October 23, 2026
Kasey Mitchell, City Manager
Mayor & Council
Council Meeting of Monday October 26, 2026
REGULAR MEETING AT 7:00 P.M.
City Manager –
Mobile Home Parks
The Sheriff’s Sale for the Mobile Home Parks was held Tuesday October 20th. Attorney Lessard was
present and placed the bid for the City. We were the only bidder. The hearing to confirm the sale has
been set for November 5th. After the Order is entered, we then have to wait 30 days at which time we can
request issuance of the Sheriff’s Deed that will then need to be recorded with the County.
IHDA Housing Survey
Kathleen Weber and Amy Vashti, our IHDA representative, will be attending the Enchanted Pumpkin
Festival Saturday in hopes connecting with community members about our housing needs and
possibilities. Be sure to stop by and see them while you are at the event.
Halloween
Halloween hours will be 5-7pm on Saturday October 31st. Public Works will deliver barricades to the busy
areas and the Police Department will be staged around town to make sure everyone stays safe while
Trick-or-Treating.
Public Works –
Downtown RDMS Update
Ameren is set to start removing poles Tuesday. A progress meeting was held October 21. The project is
on schedule and will keep progressing as weather permits, or until the week before Thanksgiving.
Elm St Update
Elm Street is substantially complete. The trees were removed, and the asphalt is done. The last items are
boxing in a manhole with concrete and reseeding the disturbed green space. The road stays closed until
October 28.
South Street Resurfacing
Replacement stop signs and street name signs at the side streets were added to the project. Hutchison
sent the IDOT paperwork for the City’s signature October 21.
Lake Street Safe Routes to School, Second Phase
Page 1 of 4
IDOT and FHWA held the project kickoff October 14. The target is IDOT’s April 2027 letting. The design
agreement with Hutchison is on the October 26 agenda.
Parkside Apartments Sidewalk, 125 N Chestnut
Hutchison’s preliminary estimate to replace the sidewalk on the Chestnut and 2nd Street sides,
including the vault under the north sidewalk and new lighting, is $412,202.50. The item is on the October
26 agenda as a discussion of funding the work through the Downtown TIF.
IL 81 Water Main
The City’s engineer and IDOT’s construction team confirmed the water main alignment, which keeps the
required separation from the new road underdrains. Water main construction has not started yet.
WWTP Improvements: IEPA Funding
CMT submitted the funding nomination form to IEPA on October 22, and IEPA confirmed receipt.
Source Water Improvements: State Loan Application
The City answered the loan program’s finance questions October 15. The application is due October 31.
North Water Plant: Reverse Osmosis Unit 1
Harn R/O Systems is scheduled to start replacing the membranes and filters in reverse osmosis unit 1 on
October 26.
Lead Service Line Replacement, Phase 1
CMT kicked off the first phase, about 400 lines, at the start of October. The City provided its GIS utility
atlas for CMT’s design drawings.
WWTP Lab HVAC
Demolition is done. The contractor repaired the missing ceiling insulation, has more than half of the new
ceiling installed, and is working in the attic on the east side of the building.
Tree Removal Grant
The City was awarded a $30,000 Illinois Community Canopy tree removal grant through Trees Forever.
Police Department –
Training
Detectives attended the Northwest ICAC and Technology Conference, which provided specialized
training in child exploitation, human trafficking, digital evidence, and emerging investigative techniques.
Braveheart Advocacy covered registration, lodging, and rental vehicle expenses, while Delta Air Lines
donated airfare. The City’s expenses were limited to meals and airport parking.
Detectives also attended a two-day Homicide Conference in Itasca. The Black Hawk Area Task Force
covered registration fees, while the City paid for lodging and meals. The training provided practical
instruction on current homicide investigative techniques, case management, and real-world case
studies.
Within the Patrol Division, one officer completed Advanced Roadside Impaired Driving Enforcement
(ARIDE) training, which enhances an officer’s ability to recognize drivers impaired by drugs, alcohol, or a
combination of substances. Several officers also attended financial literacy training, and all department
Page 2 of 4
sergeants continue to participate in weekly Supervisory Leadership training focused on leadership,
personnel management, communication, decision-making, and accountability.
Tactical Training
Experienced tactical officers from area agencies developed and conducted a local SWAT training school
covering tactical movement, team coordination, room clearing, and critical-incident response. With
several traditional regional tactical schools no longer available, opportunities for this type of training
near Kewanee have become increasingly limited.
The Department’s goal is to have every officer trained in the same fundamental tactical methods so
personnel can move safely, correctly, and cohesively during critical incidents, regardless of whether they
are members of the County SWAT Team. This training complements the Department’s ongoing activeshooter and room-clearing training, including department-wide active-shooter training conducted at a
local school this summer.
ProPhoenix Implementation
ProPhoenix is now operational at the Kewanee Police Department. The implementation has been a
lengthy process involving significant planning, configuration, data conversion, and training. The new
CAD/RMS platform modernizes the Department’s records and dispatch capabilities while bringing KPD
and participating local agencies onto a more current and integrated public-safety technology platform.
The system will improve information sharing, reporting, and overall efficiency between local agencies.
KPD Safe Return Program
The Chief has been working with Kathleen to identify and secure grant funding for the development of the
KPD Safe Return Program. The program is intended to assist individuals who may be at increased risk of
becoming lost or wandering, including children and adults with special needs, non-verbal individuals,
and elderly residents with dementia, Alzheimer’s disease, or other cognitive impairments. The program
will include voluntary registration, identification and safety resources, and equipment to assist officers in
safely returning participating individuals to their families or caregivers.
Employee Wellness Grant
Deputy Chief Minx worked with Kathleen and the Kewanee Fire Department to secure a $47,000 grant to
update the City’s weight room and employee exercise area. The improvements will provide employees
with safer, more functional fitness equipment and expanded opportunities to maintain their physical
health.
Regular physical activity can support cardiovascular health, strength, injury prevention, stress
management, and overall wellness. These improvements are especially beneficial for police, fire, and
other City employees whose positions may involve physically demanding or high-stress work, while also
providing a wellness resource available to City staff.
Community Development Woller Building
Abandoned Woller Office at 211 W 1st St. Property has been sold and new owner will be making repairs.
He plans to use the building as an office for his electrical contracting and mowing business.
IHDA SCP Grant
We have used and received all funds from the IHDA Strong Communities Program Round 2 grant. Total
funds received over the grant period was $201,000.00. Over the grant period (October 2023 to present)
we demolished 20 houses.
Sidewalks
Sidewalk Reimbursement Program has been getting a lot of use. We have used $8695 of the budgeted
$15000 this fiscal year. There’s an additional $3710 of sidewalk projects that are waiting completion.

The October 13th, 2026, Council Meeting was called to order at 7:00pm in the Council Chambers.
Councilmembers Colomer, Cernovich, Baker, and Komnick were present, along with Mayor Moore who ran
the meeting. City Attorney Zac Lessard, City Clerk Jules Smith, and City Manager Kasey Mitchell were also
present.
The Pledge of Allegiance was recited, followed by a moment of silence for our troops.
The Consent Agenda was presented with the following items:
A. Minutes from the Council Meetings on September 28th, 2026.
B. Payroll for the pay period October 3rd in the amount of $267,088.57.
C. Staff Reports
D. Enchanted Pumpkin Festival Street Closure
A motion to approve the consent agenda was made by Councilman Baker and seconded by Councilman
Colomer. Motion passed 5-0.
Bills for the October 13th Council Meeting were presented in the amount of $1,745,272.89. A motion to
approve was made by Councilman Komnick and seconded by Councilman Cernovich. Discussion: None.
Motion passed 5-0.
Public Comments:
Levi Schwigen brought up the question of adding a birthing center at the Henry/Stark County Health
Department- Kasey Mitchell said she was not sure they had the abilities to provide a service as such, but she
would reach out. Mayor Moore stated there was not much we could do to actually influence anyone to add
a birthing center to their facility, but he could try attending the board meetings for the locations he wishes
would add one. Kasey gave Levi dates for the HSHD meetings, so he can attend.
Pawel Nowak, a developer, brought the idea of a 10-megawatt edge data center at 324 N Main St. The
Council had questions on some of the specifics and the benefits, and Nowak provided answers regarding
size & energy, water usage, increase in power and monetary concerns, and much more. Nowak made sure
to mention the noise would not be a concern and that they are planning to bring retail and more job
opportunities to the City. Council also stated there would be pushback from the community, so he would
have to bring a great proposal that not only shows the center would do no harm but would also bring great
benefits to Kewanee. We added data centers to the discussion section for the next Council meeting and
invited Pawel back to bring more information in two weeks.
Gary Bradley came to remind the Council they do not have to own the mobile homes before they start
moving forward on the planning process- any time is fine.
Old Business:
a) Ameren Agreement
Discussion: Kasey read through questions she had prepared for the Ameren Agreement that was
previously tabled. Council appreciated and approved of her questions, and then asked if she could
send the questions over to them for reference- she said she would do that. Council asked if they had
Page 1 of 4
a program manager or contact person, and Kasey said there is a Community Relations contact or an
engineer they could get ahold of. Kasey told Council to let her know if they had anything specific
they wanted touched on- she would keep Ameren informed. We are keeping the Ameren agreement
on the agenda until the details are finalized.
New Business:
A. Head Start Alley Closure
A motion to approve was made by Councilman Komnick and seconded by Councilman Baker.
Discussion: Kasey has been in contact with the Director of Head Start- they requested to close the
alley by Central School for a Trunk or Treat event in their parking lot area (the timing will overlap the
time Central School gets out for the day). Council asked if any residents would be impeded- there
would be no issues with this. Motion passed 5-0.
B. Bill 26-85: Resolution authorizing an Intergovernmental Agreement for Participation in the Illinois
Public Works Mutual Aid Network and authorizing the City Manager to execute.
A motion to approve was made by Councilman Colomer and seconded by Councilman Cernovich.
Discussion: Council said the dues are not a huge amount, but they were concerned what would
happen if we did have a callout. Kasey said we can say no at any time, but we would be on the hook
for costs if that was the case. Council asked Chris Berry, Director of Public Works, what his concerns
were and reasons he believes we should not do this. Chris stated he sees little reason not to, just
that historically we have not done it before. He believes there are much more benefits than
downsides. Council questioned a few stipulations and concerns of IPWMAN, and Chris assisted in
explaining the details. Mayor Moore, along with Council, decided it would be smart to rope in the
Union, as they want them to be brought in on the discussion. Council does not want to take any jobs
from the Union, as well. Council decided to TABLE until the Union is brought into the discussion and
given the information provided at the meeting. Councilmembers Colomer and Cernovich rescinded
original motions respectfully. A motion to TABLE was made by Councilman Komnick and seconded by
Councilman Baker. Motion to TABLE passed 5-0.
C. Bill 26-86: Resolution authorizing the City Manager to execute an engagement letter with Bernardi
Securities, Inc. for underwriting or placement agent services in connection with the proposed issuance
of general obligation bonds.
A motion to approve was made by Councilman Baker and seconded by Councilman Komnick.
Discussion: Council asked who was most knowledgeable on this- important for us and folks at home
to know: we are not passing a bond with this; we are simply giving them the opportunity to develop
the framework. Kasey said this would allow Chris, Courtney, and herself to work with Bernardi
Securities to determine how much and how we can use the money (how much, interest rate, where
money is coming from, etc.)- also stated simply allowing us to set up the framework so we can bring
Council the next steps: Bond Issue Ordinance. This would be at next Council Meeting. Kasey went
through the process for this, including noting a hearing would be next. Council asked if we have
worked with Bernardi before- Kasey said yes, all of our bonds since 2012 (she believes). Mayor
Moore also said they are reputable based on his research. Council mentioned we have talked about
Page 2 of 4
pricing and familiarity; Kasey said we can hit a dollar cap, so anything over must be reevaluated and
get permission. Motion passed 5-0.
Council Communications:
Komnick: None.
Colomer: He mentioned the new restaurant, Il Piccolino Bistro, opening on Monday. He said the foods looks
great, and this restaurant is a great investment for the community and the city. Also pointed out it could fall
into the ITEP grant, as well. He said it is exciting to see what is going on downtown with all of the building and
construction going on, along with a thank you to everyone that was involved with the sidewalk project during
Hog Days weekend, as it went over well. Also questioned when the railroad closure would be reopened, as a
citizen reached out and asked him- Main Street should be done by end of the week.
Cernovich: He thanked Kasey for the memo she added to the packet for this meeting. He reminded everyone
to go and open the packet, read the information, understand, and take it in.- it is very valuable and
educational. He pointed out we have come a long way with our accountability and spending when it comes to
our bills- but says we need to really consider having some reports. Courtney Brunson, Director of Finance, said
she plans to have a Management Treasurer’s Report for Council to go over once a month at the meetings. She
also said pending on when we get all documentation, we should be good to go to start seeing reports by the
end of this month. He said he is a little concerned about where we are budgetarily and wants to check in as
soon as we can. Mayor Moore said this is the closest we have come to these reports in 8 years, so thank you.
Councilman Cernovich pointed out how the high and significant amount of projects that have been kicked off
this year are underappreciated, so he said it is very appreciated and everything is looking wonderful.
Baker: He reminded the community that we are trying to make the city better, so take a pause when it comes
to complaints about redoing parking lots and sidewalks. He said it seems very underappreciated, and the
community needs to better understand that these things take time, and it is what the city wanted to make
strides towards improvement. He also pointed out the community needs to pull their information from better
resources, such as the Council meetings, instead of social media, as things are getting construed. He made a
remark that car washes use more water than data centers. Pull facts, be patient with us, and the City of
Kewanee is looking much better. Kasey also said she was on a webinar that said a family of 4 will use more
water than a data center would.
Mayor Communications: He received a lot of complaints/concerns going through Hog Days Weekend about
the construction on Main Street- said people need to understand there are several entities that are involved in
the timeline. Sometimes the schedule is going to be inconvenient, and we do not have a choice when it begins
and ends. He also congratulated both Wethersfield and Kewanee High Schools on their Homecoming Game
wins.

DMR Copy of Record
Form Approved OMB No. 2040-0004 expires on 07/31/2026
EPA may make all the information submitted through this form (including all attachments) available to the public without further notice to you. Do not use this online form to submit personal information (e.g., non-business cell phone number or non-business email address), confidential business
information (CBI), or if you intend to assert a CBI claim on any of the submitted information. Pursuant to 40 CFR 2.203(a), EPA is providing you with notice that all CBI claims must be asserted at the time of submission. EPA cannot accommodate a late CBI claim to cover previously submitted information
because efforts to protect the information are not administratively practicable since it may already be disclosed to the public. Although we do not foresee a need for persons to assert a claim of CBI based on the types of information requested in this form, if persons wish to assert a CBI claim we direct
submitters to contact the NPDES eReporting Help Desk for further guidance. Please note that EPA may contact you after you submit this report for more information.
This collection of information is approved by OMB under the Paperwork Reduction Act, 44 U.S.C. 3501 et seq. (OMB Control No. 2040-0004). Responses to this collection of information are mandatory in accordance with this permit and EPA NPDES regulations 40 CFR 122.41(l)(4)(i). An agency may not
conduct or sponsor, and a person is not required to respond to, a collection of information unless it displays a currently valid OMB control number. The public reporting and recordkeeping burden for this collection of information are estimated to average 2 hours per outfall. Send comments on the
Agency's need for this information, the accuracy of the provided burden estimates and any suggested methods for minimizing respondent burden to the Regulatory Support Division Director, U.S. Environmental Protection Agency (2821T), 1200 Pennsylvania Ave., NW, Washington, D.C. 20460. Include
the OMB control number in any correspondence. Do not send the completed form to this address.

CITY OF KEWANEE
CITY COUNCIL AGENDA ITEM
MEETING DATE
October 26, 2026
RESOLUTION OR
ORDINANCE NUMBER
Completed by City Clerk
AGENDA TITLE
Resolution Authorizing an Agreement with the Lowest
Responsible Energy Supplier for the Purchase of
Electrical Energy for City of Kewanee Facilities
Starting January 2027
REQUESTING
DEPARTMENT
Public Works
PRESENTER
Chris Berry, Public Works Director
FISCAL INFORMATION
Cost as
recommended:
About $555,000 to $620,000
a year at Round 1 prices,
depending on the supplier,
for about 6 million kilowatthours. This is the full supply
bill, including capacity and
transmission. The current
contract runs about
$515,000 a year.
Budget Line Item:
Utilities lines in the Water,
Sewer and General funds,
plus Francis Park and the
Cemetery.
Balance Available
About $294,000 left on those
lines for the rest of this fiscal
year (as of October 21,
2026). These lines pay for all
utilities, not only electricity.
New Appropriation
Required:
No. The new contract starts
in January 2027, so only four
months fall in this fiscal year.
Next year's budget will be
set at the new price. The
General Fund and water
plant utility lines are already
running ahead of budget and
may need an adjustment at
year end either way.
PURPOSE
To authorize the City Manager to sign a retail electric
supply agreement with the lowest responsible
supplier, for the rate and term that represent the best
value, on the day final pricing is received.
BACKGROUND
The City buys electric supply for its Ameren Illinois
accounts from a retail supplier; Ameren continues to
deliver the power. The current ENGIE Resources
agreement (5.714 cents per kilowatt-hour) ends with
the December 2026 meter read.
The City’s energy consultant, E-Quantum Consulting
(Michael Ellis), received Round 1 offers on October
13, 2026 from four suppliers. Lowest offers, all from
Dynegy: 6.402 cents (12 months), 6.598 cents (24
months), 6.787 cents (36 months).
SPECIAL NOTES
Offers are priced on the daily wholesale market and
must be accepted the same day, before 3:00 p.m.
Central, so the final price cannot be known when
Council meets. Staff will request final pricing as soon
as possible after Council action.
Capacity and transmission are passed through at
MISO and Ameren rates under every offer.
ANALYSIS
Staff intends to select a 24-month term. It costs 0.196
cents more than 12 months (about $11,760 per year)
and pays off if 12-month prices rise more than about
6 percent by late 2027; energy prices rose about 6
percent this year. A 36-month term needs about 9
percent annual increases against forecasts of lower
natural gas prices and a growing MISO capacity
surplus. 24 months gives budget certainty through
2028 without locking in 2029.
If final prices move materially from Round 1, staff will
report the result to Council.

Services with Hutchison Engineering, Inc. for Phase I
update and Phase II design engineering, Belle
Alexander Lake Street Sidewalk Expansion (Safe
Routes to School)
REQUESTING
DEPARTMENT
Public Works
PRESENTER
Chris Berry, Public Works Director
FISCAL INFORMATION
Cost as
recommended:
Not to exceed $34,697.00,
billed hourly. City funds.
Budget Line Item:
Road and sidewalk
improvements, Non-Home
Rule Sales Tax fund (31-71813).
Balance Available
None. This year's road and
sidewalk budget is already
committed to the Route 81
payment, the first Lake
Street sidewalk contract and
Elm Street.
New Appropriation
Required:
Yes. A budget amendment to
this line is needed and will
come to Council separately.
The fund balance covers it.
PURPOSE
To approve the design engineering agreement for the
Lake Street Safe Routes to School sidewalk so
design can begin and the project can make an April
2027 IDOT letting.
BACKGROUND
IDOT awarded the City $250,000 in Safe Routes to
School funds on May 29, 2026 for the Belle Alexander
Lake Street Sidewalk Expansion (CRTS-025-2002):
new sidewalk on the north side of Lake Street from
east of Kewanee Properties Mobile Home Park to
Manchester Drive. Hutchison Engineering completed
the original Phase I work for the project. At an IDOT
and FHWA coordination meeting on October 14,
IDOT offered an April 2027 letting and identified
Phase I environmental and documentation updates
needed before design moves forward. This is the
second Lake Street Safe Routes to School phase.
SPECIAL NOTES
Under IDOT's 2025 Safe Routes to School Funding
Guidelines, construction and construction engineering
are reimbursable; Phase I and Phase II engineering
are not, so this agreement is paid with City funds. The
$250,000 award is fixed and cannot be increased.
Construction engineering (Phase III) is not part of this
agreement and will come to Council separately once
the Phase II plans and updated construction estimate
are complete.
ANALYSIS
The agreement is hourly, not to exceed $34,697.00:
$27,197.00 for Phase II design and $7,500.00 for the
Phase I update and IDOT coordination. The scope
covers the environmental update, review of the prior
Phase I approvals, IDOT-format plans, specifications
and estimate, the retaining wall design, utility
coordination and letting support. The terms match the
City's Elm Street agreements with Hutchison.
Approval now keeps the April 2027 letting in reach,
with June 2027 as the fallback. Fund 31 has the
balance to cover the budget amendment. The City's
share of construction for this second Lake Street
phase comes with the April 2027 letting, in FY28.

Re: Belle Alexander Lake Street Sidewalk Expansion - SRTS Project CRTS-025-2002
Dear Chris:
Hutchison Engineering, Inc. is pleased to submit the enclosed Agreement for Professional Services and
Exhibit A for the next phase of the City of Kewanee Safe Routes to School improvements along Lake
Street for consideration. The project will extend the sidewalk improvements from east of the Kewanee
Properties Mobile Home Park to Manchester Drive.
The engineering fee is based on the estimate included with the grant materials and the additional Phase
I work identified during coordination with IDOT. The BDE 213 estimate included $27,197 for Preliminary
Engineering II. That estimate did not include additional Phase I engineering.
During the recent IDOT coordination, it was determined that additional Phase I environmental and
project documentation work is required to update the prior Phase I approvals and advance the project
into Phase II and ultimately to an IDOT letting. We have added $7,500 for this work, which includes the
required environmental update, review of the prior Phase I/PDR information, and the additional
coordination and submittals with IDOT District 2 and the Central Bureau of Local Roads and Streets.
Accordingly, the total not-to-exceed engineering fee for this agreement is $34,697.00, consisting of
$27,197.00 for Phase II design engineering and $7,500.00 for the additional Phase I update and IDOT
coordination. Phase III construction engineering is not included in this agreement.
We appreciate the opportunity to continue working with the City of Kewanee on this project. If you have
any questions, please contact me at (563) 650-7452 or [email protected].
Very truly yours,

calendar days of receipt of the invoice regardless of any funding reimbursement agreements the OWNER
may have with outside agencies.
Invoices not paid within thirty (30) days from the date of the invoice will be considered delinquent and
shall bear interest at the rate of 12% per annum from the date of invoice until fully paid and OWNER shall
be liable to CONSULTANT for any reasonable attorney’s fees, court costs or related expenses incurred in

2. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the OWNER agrees to limit the CONSULTANT’s liability for the
CONSULTANT’s damages to the sum of $50,000 or the CONSULTANT’s fee, whichever is greater. This
limitation shall apply regardless of the cause of action or legal theory pled or asserted.
3. WAIVER OF CONSEQUENTIAL DAMAGES
Notwithstanding any other provision of this AGREEMENT, and to the fullest extent permitted by law,
neither the OWNER nor the CONSULTANT, their respective officers, directors, partners, employees,
contractors or subconsultants shall be liable to the other or shall make any claim for any incidental,

use, loss of profit, loss of business, loss of income, loss of reputation and any other consequential
damages that either party may have incurred from any cause of action including negligence, strict liability,
breach of contract and breach of strict or implied warranty. Both the OWNER and the CONSULTANT

directors, employees and subconsultants from any and all claims arising out of unauthorized use of the
INSTRUMENTS OF SERVICE, and The OWNER agrees, to the fullest extent permitted by law, to defend,
indemnify and hold harmless the CONSULTANT against any damages, liabilities or costs, including
reasonable attorneys' fees and defense costs, arising from or allegedly arising from or in any way related
to or connected with the unauthorized reuse or modification of the INSTRUMENTS OF SERVICE by the
OWNER or any person or entity that acquires or obtains the INSTRUMENTS OF SERVICE from or

5. CONSTRUCTION MEANS AND METHODS AND JOBSITE SAFETY
Construction means and methods and jobsite safety are the sole responsibility of the general contractor.
The CONSULTANT has no liability for and no control over construction means and methods and jobsite
safety.
6. DISPUTE RESOLUTION
The OWNER and CONSULTANT agree to engage in mediation as a condition precedent to filing any
lawsuit. The costs of the mediation will be shared equally by all parties involved. The OWNER shall not
make resolution of any dispute or payment of any amount due contingent upon the CONSULTANT’s
signing a certification, guarantee or warranty as to the existence of any conditions that the CONSULTANT
cannot personally ascertain.
7. TERMINATION
This AGREEMENT may be terminated by either The OWNER or CONSULTANT at any time with or
without cause upon ten (10) days written notice to the other PARTY. The OWNER’s failure to timely pay
S:\Templates\Hutchison\Professional Service AGREEMENT2026
invoices will constitute grounds for termination by the CONSULTANT. In the event of termination by either
PARTY, the OWNER will pay for all SERVICES rendered by the CONSULTANT, including all expenses
incurred, up to and including the date SERVICES are terminated. Final payment will be due immediately
upon receipt of the final invoice.

and any lawsuit arising out of this AGREEMENT or the SERVICES herein shall be brought in the county
where the PROJECT is located.
9. MISCELLANEOUS
Nothing contained in this AGREEMENT shall create a contractual relationship with or a cause of action in
favor of a third party against either the OWNER or CONSULTANT. The CONSULTANT makes no

Yes. A budget amendment to
44-84E-890 will come with
the design agreement, and
again with the construction
award.
PURPOSE
To ask Council whether to fund the replacement of
the sidewalk on the north and east sides of Parkside
Apartments, 125 N Chestnut Street, with TIF funds
before the City enters an engineering agreement.
BACKGROUND
The sidewalk along the Chestnut Street and 2nd
Street sides of Parkside Apartments is cracked and
does not meet ADA requirements at the building
entrances. The Housing Authority of Henry County,
which operates the building, asked the City this spring
about work that started in 2025, when a tree was
removed and the corner was barricaded but no further
work followed.
Part of the north sidewalk sits over a hollow vault. A
local concrete contractor recommended an engineer
evaluate it before any work. Hutchison Engineering
met with staff on site July 30, 2026 to set the scope:
• Remove and replace the sidewalk from the
Chestnut Street parking lot entrance to the alley on
2nd Street, and replace the curb and gutter along the
same frontage.
• Fill the vault under the north sidewalk and move the
water meter and backflow preventer into the building.
• Make all Chestnut Street entrances and the east
entrance on 2nd Street ADA compliant.
• Remove the inlet at the Chestnut and 2nd corner
and convert the existing manhole to a curb inlet.
• Replace the street lights and add pedestrian lights
to match the Main Street project, with Ameren's
overhead lines moved underground.
• Replace the grass strip along 2nd Street with
diagonal parking. Hutchison measured 2nd Street and
confirmed there is room between the centerline and
the existing sidewalk.
The building owner will replace the planters and the
main entrance canopy.
SPECIAL NOTES
This is a discussion item. No vote is requested and no
money is spent with this item.
If Council supports TIF funding, staff will bring the
Hutchison Engineering design agreement to a later
meeting. Construction would then be bid and awarded
by Council.
ANALYSIS
The estimate is preliminary and comes before design.
The largest items are the new sidewalk ($62,075), the
lighting system ($63,940), filling and walling off the
vault ($47,000) and new curb and gutter ($28,500).
Design engineering of $40,000 is Hutchison's
$24,000 fee plus $16,000 for a lighting subconsultant,
including coordination with Ameren to put the lines
underground.
