Minutes of the Shenandoah County Planning Commission
Work Session with the Board of Supervisors
Meeting: July 15, 2026
The Shenandoah County Planning Commission held a work session with Board of Supervisors
invited concerning the County’s data center ordinance, public comments, and potential ordinance
amendments.
Chairman Tommy Miller opened the work session. Mr. Lemuel Hancock, Director of Community
Development, stated that the County committed to holding two work sessions following adoption
of the data center ordinance on June 23, 2026. He explained that the meeting would review
comments received during the June 4 public hearing, the June 23 Board meeting, and a public survey
conducted from July 2 through July 12.
Mr. Hancock emphasized that no data center application or special use permit was pending and that
the work session concerned only the adopted ordinance and possible improvements. No final
ordinance amendment or project decision would be made.
Ordinance Background and Public Input
Mr. Hancock reviewed the County’s decision to define data centers separately from the former byright “data processing” use and require a special use permit in the industrial districts. He stated that
this approach ensures public hearings and technical review for any future proposal.
Ms. Brenna Menefee explained that adopting local standards before further state action may
preserve local discretion and prevent state default standards from filling regulatory gaps. She noted
that local ordinances may provide stronger requirements than state law, although the General
Assembly may later change or limit local authority.
Mr. Hancock reviewed the ordinance development process, including research of more than 30
Virginia localities, expert presentations, prior work sessions, and alignment with the Shenandoah
2045 Comprehensive Plan. He also noted recent state code changes affecting data centers and solar
energy and stated that the County’s energy ordinance may require separate updates.
Public comments most frequently addressed water and drought, the Shenandoah River, rural
character, agricultural land, power and transmission infrastructure, public health, noise, transparency,
monitoring, enforcement, and decommissioning. Fourteen survey responses were received, with
water, agriculture, rural character, power, and transmission identified as the leading concerns.
Water Resources
The Commission and Board discussed water demand, water sources, drought conditions, wastewater
treatment, and long-term compliance.
Commissioner Jim Fagan stated that data center cooling technology has changed and that closedloop systems generally use less water than older evaporative systems. Supervisor Mark Dotson
recommended strengthening verification of both projected water demand and actual operations,
including the source, use, discharge, and treatment of water.
Mr. Hancock stated that the Water Resources Advisory Committee (WRAC) would continue
discussing data centers and may provide an advisory opinion concerning water quantity and quality.
Members discussed requiring data centers to connect to public water and sewer systems. Chairman
Tim Taylor stated that public utilities would provide greater monitoring and accountability.
Supervisor Steve Baker emphasized that water is a limited resource and expressed concern about
future availability for agriculture and residents.
Supervisor David Ferguson asked staff to review whether the ordinance should specify:

The maximum amount of water that may be used;
Acceptable water sources;
Documentation of utility capacity;
Requirements during drought conditions;
Wastewater treatment and discharge standards; and
Independent verification of compliance.
Members agreed that any public utility commitment should be documented before an application
proceeds. They also discussed whether quarry water or other alternative sources could serve as
emergency or supplemental supplies, while Commissioner Gary Lantz noted that quarry water may
still be connected to groundwater resources.
Commissioner Debbie Keller recommended replacing the specific reference to closed-loop cooling
with language requiring the best available technology, provided the term can be defined clearly and
enforced consistently.
Chairman Miller asked whether cooling wastewater should be tested and pretreated before entering a
public wastewater system. Members also requested research on expected water demand by facility
size and cooling technology.
Staff was directed to review the water provisions with WRAC and return with recommendations
concerning public utilities, drought planning, water limits, wastewater treatment, monitoring, and
enforcement.
Rural Character, Land Use, and Agriculture
Members discussed the location of industrially zoned property and the relationship between the
ordinance and Shenandoah 2045. Staff confirmed that data centers are permitted only by special use
permit in industrial districts.
Supervisor Dotson stated that Shenandoah 2045 should remain the guiding document for industrial
development and rural preservation. He recommended that staff review the ordinance against the
Comprehensive Plan’s policies concerning rural character, agricultural land, residential growth,
natural resources, and the location of future industrial development. He suggested reviewing any
areas where the ordinance may not fully align with Shenandoah 2045 and recommending
appropriate changes. He emphasized that decisions made now will affect the future viability of
agriculture in the County.
Commissioner Keller stated that land should be viewed as a resource to preserve rather than only as
an opportunity for development. Supervisor Baker expressed concern about rising land prices,
pressure on agricultural property, and the difficulty young farmers face in acquiring land.
Noise, Air Quality, Health, and Enforcement
Supervisor Dotson stated that the County had established detailed noise standards but should review
whether the standards and compliance mechanisms are sufficient. Staff explained that the ordinance
requires noise assessments by qualified acoustical professionals before an application is considered
complete.
Commissioner Keith Stephens discussed the difference between A-weighted and C-weighted sound
measurements and the need to address both audible noise and persistent low-frequency sound.
Commissioners supported recurring post-construction monitoring and independent third-party
testing funded by the applicant or operator.
Supervisor Ferguson asked whether the County would have sufficient authority to respond promptly
to violations without relying solely on state agencies. Staff stated that zoning violations may be
addressed through the County’s enforcement and civil penalty processes. Members asked staff and
legal counsel to review whether penalties and corrective measures could be strengthened.
Supervisor Dotson recommended reviewing air-quality requirements for diesel, natural gas, propane,
and other fuel sources. He stated that some provisions may belong in the data center ordinance,
while broader standards for power generation should be addressed through the energy ordinance.
Chairman Miller asked staff to distinguish between emergency backup generators and equipment
used for routine or primary power generation. Members also discussed whether a data center should
be connected to the electrical grid before beginning operations.
Power, Transmission, and On-Site Generation
Members discussed electrical demand, utility capacity, transmission lines, substations, and on-site
power generation.
Supervisor Ferguson stated that applications should include documentation directly from the serving
power company confirming available capacity, the proposed source of electricity, required upgrades,
and any new transmission or substation facilities. Staff agreed to review the ordinance to ensure the
information is complete.
Members stated that on-site power generation should be treated separately from the data center use,
particularly where power could be resold or where a generating facility could continue after the data
center closes.
Commissioner Fagan referenced information distributed by the electric cooperative concerning data
center development.
Members agreed that broader standards for on-site generation, fuel storage, emissions, and
transmission infrastructure should be reviewed during the energy ordinance work session.
Decommissioning, Monitoring, and Long-Term Accountability
Supervisor Dotson recommended reviewing whether data centers should provide decommissioning
plans and financial assurances similar to large-scale energy facilities. He also raised concern about
industrial land being reserved indefinitely for projects that do not proceed. What a performance
bond or performance period would look like in the code for the County.
Chairman Miller asked staff to address electronic waste and equipment disposal during both facility
operation and decommissioning.
Members supported applicant-funded third-party review of technical studies, inspections, and
monitoring. Staff stated that the County could examine its fee structure and contracting procedures
to ensure those costs are not borne by taxpayers.
Staff Direction
Mr. Hancock summarized the principal follow-up items:

treatment, and utility verification;
Consult WRAC concerning water quantity and quality;
Review consistency with Shenandoah 2045 and rural character policies;
Evaluate noise, air-quality, health, and generator standards;
Strengthen monitoring, third-party verification, enforcement, and penalties;
Clarify requirements for utility documentation, grid connections, and on-site power
generation;
Review decommissioning, financial assurances, and electronic waste disposal;
Update the fee structure so applicants fund necessary outside review; and
Coordinate applicable changes with the County’s energy and industrial zoning ordinances.
Commissioner Lantz also requested review of fault lines and geologic conditions in relation to major
energy and utility infrastructure.
Supervisor Dennis Morris thanked the public, staff, Planning Commission, and Board members for
their participation and stated that the work session was held in response to the comments received
during the prior public meetings.
There being no further discussion, Chairman Miller adjourned the work session.
Coal Mine Hollow AFD Renewal

Introduction: Landowners throughout the County have made the commitment to keep their land in farming or
forestry by joining the Ag & Forestal District (AFD) program. In this program, a landowner voluntarily commits to
keeping their land in agricultural or forestry production for ten years. There are 18 Agricultural & Forestal Districts
in the County with over 40,000 acres enrolled. This is a voluntary program.
Landowners enrolled in the program forego the option to subdivide and develop the tracts during this 10-year
period. In exchange, those areas are protected as “right to farm” regions, with protection against government
interference in their farming and forestry operations and other benefits.
While typically there would not be any AFD’s up for renewal, the AFD Committee and staff have shifted the
renewal calendar so that there is more of an equal distribution for renewal dates in order to avoid a large number of
renewals occurring the same year.
On January 12th, 2026 the AFD Committee conducted its first review of the District. On February 23rd, 2026 a
public information session was held for those interested in joining or withdrawing from the District. On July 16th,
2026 the AFD Committee conducted its final review and recommended renewal of the District.
The Coal Mine Hollow AFD is currently 234.981 acres. There will be an addition of 6 properties which encompass
273.325 acres. There were no requests to remove any acreage from the Coal Mine Hollow District. With the additions, the
District will encompass 508.306 acres.
Planning & Zoning: Staff recommends renewing the Coal Mine Hollow AFD for another ten year period with the
next renewal taking place in 2036.

ORDINANCE RENEWING THE COAL MINE HOLLOW AGRICULTURAL AND
FORESTAL DISTRICT
Pursuant to Title 15.2 Chapter 43, Code of Virginia, 1950, (as amended), be it ordained by the
Board of Supervisors, County of Shenandoah, that the Coal Mine Hollow Agricultural and
Forestal District, which was established by ordinance and made effective on December 12, 1995, be
renewed as hereinafter set forth.
SECTION I.
The Agricultural District hereby renewed shall be identified as the "Coal
Mine Hollow Agricultural and Forestal District" and shall include the parcels
identified on the attached map, which is made a part of this ordinance. The
acreage is as follows.

The owners of the land included within the "Coal Mine Hollow Agricultural
and Forestal District" shall enjoy the privileges over the use of their land as
set forth in Title 15.2, Chapter 43, Code of Virginia, 1950, as amended,
including that said land shall qualify for an agricultural value assessment
pursuant Section 58.1-3229 et seq., of the Code of Virginia if requirements
for such assessment contained therein are satisfied. This ordinance shall not
prohibit the construction or acquisition of the minimum necessary the rightof -way for road improvements included on the current six-year secondary
road improvement plan. Nor shall it prohibit the construction or acquisition
of the minimum necessary right-of -way for utility lines and facilities
providing local service and not requiring approval by the State Corporation
Commission.
SECTION III.
The Board of Supervisors, County of Shenandoah, shall review the "Coal
Mine Hollow Agricultural and Forestal District" in 2036 in order to
determine whether to terminate, modify or continue said district. The Board
shall ask for recommendations from the County Planning Commission and
the Agricultural and Forestal District Advisory Committee prior to
completing their review.
SECTION IV.
The owners of the land included within the "Coal Mine Hollow Agricultural
and Forestal District" shall not without prior approval of the Board of
Supervisors, develop their land to any more intensive use, other than uses
resulting in more intensive agricultural production, during the period which
said parcel remains within the district. Construction and placement of
dwellings for persons who earn a substantial part of their livelihood from a
farm operation, on the same property or for members of the immediate
family of the owner and divisions of land for such family members, shall
not be viewed as a more intensive use, unless the Board of Supervisors finds
that such use in the particular case would be incompatible with farming in
the district.
SECTION V.
Landowners in "Coal Mine Hollow Agricultural and Forestal District" shall
establish a landowners committee to be registered with the Shenandoah
County Office of Community Development. The purpose of this committee
is to help track changes in ownership of land within the district. The
committee shall be established and registered with the county within sixty
(60) days of the adoption of the ordinance.
Any owner of land included in the "Coal Mine Hollow Agricultural and
Forestal District" may file a written notice to the Board of Supervisors
requesting permission to withdraw all or part of their land from said district
according to Section 15.2-4314 of the Code of Virginia. The Board after
receiving recommendations from the Shenandoah County Planning
Commission and Agricultural and Forestal District Advisory Committee shall
conduct a public hearing. Upon demonstration of good and reasonable
cause, the Board may allow the landowner to withdraw his land from the
district. In order to establish good and reasonable cause, the following
criteria must be met:

SECTION VI.
The landowner must provide a written request to the Board of
Supervisors for withdrawal of land from the district.
The request must explain in detail the reason for withdrawal from the
district.
The landowner must demonstrate that withdrawal of his land from
the district will not cause damage or disruption to the existing district
nor to the surrounding agricultural community.
The landowner must show that the withdrawal of his land from the
district would be in compliance with the County's Comprehensive
Plan and would not defeat the purpose for which the district was
created.
If the landowner’s request to withdraw is denied by the Board, the
landowner shall have an immediate right of appeal de novo to the
Shenandoah County Circuit Court. Upon withdrawal of land from the
district, the land so withdrawn shall be subject to roll-back taxes
pursuant to Section 58-769.10 of the Code of Virginia. The owner of
land so withdrawal shall be subject to those local laws and ordinances
prohibited by the provision of Section 15.2-4312 B of the Code of
Virginia. Any heir at law or devisee of an owner of land lying within said
"Coal Mine Hollow Agricultural and Forestal District" shall, as a matter
of right be entitled to withdraw from said district upon inheritance or
descent of such land by filing written notice of withdrawal with the
Board of Supervisors and the Commissioner of Revenue within two
years of the date of the death of the owner.

the next renewal taking place in 2036.

Introduction: Landowners throughout the County have made the commitment to keep their land in farming or
forestry by joining the Ag & Forestal District (AFD) program. In this program, a landowner voluntarily commits to
keeping their land in agricultural or forestry production for ten years. There are 18 Agricultural & Forestal Districts
in the County with over 40,000 acres enrolled. This is a voluntary program.
Landowners enrolled in the program forego the option to subdivide and develop the tracts during this 10-year
period. In exchange, those areas are protected as “right to farm” regions, with protection against government
interference in their farming and forestry operations and other benefits.
While typically there would not be any AFD’s up for renewal, the AFD Committee and staff have shifted the
renewal calendar so that there is more of an equal distribution for renewal dates in order to avoid a large number of
renewals occurring the same year.
On January 12th, 2026 the AFD Committee conducted its first review of the District. On February 23rd, 2026 a
public information session was held for those interested in joining or withdrawing from the District. On October
July 16th, 2026 the AFD Committee conducted its final review and recommended renewal of the District.
The Lebanon Church AFD is currently 872.717 acres. There will be an addition of 5 properties which encompass
192.605 acres. There were no requests to remove any acreage from the Lebanon Church District. With the additions, the
District will encompass 1,065.322 acres.
Planning & Zoning: Staff recommends renewing the Lebanon Church AFD for another ten year period with the
next renewal taking place in 2036.

ORDINANCE RENEWING THE LEBANON CHURCH AGRICULTURAL AND
FORESTAL DISTRICT
Pursuant to Title 15.2 Chapter 43, Code of Virginia, 1950, (as amended), be it ordained by the
Board of Supervisors, County of Shenandoah, that the Lebanon Church Agricultural and Forestal
District, which was established by ordinance and made effective on December 12, 1995, be renewed
as hereinafter set forth.
SECTION I.
The Agricultural District hereby renewed shall be identified as the "Lebanon
Church Agricultural and Forestal District" and shall include the parcels
identified on the attached map, which is made a part of this ordinance. The
acreage is as follows.
SECTION II.
The owners of the land included within the "Lebanon Church Agricultural
and Forestal District" shall enjoy the privileges over the use of their land as
set forth in Title 15.2, Chapter 43, Code of Virginia, 1950, as amended,
including that said land shall qualify for an agricultural value assessment
pursuant Section 58.1-3229 et seq., of the Code of Virginia if requirements
for such assessment contained therein are satisfied. This ordinance shall not
prohibit the construction or acquisition of the minimum necessary the rightof -way for road improvements included on the current six-year secondary
road improvement plan. Nor shall it prohibit the construction or acquisition
of the minimum necessary right-of -way for utility lines and facilities
providing local service and not requiring approval by the State Corporation
Commission.

establish good and reasonable cause, the following criteria must be met:

The landowner must provide a written request to the Board of
Supervisors for withdrawal of land from the district.
The request must explain in detail the reason for withdrawal from the
district.

SECTIONVI.
The landowner must demonstrate that withdrawal of his land from
the district will not cause damage or disruption to the existing district
nor to the surrounding agricultural community.
The landowner must show that the withdrawal of his land from the
district would be in compliance with the County's Comprehensive
Plan and would not defeat the purpose for which the district was
created.
If the landowner’s request to withdraw is denied by the Board, the
landowner shall have an immediate right of appeal de novo to the
Shenandoah County Circuit Court. Upon withdrawal of land from the
district, the land so withdrawn shall be subject to roll-back taxes
pursuant to Section 58-769.10 of the Code of Virginia. The owner of
land so withdrawal shall be subject to those local laws and ordinances
prohibited by the provision of Section 15.2-4312 B of the Code of
Virginia. Any heir at law or devisee of an owner of land lying within said
"St. Luke Agricultural and Forestal District" shall, as a matter of right be
entitled to withdraw from said district upon inheritance or descent of
such land by filing written notice of withdrawal with the Board of
Supervisors and the Commissioner of Revenue within two years of the
date of the death of the owner.
