To be in compliance with Iowa Code Section 21.4, Board of Supervisors meeting
agendas are posted on the bulletin board outside the first floor elevator a
minimum of 24 hours prior to the scheduled meeting. After such time has
passed, the posted agenda will not change; however, agenda packet attachments
may be modified or added until the start of the meeting.

Order of Discussion
Board members reserve the right to move items from the order listed on the
agenda. A person may address matters not on the agenda during the Public
Comment item. Please be aware that the Board is limited in their ability to
respond to such inquiries and the Iowa Code prohibits the Board from
deliberating or acting on items not appearing on the agenda.

Johnson County Supervisors:
I am writing to you today to oppose any big tech companies building data
centers in or near Iowa City. I don’t know if there is anything in the
works but just wanting to express my opinion about them. Please
consider a ban or moratorium.
Here are four key reason to oppose them:
Energy Consumption: High electricity use, raises bills and straining
power grids
Water Usage: Significant water consumption, worsening scarcity in
stressed regions, many in drought areas now
Pollution: Emission contributing to health risks and environment
degradation
Noise and Light Pollution: Disrupts local ecosystems and affects
community well being
Big Tech profits are not worth the utter devastation these facilities
cause local communities: thousands of acres, millions of gallons of water,
sky-high utility bills, scarce water for drinking and farming, and so
much more.
We know what happens when data centers move in: 24-hour noise, water
shortages, and sharp hikes to our power bills – on top of Trump’s energy
price hikes. This is about ultra-wealthy investors destroying our
communities for their own profits, while our neighborhoods, environment,
and wallets pay the price.
Across the country the majority of new data center construction is
planned for the areas hardest hit by drought. A recent investigation
found that of 809 data centers set to be built, 517 are in communities
that have struggled with drought for the past year.
Senator Bernie Sanders is showing what leadership looks like, demanding
Congress pass a nationwide moratorium on new data centers. I am not

trusting that this will happen so I am asking my local leadership to stand
firm and ban or at least have a moratorium on data centers.

Chairperson Green called the Johnson County Board of Supervisors to order in the Johnson County
Health and Human Services Building Boardroom at 9:00 a.m. Members present: V Fixmer-Oraiz,
Jon Green, Lisa Green-Douglass, Mandi Remington, and Rod Sullivan.
Green sought and received unanimous consent for approval of the agenda as presented.

Motion by Sullivan, second by Green-Douglass, to approve the following consent agenda items:

PROCLAMATION NO. 06-25-26-01
DEMOCRATIC REPUBLIC OF THE CONGO
INDEPENDENCE DAY - JUNE 30, 2026
WHEREAS, the Democratic Republic of the Congo (DRC) gained its independence from Belgium
on June 30, 1960, marking a significant moment in the nation’s history and the broader struggle
for African self-determination and sovereignty; and
WHEREAS, the DRC is one of the most resource-rich nations in the world, supplying copper,
cobalt, and coltan—these resources are vital to the global economy and play an increasingly
important role in the transition to clean energy, and advanced technologies; and
WHEREAS, this year marks a moment of pride for Congolese people around the world as the
Leopards return to the FIFA World Cup for the first time since 1974, while the US hosts the
tournament and welcomes the spirit of international friendship and cultural exchange; and
WHEREAS, Congolese Americans in Johnson County continue to promote diversity and enrich
our community through their traditions, entrepreneurship, leadership, and civic engagement; and

WHEREAS, while celebrating the achievements, resilience, and aspirations of the Congolese
people, we also recognize the ongoing humanitarian challenges faced by many communities,

countless lives, displaced millions of people, and continue to affect individuals and families
seeking peace and security.
NOW, THEREFORE, BE IT RESOLVED that we, the Johnson County Board of Supervisors, do
hereby commemorate Democratic Republic of the Congo Independence Day in Johnson County,
and proudly stand in solidarity with Congolese communities both locally and abroad.
Motion by Remington, second by Fixmer-Oraiz, to approve Proclamation No. 06-25-26-01.
Approved unanimously. County Board Office Communications Manager Krista Burich spoke.
Motion by Remington, second by Green-Douglass, to approve the Predesign Agreement with Iowa
Department of Transportation for the reconstruction of the I380/F12 (120th Street NW)
interchange. Approved unanimously.
Motion by Fixmer-Oraiz, second by Green-Douglass, to approve the Preconstruction Agreement
with Iowa Department of Transportation for paving of intersection return on Oak Crest Hill Road
SE at its intersection with Riverside Drive at its ramp connection to the U.S. 218 interchange.
Approved unanimously.
Motion by Fixmer-Oraiz, second by Remington, to approve the Baker Tilly Classification and
Compensation Study recommendations as follows and contained in the agenda packet of the
meeting: 21-grade general pay plan with consistent midpoint differentials maintaining market
competitiveness; position grade assignments; and implementation scenario Option 3: Time in
Position Adjustment. Approved unanimously.
Motion by Sullivan, second by Remington, to approve the Fiscal Year 2027 (FY27) Juvenile
Justice Youth Development Agreements with the following organizations:
1. Big Brothers Big Sisters of Johnson County, Iowa City, in an amount not to exceed $65,000.00
2. CommUnity Crisis Center, Iowa City, in an amount not to exceed $25,000.00
3. The Dream Center dba Dream City, Iowa City, in an amount not to exceed $65,000.00
4. Neighborhood Centers of Johnson County, Iowa City, in an amount not to exceed $70,229.00
6. Wright House of Fashion, Iowa City, in an amount not to exceed $48,771.00

Iowa Disability Alliance, Iowa City, for the use of five offices and common areas in the County

Motion by Remington, second by Fixmer-Oraiz, to approve the FY27 Lease Agreement with
AbbeHealth, Inc., Hiawatha, for the use of the GuideLink Center building and grounds, in the
amount of $1.00. Approved unanimously.
Motion by Fixmer-Oraiz, second by Remington, to reappoint Dr. Consuelo Guayara Sanchez of
North Liberty, and appoint Kisha Smith of North Liberty, LilliAnna Scott of Iowa City, and

expiring June 30, 2030. Approved unanimously.

Background:
The Board allocated $900,000 in ARPA funding for home rehabilitation projects for repairs to
owner-occupied single- family homes, including mobile homes in Johnson County. The County
contracted with Iowa Valley Habitat for Humanity (IVHH) and East Central Iowa Council of
Governments (ECICOG) to provide the housing rehabilitation services. This amendment
extends the contract term to September 30, 2026. The extension is necessary due to several
projects that have incurred construction delays due to supply chain issues and contractor
scheduling demands.

AMENDMENT No. 4 TO AMERICAN RESCUE PLAN ACT SUBRECIPIENT AGREEMENT BETWEEN
EAST CENTRAL IOWA COUNCIL OF GOVERNMENTS AND JOHNSON COUNTY IOWA
This Amendment No. 4 to Subrecipient Agreement is made between Johnson County, Iowa (“County”)
and East Central Iowa Council of Governments (“Subrecipient”) for the provision of housing
rehabilitation, modification and emergency home repair for Johnson County homeowners. This is the
fourth Amendment to that Subrecipient Agreement with an effective date of February 1, 2023, executed
by the County on February 2, 2023, and the first amendment executed by the County on November 9,
2023, and Recipient on November 20, 2023, and the second amendment executed by the County on
June 20, 2024, and the Recipient on July 1, 2024, and the third amendment executed by the County on
August 14, 2025 and the Recipient on August 24, 2025.
IT IS NOW AGREED that Subrecipient and County hereby amend the above-referenced Agreement as
follows:
1.) Effective Date and Term. This Agreement shall commence on February 1, 2023, and remain in
effect through June 30, 2026, September 30, 2026.
Except as amended and /or modified by Amendment No. 1, Amendment No. 2, Amendment No. 3 and
Amendment No. 4 the Subrecipient Agreement with East Central Iowa Council of Governments for home
rehabilitation, modification and repair shall remain in full force and effect, unaltered and unchanged.

County and the Iowa Judicial Branch For Board of Supervisor’s Work Session
Purpose of the Agreement:
The Johnson County Board of Supervisors has collaborated with the State of Iowa Judicial Branch
for several years to provide funding to improve the judicial response under Chapter 229 of the
Iowa Code for mental health commitment hearings. The Judicial Branch uses the funds to employ
part-time Judicial Hospitalization Referees in the Sixth Judicial District. The Judicial
Hospitalization Referees preside over the mental health commitment hearings two extra days each
week so that hearing can occur more quickly for the patients.
The Agreement on the Boards agenda extends this for another year from July 1, 2026-June 30,
2027. The Agreement is generally the same as in the past.

Recommendation:
The recommendation from the Johnson County Attorney is to approve this Agreement for another
year and continue to provide the funding for the Judicial Hospitalization Referees.

Background
Johnson County continues to plan for a new Sheriff’s Office and jail facility. The new facility will require
entering into a loan agreement and issuing bonds to finance the cost of the project. Before the County can
initiate said loan agreement and issue bonds, the County must hold a special election and receive a
favorable vote from at least 60% of the total votes cast. To hold the election, the Board of Supervisors
must adopt a resolution setting November 3, 2026 as the date for an election on the proposition of
entering into a loan agreement and issuing general obligation bonds for the purpose of funding a new
sheriff’s office and jail facility.
The estimated project cost is $96,000,000 and includes the cost of acquiring land and constructing,
equipping and furnishing a new sheriff’s office and jail facility.
Attached to this summary is the Resolution setting November 3, 2026 as the date for an election on
the proposition of entering into a loan agreement and issuing general obligation bonds for this
project and the Notice of Special Bond Election, which will be published in the official county
newspaper as required by state code.
The Board discussed the resolution and notice for special bond election at the June 10 work session.

RESOLUTION NO. 07-02-26-______
RESOLUTION SETTING NOVEMBER 3, 2026, AS THE DATE FOR AN
ELECTION ON THE PROPOSITION OF ENTERING INTO A LOAN
AGREEMENT AND ISSUING GENERAL OBLIGATION BONDS FOR THE
PURPOSE OF FUNDING A COUNTY JAIL PROJECT
WHEREAS, the Board of Supervisors (the “Board”) of Johnson County, Iowa (the
“County”) has deemed it necessary and advisable that the County be authorized to enter into a loan
agreement and issue bonds in a principal amount not exceeding $96,000,000 to finance the cost of
acquiring land and constructing, equipping and furnishing a new sheriff’s office and jail facility
(the “Project”); and
WHEREAS, pursuant to Sections 331.402, 331.442 and 39.2(4)(d) of the Code of Iowa,
before the County may enter into a loan agreement and issue its bonds for such purposes, the
County must hold a special election upon such proposition on the first Tuesday after the first
Monday in November, and receive a favorable vote from at least 60% of the total votes cast at
such special election; and
WHEREAS, in accordance with Section 331.442 of the Code of Iowa, as part of the
Board’s action to set a date for an election on such proposition, the Board must publish notice of
such proposition, including a statement of the amount and purposes of the loan agreement and the
bonds to be issued, a statement of the estimated cost of the Project, and an estimate of the annual
increase in property taxes as the result of the bond issuance on a residential property with an actual
value of one hundred thousand dollars, which notice must be published, as provided in Section
331.305 of the Code of Iowa, with the minutes of the meeting at which the Board adopts a
resolution setting the date for an election on the question of entering into the loan agreement and
issuing such bonds, and which notice must be mailed, as provided in Section 39.5 of the Code of
Iowa, to each registered voter within the jurisdiction;
NOW, THEREFORE, IT IS RESOLVED by the Board of Supervisors of Johnson County,
Iowa, as follows:
Section 1.
The Board of Supervisors intends to undertake the Project at an estimated
cost of $96,000,000. In accordance with Section 331.442 of the Code of Iowa, this cost figure is
an estimate and shall not be binding on the Board in later proceedings related to the Project.
Section 2.
A special county election is hereby called and ordered to be held in and for
the County in conjunction with the general election on November 3, 2026, at which there will be
submitted to the voters of the County the following proposition:
“Shall the County of Johnson, State of Iowa, issue its general obligation bonds in an amount
not exceeding the amount of $96,000,000 for the purpose of acquiring land and
constructing, equipping and furnishing a new sheriff’s office and jail facility?”
Section 3.
It is estimated the annual increase in property taxes on a residential property
with an actual valuation of one hundred thousand dollars resulting from issuing the bonds will be

outstanding to alternatively budget from any other available revenues for the payment of principal,

beds upon initial construction.
Section 4.
All of the foregoing matters are adopted and resolved by this Board, and the
County Auditor is hereby authorized and directed to issue a proclamation and notice of the
proposition and of the time and place of the election and to take all other actions necessary pursuant
to state law to conduct the election. In addition, in accordance with Sections 331.305, 331.442
and 39.5 of the Code of Iowa, the County Auditor is hereby authorized and directed to publish the
minutes of the Board meeting at which this Resolution is adopted, including the full text of this
Resolution, and to publish along with those minutes the Board’s Notice of Special Bond Election
that is attached to this Resolution, in one or more newspapers published in and having general
circulation in the County, and to mail the Board’s Notice of Special Bond Election to each
registered voter within the jurisdiction.
Section 5.
All resolutions or parts of resolutions in conflict herewith are hereby
repealed, to the extent of such conflict.
