Agenda Title:
Discussion, consideration, and possible action on Ordinance
No.2026-31, an ordinance relating to the designation of Tax
Abatement Reinvestment Zone Number 12 for iMarket.
Council Action to be Taken: Approve Ordinance
Department Submitted:
City Management
Staff Contact:
Brian LaBorde, City Manager
1. PURPOSE / DESCRIPTION
To approve the creation of a reinvestment zone under CH 312 of the Texas Tax Code (Property
Redevelopment and Tax Abatement Act).
The proposed reinvestment zone is part of a financing structure under which iMarket will fund $15
million of the cost of constructing a 24-inch water transmission line from the Brazos River Authority
(BRA) East Williamson County Water Treatment Plant along FM 619 to FM 619/Highway 79 (see
exhibits A and B).
The proposed tax abatement and related Chapter 380 agreements are intended to reimburse iMarket
for those infrastructure costs actually funded by iMarket, up to a maximum aggregate reimbursement
of $15 million. The reimbursement is not an additional economic development incentive or grant to
iMarket, but rather a mechanism for repayment of a portion of the City's infrastructure costs initially
funded by the developer.
In doing so, state statutory measures in the form of public hearings, public notice and the like need to
be followed in order to consider any statutory agreements for reimbursement to the developer.

2. STAFF ANALYSIS / BACKGROUND / PRIOR COUNCIL ACTIONS
The FM 619 water line has been identified as a needed near-term transmission line in our master
water plan as presented at the special called Council meeting on July 27,2026. This line is critical to
distribute more water to the east side, maintain pressure, provide fire suppression flows, and
redundancy to the distribution system with city only having one main feed along Main St from the
BRA East WILCO water treatment plant (see Exhibit C)
Exhibit C.
Blue line is existing
single main feed from
BRA water treatment
plan
The total estimated cost of the project is $34.5 million, with $15 million funded by the City of
Taylor, $4.5 million funded by the Taylor Economic Development Corporation, and the remaining
$15 million initially funded by iMarket. The City’s $15 million portion is anticipated to be financed
through debt issued in the next fiscal year and repaid from water utility revenues. The Taylor
Economic Development Corporation has committed $4.5 million to assist with design, easement
acquisition, and other soft costs associated with construction. iMarket will initially fund the
remaining $15 million of project costs, thereby reducing the amount of interest-bearing debt the City
would otherwise need to issue for the project. The City proposes to reimburse iMarket for those
project costs through agreements authorized by state law. Under the proposed tax abatement
agreement, 60% of the otherwise applicable property taxes will be abated and credited toward
reimbursement of the project costs funded by iMarket. Once iMarket has received aggregate
Page 5 of 27
reimbursements totaling $15 million, the abatement will terminate and the property will thereafter be
taxed at 100% of its appraised value.
Why is iMarket participating? Current water distribution on the east side is approximately 500,000
gallons daily. While there is plenty of water supply at Lake Granger and BRA Water Treatment
Plant, existing water lines and line size can only push so much water in the system.
iMarket is an industrial office technology park (Exhibits D, E, F) with a phase-in-plan to provide
industrial office and warehousing flex spacing to attract international and domestic primary
employers. Their current phasing plan can accommodate the existing approximate 500,000 gallons a
day the current east side water distribution system can provide ; however, future phasing needs
additional water distribution for fire suppression and domestic use.
Exhibit D.
Exhibit E.
Exhibit F.
There are two proposed agreements to achieve repayment to iMarket:
1) CH 312 of the Texas Tax Code (Property Redevelopment and Tax Abatement Act)
provides for property tax repayments for a developer’s contribution.
a. First, a municipality needs to adopt a tax abatement policy governing tax abatement
agreements wherein Council adopted on May 14, 2026. Every two years such policy
needs to be reauthorized.
b. Second, a reinvestment zone needs to be created covering the area any tax abatement
agreement is entered into. The need for water distribution to the site will meet the
conditions for unsanitary or unsafe conditions and result in the retention or expansion
of primary employment or to attract major investment in the zone. The reinvestment
zone will require a public hearing and notice in the paper seven (7) days prior to
public hearing. The reinvestment zone will need to be adopted by ordinance and
needs two readings as required by City Charter. Sept 24th Council meeting will
present the proposed ordinance for consideration of first reading, and a subsequent
Council meeting will ensue for the second reading if first reading is considered.
c. Finally, a tax abatement agreement can be entered into with businesses in the zone.
First, a 30-day notice needs to be posted on city’s website prior to an agreement being
considered at a council meeting. An agreement will need to be posted on city’s
website along with the 30-day notice. Such notice can be posted the day after the
second reading of ordinance creating the reinvestment zone.
The proposed iMarket tax abatement agreement provides for a grant of 60% of the
taxable value for each phase. Each phase is given 10 years of such abatement until
repayment of the $15M funding is reached.
2) CH 380 of the Texas Local Government allows for grants to promote state or local
economic development and to stimulate business and commercial activity in the
municipality. The CH 380 will be used for the reimbursement of water impact fees of 100%
imposed by city assessed on the iMarket property; however, reimbursement ends on the
sooner of either the $15M grant is paid off or ten (10) years from effective date.
As Council is aware, impact fees can only be used on new growth and not on existing repairs
or maintenance, thus the FM 619 line is a new line identified in our Master Water Plan that
makes it eligible.
Both agreements will be posted for public viewing on city website during the 30-day notice
requirement after the second reading of the ordinance creating Reinvestment Zone # 12.
City Council held a public hearing and introduced the ordinance on September 24, 2026.
3. PROS and CONS
PROS
•
Developer contribution with no interest
versus city issuing interest-bearing
debt.
•
Reimbursement ends when $15M is
paid back. Property is taxed at 100%
appraised value.
•
Meets a critical near-term water line for
increase in distribution of water, fire
suppression, and redundancy to reduce
reliance on one main water line feed
from BRA.
•
No penalty to pay back sooner.
Performance based as the developer
attracts more businesses and grows
value, payments are larger.
CONS
• More interest paid and possible rate
increase if city needs to issue full $30M.

Importance of this line
• Identified as a critical near-term transmission line in city master
water plan.
• Distribute more water to east side. Example…City provides
wholesale water to City of Thrall.
• Maintain critical state-required pressure levels for domestic use.
• Provide fire suppression flows
• Redundancy to the distribution system with city having onlyone main
feed along Main St. from BRA water treatment plant.

• Industrial warehouse office space technology park.
• 3 phases of development providing office and warehousing flex
space to attract international and domestic primary employers.

Why is iMarket participating?
.
Working with iMarket for two years on
water options.
• Current water distribution can serve
approx. .5MGD which can handle phase
one(1) but not subsequent phases.
Eliminates their need to provide water
storage tanks on site.
• FM 619 water line provides not only
enough water distribution on east side,
but maintain pressure, provide fire
suppression flows, and redundancy to the
entire lower pressure zone distribution
system.
