ENGINEERING & PUBLIC WORKS
1.

Staff recommends motion to approve: Change Order No. 5 to the Contract with
Ranger Construction Industries, Inc. (Ranger) dated September 15, 2020 (R20201314) (Contract) for a retroactive time extension of 468 days for Gateway Boulevard
and High Ridge Road (Project). SUMMARY: Pursuant to Contract Specifications 43, 8-6.4, and 8-7.3.2, approval of Change Order No. 5 will provide a retroactive
contract time extension of 468 calendar days for the Project. This extension accounts
for documented delays to the Project's critical path, including 48 calendar days
attributed to holidays in accordance with Specification 8-6.4, 23 calendar days
attributed to inclement weather in accordance with Specification 8-7.3.2, and the
remaining time associated with excusable, non-compensable delays, including utility
relocation conflicts, plan revisions, unforeseen field conditions, ADA compliance
revisions, storm drainage modifications, and documented material procurement
delays encountered during construction. Per PPM CW-F-050, the total time extension
associated with this Change Order exceeds staff approval authority for contract
change orders and therefore requires approval by the Board of County
Commissioners (BCC). The Contract was approved on September 15, 2020, in the
amount of $1,297,399. Previous Change Orders totaling $243,568.55 bring the total
Contract amount to $1,540,967.55. Prior to Change Order No. 5, previous Change
Orders adjusted the Contract completion date to October 13, 2021. Approval of this
Change Order retroactively revises the Contract completion and substantial
completion dates to January 24, 2023. This Project is complete, and this Change
Order represents the final Contract adjustment required to close out the Project. The
Change Order took significant time, as it required numerous reviews and verifications
for Contract compliance, before it could be brought to the BCC for approval. The
Project was presented to the Goal Setting Committee (GSC) on March 4, 2020, and
the GSC established the following Affirmative Procurement Initiative (API): a 10%
minimum mandatory Small Business Enterprise (SBE) participation. Ranger
committed to 21.3% SBE participation for the life of the Contract. For this Change
Order, the proposed SBE participation is 0%. To date, the overall SBE participation
achieved on this Contract is 26.04%. District 2 (YBH)

COUNTY ATTORNEY
1.

Staff recommends motion to approve: the Settlement Agreement and Release in
the case styled B. & B. Properties, Inc. v. Palm Beach County, Florida, 50-2019-CA008660-XXXX-MB AI in the amount of $275,000. SUMMARY: Plaintiff, B. & B.
Properties, Inc., brought a class action lawsuit on behalf of property owners in Palm
Beach County who had a lien recorded against their properties for unpaid code
enforcement fines. Plaintiff brought claims under Florida and federal law, challenging
the charging of interest and collection agency fees in connection with code
enforcement fines and liens. A class was certified. Plaintiff prevailed on all claims
under a final judgment entered in July 2025, awarding the class $490,201.38 in
damages. Because Plaintiff prevailed on federal claims, it is entitled to reasonable
attorney’s fees to be paid by the County. Plaintiff was represented by two groups of
attorneys during the litigation, one group from July 2019 to December 2020, and the
other from December 2020 until the conclusion of the case. As to the second group
of attorneys, Palm Beach County (County) entered into a Mediated Settlement
Agreement that was approved by the Board of County Commissioners (BCC) in
August 2025, in the total amount of $1,500,000. That Mediated Settlement
Agreement was without prejudice to the attorney’s fees and costs incurred by the
group of attorneys who brought the case and handled it from July 2019 to December
2020. As to those attorneys, the parties have now negotiated the Settlement
Agreement and Release being presented to the Board for approval, proposing to
settle the amount owed to Plaintiff for the fees and costs incurred by the original
attorneys in the amount of $275,000. Countywide (SCF)

The Amendment adds funding in the amount of $6,500,000 to Financial Project
No. 451546-1-94-01 for the Terminal Project with a local match requirement of
50% of the eligible Terminal Project costs. The required local match for
Financial Project No. 451546-1-94-01 is $6,500,000. The Amendment also
provides additional funding through Financial Project No. 451546-1-94-02
(CFSA No. 55.014), for the Signage and Security Project at DJT in the amount
of $6,250,000, which is funded 100% by FDOT with no local match
requirement. Resolution R2020-1017, as amended by Resolutions R20251015 and R2026-1168, authorizes the County Administrator or designee,

B)

acceptance of Individual Law Enforcement Officers Reimbursement Program
(LEORP) Other Transaction Agreement (OTA) 70T01026T6114N110 (Individual
OTA) with the Transportation Security Administration (TSA) for reimbursement of a
portion of the cost of law enforcement services at President Donald J. Trump
International Airport (DJT) in the amount of $365,000 for the period commencing on
September 1, 2026, and ending on August 31, 2027; and

C)

a Budget Amendment in the Airport’s Operating Fund, for the receipt of $365,000 of
funding from the TSA, and an increase to Reserves in the amount of $365,000.

SUMMARY: The TSA LEORP provides for reimbursement to airport operators for
expenses incurred for the provision of law enforcement services at airport security
checkpoints. The terms and conditions for participation in the TSA LEORP are set
forth in the Parent Agreement. Airport operators participate in the TSA LEORP by
accepting funding through Individual OTA’s, which require compliance with the Parent
Agreement. Both the Parent Agreement and Individual OTA are structured as
unilateral agreements that do not require approval or signature by the County. Law
enforcement services currently provided by the Palm Beach County Sheriff’s Office
(PBSO) at DJT satisfy the requirements of the Parent Agreement and Individual OTA.
Acceptance of the Parent Agreement and Individual OTA will allow the County to
recoup a portion of its costs for law enforcement services in the amount of $365,000
for the period commencing on September 1, 2026, and ending on August 31, 2027.
The Parent Agreement includes non-standard liability language that differs from that
adopted for use by the County under PPM #CW-F-049. The Risk Management
Department and County Attorney’s Office have reviewed the non-standard provisions
and advised staff accordingly. The Parent Agreement provides that neither party will
save or hold harmless the other party for the consequences of any act or omission
on the part of its own agents or employees. Additionally, the Parent Agreement
provides that neither party shall be liable to the other for consequential punitive,
special and incidental damages, claims for lost profits or other indirect damages.
Given the services are already being performed to qualify for participation in the TSA
LEORP, staff is recommending approval. Reimbursement is awarded on a first–
come, first-serve basis, subject to available funding. Additional funding may be
unilaterally awarded by TSA through modifications to the Individual OTA. Countywide

Staff recommends motion to approve: the Annual Certified Budget for Arthropod
Control (Form 13617) with the Florida Department of Agriculture and Consumer

(FY) period beginning October 1, 2026 through September 30, 2027. SUMMARY:
As part of the FDACS routine agency review of Florida mosquito control programs
participating in the “State Approved” mosquito control program, FDACS requests
financial information from the mosquito control programs participating to determine
what, if any, grant funding is allocated to each mosquito control program. As the total
State grant is a finite amount, and is divided amongst the programs based on the tier
they fall under, as determined by FDACS Form 13617, it is necessary that the County
provide this financial report in order to maintain its participation in the “State
Approved” mosquito control program. Since the Palm Beach County Mosquito
Control Division’s budget exceeds $3M, it places the program in the State’s Tier I,
which does not qualify for additional funding under Florida Administrative Code

States Department of Agriculture/Natural Resources Conservation Service
(USDA/NRCS) to support agricultural producers with conservation planning, Best
Management Practice implementation, and assistance addressing natural resource
concerns. These practices improve water quality, reduce soil erosion and

PLANNING, ZONING, & BUILDING
1.

Staff recommends motion to:
A) approve an Interlocal Agreement (ILA) by and between Palm Beach County
(County) and the Village of Wellington (Village) resolving the dispute over the
annexation of approximately 446.14 acres of land located on the north side of
State Road 80 (Southern Boulevard) approximately 1.75 miles west of Seminole
Pratt Whitney Road.
B) approve the Public Benefit Agreement (PBA) by and between the County and KH
Artistry Lakes LLC (Artistry Lakes), the owner and developer of the subject
property, for a $2 million contribution towards the County’s Workforce Housing
Trust Fund; the dedication of a 4-acre Public Civic Site at Artistry Lakes; and the
dedication of a Right-of-Way and Utility Easement for the Okeechobee Boulevard
Extension.
Note: Both motions require a supermajority vote.
SUMMARY: On March 10, 2026, the Village adopted an ordinance annexing
approximately 446.14 acres of land, known as Artistry Lakes. The County objected
to the annexation because the annexation area does not meet the requirements of
Section 171.043, Florida Statutes. On March 26, 2026, the County passed a
resolution initiating the Conflict Resolution Procedures under Chapter 164. Florida
Statutes. On February 10, 2026, after discussions with the County, the Village
initiated the Interlocal Service Boundary Agreement (ISBA) process to negotiate
the terms under which the subject property and adjacent properties will be
annexed. The County adopted its responding resolution on February 26, 2026.
While the Village approved the ISBA, the Palm Beach County Board of County
Commissioners (BCC) denied it on August 26, 2026. On September 30th, 2026
the County Administrator and the Village Manager met per Ch. 164 Conflict
Resolution Proceedings. Both the County Administrator and the Village Manager
agreed to bring the ILA to their respective governing bodies. The County also
agreed to bring the PBA to the BCC at the same time as the ILA. The Village
Council approved the ILA on October 13, 2026. The County Commission will now
consider the ILA and PBA. The proposed ILA and PBA contain several conditions,
including: the developer’s contribution of $1 million to the Village and $2 million to
the County to support workforce housing; a density limit of 1.4 units per acre; the
dedication of a 4-acre Public Civic Site at Artistry Lakes; and the dedication of a
Right-of-Way and Utility Easement for the Okeechobee Boulevard Extension. The
motions will require a supermajority vote of the BCC because they involve land
acquisition and are therefore subject to Section 22-106 of the Palm Beach County
Code of Ordinances. District 6 (DL)

MOTION (cont’d.):

II) approve a Letter Agreement (Hotel 1) between the County, CityPlace Hotel,
Related Companies, Seller and BDT & MSD RSLP Lending C, LLC, a Delaware
limited liability company (CityPlace Hotel’s lender);

JJ) approve a Letter Agreement (Hotel 2) between the County, Seller and CityPlace
Hotel;
The approval of this agenda item by the Board of County Commissioners (BCC)
constitutes its independent authorization of the transaction approved in Agenda
Item 3C-1 and supersedes the agreements, and related budget items, previously
approved by the BCC on September 29, 2026, which agreements were executed
by the Mayor on October 1, 2026. SUMMARY: On February 3, 2026, the Board
of County Commissioners (BCC) directed staff to continue negotiations with
Related Ross, LLC (Related) on a second hotel to support and complement the
Palm Beach County Convention Center (Convention Center). This agenda item
presents a coordinated transaction to deliver additional hotel capacity, secure
room commitments for convention events, generate recurring County revenues,
and support the Convention Center’s existing operations and planned expansion.
The proposed transaction provides for development of Hotel 2. The hotel would
address a substantial portion of the projected need for 600 additional hotel rooms
serving an expanded Convention Center. A Related affiliate would be responsible
for financing, constructing and operating the hotel. The County would acquire the
completed hotel and land for $26,000,000, with the purchase price advanced
through deposits released to Seller to be used toward construction costs and
credited at closing. Upon acquisition, the County would lease the property back
for an initial 33-year term, with renewal options providing a potential total term of
97 years. The transaction combines County ownership with private hotel
operations and contractual commitments supporting the Convention Center. A
new Hotel 2 RBA, together with revisions to the existing Hotel 1 RBA, would
secure access to hotel rooms for scheduled conventions, meetings and events
under negotiated booking and pricing provisions. These commitments are
intended to strengthen the County’s ability to attract and retain convention
business, accommodate larger events and increase use of the Convention
Center. The financial terms provide initial Hotel 2 annual base rent of $1,117,000
and combined initial annual parking rent of $708,000, totaling approximately
$1,825, 000 at initial contractual rates, with 3% annual increases. Actual receipts
are subject to the agreements’ commencement dates and the negotiated Hotel 2
base-rent deferral. Additional Hotel 2 participation rent equals 6% of gross annual
revenues above an initial $77,000,000 threshold, which increases 3% annually
and is subject to specified adjustments under the lease. Continued next page.

FACILITIES DEVELOPMENT & OPERATIONS

SUMMARY (cont’d.): The transaction is expected to support substantial private
investment, construction and ongoing hospitality employment, local contracting and
purchasing opportunities, and additional tourist development and sales tax revenues.
County ownership of the Hotel 2 Land, together with its continued private operation
under a long-term lease, will further these economic development objectives while
providing contractual hotel and parking revenues to the County. Collectively, these
benefits enhance economic activity, support private enterprise and employment, and
protect and strengthen the County’s investment in the Convention Center complex.
Staff recommends approval of the transaction and the associated implementation
authority, subject to the limitations described in the motions. The Property Review
Committee reviewed the acquisition on September 18, 2026, and recommended
approval without comment. The requested delegations permit execution of related
documents without materially changing the terms approved by the BCC. Detailed
transaction terms, financial considerations, County obligations and contractual
protections are provided in the Fiscal Impact Analysis and Background and Policy
Issues sections of this Agenda Item Summary. The Disclosures of Beneficial Interests
in Attachments 26 and 27 identify Stephen Ross and any other persons holding a five
percent (5%) or greater beneficial interest in Seller and CityPlace Hotel. Approval of
the PSA requires a Supermajority Vote (5 Commissioners). (FD&O
