MINUTES OF COMMISSIONERS COURT, MOORE COUNTY, TEXAS
SPECIAL CALLED MEETING MONDAY, JULY 20, 2026

STATE OF TEXAS §
COUNTY OF MOORE {}

BE IT REMEMBERED THAT ON THIS 207! DAY OF JULY, 2026 there came to
be held a Special Called Meeting of Commissioners Court of Moore County, Texas at the
Community Building 1600 S. Maddox in Dumas, Texas. The following persons were present to
wit: Rowdy Rhoades, County Judge; Miles Mixon, Commissioner Precinct 2; Dee Vaughan,
Commissioner Precinct 3 and Brenda McKanna, County Clerk.

Commissioners Garcia and Farni were absent from the meeting.

Judge Rhoades called the public meeting to order, there were representatives from the City
of Sunray, City of Cactus and City of Dumas present at the meeting along with large group
of concerned citizens.

The meeting was held to discuss the bitcoin facility that has been built east of the City of
Dumas and data centers. Commissioner Vaughan stated the Commissioners’ Court had no
prior knowledge of the bitcoin facility being built. He stated when he did find out about the
facility, he wanted to hold a public meeting to hear from the citizens. The company offered
to be present on July 27" but the meeting had already been posted and the court wanted to
have the meeting as quickly as possible. Some of the concerns of the citizens were: How
much land has the company purchased and they stated they have purchased 10 acres. Are
there people being relocated to Dumas for the bitcoin project. Judge Rhoades addressed the
two hotels and apartments complex being bought has nothing to do with the bitcoin facility.
Is there an action plan in place in case of an accident at the facility? It was stated they do
have a fire suppression system in place, and who is doing the management of the
environmental testing and is there any wastewater going back into the ground. Who is the
local government and local contact that Bitari Inc. was dealing with and how did they decide
to build in Dumas. They stated they had contact with the DEDC and the decision to build in
Dumas was because of Xcel and the power grid.

The Representatives from Bitari Inc. presented an overview of the facility along with a slide
show regarding the water use of the facility via zoom. They stated the company host
computers for other companies that run 24/7 securing a bitcoin network. They explained
how they keep the facility cool. They use less than 150 gallons of water per year using a
closed loop system to cool the facility. They have their own well and are not connected to
the City of Dumas water system and have the proper permits in place for water well usage.
They stated the loop is never drained into the ground or any type of drainage system, they
have remote level sensors that create and alert of any drop, shut-off valves isolate each circuit
and drip trays under the connections catch and recover the fluid on the containers to prevent

any type of pollution. There were concerns from the citizens regarding the use of electricity
and they stated they use Xcel Energy’s power grid and pay a monthly usage fee, and they
don’t anticipate any spikes in usage that would affect the community. They do have a septic
tank approved by TCEQ and will install separate toilet facilities. There were concerns about
the noise and the impacts on nearby residents, the company’s transparency, electromagnetic
fields and internet usage capabilities. Scott Higginbotham, County Attorney, addressed the
group regarding property sales. Scott stated the local governments have no direct authority
over private sales of property, but cities do have the power to create ordinances regarding
noise and setbacks. Scott stated the City Commission can have an influence on what is being
built 5,000 feet outside the city limits due to ETJ. He stated there was a bill named the Death
Star Bill passed in 2023 that states no local government can pass regulations that conflict
with state law and any individual can sue any local government under the bill. He stated it
limits the local government's ability to regulate what is built within the county. The City of
Dumas could possibly implement a noise ordinance with the possibility of implementing a
fine if the decibels go over a certain amount. The group asked if the county could draft
zoning rules and Scott stated yes, they can under very limited circumstances.

Pat Sims, City of Dumas Mayor stated he heard about the bitcoin center three weeks ago.
He reported that if the company had visited with DEDC it was never brought to the EDC
Board and anything the DEDC does must come before the board. He will investigate the
noise ordinance and stated they are very limited as to what they can implement.

Bitari representatives stated they will host an open house and after the open house the group
encouraged the commissioners to host another public meeting.

Bitari Inc. presented an overview of the meeting and an overview of the water use at the
facility. An overview of concerns of citizens was presented. Copies of the documents are
attached and made a part hereof by references.

It appears there is no other business to come before the court. Motion was made by
Commissioner Mixon to adjourn. Motion was seconded by Commissioner Vaughan.
Motion carried.
