PLANNING AND ZONING BOARD MINUTES FOR SPECIAL MEETING HELD WEDNESDAY, AUGUST 12, 2026, 7:00 PM
Via Zoom
The Special Meeting of the Planning and Zoning Board came to order at 7:02 pm by Chairman Quish
ROLL CALL
Members Present: J. Agnese, B. Anderson, S. Firmender, M. Macchio, J. Mortimer, R. Satti, J. Quish
Members Not Present: J. Alling, B. Kaligian, M. Zahariades
Staff: D. Sulkis, City Planner; A. Meahan, Rec. Sec’y
NEW BUSINESS:
Presentation of consultant John Guszkowski regarding updates to the Zoning regulations for compliance with Public
Act 25-1
John Guszkowski
- Mr. Guszkowski states he is the planning and zoning consultant hired by SCROG to assist with updating Milford’s
Zoning Regulations to be compliant with 25-1
- First component took effect in July of this year
- A portion of 25-1 requires that all zoning regulations under CGS 8-2 had to contain some specific items under
two categories
- Change 1: Transit-Oriented Middle Housing
o Smaller scale multi-family residential housing with 2-9 units
o Public Act requires all municipalities that have zones for business or mixed-use zones to provide
allowance for this category of housing, to be allowed by a site plan review
o Does not include residential zones, nor are you required to require in any non-commercial zones
o Strictly for commercial and mixed-use zones
- Change 2: mandatory cap on off-street parking for multi-family developments
o Mr. Guszkowski summarizes the minimum off-street requirements effective in 2022
o Municipalities had a choice to opt out
o If there are under 16 units – there is no parking minimum; zoning cannot deny a multifamily
development 16 units or under solely for failure to provide off-street parking
o Municipalities are allowed to designate certain areas with parking hazards
- Mr. Guszkowski reviewed zoning regulations to find where change was needed regarding these two changes
-

Mr. Mortimer asks if there is an exception for the elderly
Mr. Guszkowski states elderly housing is not true multifamily, so it would not apply
Mr. Satti refers to 2-9 units and heard the term “as of right”
Mr. Guszkowski states the language uses “summary review,” so no conditional approvals; it either meets the
regulations, or it doesn’t
Mr. Satti asks if this goes to the Board
Mr. Guszkowski states it could go to the Board, or it could go to staff for approval
Discussion ensued on how transit-oriented is defined

John Guszkowski
- Mr. Guszkowski presents the sections that need to include the transit-oriented middle housing provision and
refers to the meeting document titled “Milford Zoning Regulations Notes – Compliance with PA 25-1”
- Refers to the interchange commercial district – mall area – and suggests the Board may want to consider this
and make it clear that this is a special category not appropriate for housing
- Presents the zones not subject to transit-oriented middle housing provision
- Mr. Guszkowski refers to the BB zone (boat business) and presents the suggested clarifying statement that this is
not a standard business or mixed-use district
Vol 56, page 3338

PLANNING AND ZONING BOARD MINUTES FOR SPECIAL MEETING HELD WEDNESDAY, AUGUST 12, 2026, 7:00 PM
Via Zoom
-

Presents other areas to add the suggested clarifying statement that this is not a standard business or mixed-use
district
Chairman Quish notes he will keep this suggested statement as an open item when the entire board can discuss
it
Mr. Guszkowski refers to section 3.17 as a good section to cross-reference
Presents Parking Table Figure 4 and notes it would be revised
Suggests adding a couple of definitions for clarity
Presents change to 3.18.5.2; highlighted in the document
Mr. Guszkowski concludes his presentation on the mandatory changes
Mr. Guszkowski reminds the Board we are now past July 1st, so if someone comes forward with a small multifamily, it is currently allowed in a commercial area
Mr. Satti and Mr. Guszkowski discussed a table in the document presented
Mr. Satti refers to a single-family ADU
Mr. Guszkowski states this is a different use
Chairman Quish states the Board will have to decide if these will be heard by the Board or approved
administratively
Chairman Quish considers having a looser version of mixed-use and applying 25-1 to anything considered mixeduse
Mr. Satti notes having these ready by September 1st is very optimistic
Chairman Quish states they have a couple of weeks to review everything and potentially move forward at the
September 1st meeting

Discussion of regulations regarding the CDD-3 Zone-DRAFT
- Chairman Quish reminds everyone this is from McDonald's in Devon to the fork in the road, and down to Mr.
Mac's
- Mr. Sulkis gives an overview of the draft CDD-3 regulations
- Mr. Sulkis states there have been discussions over the last few years about the great variations in uses that exist
there today
- Notes these discussions led to the idea of a floating zone, and since then, a floating zone was created on
Wheelers Farms Rd
- Mr. Sulkis states he attempted to adapt the floating zone regulations as a base to this zone
- Notes we still have underlying CDD-3 regs, currently as they are today
- Mr. Sulkis states a developer can present a plan, and the Board has control over the design criteria and
expectations
- One of the things required is a minimum lot size of 30,000SF or more (actual minimum size to be determined)
- Mr. Sulkis presents the CDD-3 draft document
- Includes an affordability component, also used for the other floating zone
- Mr. Sulkis states he is calling this ARDD-3 (Wheelers Farms is ARDD)
- Developers would still need a written statement of use
- Board would have control under the floating zone to work with an applicant on the standards
-

Chairman Quish states he believes this is an open door to developers and commends the residential aspect’s
addition to the grand list
Chairman Quish states this will be on the next Agenda for the Board to discuss the good points and any
problems
Mr. Sulkis reminds the Board 25-1 now allows housing up to 9 units on any one of the properties, if the existing
is a business or mixed-use
Discussion ensued about making CDD-3 more like the downtown district

Discussion of proposed updates to the SCD Zone regulations (Shopping Center Design District) -DRAFT
- Chairman Quish notes this is the mall site
- Mr. Sulkis states he had a meeting with the mall ownership, and they told him that they cannot do what they
promised they could do; the project is dead
- Mr. Sulkis refers to 2019 -2023 and the work the Board put into the vision for integrated development
- Mr. Sulkis states the city cares about the mall and its place in the community
- Mr. Sulkis states the recommendation from the city is to protect the property and ensure whatever is developed
is good for both the ownership of the mall and the community as a whole
- Mr. Sulkis states when the mall decides to move forward, the city will work with them
- Mr. Sulkis recommends the regulations be rewritten to what they were, which would eliminate the housing
aspect allowed, but never developed
- Notes the regulations will need to adhere to 25-1
- Chairman Quish asks if the lot is subdivided, can the lots have 9 units on each
- Mr. Sulkis responds 9 units are allowed on a 40-acre parcel according to 25-1
- Chairman Quish asks about the overlay for the mall as well
- Mr. Sulkis responds, in effect, we have that, but not quite a floating zone
- Mr. Sulkis states there is nothing to prevent the mall from asking for a floating zone, if the Board is in agreement
- Mr. Sulkis presents the draft document and has adjusted to rescind the changes made in 2023
- Mr. Sulkis notes a notable change at the end under “prohibitions”
o 3.9.5.5 added additional prohibitions to this regulation
- Chairman Quish states he does not like that solar farms are prohibited
- Mr. Sulkis states it's there so someone doesn't convert the mall to a solar farm
- Discussion ensued on what constitutes a solar farm
- Discussion ensued on data centers
- Mr. Sulkis reminds the Board that he wants to make sure that however the mall evolves, it is advantageous to
property owners and the city
- Chairman Quish encourages the Board to review this information before the September 1 st meeting
- Mr. Sulkis states he speaks for the administration and notes the regulations will be moving forward and brought
before the Board for discussion on September 1st
- **Mr. Satti requests from Mr. Sulkis changes made to the mall in the last 5-10 years, minutes, and votes
- Mr. Mortimer confirms the mall project is dead, but asks if there are any other plans
- Mr. Sulkis responds that no alternative plans have been discussed but have streamlined regulations so the mall
can have their special events whenever they want
- Mr. Anderson notes Centennials' responsibility as a management agency and as an owner have changed
drastically. Mr. Anderson notes they have taken on responsibility of the Trumbull shopping center and states his
disappointment that their project did not come into fruition
- Mr. Anderson believes the Board needs to contemplate the possibility of new construction and did not see
reference to this in the regulations
- Mr. Sulkis states new construction is not the language used in regulations; the language used is: “uses
permitted” and “special uses”
- Discussion ensued about new construction before moving to the next item on the Agenda
Action Items Before Next Meeting – None.
