Key Issues Raised by Citizens
Pat Davis Pat Davis urged the County to eliminate data centers as a by-right use and narrow their zoning
definition, drawing on other counties’ experiences. She expressed concern that by-right approval allows overly
broad industrial development and stated that it contributed to the County’s current issues involving Point One.
Brandi Marano spoke on behalf of several absent residents from the Brentwood Estates and Old Union areas. She
questioned the approval of legal expenses without supporting documentation and whether more affordable
representation had been considered. She called for greater transparency regarding DEQ consent orders and
wastewater projects and urged review of data center actions for consistency with the executive order she
referenced. She also raised concerns about the canceled BZA hearing, alleged errors in member appointment
procedures, and the County’s awareness and disclosure of data center turbine and generator details.
Jackie Stewart encouraged residents to remain engaged and expressed hope that future Board membership
changes could lead to reconsideration of current decisions. She raised concerns about recurring financial audit
issues and urged continued community participation. Identifying herself as an at-large candidate, she
announced that she would be at the library Saturday at 11 a.m. to hear residents’ concerns.
Thelma Whitehead, speaking on behalf of a group, questioned the County Attorney’s role and whether
separately retained legal representation should be Mr. Adkins’s personal responsibility. She expressed
concern about Mr. Patterson’s reported difficulty obtaining timely information and called for accountability.
She also questioned approval of legal expenses without clear, itemized documentation and stated that
residents would continue challenging the decision.
Bill Hopke speaking on behalf of a group, questioned the proposed $53,350 payment of Mr. Adkins’s legal fees and
stated that dismissal of the removal proceeding left residents’ underlying concerns unanswered. He requested the
County Attorney’s clarification regarding Mr. Adkins’s potential personal interest and eligibility to participate in the
vote. He also requested written certifications from supervisors supporting reimbursement concerning their knowledge
of conduct affecting County finances and documented efforts to recover or reconstruct financial records unavailable
to the forensic auditor. He emphasized transparency and accountability when using public funds..
Robert Tyler, speaking on behalf of a group, criticized legal expenditures related to Mr. Adkins and alleged that
the County obstructed the forensic audit and improperly destroyed supporting records. He raised concerns
about land transactions, undocumented food pantry expenditures, the accounting of COVID funds, and
discrepancies involving the Market 5 contract, container delivery, and payment transfers. He supported ending
the audit, stating that he believed the available findings warranted a criminal investigation.
Lloyd Carter raised concerns about proposed lithium battery storage at solar facilities, including fire response
plans, containment measures, and potential contamination of local waterways. He urged the County to prioritize
residents’ safety and revisit water-monitoring requirements associated with solar project approvals. He also
requested information about property reassessments and potential tax impacts and called for accountability
regarding County affairs.
6 of 69

John Manning stated that online commentary prompted his attendance and expressed concern about what he
viewed as character attacks. He indicated that he accepted the judge’s decision because the allegations had not
been proven in court.
Martha Harris speaking on behalf of a group, opposed payment of Mr. Adkins’s legal fees, questioned his
participation in the vote, and requested clarification about potential insurance reimbursement. Citing reported
staffing-related closures at Fire Station 3, she raised concerns about emergency response times and spending
priorities. She also described residents’ concerns about grinder pump placement and safety in the Mt. Zion sewer
project, questioned the proposed transfer of the schools’ wastewater treatment plant amid County compliance
issues, and called for continued efforts to account for financial matters raised by the forensic audit.
Preston Adkins expressed disappointment with the decision regarding the schools’ treatment plant, citing past
DEQ violations during County management and subsequent improvements under school oversight. He urged the
County to prioritize reliable service and regulatory compliance, noting that a water outage could force school
closures. He also questioned the County’s record of completing projects successfully.
Jared Kline questioned the consistency of public comment time limits for group representatives and urged the
County Administrator to take responsibility for addressing longstanding issues. He recommended presentations
and supporting documentation to inform Board decisions and improve public transparency. He also questioned
Mr. Hill’s vote given concerns about incomplete information and encouraged Board members to make motions
addressing spending concerns and unanswered questions.

Financial Update

enhanced based on the newly adopted budget

raised by the audit and continue to improve the County’s financial practices.
October Board work session will discuss the financial reporting, financial polies, and implementation
progress.

Systems (BESS), including potential categorizations based on storage capacity thresholds
(e.g., commercial vs. utility-scale).
3. Zoning Ordinance Amendment (District & Permitting): Classify BESS facilities, or
categories thereof, as a use permissible only upon the issuance of a Special Use Permit
(SUP) within appropriate Zoning Districts (including, but not limited to, the M-1 and M-2
districts).
4. Zoning Ordinance Amendment (Technical Performance Standards): Formulate
strict technical performance standards within the text amendment, including specific
criteria governing emergency response planning, fire suppression, thermal runaway safety
compliance, setbacks, screening, noise limits, and localized site security parameters.
BE IT FURTHER RESOLVED that the Planning Commission shall hold the required public
hearings on these proposed text and plan updates in accordance with Code of Virginia § 15.22204, and forward its final structural text and policy recommendations to this Board for legislative
review.

Purpose

Background of
agenda item

Neither the county Comprehensive Plan nor the Zoning Regulations
address Battery Energy Storage Systems. The Comprehensive Plan
should be amended to establish policy concerning BESS location, siting,
development standards and environmental protections and mitigations.
The zoning regulations should define BESS and place the plan-defined
policies into county zoning code, including best practice performance
measures. The BESS would be permitted as a use permit in the industrial
zoning districts.

Resolution Initiating Comprehensive Plan and Zoning Text Amendments Regarding Data
Center Uses, Private Power Generation Uses, and Related Buildings and Structures
WHEREAS, at the regular meeting of the Board of Supervisors of Charles City County, Virginia, held in the Government Administration Building in Charles City County, Virginia, on October 27, 2026, at which meeting a quorum was present, action was taken on the following resolution:
WHEREAS, the Board of Supervisors of Charles City County, Virginia, is dedicated to
promoting orderly land use, protecting the County’s historical and natural resources, and
safeguarding the public health, safety, and general welfare of its residents; and
WHEREAS, the County's current Zoning Ordinance permits data center developments as a
matter of right ("by-right") within certain Industrial Zoning Districts, and does not permit private
power generation uses in any of the County’s zoning districts; and
WHEREAS, data centers, private power generation, and the buildings and structures relating
thereto present unique land-use, environmental, infrastructure, and public utility
considerations—including exceptional electrical energy demands, localized noise from cooling
infrastructures, environmental concerns, expansive electrical substation footprints, and distinct
long-term impacts on local community character; and
WHEREAS, pursuant to § 15.2-2229 of the Code of Virginia, the Board of Supervisors may
direct the local planning commission to prepare amendments to the County’s Comprehensive
Plan to establish proactive guidelines, ideal location criteria, siting standards, and infrastructure
mitigation strategies for such data center and power generation infrastructure; and
WHEREAS, pursuant to § 15.2-2286(A)(7) of the Code of Virginia, the Board of Supervisors is
authorized to initiate amendments to the text of the County’s Zoning Ordinance to ensure proper
categorization, definitions, and performance thresholds for emergent technical uses; and
WHEREAS, the Board of Supervisors finds that deleting data centers as a permitted use by
right, establishing detailed definitions and performance criteria for data center and private power
generation uses, and addressing such uses exclusively through the Special Use Permit (SUP)
process in the appropriate Industrial Zoning Districts is necessary to provide proper local
oversight, ensure site-specific conditions, and protect the surrounding environment, and is in
furtherance of the public necessity, convenience, general welfare, and good zoning practice;
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Charles City
County, Virginia, that the Charles City County Planning Commission, with the active assistance
of the County Administration and Community Development staff, is hereby directed and
authorized to proceed with the following legislative and policy updates:
1. Comprehensive Plan Amendment: Prepare a text and policy amendment to the
Charles City County Comprehensive Plan establishing clear county-level criteria
addressing factors such as the optimal geographic placement, landscape siting, fiber-optic

routing proximity, and community/environmental impact mitigation metrics for data
centers and private power generation facilities.
2. Deletion of By-Right Allowances: Draft text amendments to the Charles City County
Zoning Ordinance to delete, remove, and eliminate "Data Centers" (and substantially
similar tech/server infrastructure uses) as a permitted use by right in all applicable
Industrial Zoning Districts, including but not limited to the M-1, M-2 districts and
Planned Industrial Districts.
3. Special Use Permit Requirement: Amend the text of the Charles City County Zoning
Ordinance to reclassify data centers and add private power generation as a special use
permissible only upon the review and successful legislative issuance of a Special Use
Permit (SUP) within the appropriate Industrial Zoning Districts.
4. Siting and Technical Performance Standards: Formulate strict technical
performance standards within the text amendment, including specific criteria governing
noise limits and sound attenuation, structural screening, water-cooling efficiency,
electrical utility grid impacts, environmental safeguards, and localized site security
parameters.
BE IT FURTHER RESOLVED that the Planning Commission shall hold the required public
hearings on these proposed text and plan updates in accordance with Code of Virginia § 15.22204, and forward its final structural text and policy recommendations to this Board for
legislative review.
BE IT FURTHER RESOLVED that this resolution shall take effect immediately upon its
adoption.
The Clerk of the Board of Supervisors of Charles City County, Virginia hereby certifies that the
