Aberdeen, South Dakota
Water Tower and Transmission Line Project
C462072-05
DATE
AMENDMENT TO THE CATEGORICAL EXCLUSION DETERMINATION
FOR THE PROPOSED PROJECT WITHIN THE CITY OF
ABERDEEN, SOUTH DAKOTA
The South Dakota Department of Agriculture and Natural Resources (DANR) issued a
Categorical Exclusion (CATEX) published July 17, 2025, for a proposed project from
the city of Aberdeen, located in Brown County, to conduct a Water Tower and
Transmission Line Project. The CATEX is being amended to reflect additional funding
to the city of Aberdeen that was provided by DANR to complete the project.
In March 2024, the city of Aberdeen was awarded a $10,000,000 Drinking Water State
Revolving Fund (DWSRF) loan at 3.5 percent interest for 20 years to fund the project.
Due to price escalation in materials and construction costs, additional funding is
required to complete the project.
On September 24, 2026, the city of Aberdeen was awarded an additional $2,500,000
DWSRF loan at 3.75 percent interest for 20 years to cover the expected funding
shortfall. Aberdeen has pledged a project surcharge to repay the new loan. This
surcharge will be $1.75 per user per month.
Comments supporting or disagreeing with this decision may be submitted to
[email protected] for consideration by DANR after publication of the Categorical
Exclusion Determination Amendment. After evaluating the comments received, DANR
will make a final decision.

RECOMMENDATIONS FOR APPOINTING VOLUNTEERS
The following recommendation has been approved by the SDML Workers’ Compensation Fund’s Board of Trustees
to be used as guidelines to consider when appointing volunteer positions. It does not guarantee, assure, or warrant in
any way that the Member is in compliance with any Federal, State, or local laws, statutes or regulations and does not
carry the force of legal opinion.

The Minimum age of a Volunteer should be eighteen (18)
If someone under the aforementioned Minimum age of eighteen (18) that the Federal Child Labor laws are used
to define any job functions
There is someone in a supervisory position to oversee and offer guidance to Volunteer
Training has been offered to Volunteer
A ‘job description’ is available to outline the duties of said Volunteer
All Volunteers are listed in the entities minutes pursuant to SDCL 62-1-5.1 including the fire department and
ambulance service rosters. An easy way to make the entry in the council/commission meeting minutes is
for the Finance Officer/Auditor/HR person/ Emergency Manager (the person in charge of appointing
volunteers) to recognize the volunteers at the next council/commission meeting. The entry in the minutes
could read something like this: “Volunteers for (the Name of your Entity) for (Date) 2014 were
recognized and it is the intent of the City Council/County Commission to cover these volunteers for work
comp purposes. The list is on file at the (your office that keeps records on file)”.
In an emergency situation, a sign in sheet is available to have each Volunteer sign their name, Social Security
number, the time that they are checking in, and a time when they leave. These lists need to be entered into the
minutes at the end of the emergency

SDCL 62-1-5.1 Volunteers serving state or political subdivision without pay – Computing or imputing wage –
Certain persons not deemed volunteers.
Any volunteer worker rendering services in or for any agency, department, institution, or instrumentality of the state
or of any of its political subdivisions, including counties, townships, school districts, or municipalities, whose
services have been duly recommended to the officer or appointed thereto by such officers or governing body,
shall for purposes of this title be deemed an employee of the state or the political subdivision, as the case may be.
The appointment shall be entered into the official records or minutes of the entity.
In the event of injury or death, for the purposes of computing compensation for volunteer workers other than
volunteer firefighters, a volunteer uncompensated worker’s employment earnings from all sources during the last six
months of employment shall be used. In the event the volunteer uncompensated worker has never been employed,
the worker shall be considered to be earning the state minimum wage over a forty-hour week. The worker’s average
weekly wage shall be calculated by one of the methods in §§ 62-4-25 to 62-4-27, inclusive. In no event may
payments to volunteer uncompensated workers exceed the maximum limitations for benefits as set out in this title.
No local prisoner, state inmate, or federal inmate providing services to the state or any of its political subdivisions
may be considered a volunteer worker under this section.
Rating Basis
If such “Volunteer” receives any remuneration for services, that compensation will be included in the correct
classification at audit to determine the Members actual payroll. This said remuneration then eliminates the
“Volunteer” status of said individual and they become an employee. All “Volunteers” must be shown in the
Members minutes.

Agenda Item Title:
Approval of notice of public hearing regarding a proposed resolution extending the data
center moratorium to July 1, 2027.
Proposed or Possible Action:
Motion by _________, second by _________ to approve publication of the Notice of
Public Hearing on a proposed resolution extending the data center moratorium to July 1,
2027, and to set the hearing for October 19, 2026.
Overview:
Resolution No. 26-07-04R established a moratorium on issuance of City permits and
licenses related to the construction, development, or operation of data centers, with an
expiration date of November 18, 2026. Following a public hearing on October 19, 2026,
the City Attorney intends to propose a resolution to extend the moratorium to July 1, 2027,
or the earlier effective date of the permanent data center zoning ordinance, in order to
provide additional time to study data center impacts, receive public input, and consider
permanent regulations.
SDCL § 11-4-3.1 requires a public hearing for temporary emergency zoning and
subdivision ordinances, while the Data Center Bill of Rights at SDCL § 49-50-1 expressly
authorizes local action by resolution. A hearing may not be required to extend the
moratorium but is recommended to provide an opportunity for those property owners and
developers who may be negatively impacted to provide information to the Council. A
public hearing on October 19 will give interested persons the opportunity to voice their
support or opposition to the extension. Notice of the public hearing will be published in the
legal newspaper at least ten days before the hearing.

NOTICE OF PUBLIC HEARING
ON PROPOSED EXTENSION OF THE DATA CENTER MORATORIUM
TO JULY 1, 2027
NOTICE IS HEREBY GIVEN that the City Council of the City of Aberdeen, South
Dakota, will hold a public hearing to consider a proposed temporary emergency resolution
extending the moratorium established by Resolution No. 26-07-04R on issuance of local
permits and licenses for data centers within the corporate limits of the City of Aberdeen.
The proposed extension would continue the moratorium until July 1, 2027, or the
earlier effective date of an ordinance amending Aberdeen City Code Chapter 60 to
regulate the construction, development, or operation of data centers. The extension would
provide additional time for the City to study data center impacts in relation to its
comprehensive plan and zoning regulations, receive public input, and consider
permanent regulations to protect public health, safety, and general welfare. The proposed
measure will apply to data centers, including those defined in SDCL § 49-50-1.
NOW, THEREFORE, NOTICE IS HEREBY GIVEN that the public hearing will be
held by the City Council in City Council Chambers, 123 South Lincoln Street, Municipal
Building, in the City of Aberdeen, South Dakota, on October 19, 2026, at 5:30 p.m., when
and where any interested person may appear and be heard concerning the proposed
extension before the City Council takes action to adopt the measure.
This notice shall be published once in a legal newspaper of the City of Aberdeen
at least ten days before the public hearing.
BY ORDER OF THE CITY COUNCIL of the City of Aberdeen, dated this 5th day
of October, 2026.

RESOLUTION NO. 26-10-01R
A TEMPORARY RESOLUTION EXTENDING THE
MORATORIUM ON ISSUANCE OF LOCAL PERMITS FOR
DATA CENTERS WITHIN THE CITY OF ABERDEEN TO JULY 1, 2026
WHEREAS, SDCL § 49-50-3 expressly preserves local authority to adopt
ordinances and resolutions limiting, prohibiting, or otherwise regulating the construction,
development, or operation of data centers; and
WHEREAS, the City Council adopted Resolution No. 26-07-04R on July 20, 2026,
establishing an emergency temporary moratorium on issuance of local permits for data
centers within the corporate limits of the City until November 18, 2026, or the earlier
effective date of an ordinance regulating data centers under Chapter 60 of the Aberdeen
City Code (“Zoning Regulations”); and
WHEREAS, the City has undertaken study and consideration of data center
regulations in relation to its 2019 comprehensive plan and zoning regulations, including
public input, and additional time is necessary to complete that work; and
WHEREAS, the Council finds that the City’s current regulations may not
adequately address data center demands on water supply, wastewater capacity, electric
infrastructure, emergency services, and neighboring properties, including noise and land
use compatibility; and
WHEREAS, issuance of permits before completion of this work could authorize
development creating substantial infrastructure demands and land use impacts before
appropriate standards are in place, therefore, maintaining the moratorium is necessary to
preserve the public health and safety while the City diligently completes its review; and
WHEREAS, the extension to July 1, 2027, remains less than one year from the
original moratorium’s effective date of July 20, 2026, and is a limited period for completing
studies, receiving public input, and considering permanent regulations; and
WHEREAS, following notice published in the City’s legal newspaper on October
8, 2026, at least ten days before the hearing, the Council held a public hearing on October
19, 2026, to receive testimony on the proposed extension; and

WHEREAS, the Council finds this temporary measure necessary for the immediate
preservation of the public health and safety within the meaning of SDCL § 9-19-13.
BE IT RESOLVED BY THE CITY OF ABERDEEN, SOUTH DAKOTA, as
follows:
1.
Extension and continuity. Section 2 of Resolution No. 26-07-04R is
amended to provide the expiration stated in Section 3 below. The original moratorium
remains continuously in effect, subject to the clarifications and safeguards in this
Resolution. This Resolution does not restart the period of the original moratorium.
2.
Scope and administration. “Data center” means real property where the
principal use is as a centralized repository for the dissemination, management, processing,
and storage of electronic data and information. During the moratorium, City officials shall
not issue a local permit or license authorizing new construction, development, expansion,
or commencement of operation of a data center within the City’s corporate limits. Officials
shall receive and retain applications and notify applicants in writing of the moratorium and
its expiration. Approval and issuance shall be deferred only to the extent permitted by
applicable law. No statutory deadline is extended by this Resolution.
3.
Expiration. The moratorium expires and this Resolution is automatically
repealed at 12:01 a.m., local time, on July 1, 2027, or upon the earlier effective date of an
ordinance amending the Zoning Regulations to regulate the construction, development, or
operation of data centers. Permitting may resume on July 1, 2027, subject to thenapplicable law. There is no automatic renewal.
4.
Existing rights and safety work. This Resolution does not revoke a valid
permit previously issued or impair a vested right established under applicable law. It does
not prohibit continued lawful operation of an existing facility or permits solely for
maintenance, repair, or correction of a health or safety hazard that do not authorize
expansion or increased approved capacity.
5.
Continued study. City staff shall continue the study of data center impacts,
review proposed regulations in relation to the comprehensive plan, solicit public input, and
provide progress reports to the Council. The Council shall consider ending the moratorium
earlier when its purpose has been fulfilled.
6.
Effective date. Based on the findings above, this Resolution takes effect
immediately upon adoption pursuant to SDCL § 9-19-13(1). The Finance Officer shall
record this Resolution in full with the votes for and against and arrange publication in the
City’s official newspaper. Section 2 of Resolution No. 26-07-04R is amended upon this
Resolution’s effective date and its administration is governed by this Resolution.

RESOLUTION NO. 26-07-04R
A TEMPORARY RESOLUTION ESTABLISHING
A MORATORIUM ON ISSUANCE OF LOCAL PERMITS FOR
DATA CENTERS WITHIN THE CITY OF ABERDEEN

WHEREAS, effective July 1, 2026, SDCL § 49-50-3 authorizes local units of
government to adopt ordinances and resolutions limiting, prohibiting, or otherwise

regulating the construction, development, or operation of data centers; and
WHEREAS, the City of Aberdeen, South Dakota, by and through its City Council,
makes a preliminary finding that the City’s current regulations and controls may not

adequately address the unique needs and impacts on the community of data centers as
defined in SDCL § 49-50-1; and
WHEREAS, the City Council makes a preliminary finding that City of Aberdeen

planning, zoning, and building officials are hampered in their ability to adequately assess
permit applications for data centers, which creates unpredictability in the permitting
process and risks stranding real property investments; and
WHEREAS, the City Council makes a preliminary finding that the City needs
further study of data centers as they relate to the comprehensive plan adopted by the City

in 2019 and the zoning ordinances, and that the public interest requires that the City study,
analyze, and evaluate the impacts of data centers and proposed regulations regarding data
centers; and
WHEREAS, the City Council makes a preliminary finding that it would be
inappropriate for City officials to issue any local permit or license regarding the
construction, development, or operation of a data center; and

WHEREAS, a short-term moratorium will provide the City time to ensure that more
comprehensive zoning ordinance and building permit changes, licensing permits, and any

proposed amendments to the City’s comprehensive plan can be completely examined with
adequate public input from citizens, business interests, and data center industry
representatives; and
WHEREAS, the City finds that an emergency stopgap resolution is necessary and
reasonable to preserve the status quo and prevent significant investment pending the
outcome of the above study and any proposed regulations emanating therefrom; and

WHEREAS, the City finds that the following resolution is necessary as an

emergency measure to protect and preserve the public health, safety, welfare, peace, and
support of the municipal government and its existing public institutions.
BE IT RESOLVED BY THE CITY OF ABERDEEN, SOUTH DAKOTA, as
follows:
1.

Prohibited Issuance of Permit Regarding Data Center.

City zoning and

building officials shall not issue any permit or license related to the construction,
development, or operation of a data center within the corporate limits of the City during
the time period set forth in Section 2. Any application for a permit or license related to the
construction, development, or operation of a data center shall be held by the receiving City

official without review or action during the time period set forth in Section 2.
2.

Sunset Provision.

Unless amended, this resolution shall expire and be

automatically repealed on November 18, 2026, or upon the effective date of an ordinance
amending the zoning regulations at Aberdeen City Code, Chapter 60 - ZONING related to

the construction, development, or operation of data centers, whichever date occurs first.
3.

Immediate Effect.

This resolution shall take immediate effect as necessary

to protect and immediately preserve the public health, safety, welfare, peace, and support
of the municipal government and its existing public institutions pursuant to SDCL §9-1913.

The foregoing Resolution was approved after first reading and passed at a regular

meeting of the City Council on the 20th day of July, 2026.
