payment for those services affected until such time that the
contractor has remedied the condition to the satisfaction of the Owner, at no additional
charge to the Owner.
9. SAFETY DATA SHEET (Right to know)
Any vendor who receives an order or orders resulting from this invitation agrees to
submit a Material Safety Data Sheet (MSDS) for each toxic or hazardous substance or
mixture containing such substance pursuant to RSA 277-A when deliveries are made.
The vendor agrees to deliver all containers properly labeled pursuant to RSA 277-A.
Failure to submit an MSDS and/or label on each container will place the vendor in
noncompliance with the purchase order. Failure to submit MSDS and/or labels on each
container may result in civil or criminal penalties, including bid debarment and action
to prevent vendor from the selling said substances, or mixtures containing said
substances within the state. All vendors furnishing substances or mixtures subject to
RSA 277-A are cautioned to obtain and read the law referenced above.
10. PATENT PROTECTION
The seller agrees to indemnify and defend the Town of Goffstown from all claims and
losses resulting from the alleged and actual patent infringements and further agrees to
hold the Town of Goffstown harmless from any liability arising under RSA 382-A, 2313 .
11. THE BIDS
When identical low Bids are received, with respect to price, delivery and quality, the
award may be made that is deemed to be in the best interest of the Town. When a tie
Bid exists between a local and out-of-town bidder, preference will be given to the local
bidder. Any bidder having a local agent who is a bona fide resident of the Town is
considered a local bidder.
12. AWARD OF CONTRACT
The Contract may be awarded to the lowest responsible bidder (net total amount) as
soon as approved and awarded by Town Council after Bid opening. The Town of
Goffstown reserves the right to waive any formality in Bids submitted and the right to
reject any or all Bids at its discretion and to accept the Bid, which will be in the best
interest of the Town. In case of error in the extension of prices, the unit prices Bid shall
govern and the unit prices in writing shall take precedence over the unit prices in
figures. Also, in the event of a discrepancy between the total of the items and the lump
sum total stated, the total of the items shall govern.
13. REFERENCES
Bidders are required to submit a list of references along with a list of equipment that is
planned to be used for this contract. References shall be included with the submitted
bid. The Town is seeking bids from firms that have experience in snow plowing and

winter maintenance for municipal facilities similar in size and scope to the work
outlined in this bid. The Town reserves the right to reject any bid that does not have
sufficient experience/equipment as the Town deems appropriate.
14. RENEWAL OF CONTRACT
At the Town's sole discretion, the contract may be annually renewed for up to three (3)
additional years, provided that there is no substantial change to scope of service and/or
in the contract price as mutually agreed upon between the Town and the Contractor.
15. TERMINATION OF CONTRACT:
If the Contractor refuses or fails to prosecute the work with such diligence as will
insure its completion within the time specified in these Contract Documents, plus any
extension thereof as provided in these Contract Documents, the Owner, by written
notice to the Contractor, may terminate the Contractor's right to proceed with the work.
Upon such termination, the Owner may take over the work and prosecute the same to
completion, by contract or otherwise, and the Contractor shall be liable to the Owner
for any additional cost incurred by the Owner in its completion of the work as well as
any legal fees incurred by the Owner related to this contract.
16. APPROPRIATE CLAUSE
This Contract is subject to the annual appropriation of sufficient funds at the Budgetary Town
Meeting to cover the said annual payment(s) when due. Should the annual appropriation by
vote at Budgetary Town Meeting not be approved, this Contract shall become null and void,
and the vehicles and/or equipment, etc. purchased shall be returned to the financing institution
and furthermore, the Town shall have no further obligation in the Contract. The Contract will
be underwritten for a specified period of time.

On Thursday, 08/07/26 the Town’s Capital Improvement Program (CIP) Committee voted to bring
forward the attached 2027-2032 CIP Matrix to the Planning Board on 09/10/26.

BACKGROUND:

The CIP Committee met with Town Departments and the School District throughout the
summer (June – August).

The CIP Committee will present the CIP Matrix to the Planning Board Thursday, 09/10/26,
at 7:00 p.m.

The Town’s CIP Matrix for 2027 has a significant increase over CIP items approved at
Town Meeting in 2026.
o 2026 Voters approved use of Unassigned Fund Balance for three CIP items.

$350,000 deposit into Fire Apparatus CRF

$50,000 deposit into Goffstown Public Library CRF

$450,000 towards Road Plan

o 2027 Town CIP requires additional $2.5M of funding above 2026 approved budget.

Procedures of the Goffstown Select Board
and
Committees appointed by the Select Board
2.8 Public Participation in the Board Meetings
2.8.1 Each person desiring to speak during public comment shall state his name,
street and if not a Goffstown resident, his/her town and shall fill out the roster
provided by the Town Administrator.
2.8.2 The Presiding Officer shall schedule appropriate public comment time for
Goffstown residents at the beginning and end of each regular meeting. The
Presiding Officer, at his/her discretion, may allow other speakers for a germane
topic. Public comment speakers are limited to three minutes each.
2.8.3 Agenda appointments with the Board may be made for a regular meeting
through the Town Administrator, for Town-related business. The Presiding
Officer has the discretion to schedule a different date and time.
2.8.4 Unless a concern expressed at the public comment period or an agenda
appointment is an urgent matter, the Board may take up the concern at the next
regular meeting under Old Business.
2.8.5 Special Board meetings shall not have public comment nor agenda
appointments unless the appointment is the purpose of the special meeting.
