ITEM #1 - PUBLIC WORKS 2026 EQUIPMENT PURCHASES
Curtis Mader, Public Works Director, came before the Board for approval to solicit bids for one
additional pick up for the Assistant County Engineer. Public Works develops and maintains an
equipment replacement plan for all of its divisions and was presented during the Capital Improvement
Plan (CIP) meetings. This plan is used as a tool to help budget for equipment replacement and is
incorporated into the County’s current CIP and adopted budgets. Equipment, however, is operated until
it is ready to be replaced. Several pieces of equipment are ready for replacement or purchase in 2026.
When Public Works lost a surveyor, that pickup was reassigned for use to the Sewer Department. At that
time, the Sewer Technician's 1.5-ton truck was transferred to Road and Bridge Department since the
Sewer Technician primarily travels between districts and only occasionally needs to tow equipment.
When towing is required, a larger truck remains available. The other Engineering pickup (an F-150) was
transferred to the Landfill because it was not being utilized. That pickup is now experiencing significant
engine problems, and the County’s mechanics have determined that it is not worth repairing and would
not be reliable enough to return to Engineering service. Mr. Mader has recently hired a new surveyor,
and the GMC Yukon, which houses the survey equipment, will become his assigned vehicle. As a result,
staff needs to replace the Engineering inspection vehicle. Staff is recommending purchasing a new
pickup for the Assistant County Engineer and to reassign his current pickup as the Engineering
inspection vehicle. Since Public Works is already out to bid for two additional pickups, Staff is
requesting approval to add one more pickup to the bid.
Commissioner Woydziak motioned to approve Public Works to add another half-ton pickup to the bid
package. Commissioner Masterson seconded the motion. Motion carried 5-0.

ITEM #2 - FUEL PUMP REPLACEMENT AT NORTH SHOP
Curtis Mader, Public Works Director, came before the Board for approval to allow Public Works to bid
for a fuel pump replacement at the North Shop. The fuel pumps at the North Shop are utilized by
multiple County Departments. Fuel usage is tracked for each department, and the associated costs are
transferred back to Road and Bridge to reimburse the department for the fuel provided. For

approximately the past year, the fuel pumps have experienced ongoing issues with either not pumping
fuel or pumping at a very slow rate, particularly during the afternoon hours. While performance is
somewhat better in the mornings, the pumps are still not operating, as they should. Staff has retained two
separate vendors to diagnose and repair the system, and both have concluded that the existing pumps use
outdated technology and should be replaced and cannot be repaired. The current system uses suction
pumps that pull fuel from the storage tanks, and both vendors have recommended upgrading to a modern
system that utilizes pumps at the tanks to push the fuel, providing more reliable and efficient operation.
Staff is currently evaluating the best replacement system. Once a system has been selected Staff will
advertise the project for competitive bids for both the equipment and installation.
Commissioner Jackson motioned to approve Public Works to solicit bids for the replacement of the
north shop fuel pumps. Commissioner Woydziak seconded the motion. Motion carried 5-0.

Ryan Adkison, Assistant Administrator/Finance Director, informed the Board of the intent of the County
to exceed the Revenue Neutral Rate (RNR) for the Butler County 2027 budget and for the Butler County
Fire Districts #1 through #12’s 2027 budgets. K.S.A. 79-2988(b) requires governing bodies, on or before
July 20th, to notify the County Clerk of its proposed intent to exceed the RNR and to provide the date,
time and location of the public hearing and the proposed tax rate. The proposed mill levies and
corresponding RNRs will be presented to the Board. By not passing the notice to exceed, the RNR
would cap the budget year taxes levied to the prior year taxes levied.

BACKGROUND
David and Karyl Rush own a tract of land containing 154+/- acres, located at 1590 SW Boyer Rd.,
Eldorado, KS, which is located North of W Kechi Rd., on the east side of SW Boyer Road. The
property is currently zoned Agricultural Residential District (A-R) and is located within El
Dorado’s growth area. The owner has applied for a Special Use Permit through the City of El
Dorado that would allow the owner to lease land to Tillman Infrastructure. Tillman desires to construct
a 150’ monopole cell tower to provide service to AT&T. As it falls within El Dorado’s growth
area, the city is asking for a recommendation to their Boards.
ANALYSIS
The property is adjacent to the city limits of El Dorado. In the immediate area, there appears to be a
mixture of lot sizes, many of which appear to be used for the oil industry. The city's A-R classification
does allow for the construction of a cell tower. Staff believes, based on tower design and zoning
classification, the request would be consistent with our regulations. The 150-foot cell tower of
monopole design will be located in a 50’X50’ leased area. The tower will have a lightning rod
that extends an additional 10 feet. The proposal includes a 6-foot-tall wooden privacy fence and the
planting of trees and shrubs surrounding the perimeter of the leased area. The tower will be set back
183 feet from the nearest property line, which would provide for the required fall distance. There is an
existing cell tower located on a separate parcel to the South. The company considered colocation
opportunities. Power will be provided by Evergy. Power and fiber will run with an underground
easement to the nearest utility pole. Rural water exists in the area. There are no FEMA-mapped areas
located on the property.

Dear Ms. Stalnaker,
Skyward Land Services, on behalf of Tillman lnfrastructure (Tillman), files this Special Use Application to allow
the construction of a wireless telecommunications facility at the above referenced property. Tillman has
finalized a lease agreement with the owner(s) ofthe property, David A. Rush and Karyl Rush. The proposed
facility is designed to accommodate multiple carriers and will provide the technology needed to provide clear
and uninterrupted wireless telecommunications services to the residents of Butler County and the City of El
Dorado.
The proposed wireless telecommunications facility will consist of a 150' tall monopole tower to be located
within a 50'-0" x 50'-0" lease area. Future expansion of the lease area can be accommodated, if needed, for
multiple carrier's ground equipment. The proposed towerwill be erected, owned, and managed byTillman.
The facility will be unstaffed and will only require carrier service technicians, in a pick-up/van sized vehicle, to
visit the site approximately once per month.
The facility is proposed in the City of El Dorado's AG - R (Agriculture - Residential) zone. Pursuant to the City,
the tower location falls within their 3mile Extra Territorial Jurisdiction which was confirmed by phone

conversation on December 18, 2024. Towers are allowed in the AG- R zone by Special Use Permit approval by
the Planning Commission and will require notice to the surrounding landowners.

INTRODUCTION
Tillman lnfrastructure, LLC (Tillman) proposes to construct a new telecommunications tower in El Dorado,
Kansas. The proposed site will allow wireless carriers to improve the quality of services for their customers rn
Butler county and the city of El Dorado. The tower is designed to accommodate three (3) carriers
As shown in this application narrative, Tillman's proposal meets the city of El Dorado code criteria. The

selected site is zoned Agricultural - Residential, and 153.7 acres, where towers are allowed by Special Use
Permit approval by the Planning official.
As demonstrated below, the proposal meets all the City's criteria for development in the Agricultural -

Residential zone, including height and setbacks. Tillman respectfully requests that the City approve the new
facility as proposed.
PROPOSAL

Tillman proposes a new monopole tower for wireless telecommunications be constructed on a parcel at L590
SW Doyer Rd. (the "Property"). The Property is currently undeveloped. The proposal consists of a 150-0" tall
monopole tower. Antenna arrays can be located at three (3) different locations on the tower, to
accommodate up to three (3) different carriers. The facility, inclusive of a wooden privacy fence, will initially
comprise a 50'x50'area. Space is available for future expansion, ifneeded. A new L2' wide gravel access
road, running from the existing road at the right of way (SW Boyer Rd.) to the compound, will be added.
Power and fiber will run underground from the nearest utilitY pole to the fenced lease area,

The proposed Tillman facility complies with all applicable requirements of the El Dorado City Zoning
Ordinance. Article 6 - Supplementary Use Retulations / wireless Communications Facilities

Location/

Guidelines:

Wireless Communication Facilities by a Special Use Permit in Agricultural-Residential zone up to

150ft
All ground-mounted towers shall be set back from the all-property lines a distance equal to or greater than
the height of the proposed structure. lf substantiated by a licensed engineer, the setback may be equal to the
maximum distance the structure is designed to fall, as measured from the center of the structure.

Apoliconts Response:
The tower is setback 183ft from the nearest property line. The tower is 15oft in heiSht, therefore, this requirement
is exceeded by 33ft.

At the time of requesting a Permit for a new ground-mounted wireless communication facility, the
applicant shall demonstrate to the satisfact;on of the approving authority that:
a

There is no available space on existing or approved wireless communication facilities or other
structures that can be utilized to meet the applicant's communication needs; and

b. There is no other technically feasible opportunity to modify or rebuild an existing structur€ on which
the communication equipment may be located.
ApDlicdnts Response
This requirement is not applicable as it is superseded by K.S.A.66-2019 (f) (3) which in summary states that a

jurisdiction shall not evaluate an application based on the availability of other potential locations for the
placement of wireless support structures or wireless facilities, including without limitation the option to
collocate instead of construct a new wireless support structure. Nevertheless, Tillman conducted an initialand
thorough analysis of available collocation opportunities on existing wireless tower within the same search ring
defined by the applicant before contacting any landowners in the search area.
At the time of requesting Permit for a wireless communication facility, the owner of a proposed new
undisguised ground-mounted wireless communication facility, and the owner of the land, if not the same, shall
certify in correspondence submitted with the permit, that:
a

The support structure is designed, and the ground area is adequate or can be made adequate, to
accommodate at least one (1) other carrier, if more than eighty (80) feet in height, and at least two
(2) other carriers, if more than 1OO feet in height. Lattice towers no larger than 18 inches on any side
are excluded from the co-location requirements;

Applicants Resoonse:
The proposed application package depicts three (3) total unique carriers. Therefore, the location and facilities
are adequate to accommodate at least one future potential carrier.

b. Reasonable accommodations will be made to lease space on the facility to other carrier so as to avoid
having a proliferation of support structures that are not fully utilized; and

AoDliconts Resoonse:
The proposed application package depicts three (3)total unique carriers. Therefore, the location and facilities
are adequate to accommodate at least one future potential carrier.
The visibility of facilities shall be minimized by techniques such as concealment, disguise, camouflage, and
sensitive design and siting. Economic infeasibility shall not be a cause for waiver from any design guideline. Accept
as proven by the owner(s)to be technically unfeasible, all facilities approved must meet the following specific

guidelines;

1. Preserving the pre existing character of the area as much as possible.
Apoliconts Resoonse:
The area is currently being utilized as a storage area for broken down equipment whose parts could be
utilized in the future. Therefore, camouflaging, concealing, or disguising the structure would not benefit the

overall design or siting of the facility. Furthermore, the structure is a monopole which by its nature is visually
less obtrusive than a self-support or guyed tower.

Minimizing the height, mass or proportion ofthe facility to minimize conflict with the character of its
p.oposed surroundings.

Appliconts Resoonse:
The structure is 150ft which is the minimum needed by AT&T to serve the surrounding area. Furthermore,
the structure is a monopole which by its nature is visually less obtrusive than a self-support or guyed tower.

3. Minimizing the silhouette presented by new support structures and antenna arrays. Generally,
monopoles are favored over lattice-type support structures to a height of at least 150 feet, and
antennas mounted flush to the support structure are favored over triangular top hat" antenna
arrays.

Appliconts ResDonse:
The application proposes that a 150ft monopole is being utilized, however, the latest technologies that
carriers use are not conducive to flush mounted antennas because remote radio units need to be mounted
between the antenna and the tower.

4. Using colors, textures and materials that blend in with the existing environment; under some
circumstances, surfaces should be painted, or otherwise treated, to match o. complement existing
background structures and surfaces, or the sky, as appropriate, and to minimize reflection Painting
support structures red and white may also be necessary to avoid strobe lighting that would otherwise
be required by applicable governing agencies.
ADpliconts Response:
The tower is finished in a galvanized steel which is grey and by its nature will blend in with the sky.

Concealing facilities within potential space in or on existing structures, or disguised to look like
another type of facility, like a flagpole, clock tower, or church steeple.

Appliconts Response:
A flagpole, clock tower, or church steeple, would not be appropriate for an equipment storage yard.

Placing facilities in areas where trees and/or buildings obscure some or all the facility from view, and
installing new plantings/screening around the site where visible from major street or residential areas.

Aooliconts Resoonse:
The proposal does include plantings of shrubs around the compound area to further conceal the ground
equipment and a 6ft wooden privacy fence is included. This is shown inthe Engineerstamped drawingsthat
are submitted as part of this application package.

Placing facilities on existing walls, flush-mounted, or on roofs building (excluding single-family and
duplex) and structures, up to 20 feet above the existing structure, as opposed to building new groundmounted support structures. Facilities on rooftops generally should be set back from roof edges or
screened from view.

ADDliconts Resoonse:
There are no roofs in the area that are tall enough to support a 150ft antennas.

8. screening equipment shelters and cabinets through landscaping, walls and/or fencing, as appropriate
to the surroundings and generally consistent with the City's screening regulations. ln most cases,
ground-level equipment should respect the setbacks for accessory uses in the applicable zoning district
and be enclosed by 6-8ft height security fencing, of a material compatible with its surroundings.
Equipment should be encouraged indoors if space is available nearby. Burying equipment in an
underground vault, to keep most of the equipment out of sight, may be necessary in rights of way and
in some other visually/environmentally sensitiv€ locations, such as tourist attractions, historic
landmarks/districts, museum district, river corridor, and other location5 of civic importance or
architectural significance.
ADolicdnts Resoonse:
The proposal does include plantings of shrubs around the compound area to further conceal the ground
equipment and a 6ft wooden privary fence is included.

9. Ground level shelters/equipment, appropriately screened and generally landscaped with trees and/or
shrubs, should be permitted on lots adjacent to rights of way, to facilitate the use or reconstruction
of utility poles in those rights of way.

ADpliconts ResDonse:
The ground equipment will be screened by the wooden privacy fence and landscaping.

10. Permitting lighting on facilities only if required by federal regulations, and not by strobes (except by
variance).

ADDliconts Response:
The FAA does not require a tower under 2OOft to be lit however, in some instances if a tower is in close proximitY
to an airport there may be additional FAA regulations. Therefore, we will submit a copy of the FAA approval as
soon as it is received.

CONCLUSION
The proposed wireless telecommunications facility meets or exceeds all requirements of El Dorado's land use
ordinances. We respectfully request that the City approve the proposal as designed, subject only to the CitY's

standard conditions of approval.

Action to be considered:
Request to consider SU 26-01, a special use request to construct a cell tower on property located
at 1590 SW Boyer Rd., El Dorado, KS.
Background:
David and Karyl Rush own a tract of land containing 154+/- acres, located at 1590 SW Boyer
Rd., Eldorado, KS, which is located North of W Kechi Rd., on the east side of SW Boyer Road.
The property is currently zoned Agricultural Residential District (A-R), and is located within El
Dorado’s growth area. The owner has applied for a Special Use Permit through the City of El
Dorado that would allow the owner to lease land to Tillman Infrastructure. Tillman desires to
construct a 150’ monopole cell tower to provide service to AT&T. As it falls within El Dorado’s
growth area, the City is asking for a recommendation to their Boards.
Analysis:
The property is adjacent to the city limits of El Dorado. In the immediate area, there appears to
be a mixture of lot sizes, many of which appear to be used for the oil industry. The city's A-R
classification does allow for the construction of a cell tower. Staff believes, based on tower
design and zoning classification, the request would be consistent with our regulations.
The 150-foot cell tower of monopole design will be located in a 50’X50’ leased area. The tower
will have a lightning rod that extends an additional 10 feet. The proposal includes a 6-foot-tall
wooden privacy fence and the planting of trees and shrubs surrounding the perimeter of the
leased area. The tower will be set back 183 feet from the nearest property line, which would
provide for the required fall distance.
There is an existing cell tower located on a separate parcel to the South. The company
considered colocation opportunities. Power will be provided by Evergy. Power and fiber will run
with an easement underground to the nearest utility pole. Rural water exists in the area. There are
no FEMA-mapped areas located on the property.
Recommended Action:
Staff recommends approval.

BACKGROUND
Pine Technologies has provided support for the Justware software since 2020. We would like to extend
the current contract for an additional year.
ANALYSIS
Pine Technologies has proven to be a valuable partner for the County in maintaining the proper
operation of the Justware software that the County Attorney's office relies on. The new cloud based
version has renamed to Pine CMS, and combines the Justware and Docksushare components that were
previously separate.
FINANCIAL CONSIDERATION
The total cost to extend this contract from 7/1/2026 through 6/30/2027 is $40,000. $26,000 is budgeted
under IT contractuals 0001-008-6214-000, and the other $14,000 from fund 0090, the County Attorney
diversion fund. It should be noted that in the past this was billed under two separate invoices, but is now
combined as part of the move to the cloud based environment.

BACKGROUND
Butler County has persistently pursued funding for the replacement of the Walnut River Bridge on SW
80th Street, designated as project 17N1-27-5 (OS 156). After 11 submissions, the project was finally
awarded funding through the KDOT Off-System Bridge Program. In response to ongoing feedback
from KDOT regarding project delays across counties, the Butler County Engineering Department
implemented a new policy in the past year: all bridge structures will now be fully designed before grant
applications are submitted. This proactive approach allows the County to submit Field Check plans
immediately upon grant approval, putting projects at least one year ahead of schedule in the KDOT
process. This strategic shift not only increases the likelihood of timely project delivery but also
strengthens Butler County's competitiveness for future grant funding.
ANALYSIS
We were awarded $2,000,000 in a KDOT Off-System grant for 17N1-27-5 (OS 156) Walnut River
Bridge Repl. on SW 80th St. Three parcels of right-a-way easement will need to be purchased. This
parcel is for the Tamara L. Berndsen revocable Living Trust and we are purchasing 0.423 acres for
$5,683.01. To determine this amount, we look at previous land sales and Butler County Website
property values.

This purchase will be paid out of 0043-041-6604-000 Capital Projects

BACKGROUND
The Department of Public Works develops and maintains an equipment replacement plan for al of its
divisions. This plan is used as a tool to help budget for equipment replacement and is incorporated into
the County’s current CIP and adopted budgets. Equipment, however, is operated until it is ready to
be replaced.
ANALYSIS
One of our tandem dump trucks—a 2013 Kenworth T470—was recently involved in a wreck and will
most likely be totaled. This truck was originally scheduled for replacement in 2032. Typically, when we
replace trucks, the dump beds are in poor condition; however, in this case, the bed is still in very good
shape. By purchasing a new chassis and transferring the existing bed, we can save approximately
$50,000. We received three bids with Truck Center Companies being low bid at $186,182. This is a turn
key cost for the chassis and to have the be installed.
FINANCIAL CONSIDERATION
The vendor for this purchase is Truck Center Companies and $186,182 will be paid out of 0044-0416604-000 Capital Projects
