Commissioner Davis asked for clarification on what we are paying, and he asked for details
about what the Extension Service does. Extension Agent Clark McAllister said the UGA
Extension Service has three main branches: Agricultural and Natural Resources, 4-H youth
programs, and family consumer sciences, which includes things like health education and
food preservation (which is not offered at our location). All of this information is
disseminated to the public, he explained. Commissioner Davis asked if anyone can call for
help, and he asked what kind of calls Mr. McAllister typically gets. Mr. McAllister said he
gets a lot of calls about tree consultations. Commissioner Davis asked what kind of degree
or specialty he has, and Mr. McAllister said he has a bachelor's degree in horticulture.
Commissioner Davis asked about the payment arrangement, and County Clerk Melissa
Witcher said for 2026, their total was $57,612, and we pay half of that. Commissioner
Moran asked if anyone at UGA was working on something for all the invasive Joro spiders,
and Mr. McAllister said UGA has entomologists investigating, but it is doubtful the Joros
can be eradicated easily. They are well-adapted to our area, and the young spiders spread
via web parachutes, enabling them to travel miles at a time.
Commissioner Mayfield said we have a great 4-H program that the kids love, and the
current Extension Office employee over 4-H has really energized it. Commissioner Greene
said the Wahsega 4-H facility is outstanding.

the County's accounting and financial software.
PUBLIC COMMENTS
Citizen Katherine James gave an update on her progress with a draft data center ordinance for the
Commissioners to consider. Ms. James said she has spoken extensively with data center experts
around the country during her research on the topic. One of the most important things she learned
is that fines are absolutely not a deterrent to data center developers because they include those
costs in their budgets, and it is better to have penalties such as business license revocation,
building permit revocation, or imprisonment. Ms. James said most of the concerns regarding data
centers revolve around noise, lighting, construction, environmental impacts, and
decommissioning. Additionally, data centers should be evaluated for how they can impact the
local water and power supply. She advised against providing data centers with tax abatements, and
said the data centers should be paying the county instead. In Effingham County, for example, an
OpenAI data center provided the county with $80 million dollars.
Ms. James said there have been instances of data center developers getting officials to sign
nondisclosure agreements, but these were found to be unlawful because they go against open
record laws. She said any ordinances must have teeth because we cannot expect these developers
to self-regulate in the spirit of being "neighborly." Ms. James said she is not against data centers,
because when done correctly, they can be a great asset. If done incorrectly, that is when they can
become a nuisance. She encouraged the Board to adopt a thorough data center ordinance so we
will be prepared.
Chairman Stringer said ACCG had a panel on data centers at a recent training, and it seems to be
split 50/50 on whether they are bad or good. It can be greatly beneficial if done right. He said
there was a county that was able to do away with all of its taxes because of the income from data
centers. Commissioner Mayfield thanked Ms. James for her extensive work on this draft
ordinance, and he expressed thanks to Mr. Melvin Turner for providing an example ordinance
from Union County. Commissioner Mayfield said he believes in government transparency, so he
will never sign a nondisclosure agreement from a data center developer. He said we need to be
prepared for these big city lawyers so they do not take advantage of us, but data centers in general
are making great strides and could be beneficial. Commissioner Mayfield said China has been
purposefully pushing anti-data center viewpoints so they could get ahead of us in the AI race.
Citizen Thomas Johnson made some comments about Flock cameras. As a libertarian
conservative, Mr. Johnson said he is tired of the government intruding on the privacy of the
people. He said the misidentification rate of every license plate is 7%, and there have been at least
two cases of wrongfully identified individuals being held at gunpoint by police. Mr. Johnson said
he is worried about the health and safety of the citizens. Commissioner Davis asked where he got
the 7% statistic from, and Mr. Johnson said he believes that number came directly from Flock.

CALL TO ORDER
The meeting was called to order at 9:04 pm. Present were Chairman Rhett Stringer and
Commissioners Tucker Greene, Bobby Mayfield, Nathan Davis, and Jeff Moran.
CONSIDERATION OF AGENDA
Motion: Commissioner Greene moved to approve the agenda and was seconded by
Commissioner Mayfield. The motion was approved unanimously.
RESOLUTIONS
1.
2026-58 Resolution Establishing an Internal Financial Controls and Access Policy
Motion: Commissioner Mayfield moved to approve the resolution and was seconded by
Commissioner Moran. Commissioners Greene, Mayfield, and Moran were in favor of the
motion. Commissioner Davis was opposed. The motion carried.
Commissioner Davis asked the County Attorney if she knew who drafted this resolution,
and if she had reviewed it. Ms. Edelberg said she drafted the resolution. Commissioner
Davis asked if AI was used, and Ms. Edelberg said AI was used to review the policy and
examples from other policies were consulted. Commissioner Davis asked if this resolution
conflicted with our enabling legislation (SB 58), and Ms. Edelberg said she does not think
it conflicts. Commissioner Davis asked how does it not conflict? In his opinion, this
resolution is dead on arrival because County commissioners cannot abdicate their authority
to staff members.
Commissioner Moran, addressing Commissioner Davis, said he has been provided with
every bit of the County budget he requested. Just because the information is too large or
too cumbersome does not give Commissioner Davis the right to access the financial
software. Commissioner Davis said he has been denied read-only access to our software,
though the software does allow for read-only access. He said the 46,000 line file he
received would barely open on his computer, and he should be able to do what the law
allows. Commissioner Moran said Commissioner Davis has been given the exact same data
as everyone else. Commissioner Moran said when he and Commissioner Davis spoke,
Commissioner Davis said he wanted to put some numbers in Excel to do pivot tables, and
that is what he did. Commissioner Davis said the financial sample data he was given by the
Finance Department did not work for what he wanted.

c/o Rhett Stringer – Canoe Launch Sublease Renewal (County Clerk
Melissa Witcher)
Item Description:
Recommendation on renewing contract with Chestatee River
Adventures for use of the Chestatee River Access Park.
Facts & Historical
Information:
In 2009, the Chestatee River Access Park was opened to the public. In
February 2012, Halls Mill Enterprises LLC, doing business as Chestatee
River Adventures and represented by Rhett Stringer, entered into a
contract with Lumpkin County for the launch and pickup of watercraft
and parties using the river for recreational purposes. The annual contract
amount was set at $4,000, payable in either cash or in-kind
improvements to the park. The contract has been renewed annually, with
the contract amount historically covered by in-kind services.
In 2016, the Board of Commissioners voted not to require
documentation of the value of in-kind services provided by the lessee.
However, in 2017, the Corps of Engineers notified staff of the necessity
for documentation of the value of in-kind services for inclusion in the
annual report on the Chestatee River Access Park. Since then, the
contractor has consistently provided this documentation.
Potential Courses of
Action:
A) Renew the contract with Chestatee River Adventures.
B) Do not renew contract
Budget Impact:
A) In accordance with the County’s contract with the Corps of
Engineers, all revenue generated by this contract must be spent on the
maintenance and improvements of the park. The in-kind work done by
the lessee reduces the amount of funds the County spends to maintain
the park.
B) Not renewing the contract will result in the county having to budget
for the maintenance of the area.

In 2009, the Chestatee River Access Park was opened to the public. On

The annual amount of the contract was $4,000, either in cash or in-kind
improvements to the park. Since that time, the contract has been
renewed each year, and the contract amount has been paid for by in-kind
work.
In 2016, the BOC voted not to require any documentation of the value of
in-kind services provided by the lessee. In 2017, the Corps of Engineers
informed staff that they required documentation of the in-kind service

2026-093 Classic Cleaners – 2027 Lease (County Clerk Melissa
Witcher)
Item Description:
Annual renewal of lease at 235 E. Main Street.
Facts & Historical
Information:
Lumpkin County acquired property located at 235 East Main Street in
1998. Without a formal plan for development, the County entered into a
lease agreement with Best Classic Cleaners, also known as Classic
Cleaners, which has remained the rent-paying tenant since the
commencement of the lease. The monthly rent was increased in 2017
from $1,250 to $1,500. This rental income is accounted for in the 2027
budget. Currently, there are no known issues with the tenant. The lease
agreement presented for consideration is a renewal of the previous
contract, with the only modification being the effective date.
Potential Courses of
Action:
A. The Board may approve the lease agreement as presented. The rent
was last increased in 2017, and no additional inquiries for use of this
space have been received.
B. The Board may direct staff to increase the rent in the lease agreement,
which could lead the tenant to decline lease renewal. Renovations would
be necessary before offering the facility on the open market.
C. The Board may choose not to renew the proposed lease agreement.
Absence of formal plans for the surrounding land indicates that losing
this tenant would be unfavorable and negatively affect the revenue
stream in the 2027 budget.
Budget Impact:
There is no negative impact to the budget if the contract is renewed at
the current monthly lease amount.
Staff
Recommentation:
The recommendation of staff is to renew the contract.

STATE OF GEORGIA
COUNTY OF LUMPKIN
COMMERCIAL LEASE
CLASSIC CLEANERS - 2027
This lease is made and entered into by and between LUMPKIN COUNTY, a political
subdivision of the State of Georgia (herein referred to as "Lessor") and BEST CLASSIC
CLEANERS, LLC, (hereinafter referred to as "Lessee"), jointly referred to herein as the
"Parties".
WITNESSETH:
WHEREAS, Pursuant to Lumpkin County Resolution 98-22, Lessor purchased 8.74 acres
for use in connection with various future Lumpkin County purposes, upon which was, and is,
located a commercial building that was, and is, being leased by Lessee in connection with
Lessee's laundry and dry cleaning business, said commercial building being located at, and more
fully described as, 235 East Main Street, Dahlonega, Georgia, (hereinafter being referred to as
the "Property" or "Premises"), and
WHEREAS, Lessor has not yet determined the best use of the property for county
purposes and has not yet developed a comprehensive plan for county use of the property, and
WHEREAS, Lessor is in need of said property being maintained for future use in
connection with county purposes until Lessor determines the best county use of the property, and
WHEREAS, Lessee is desirous of continuing to lease the premises for continued use in
connection with Lessee's laundry and dry cleaning business, and
WHEREAS, Lessor, as governing authority of Lumpkin County, has determined that it is
in the best interest of Lumpkin County to lease the premises to Lessee under the conditions
herein, and
WHEREAS, the parties are desirous of entering into this Agreement according to and
subject to the terms, conditions and provisions hereinafter set forth;
NOW THEREFORE, for and in consideration of the covenants, agreements and premises
herein contained, LESSOR and LESSEE intending to be legally bound hereby, do covenant and
agree as follows:
1. Term of Lease. Lessor hereby leases and grants to Lessee use of the Property for a term of
twelve (12) months beginning January 1, 2027 and expiring December 31, 2027, subject to the
terms, conditions and provisions set out herein.
As governing authority of Lumpkin County, and upon a determination by resolution of
the governing authority of Lumpkin County that a public need for the facility exists, Lessor
retains the right, power and authority to terminate this agreement upon thirty days’ notice, and
Lessee agrees, as a bargained consideration of the lease, that Lessee does hereby waive any
claim for damages arising from such early termination. In the event of such notice, Lessee shall
be responsible for removing all equipment, fixtures and operational residue from the premises
within thirty days of receiving such notice. Such notice may be by personal service or by
“tacking” to the door of the premises.
2. Rent. Lessee shall pay to Lessor the amount of One Thousand Five Hundred and no/100s
Dollars ($1,500.00) per month as rent for the use of the property. In further consideration for said
lease and use agreement, Lessee shall maintain the Property as set out herein.
3. Use of Premises. The Parties agree that the Property shall be used only as a laundry and dry
cleaner business and associated purposes. In the event that the Property is no longer used for
such purposes, Lessor is authorized, but is not required, to terminate this lease agreement upon
10 days’ notice to Lessee.
4. Maintenance/Repairs. Lessee shall maintain the premises in good, clean, attractive and safe
condition, including but not limited to windows and glass, electrical wiring, plumbing, heating
and cooling installations and all other systems and equipment upon the premises, and shall
surrender the same at termination hereof, in as good condition as received. Lessee shall be
responsible for all repairs required in order to maintain the premises in their present condition.
Lessor shall not be responsible for making any repairs to the Premises.
5. Utilities. All applications and connections for necessary utility services on the demised
premises shall be made in the name of Lessee only, and Lessee shall be solely liable for utility
charges as they become due, including but not limited to those for sewer, water, gas, electricity,
and telephone services.
6. Entry and Inspection. Lessee shall permit Lessor or Lessor's agents to enter upon the
premises at reasonable times and upon reasonable notice, for the purpose of inspecting the same,
and will permit Lessor at any time within sixty (60) days prior to the expiration of this lease, to
place upon the premises any usual "To Let" or "For Lease" signs, and permit persons desiring to
lease the same to inspect the premises thereafter.
7. Alterations/Improvements. Lessee may make alterations, additions, or improvements in, to
or about the premises only with the prior written approval of Lessor. Lessor may make necessary
alterations, additions, improvements or repairs in, to or about the premises so long as Lessee's
business operations are not unreasonably impaired. Costs of alterations, additions, or
improvements shall be the responsibility of the party making such alterations, additions, or
improvements unless otherwise agreed to in writing by the parties.
8. Ordinances and Statutes. Lessee shall comply with all statutes, ordinances and requirements
of all municipal, state and federal authorities now in force, or which may hereafter be in force,
pertaining to the premises, occasioned by or affecting the use thereof by Lessee.
9. Assignment and Subletting. Lessee shall not assign this lease or sublet any portion of the
premises without prior written consent of the Lessor. Any such assignment or subletting without
consent shall be void and, at the option of the Lessor, may terminate this lease immediately.
10. Indemnification of Lessor. Lessor shall not be liable for any damage or injury to Lessee, or
any other person, or to any property, occurring on the demised premises or any part thereof, and
Lessee agrees to indemnify and hold Lessor harmless from any claim for such damages, no
matter how caused.
11. Insurance. Lessee shall maintain reasonably adequate property damage insurance and
liability insurance with a minimum coverage for bodily injury in the amount of $500,000.00 and
for real property damage in the amount of $500,000.00. Lessee shall provide Lessor with a
Certificate of Insurance showing Lessor as the beneficiary as to any real property damage and as
an additional insured as to all other damage. The Certificate shall provide for a ten-day written
notice to Lessor in the event of cancellation or material change of coverage.
12. Taxes. Lessor is exempt from the obligation of ad valorem taxes on the property. In the event
that any tax obligation arises on the property, then Lessee shall be responsible for payment of
such tax obligation.
13. Destruction of Premises. In the event of the destruction of a significant portion of the
premises during the term hereof, from any cause, Lessor shall have the option of repairing the
same or terminating this lease for the complete removal of the remaining structure. If Lessor
does not begin repairing the premises within 30 days, Lessee shall have the right to terminate this
lease. Lessee shall be entitled to a proportionate reduction of rent while such repairs are being
made, based upon the extent to which the making of such repairs shall interfere with the business
of Lessee on the premises. If such repairs cannot be made within said sixty (60) days, Lessor, at
its option, may make the same within a reasonable time, this lease continuing in effect with the
rent proportionately abated as aforesaid, and in the event that Lessor shall not elect to make such
repairs which cannot be made within sixty (60) days, this lease may be terminated at the option
of either party.
14. Lessor's Remedies on Default. If Lessee defaults in the performance of any of the
covenants or conditions hereof, Lessor may give Lessee notice of such default and if Lessee does
not cure any such default within 30 days, after the giving of such notice (or if such other default
is of such nature that it cannot be completely cured within such period, if Lessee does not
commence such curing within such 30 days and thereafter proceed with reasonable diligence and
in good faith to cure such default), then Lessor is not required to, but may at its option terminate
this lease on not less than 20 days' notice to Lessee. On the date specified in such notice the term
of this lease shall terminate, and Lessee shall then quit and surrender the premises to Lessor, but
Lessee shall remain liable as hereinafter provided. If this lease shall have been so terminated by
Page 58 of 87
Lessor, Lessor may at any time thereafter resume possession of the premises by any lawful
means and remove Lessee or other occupants and their effects. No failure to enforce any term
shall be deemed a waiver.
15. Security Deposit. Lessee shall not be required to deposit with Lessor a security deposit for
the performance of Lessee's obligations under this lease.
16. Attorney's Fees. In case suit should be brought for recovery of the premises, or for any sum
due hereunder, or because of any act which may arise out of the possession of the premises, by
either party, the prevailing party shall be entitled to all costs incurred in connection with such
action, including a reasonable attorney's fee.
17. Notices. Any notice which either party may, or is required to give, shall be given by mailing
the same, postage prepaid, to Lessee at the premises, or to Lessor at: Lumpkin County Board of
Commissioners, 99 Courthouse Hill, Suite H, Dahlonega, Georgia 30533, or at such other places
as may be designated by the parties from time to time, except such notice by “tacking” as is
hereinabove provided.
18. Heirs, Assigns, Successors. This lease is binding upon and inures to the benefit of the heirs,
assigns and successors in interest to the parties.
19. Subordination. This lease is and shall be subordinated to all existing and future liens and
encumbrances against the property.
20. Entire Agreement. The foregoing constitutes the entire agreement between the parties and
may be modified only by a writing signed by both parties.

2026-094 Request to Consider First Responder PTSD Insurance
(Community & Employee Services Director Alicia Davis)
Item Description:
PTSD Supplemental Insurance
Facts & Historical
Information:
Effective January 1, 2025, the Ashley Wilson Act (HB 451) requires all
public entities in Georgia to offer a supplemental benefit program for
eligible first responders diagnosed with post-traumatic stress disorder
(PTSD) resulting from exposure to line of duty traumatic events. It
provides a financial safety net to assist with uninsured costs associated
with PTSD treatment and recovery. A first responder may access the
benefits quickly and confidentially to reduce worry over stigma or job
loss. The Act does not impact employer health plans, which provide
coverage for PTSD and other mental health conditions.
First responder occupations covered under the Act that are applicable to
Lumpkin County include:
• Communications Officer
• Law Enforcement Officer
- Emergency Medical Professional
• Firefighter
• Jail Officer
• Emergency Medical Technician
The Act requires two once-per-lifetime benefits.
1. The first is a $3,000 lump-sum benefit paid following diagnosis
of occupational PTSD by a qualified diagnostician.
2. The second is a long-term disability benefit if the eligible first
responder is no longer able to perform their duties as a first
responder due to their PTSD diagnosis. The disability benefit
begins 90 days following a first responder’s inability to continue
regular occupational or volunteer duties as a first responder due

to the covered occupational or volunteer duties as a first
responder due to the covered condition, despite receipt of
appropriate treatment.
• The disability benefit is paid monthly for up to 36 months.
- Paid first responders receive 60% of their monthly pay to a maximum
of $5,000 per month.
- Volunteer first responders receive $1,500 per month.
Since the inception of this requirement, the Board has elected to use
ACCG PTSD insurance offered through MetLife, which has seemed to
work well.
Potential Courses of
Action:
A. Approve the purchase of the minimum required level of coverage
from ACCG/Metlife at a cost of $28,920.00 (billed semi-annually.)
B. Choose not to accept this proposal.
Budget Impact:

safety compliance, and cost-effective maintenance of the Tek84

David Wimpy)
Item Description:
This is an annual agreement to provide maintenance for the cardiac heart
monitors that the Emergency Services Department owns.
Facts & Historical
Information:
This agreement is an ongoing operating budget item that provides the
necessary maintenance and certification of our vital Cardiac Heart
monitors that we carry on our emergency vehicles. The agreement
provides for fast and efficient maintenance and repairs when we have
any issues with any of the equipment. If any of the equipment has an
issue and it cannot be fixed on site, they will provide us with a
replacement until it is repaired. This agreement also provides 1 in-house
preventive maintenance service during the year to make sure the
equipment is re-certified and to catch and fix any issues that may occur.
Potential Courses of
Action:
A. Complete and submit the maintenance agreement for approval and
continue to receive coverage in the event that one of the pieces of
equipment fails.
B. Do not renew the agreement and take the risk of one of the pieces of
equipment failing and costing more than the agreement to fix.
Budget Impact:
There is no budget impact, as the agreement is already included in the
department's yearly budget and operating costs.
Staff
Recommentation:
The recommendation of staff is to approve the agreement to continue
seamless coverage for our equipment in the event of failure during the
upcoming year.

2026-097 Liquid Storage Tanks for Brine System Bid Award - Tank
Depot (Public Works Director Chris Thomas) Ratify
Item Description:
Bid Award for the Liquid Storage Tanks for the Brine System
Facts & Historical
Information:
The Board of Commissioners previously approved the purchase and
funding of a brine system for installation in 2026. Following this
approval, staff began procuring the necessary components for the
system, including the liquid storage tanks required for its operation.
In accordance with the County’s Purchasing Policy, an Invitation to Bid
for the storage tanks was issued on September 16, 2026. After receiving
no responsive bids, the County reissued the solicitation on October 7,
2026, with bids due October 15, 2026.
The County received three responsive bids, with Tank Depot submitting
the lowest bid in the amount of $35,805.50.
The project is funded through TSPLOST, and the proposed purchase is
within the previously approved project budget. Therefore, no additional
funding is required.
The anticipated lead time for delivery of the tanks is four to six weeks.
Timely approval will help ensure the system is installed and operational
in preparation for winter weather.
Potential Courses of
Action:
A. Award the Bid to Tank Depot: Approve the purchase of the liquid
storage tanks from Tank Depot for the brine system. This will allow
staff to proceed with completing the installation and preparing the
system for operation ahead of the upcoming winter weather season.
B. Do Not Award the Bid: Decline to award the bid to Tank Depot.
Without the required liquid storage tanks, staff will be unable to
complete the installation, and the brine system will not be operational
for the upcoming winter weather season.
C. Rebid the Liquid Storage Tanks: Direct staff to reissue the
Invitation to Bid for the liquid storage tanks. This would delay

procurement and installation, preventing the brine system from being
completed and operational in time for the upcoming winter weather
season.
Budget Impact:

2026-098 Legacy Link, Inc. SFY 2027 Contract (Senior Life Enrichment
Center Manager Marc Bottoms)
Item Description:
CONTRACT FOR SERVICES – SFY 2027 Lumpkin County Board
of Commissioners will consider entering into a contract with Legacy
Link, Inc. for the Lumpkin County Senior Life Enrichment Center to
provide nutrition and wellness services, nutrition screening and support
services for senior adults in Lumpkin County.
Facts & Historical
Information:
Lumpkin County’s senior program was created over thirty years ago.
The Center has been operating for many years with services that are
centered on traditional programming such as nutrition which includes
home-delivered and congregate meals, social and wellness activities.
These programs were created for older adults to age in place in their
communities. Clients receiving meal services are older adults who tend
to be isolated, often experiencing chronic health and mobility issues.
These programs will always remain the core of the Lumpkin County
Senior Life Enrichment Center.
Historically, funding for the Lumpkin County
Senior Life Enrichment Center (including cost of
meals and operation of the Center) has largely
been from federal grants appropriated through the
Older Americans Act enacted in 1965, state grants
and local sources. Legacy Link, Inc. is the Area
Agency on Aging that administers federal and
state funding allocations for the region that
includes Lumpkin County.
For SFY 2027 (July 1, 2026 – June 30, 2027), it is
requested that the Lumpkin County Board of
Commissioners consider entering into a contract

with Legacy Link, Inc. for the Lumpkin County
Senior Life Enrichment Center to provide
nutrition and wellness services, nutrition
screening and support services for senior adults in
Lumpkin County.
Lumpkin County Senior Life Enrichment Center
is contracting to provide 6,000 congregate meals,
28,600 home delivered meals, 2,900 wellness
units, and 1,500 units of transportation services.
Note that these transportation units were approved
by the Department of Aging Services prior to the
center’s restructuring of services in which daily
transportation routes ended effective 9-14-26.
Once the DAS approves Legacy Link’s revision,
there will be an amendment forthcoming to reflect
the changes, which will reduce transportation
from 1,500 units to 914 units.
Potential Courses of
Action:
A. Submit an approved and signed contract.
B. Do not submit an approved and signed contract.
Budget Impact:
This contract provides for a total of $178,215 in revenue from federal
and state funds. The County cash match is $16,000. The Board of
Commissioners has already approved the cash match portion of this at
the March 2026 meeting. The revenue and match expense are included
in the 2026 budget and has been included in the 2027 budget.
Staff
Recommentation:
It is recommended that the approved and signed contract be submitted to
Legacy Link, Inc. Federal and state funds are necessary to continue to
meet the needs of senior adults in Lumpkin County.
