A RESOLUTION.

Objecting to the Issuance of Liquor Permit
No. 10007766-1, Leela Group LLC DBA
Dayton Downtown BP, 433 S. Main St.,
Dayton, Ohio 45402, and Declaring an
Emergency.

WHEREAS, Section 4303.26 of the Ohio Revised Code (“ORC”) authorizes the
legislative authority of a municipal corporation to object to the issuance, transfer, or
change of location of liquor permits issued under ORC Sections 4303.11 through
4303.184 within its boundaries and request a hearing thereon; and, 4
WHEREAS, The City of Dayton received information about an application by

this business for a C1 liquor permit last December which this Commission objécted to;
and

WHEREAS, While that objection is currently pending and waiting for a hearing,

the City received notice of a new application by this business for a C1 and a C2 liquor
permit; and

WHEREAS, This Commission caused an investigation to be made by
Departments of the City of Dayton and received objections concerning this permit
premises within the City of Dayton; and,

WHEREAS, The Dayton Police Department has expressed opposition to this
permit on the grounds of substantial interference with public decency and sobriety, and
other reasons provided for in ORC Section 4303.292; and,

WHEREAS, For the usual and daily operation of City departments and the
immediate preservation of public peace, property, health, and safety, it is necessary that
this Resolution take effect immediately upon passage; now, therefore,

BE IT RESOLVED BY THE COMMISSION OF THE CITY OF DAYTON:

Section 1. That this Commission objects to the issuance of Liquor Permit No.
10007766-1, Leela Group LLC DBA Dayton Downtown BP, 433 S. Main St., Dayton,
Ohio 45402, for all the statutory reasons provided in ORC Section 4303.292, as well as
for the reasons stated in the preamble, and that this Commission requests that the Division
of Liquor Control also reject the application for good cause.

Section 2. That two (2) certified copies of this resolution, together with a request
that a hearing be held in the City of Dayton, the county seat of the county in which said

on the high volume of calls to this busin noting its proximity to Chaminade Julianne High

for the purpose of consideration of objections to said proposed vacation, as provided by the
Charter of the City of Dayton, has recommended to vacate Vicksburg Street from Maywood

SUBJECT: Vacation of Vicksburg Street from Maywood Avenue
to Maywood Avenue.

Attached is the ordinance to vacate the subject property. Please present this
legislation to the City Commission for their action at the April 8th and April 15th
meetings.

A petition requesting the vacation was received from the Montgomery County Land
Bank on January 22, 2026. Resolution No. 6918-26 declaring the Commission’s
intention to vacate was adopted on February 25, 2026. The Board of Revision of
Assessments recommended the vacation on March 13, 2026. The vacation will
enable the abutting property owner to safeguard this property.

TO THE CITY COMMISSION OF THE CITY OF DAYTON

In the Matter of the Vacation of Vicksburg Street from Maywood Avenue to Maywood Avenue

Pursuant to proper notice being given, the Board of Revision of Assessments reports that it convened its
meeting on March 13, 2026 in the Fifth Floor Conference Room of the Department of Public Works,
for the purpose of considering the above matter.

AGENDA ITEMS: One item was on the agenda. There were no interested parties in attendance.

The Board of Revision of Assessments meeting was convened by John Musto on March 13, 2026
in the Public Works Fifth Floor Conference Room. Mr. Musto agreed to chair the meeting.

ITEM #1: Resolution No. 6918-26 In the Matter of the Vacation of Vicksburg Street from
Maywood Avenue to Maywood Avenue.

Service was made to one property owner: Bright Neon Lights, LLC, 130 W. Second St., Suite 1425,
Dayton, Ohio 45402.

Discussion followed as to the reason for the vacation request. Mr. Musto stated the conditions established
by the City Plan Board meeting on January 13, 2026 as follows:

1. The area shall be marked in a manner acceptable to the Division of Civil Engineering to
indicate that it is not public right-of-way.

2. The street openings at Maywood Avenue shall be removed and replaced with curb and walk,
or a driveway shall be constructed. All work shall be completed within 90 days of the vacation
to City of Dayton standards.

Mr. Klein made a motion to accept the vacation with the conditions from the City Plan Board meeting
meeting on January 13, 6. Mr. Zamonstny seconded and the vacation passed unanimously.

With no other business to come before the Board, Mr. Zamostny made motion to close meeting and
Mr. Klein seconded. All present said “aye” and the motion carried. The meeting was adjourned.
