RESOLUTION OF THE TOWNSHIP OF STAFFORD, COUNTY
OF OCEAN, STATE OF NEW JERSEY CERTIFYING ALL
MEMBERS OF THE GOVERNING BODY HAVE REVIEWED, AS
A MINIMUM, THE SECTIONS OF THE ANNUAL AUDIT
ENTITLED “COMMENTS AND RECOMMENDATIONS”
WHEREAS, N.J.S.A. 40A: 5-4 requires the governing body of every local unit to have made an annual
audit of its books, accounts and financial transactions, and
WHEREAS, the Annual Report of Audit for the year 2025 has been filed by a Registered Municipal
Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A: 5-6, and a copy has been received by
each member of the governing body; and
WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to
prescribe reports pertaining to the local fiscal affairs; and
WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the
governing body of each municipality shall, by resolution, certify to the Local Finance Board of the
State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections
of the annual audit entitled “Comments and Recommendations”; and
WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual
Report of Audit, and specifically the sections of the Annual Audit entitled “Comments and
Recommendations, as evidenced by the group affidavit form of the governing body attached hereto; and
WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than fortyfive days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and
WHEREAS, all members of the governing body have received and have familiarized themselves with, at
least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated
aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and
WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New
Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52,
to wit:
R.S. 52:27BB-52: A local officer or member of a local governing body who, after
a date fixed for compliance, fails or refuses to obey an order of the director
(Director of Local Government Services), under the provisions of this Article,
shall be guilty of a misdemeanor and, upon conviction, may be fined not more
than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or
both, in addition shall forfeit his office.
NOW, THEREFORE BE IT RESOLVED, That the Committee of the Stafford Township,
hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy

ORDINANCE NO. 2026 – 22
AN ORDINANCE OF THE TOWNSHIP OF STAFFORD, COUNTY OF
OCEAN, STATE OF NEW JERSEY, SUPPLEMENTING SECTION 2114.1 OF THE TOWNSHIP CODE, ENTITLED “ADDITIONAL
PROHIBITED USES”
NOW, THEREFORE, BE IT ORDAINED, by the governing body of the
Township of Stafford, County of Ocean, State of New Jersey, as follows:
SECTION 1.

The Township Code of the Township of Stafford is hereby

amended and supplemented, so as to amend Chapter 211, entitled “Zoning,” so as to amend
Section 211-4.1 “Additional prohibited uses,” which shall now read as follows:
§ 211-4.1. Additional prohibited uses.
A. Definitions. As used in this section, the following terms shall have the meanings
indicated:
CANNABIS
All parts of the plant Cannabis sativa L., whether growing or not, the seeds thereof, and
every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its
seeds, except those containing resin extracted from the plant, which are cultivated and,
when applicable, manufactured in accordance with P.L. 2016, c. 16, for use in cannabis
products as set forth in this act, but shall not include the weight of any other ingredient
combined with cannabis to prepare topical or oral administrations, food, drink, or other
product. "Cannabis" does not include: medical cannabis dispensed to registered qualifying
patients pursuant to the Jake Honig Compassionate Use Medical Cannabis Act, P. L. 2009,
c. 307 (N.J.S.A. 24:6I-1 et seq.), and P.L. 2015, c. 158 (N.J.S.A. 18A:40-12.22 et seq.);
"marijuana," as defined in N.J.S.A. 2C:35-2, and applied to any offense set forth in
Chapters 35, 35A, and 36 of Title 2C of the New Jersey Statutes, or P.L. 2001, c. 114
(N.J.S.A. 2C:35B-1 et seq.), or "marihuana," as defined in Section 2 of P.L. 1970, c. 226
(N.J.S.A. 24:21-2), and applied to any offense set forth in the New Jersey Controlled
Dangerous Substances Act, P.L. 1970, c. 226 (N.J.S.A. 24:21-1 et seq.); or hemp or a hemp
product cultivated, handled, processed, transported, or sold pursuant to the New Jersey
Hemp Farming Act, P.L. 2019, c. 238 (N.J.S.A. 4:28-6 et seq.).
CANNABIS CULTIVATOR
Any licensed person or entity that grows, cultivates, or produces cannabis in this state, and
sells, and may transport, this cannabis to other cannabis cultivators, or usable cannabis to
cannabis manufacturers, cannabis wholesalers, or cannabis retailers, but not to consumers.
CANNABIS DELIVERY SERVICE
Any licensed person or entity that provides courier services for consumer purchases of

cannabis items and related supplies fulfilled by a cannabis retailer in order to make
deliveries of the cannabis items and related supplies to that consumer, and which services
include the ability of a consumer to purchase the cannabis items directly through the
cannabis delivery service, which after presenting the purchase order to the cannabis retailer
for fulfillment, is delivered to that consumer.
CANNABIS DISTRIBUTOR
Any licensed person or entity that transports cannabis in bulk intrastate from one licensed
cannabis cultivator to another licensed cannabis cultivator, or transports cannabis items in
bulk intrastate from any one class of licensed cannabis establishment to another class of
licensed cannabis establishment, and may engage in the temporary storage of cannabis or
cannabis items as necessary to carry out transportation activities.
CANNABIS MANUFACTURER
Any licensed person or entity that processes cannabis items in this state by purchasing or
otherwise obtaining usable cannabis, manufacturing, preparing, and packaging cannabis
items, and selling, and optionally transporting, these items to other cannabis manufacturers,
cannabis wholesalers, or cannabis retailers, but not to consumers.
CANNABIS RETAILER
Any licensed person or entity that purchases or otherwise obtains usable cannabis from
cannabis cultivators and cannabis items from cannabis manufacturers or cannabis
wholesalers, and sells these to consumers from a retail store, and may use a cannabis
delivery service or a certified cannabis handler for the off-premises delivery of cannabis
items and related supplies to consumers. A cannabis retailer shall also accept consumer
purchases to be fulfilled from its retail store that are presented by a cannabis delivery
service which will be delivered by the cannabis delivery service to that consumer.
CANNABIS WHOLESALER
Any licensed person or entity that purchases or otherwise obtains, stores, sells or otherwise
transfers, and may transport, cannabis items for the purpose of resale or other transfer to
either another cannabis wholesaler or to a cannabis retailer, but not to consumers.
DATA CENTER
A Facility or Facilities:

components such as servers, network equipment and appliances, telecommunications, and data
storage systems, systems for monitoring and managing infrastructure performance, Internetrelated equipment and services, data communications connections, environmental controls, fire
protection systems, and security systems and services; and

3.
Is a commercial customer for retail electric service that requests service of 2 100
megawatts 2 or more of peak load, served at a single meter location or a single contiguous
facility, if served by more than one meter location
B. Prohibitions:
1.
Prohibition of cannabis uses. All cannabis cultivators, cannabis delivery
services, cannabis distributors, cannabis manufacturers, cannabis retailers, and cannabis
wholesalers are hereby prohibited from operating anywhere in the Township of Stafford,
except for the delivery of cannabis items and related supplies by a licensed cannabis
delivery service based and initiated from a cannabis delivery service licensed location
outside of the Township of Stafford.
2.
Prohibition of data centers. All data centers are hereby prohibited from
operating anywhere in the Township of Stafford.
SECTION 2. After introduction of this ordinance, the Township Clerk shall send
a copy of this ordinance to the Township Planning Board for its review and comment. The
Township Clerk shall also send a copy of the ordinance to the Ocean County Planning Board
pursuant to N.J.S.A. 40:55D-16.
SECTION 3. All ordinances or parts of ordinances inconsistent herewith are
hereby repealed.
SECTION 4.

If any section, subsection, sentence, clause, phrase or portion of

this ordinance is for any reason held to be invalid or unconstitutional by a court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and
such holding shall not affect the validity of the remaining portions hereof.
SECTION 5.

This ordinance shall take effect after second reading and

publication as required by law.

NOTICE IS HEREBY GIVEN that the foregoing ordinance was introduced and passed
by the Township Council on first reading at a meeting of the Township Council of the Township
of Stafford held on the 21st day of July, 2026, and will be considered for second reading and final
passage at a regular meeting of the Township Council to be held on the 18th day of August, 2026
at 7:00 p.m., at the Municipal Courtroom, located at 260 East Bay Avenue, Manahawkin, New
Jersey, at which time and place any persons desiring to be heard upon the same will be given the

PLANNING
SERVICES
FROM
THE
DEPARTMENT OF COMMUNITY AFFAIRS, DIVISION OF
LOCAL PLANNING SERVICES
WHEREAS, the Township of Stafford is in need of professional planning services to
prepare a Master Plan update for the Township of Stafford (“the project”); and
WHEREAS, the New Jersey Department of Community Affairs, Division of Local
Planning Services (“LPS”) provides a variety of planning services at no direct cost to eligible
municipalities; and
WHEREAS, the Township of Stafford is an eligible municipality and an application for
services was submitted by the Township Administrator to Local Planning Services on October
3rd, 2025; and
WHEREAS, Township of Stafford has received the Scope of Services for the project
prepared by Local Planning Services (attached); and
WHEREAS, Township of Stafford desires to accept the aforementioned Scope of
Services; and
WHEREAS, there is no budgetary impact on Township of Stafford for the services being
provided by LPS; and
WHEREAS, the Township of Stafford does not have in-house planning capabilities to
perform the services being provided by LPS nor is the Township of Stafford under contract with
a professional planner to complete the project; and
WHEREAS, the Township of Stafford deems the interests of the Township will be best
served by accepting the services being provided by LPS; and
WHEREAS, as a condition of receiving LPS’s services, the Township of Stafford is
required to form a Working Committee to guide and provide information to LPS; and
WHEREAS, the Township of Stafford is committed to the completion of this project and
will assist LPS as needed.
NOW THEREFORE BE IT RESOLVED that the Township of Stafford hereby
appoints the Township Administrator as the municipal contact and authorizes him to perform all
acts necessary to accomplish the intent of this resolution; and
BE IT FURTHER RESOLVED by the Township of Stafford as follows:

1. The Township of Stafford will retain professional planning services provided by LPS and
approves the attached Scope of Services for the project.

2. The Township of Stafford has or will form a Working Committee to assist LPS, and
authorizes the Mayor or municipal designee to appoint the members of the Working
Committee and/or any replacement members necessary to retain functionality of the
Committee in the event of vacancies; and
3. The Township of Stafford will provide access to appropriate municipal staff, consultants
and officials; meeting space, municipal land use records, and other non-monetary
resources that may be necessary to complete the project.

AUTHORIZING AN AMENDMENT TO THE 2026 BUDGET
TO ALLOW FOR THE INSERTION OF A SPECIAL ITEM
OF REVENUE AND APPROPRIATION PURSUANT TO
N.J.S.A. 40A:4-87
WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local
Government Services may approve the insertion of any special item of revenue in the budget of
any local unit when such item shall have been made available by any public or private funding
source and the amount thereof shall not have been determined at the time of the adoption of the
budget; and
WHEREAS, N.J.S.A. 40A:4-87 further provides that the Director may approve the
insertion of an appropriation item of an amount equal to any such special item of revenue
making such item of revenue available for expenditure; and
WHEREAS, the Township of Stafford has received a Grant in the amount of $6,790.00
from the State of New Jersey, Division of Highway Safety, Click It or Ticket 2026 Seat Belt
Mobilization Grant; and
WHEREAS, the Mayor and Township Council of the Township of Stafford desire to
amend the 2026 Budget to include this amount as revenue and appropriation:
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Council of the
Township of Stafford, County of Ocean, State of New Jersey, as follows:

That the Mayor and Township Council do hereby authorize an amendment to the
2026 Budget to provide for the insertion of a special item of revenue in the amount of
$6,790.00 by the Director of the Division of Local Government Services, which is now
available as a revenue from:

the SOURCEWELL contract #Horton 122123-RVG-2: (1) New/Unused 2027 Ford F-550 4x4,
Horton 603F Type I Ambulance with Patient Handling Equipment, VCI Emergency Vehicle
Specialists, Inc., quote dated May 20, 2026; and
WHEREAS, the Chief of the Stafford Township Volunteer EMS Squad and the Stafford
Township Purchasing Agent have exercised due diligence and thoroughly reviewed the
authorized quote submitted by SOURCEWELL Contract Vendor’s authorized dealer; and
WHEREAS, the mandatory paperwork submitted by VCI Emergency Vehicle
Specialists, Inc., (authorized dealer for REV Ambulance Group Orlando, Inc., d/b/a Horton
Emergency Vehicles) is in compliance with the Local Public Contracts Law and Rules (N.J.S.A.

the attached agreement with authorized dealer VCI Emergency Vehicle Specialists,
Inc., (authorized dealer for REV Ambulance Group Orlando, Inc., d/b/a Horton
Emergency Vehicles).

This Resolution is adopted inasmuch as it is in accordance with the Township’s
budgetary constraints.

5.

VCI Emergency Vehicle Specialists, Inc., (authorized dealer for REV Ambulance
Group Orlando, Inc., d/b/a Horton Emergency Vehicles) shall maintain all
documentation related to products, transactions or services under this contract for a
period of five years from the date of final payment. Such records shall be made
available to the New Jersey Office of the State Comptroller upon request.

6.

The purchase shall be undertaken after completion of the requirements set forth in
Local Finance Notice 2012-10, promulgated by the New Jersey Department of
Community Affairs, Division of Local Government Finance.

7.

That this resolution shall take effect immediately.

Township Council of the Township of Stafford, County of Ocean, State of New Jersey, as follows:
1. That the governing body does hereby authorize the Purchasing Agent to purchase certain goods or
services from those approved New Jersey State Contract Vendors on the attached list, pursuant to
all conditions of the individual State contracts; and
2. That the governing body pursuant to N.J.A.C. 5:30-5.5(b), the certification of available funds, shall
either certify the full maximum amount against the budget at the time the contract is awarded, or no
contract amount shall be chargeable or certified until such time as the goods or services are ordered
or otherwise called for prior to placing the order, and a certification of availability of funds is made
by the Chief Finance Officer; and

WHEREAS, the Township of Stafford, pursuant to N.J.S.A. 40A:11-11(5) and N.J.A.C. 5:34-7.1 et seq.,
may by resolution and without advertising for bids, purchase any goods or services under the NJ Cooperative
Purchasing Alliance (Bergen County Cooperative Purchasing #CK04) for any co-op contracts entered into on

WHEREAS, the Township of Stafford has the need on a timely basis to purchase goods or services

WHEREAS, on March 9, 2021 (Reso#2021-107) the Township of Stafford Governing Body authorized
the Township of Stafford to become a member of the NJ Cooperative Purchasing Alliance (Bergen County

WHEREAS, the State of New Jersey, Department of Community Affairs, Division of Local Government
Services authorized the addition of the Township of Stafford as a member to the NJ Cooperative Purchasing
Alliance (Bergen County Cooperative Purchasing #CK04), effective March 19, 2021; and
WHEREAS, on January 6, 2026 Resolution No. 2026-52 was adopted by the Stafford Township
Governing Body authorizing contracts with certain NJ Cooperative Purchasing Alliance (Bergen County
Cooperative Purchasing #CK04) contract vendors; and
WHEREAS, on March 3, 2026 Resolution No. 2026-107 was adopted by the Stafford Township
Governing Body authorizing contracts with certain NJ Cooperative Purchasing Alliance (Bergen County
Cooperative Purchasing #CK04) contract vendors; and
WHEREAS, on March 31, 2026 Resolution No. 2026-126 was adopted by the Stafford Township
Governing Body authorizing contracts with certain NJ Cooperative Purchasing Alliance (Bergen County

WHEREAS, on April 28, 2026 Resolution No. 2026-177 was adopted by the Stafford Township
Governing Body authorizing contracts with certain NJ Cooperative Purchasing Alliance (Bergen County
Cooperative Purchasing #CK04) contract vendors; and
WHEREAS, on May 26, 2026 Resolution No. 2026-223 was adopted by the Stafford Township
Governing Body authorizing contracts with certain NJ Cooperative Purchasing Alliance (Bergen County
Cooperative Purchasing #CK04) contract vendors; and

WHEREAS, on June 23, 2026 Resolution No. 2026-254 was adopted by the Stafford Township
Governing Body authorizing contracts with certain NJ Cooperative Purchasing Alliance (Bergen County
Cooperative Purchasing #CK04) contract vendors; and
WHEREAS, the Township of Stafford intends to enter into contracts with the attached referenced NJ
Cooperative Purchasing Alliance (Bergen County Cooperative Purchasing #CK04) contract vendors through this
resolution, which shall be subject to all the conditions applicable to the current awarded NJ Cooperative
Purchasing Alliance (Bergen County Cooperative Purchasing #CK04) contracts.
WHEREAS, it has been determined that additional authorized vendors through the NJ Cooperative
Purchasing Alliance (Bergen County Cooperative Purchasing #CK04) need to be added to the existing referenced
list of approved vendors.
NOW, THEREFORE, BE IT RESOLVED, this 21st day of July, 2026 by the Mayor and Township
Council of the Township of Stafford, County of Ocean, State of New Jersey, as follows:
1.

That the governing body does hereby authorize the Purchasing Agent to purchase certain goods or
services from those approved #CK04 Contract Vendors on the attached list, pursuant to all conditions
of the individual #CK04 contracts; and

2.

That the governing body pursuant to N.J.A.C. 5:30-5.5(b), the certification of available funds, shall
either certify the full maximum amount against the budget at the time the contract is awarded, or no
contract amount shall be chargeable or certified until such time as the goods or services are ordered or
otherwise called for prior to placing the order, and a certification of availability of funds is made by
the Chief Finance Officer; and

3.

That the duration of the contracts between the Township of Stafford and the Referenced #CK04
Contract Vendors shall be from January 1, 2026 to December 31, 2026.

4.

A certified copy of this Resolution shall be forwarded by the Township Clerk to the following:

AWARDING CONTRACT FOR THE FURNISHING AND DELIVERY
OF OFFICE SUPPLIES FOR THE STAFFORD TOWNSHIP
COOPERATIVE PRICING SYSTEM TO W.B. MASON COMPANY,
INC. (RE-BID #2026-005A)
WHEREAS, Stafford Township is the Lead Agency of the Stafford Township
Cooperative Pricing System; and
WHEREAS, the Township of Stafford (hereinafter referred to as “Township”) has
solicited bids in regard to the furnishing and delivery of Office Supplies for the Township of
Stafford Cooperative Pricing System (the “Contract”); and
WHEREAS, the bids have been solicited by the Township in conformance with the
provisions of the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, in response to the request for re-bids, one (1) bid proposal was received in
response to the electronic bid solicitation on July 15, 2026 from W.B. Mason Company, Inc.;
and
WHEREAS, the participating units in the Stafford Township Cooperative Pricing
System who supplied their estimated quantities that each registered member proposes to contract
for during the life of the master contract for the furnishing and delivery of Office Supplies are
Beach Haven Borough, Beachwood Borough, Berkeley Township, Bradley Beach Borough,
Brick Township, Howell Township, Jackson Township Board of Education, Lacey Township,
Little Egg Harbor Township, Long Beach Township, Manchester Township, Pine Beach
Borough, Point Pleasant Borough, Southern Regional Board of Education, Toms River
Municipal Utilities Authority, as well as the Township of Stafford; and

WHEREAS, W.B. Mason Company, Inc., has agreed to extend their prices to the
participating Stafford Township Cooperative Pricing System Members; and
WHEREAS, this Contract award is made in conformance with the Open and Fair
Process; and
WHEREAS, W.B. Mason Company, Inc., did not list any exceptions in their submitted
bid proposal; and
WHEREAS, the bid documentation submitted by W.B. Mason Company, Inc., has been
reviewed by the Township’s Administrative and Professional Staff and found to be acceptable as
to form and content; and
WHEREAS, the bid submitted by W.B. Mason Company, Inc., is in substantial
compliance with the contract documents and in accordance with the bid specifications as written
(see attached Schedule A).
NOW, THEREFORE, BE IT RESOLVED on this 21st day of July, 2026 by the
Township Council of the Township of Stafford, County of Ocean, State of New Jersey as follows:
1.

The Township hereby awards the contract for itself and as the lead agency

for the Stafford Township Cooperative Pricing System for the furnishing and delivery of Office
Supplies to W.B. Mason Company, Inc., having their principal offices located at 59 Centre Street,
Brockton, MA 02301, (BRC Address: 535 Secaucus Road, Secaucus, NJ 07094-2529), for the
price and discount referenced on the attached Schedule A.
2.

The contract for the furnishing and delivery of Office Supplies shall be in

effect for twenty-four (24) months. The term of the contract will be from August 19, 2026
through August 18, 2028.

3.

The 2026 United Stationers Supply Company Online Catalog shall remain

in effect from August 19, 2026 to August 18, 2027, and the 2027 United Stationers Supply
Company Online Catalog shall remain in effect from August 19, 2027 to August 18, 2028.
4.

The Governing Body does hereby award a contract for ITSELF as the lead

agency for the Stafford Township Cooperative Pricing System for the purchase and delivery of
Office Supplies to W.B. Mason Company, Inc. and shall not exceed One Hundred Fifty Thousand
($150,000.00) Dollars for contract year one (1), and One Hundred Fifty Thousand ($150,000.00)
Dollars for contract year two (2); and

The Governing Body does hereby award a contract as the lead agency for

the Stafford Township Cooperative Pricing System and the participating contracting units for the
purchase and delivery of Office Supplies to W.B. Mason Company, Inc. and shall not exceed Six
Hundred Ninety One Thousand Dollars ($691,000.00) for contract year one (1), and Six Hundred
Ninety One Thousand Dollars ($691,000.00) for contract year two (2).

That the Mayor and Municipal Clerk are hereby authorized to execute any

and all necessary documents in order to implement the intent of this Resolution with W.B. Mason
Company, Inc., in accordance with the bid submitted by W.B. Mason Company, Inc., and the bid
specifications.

That the Stafford Township Purchasing Agent is hereby authorized to

issue purchase orders to W.B. Mason Company, Inc., for the furnishing and delivery of Office
Supplies for the Township of Stafford Cooperative Pricing System in accordance with the bid
submitted by W.B. Mason Company, Inc., and the bid specifications.
8.

The contract for the furnishing and delivery of Office Supplies shall be in

effect for twenty-four (24) months. The term of the contract will be from August 19, 2026
through August 18, 2028. The Township reserves the right to include provisions for an extension

to the contract with the vendor’s agreement. If the Township desires to extend a contract under
the provisions of N.J.S.A. 40A:11-15 the index rate is the basis to determine the appropriate
increase in the contract price. The extension may be for one two (2) year extension or two one
(1) year extension as per the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.

No purchases shall be made under this Contract until the Chief Financial

Officer has certified the availability of funds for such purchases.

WHEREAS, the Township Council of the Township of Stafford, County of Ocean, State
of New Jersey (the “Township”) has previously awarded a contract to West End KB, LLC,
(hereinafter referred to as the "Contractor”) for Project #2024-107 for the Renovation of the
Warren Grove Fire Company, Block 1, Lot 12, 1475 Main Street Project for the Township of
Stafford (hereinafter referred to as the “project”); and
WHEREAS, the original contract was awarded on November 12, 2024 in the amount of
$947,000.00 (Resolution #2024-407); and
WHEREAS, on April 28, 2026, the Township Council approved W&S Resolution
#2026-163 authorizing Change Order No. 1 for the Renovation of the Warren Grove Fire
Company, Block 1, Lot 12, 1475 Main Street Project resulting in an overall increase in the
original contract amount from $947,000.00 to an adjusted final total of $968,193.00 (increase of

A RESOLUTION OF THE TOWNSHIP OF STAFFORD, COUNTY OF
OCEAN, STATE OF NEW JERSEY, OPPOSING CERTAIN RECENTLY
ENACTED STATE LAWS AFFECTING LAW ENFORCEMENT
OPERATIONS, FEDERAL-STATE COOPERATION, AND PUBLIC
SAFETY, AND URGING THEIR REPEAL
WHEREAS, the Mayor and Township Council has a fundamental responsibility to protect the
health, safety, and welfare of its residents and to support law enforcement officers in the lawful
execution of their duties; and
WHEREAS, the Governor of New Jersey recently signed three (3) bills impacting federal-state
cooperation in immigration enforcement, creating sanctuary spaces for immigrants in the country
illegally and impacting law enforcement operations; and
WHEREAS, A4071/S3521 restricts certain communications and cooperation between state and
local law enforcement and federal immigration authorities; and
WHEREAS, SCS for S3114 and S3216/A1743 requires law enforcement officers, including ICE
agents, to reveal their facial identity during certain public interactions and to present identification
before arresting or detaining an individual, which this governing body believes may interfere with
law enforcement operations and raise constitutional concerns; and
WHEREAS, A4070/S3522, described as the "Privacy Protection Act," limits the collection and
sharing of certain personal information, which this governing body believes may hinder law
enforcement investigations and interagency coordination; and
WHEREAS, the so-called “Safe Communities Act,” or S-5036, prohibits sensitive locations from
assisting or participating in federal civil law enforcement, and would also prohibit enforcement on
the premises of those locations including hospitals, public schools, shelters, disaster and
emergency response sites, funeral homes, courthouses, and places of worship, thus creating safe
spaces for criminals to hide from law enforcement; and
WHEREAS, this governing body recognizes the importance of constitutional rights, due process,
lawful policing, and public accountability, but also finds that public policy should not jeopardize
officer safety, operational effectiveness, intergovernmental cooperation, the ability of law
enforcement agencies to respond to evolving public safety threats, or negatively impact the safety
of the public at large; and

WHEREAS, this Mayor and Township Council is concerned that restrictions affecting
communication, coordination, identification practices, and information-sharing, as well as policies
that prohibit law enforcement from pursuing criminals at certain locations will create uncertainty
for local law enforcement agencies, complicate interactions with federal authorities, increase risks
to officers operating in volatile and rapidly developing situations and give sanctuary to criminals
among the very communities these laws purport to seek to protect; and
WHEREAS, this Mayor and Township Council further recognizes that immigration law and
enforcement are federal functions under the United States Constitution and believes that legislation
restricting federal-state cooperation in this area is subject to constitutional challenge under the
Supremacy Clause; and
WHEREAS, this Mayor and Township Council is also concerned that enactments designed to
restrict cooperation or disclosure may invite costly litigation, create preemption disputes,
undermine consistent enforcement practices, and expose municipalities and their officers to legal
uncertainty, financial burdens, and operational difficulties, observing that the federal government
has already sued New Jersey twice since March 2026; and
WHEREAS, this Mayor and Township Council is additionally concerned that requiring officers
to reveal facial identity without adequate operational exceptions may increase the risk of
retaliation, harassment, doxxing, targeting of officers and their families, and compromise of
undercover, tactical, or other security-sensitive functions; and
WHEREAS, this Mayor and Township Council also finds that limiting the collection or sharing
of personal information may impede legitimate law enforcement investigations, interagency
coordination, and emergency response efforts, including efforts involving individuals who may
pose threats to public safety; and
WHEREAS, this Mayor and Township Council therefore wishes to formally express its
opposition to the foregoing enactments and to urge the Legislature and the Governor to repeal
them; and
WHEREAS, New Jersey’s sanctuary policies have directly resulted in two (2) avoidable lawsuits
initiated by the federal government challenging unconstitutional policies as well as violent unrest
and disorder outside of Newark’s Delaney Hall, a U.S. Immigration and Customs
Enforcement's (ICE) detention facility, and the injury of an ICE officer in Stafford Township;
NOW, THEREFORE, BE IT RESOLVED this 21st day of July, 2026, by the governing body
of the Township of Stafford, County of Ocean, State New Jersey, as follows:

1.- The Mayor and Township Council of the Township Council hereby formally opposes the
recently enacted laws identified above.
2.- This Mayor and Township Council finds that these laws, individually and collectively, raise
substantial concerns regarding public safety, law enforcement officer safety, effective federal-state
and interagency cooperation, and the ability of local law enforcement to carry out its
responsibilities in a clear, coordinated, and lawful manner.
3.- The Mayor and Township Council further finds, as a matter of policy and legal concern, that
state measures restricting cooperation, identification practices, or information-sharing in this area
may create practical conflicts with legitimate law enforcement objectives, burden municipal
operations, and contribute to costly and divisive disputes concerning the limits of state authority,
federal supremacy in immigration matters, and preemption principles under the United States
Constitution.
4.- The Mayor and Township Council urges the Governor of New Jersey and the New Jersey
Legislature to repeal the laws identified above and to take such prompt executive and legislative
action as may be necessary to eliminate the risks these laws may pose to officer safety, law
enforcement effectiveness, and sound intergovernmental relations.
5.- The Mayor and Township Council further urges that any future legislation in this area respect
the supremacy of the federal government under the United States Constitution in matters of
immigration policy and enforcement, and include clear protections for officer safety and
operations, workable standards for interagency coordination, and provisions that preserve the
ability of law enforcement to respond effectively to threats to the public.
6.- The Mayor and Township Council encourages state, county, and local law enforcement, to the
fullest extent permitted by law, to cooperate with other law enforcement agencies in securing our
community against threats to public safety as well as assist federal authorities in safeguarding
government installations located in the Garden State;
7.- The Municipal Clerk is hereby directed to transmit a certified copy of this Resolution to the
Governor of New Jersey, the President of the New Jersey Senate, the Speaker of the New Jersey
General Assembly, the municipality's representatives in the New Jersey Legislature, the Attorney
General of New Jersey, the New Jersey State League of Municipalities, the New Jersey
Association of Counties, the United States Attorney for the District of New Jersey, and such other
public officials and organizations as may be appropriate.

RESOLUTION OF THE TOWNSHIP OF STAFFORD,

THE NEW JERSEY STATE LEGISLATURE AND
GOVERNOR TO REPEAL THE GAS TAX ESCALATOR AND
RESTORE ACCOUNTABILITY TO FUEL TAX INCREASES

WHEREAS, the residents of the State of New Jersey and the Township of Stafford are
burdened by one of the highest overall tax structures in the United States; and
WHEREAS, in 2016, the State of New Jersey enacted legislation restructuring the
Transportation Trust Fund and implementing an automatic adjustment mechanism commonly
referred to as the “gas tax escalator”; and
WHEREAS, the gas tax escalator permits periodic increases in the motor fuels tax
without a direct vote of the New Jersey State Legislature; and
WHEREAS, such automatic increases lack transparency and reduce accountability to
taxpayers, who bear the financial burden without direct legislative oversight; and
WHEREAS, increases in the motor fuels tax raise the cost of commuting, goods, and
services, placing additional financial strain on working families, seniors, residents, and
businesses; and
WHEREAS, increased fuel costs also impact municipal operations, including
transportation, public works, emergency services, and general service delivery, thereby placing
additional pressure on local budgets and, ultimately, property taxpayers; and
WHEREAS, local governments have a responsibility to advocate for policies that
protect their residents from unnecessary and unaccountable tax increases.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Council of
the Township of Stafford, County of Ocean, State of New Jersey, that the Township hereby urges
the New Jersey State Legislature and the Governor to:

direct vote of the New Jersey State Legislature; and

access the funds, the Township’s HIP Mortgage must be placed subordinate to the HELOC; and

to permit them to complete the HELOC process and access the funds; and
WHEREAS, CGP&H, the Township’s affordable housing consultant, has reviewed the
request and recommends the execution of same.

Construction Management, Inspection and As-Built Services associated with the Sewer Main
Replacement - Beach Haven West Phase 8 (Schedule A); and
WHEREAS, the submitted proposal by RVE is to provide Construction Management,
Inspection and As-Built Professional Engineering Services related to the replacement of sewer
infrastructure at Beach Haven West Phase 8 Sewer Main Replacement will be within Mill Creek
Road, Budd Drive, Maryalice Road, Gregg Drive and Jonathan Drive, along with the replacement
of drainage catch basins, installation of new drainage piping and repaving of the roadway from
edge of pavement to edge of pavement.
WHEREAS, the base scope of work will include removal and reconstruction of sanitary
sewer system including 56 manholes, 6,918 linear feet of sanitary sewer and 198 laterals and the
roadway improvement will include drainage improvements and full width mill and overlay of all
affected roadways; and
WHEREAS, the Township, through its Qualified Purchasing Agent (“QPA”) has
received the mandatory documents including but not limited to a Business Entity Disclosure
Certification, pursuant to the provisions of N.J.S.A. 19:44A-20.1 et seq., from Remington &

RESOLUTION OF THE TOWNSHIP OF STAFFORD, COUNTY OF
OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE PAYMENT
OF TOWNSHIP BILLS IN THE AMOUNT OF $19,698,181.94.

WHEREAS, THE STAFFORD TOWNSHIP COUNCIL HAS EXAMINED THE VOUCHERS PRESENTED
FOR PAYMENT.
NOW, THEREFORE, BE IT RESOLVED, THAT THE APPROVED VOUCHERS AMOUNTING TO
$19,698,181.94. BE AUTHORIZED TO BE PAID UPON VERIFICATION OF THE CHIEF FINANCIAL
OFFICER THAT THERE IS SUFFICIENT MONEY IN THE APPROPRIATE ACCOUNTS, SUBJECT TO THE
ADEQUATE SIGNATURES AND FUNDING. SAID VOUCHERS SHALL BE LISTED IN THE MINUTE
BOOK.
