Commission Chair Marc Murphy called the Butler County Board of Commissioners meeting to
order at 9:00 a.m. Present were Commissioner Jeff Masterson, Commissioner Kelly Herzet,
Commissioner Darren Jackson, Commissioner Dan Woydziak, County Administrator Will
Johnson, County Counselor Terrence Huelskamp and Executive Assistant Anna Wealand.

Commissioner Woydziak motioned to approve the minutes as presented from the April 21,
2026, Butler County Commission meeting. Commissioner Jackson seconded the motion.

PUBLIC COMMENTS
Randall Wells, 4506 SW Lakeview Ct, Towanda, came before the Board to thank the Board on
behalf of himself and other residents for their assistance with SW 50th St; Mr. Wells stated it
looks like the chip seal will happen.
Megan Wright, 2499 NW River Valley Rd, Towanda, approached the Board and asked if any of
the County Commissioners attended the meeting El Dorado Inc held last night regarding data
centers. Ms. Wright asked if any staff or Board members have signed a non-disclosure agreement
(NDA.) Administrator Johnson and Counselor Huelskamp confirmed Ryan Adkison, Assistant
Administrator/Finance Director, has signed a NDA but the company has not executed their
portion of the agreement; therefore, the NDA is not enforceable at this time. Ms. Wright asked
about data center regulations and the process for establishing those and whether the process
includes public hearings. The Board and Administrator Johnson confirmed no regulations have
been established at this time and the development of such regulations involves several
opportunities for public comment. Administrator Johnson stated he is currently not aware of any
applications for data centers anywhere in Butler County. Commissioner Jackson said he is aware
of a signed contract for property in the northern portion of the County, with rumors of a contract
in the southern portion of the County. Ms. Wright expressed concern regarding the County’s
reception of protest petitions generated utilizing artificial intelligence (AI,) stating Counselor
Huelskamp said that those protest letters “look like they were probably written by AI and
therefore you all did not have to recognize them.” Administrator Johnson stated Counselor
Huelskamp did not say anything to that effect, referring Ms. Wright to discussion regarding a
protest petition that was covered during the March 10, 2026, Commission Meeting when
Counselor Huelskamp reviewed the Memorandum of Findings for RZ-25-20 in response to the
request of Commissioner Masterson.

ITEM #1 – PL 26-09
Toby Stewart, Community Development Director, came before the Board for the consideration
of the Planning Commission's recommendation to approve a Mortgage Lot Split with an
Agricultural Preservation Overlay (APO) on property located at 21317 SW Purity Springs Rd,
Douglass. Property owner Lawrence Lay owns a tract of land containing 117+/- acres. The
property is located at the southwest corner of SW Purity Springs Rd and SW 210th St near
Douglass and is zoned AG-80. Mr. Lay desires to split out 10+/- acres to deed over to a son who
would like to build a home; 70+/- acres will be placed into an APO. The property is located
outside the Urban Growth Area (UGA) of the County and is surrounded by AG-80 properties,
with some RE-zoned properties and one (1) RR property located to the east. The property is
currently being used for agricultural purposes. The newly created lot would be serviced by a
private wastewater system. There is rural water in the area; a water main runs along SW 210th St.
Electricity is provided by Butler Rural Electric. There are no Federal Emergency Management
Agency (FEMA) mapped flood plain areas located on the property. SW 210th St is a paved
roadway maintained by Butler County and SW Purity Springs Rd is a gravel roadway maintained
by Rock Creek Township. The Planning Commission approved the split and APO by a vote of 50. Surrounding property owners were notified of the public hearing.
Commissioner Herzet motioned to approve the Homestead Lot Split and Agricultural
Preservation Overlay (APO) agreement, PL 26-09, on property located at 21317 SW Purity
Springs Rd, Douglass, Kansas. Commissioner Masterson seconded. Motion carried 5-0.

ITEM #2 – PL 26-10
Toby Stewart, Community Development Director, approached the Board for the consideration of
the Planning Commission's recommendation to accept road and easement dedications on
property located east of SW County Line Rd on SW 160th St in S30, T,28, R3E, Rose
Hill. Hurley Butler Holdings LLC owns a tract of land containing 40+/- acres located east of SW
County Line Rd on SW 160th St. The property was rezoned to RE on December 23, 2025. On
March 3, 2026, the Planning Commission approved the preliminary plat. The owner desires to
plat four (4) lots; one (1) of the lots is 16.64 acres in size and the other three (3) lots are roughly
7+/- acres in size. The plat does include 70’ internal roadway along with drainage and utility
easements. The property is located in a “gradient” area surrounded by AG-40 and RR-zoned
properties. The plat will dedicate an internal roadway, which is located on SW 160th St. SW 160th
St is a gravel roadway maintained by Pleasant Township. In addition, the plat will dedicate
drainage and utility easements. Additional water meters will be provided to the properties by
Sedgwick County Rural Water District #3. The properties would be serviced by private
wastewater systems. Butler Rural Electric provides electricity, and there are no FEMA-mapped
floodplain areas located on the property. A drainage plan was approved by the County Engineer.
The Planning Commission approved the final plat by a vote of 5-0. Surrounding property owners
were notified of the public hearing.
Commissioner Jackson asked if any drainage concerns exist; Mr. Stewart confirmed there are no
existing drainage concerns. Administrator Johnson inquired if this property is where drainage
concerns recently existed; Mr. Stewart stated no drainage concerns have existed for this property.

Commissioner Woydziak motioned to approve the acceptance of easements, road, and road
rights-of-way as indicated on the Hurley Farms Plat, PL 26-10, on property located east of SW
County Line Rd on SW 160th St, Rose Hill, Kansas. Commissioner Herzet seconded. Motion
carried 5-0.

ITEM #3 – RZ 26-06
Toby Stewart, Community Development Director, came before the Board for the consideration
of the Planning Commission's recommendation to approve the requested change in zoning from
AG-80 to RR on property located at 14790 SW Ohio Street Rd, Augusta. John Danler owns a
tract of land containing 10.6+/- acres. The property is located north of SW 150th St on SW Ohio
Street Rd and is currently zoned AG-80. Mr. Danler wishes to rezone a portion of the property to
Rural Residential (RR,) which would allow him to split out 5.1+/- acres along SW Ohio Street
Rd to be sold to his son. The remaining five (5) acres located at the back of the property will be
combined with another parcel of land Mr. Danler owns to the south.
The property is located outside, but within a half mile, of the County’s UGA. The property is
surrounded by AG-80, AG-40, and RR-zoned properties with many similarly-sized tracts in the
area. SW Ohio Street Rd is within close proximity to major transportation corridor SW Highway
77. Many of the properties along SW Highway 77 and SW Ohio Street Rd are zoned RR. The
property has been used for a home site and agricultural purposes. No new construction or
services are required; rural water does exist and the current home utilizes a lagoon. The new
property size of 5.1 acres would allow for the existing lagoon. Electricity is provided by Evergy.
No FEMA-mapped floodplain areas exist on the property. SW Ohio Street Rd is a gravel
roadway maintained by Walnut Township. The Planning Commission approved the rezone by a
vote of 5-0. The Planning Commission also reviewed the Lot Split application and approved the
Certificate of Survey by a vote of 5-0. Surrounding property owners were notified of the public
hearing.
Commission Chair Murphy asked for clarification as to the future of the remaining property once
the split occurs; Mr. Stewart clarified that Mr. Danler will combine the remaining land with
another parcel to as avoid a landlocked parcel.
Commissioner Woydziak motioned to approve Resolution 26-18 for the rezoning of property
from AG-80 to RR, Case RZ 26-06, on property located at 14790 SW Ohio Street Rd, Augusta,
Kansas. Commissioner Jackson seconded. Motion carried 5-0.

ITEM #4 – CU 26-03
Toby Stewart, Community Development Director, approached the Board for the consideration of
the issuance of a Conditional Use Permit (CUP) to construct and operate a construction office for
CU 26-03. The Planning Commission recommends the approval of a CUP on a tract of land
containing 71+/- acres owned by Chris Dare located at 16544 SW 140th St, Rose Hill; the
property is zoned AG-40. Mr. Dare would like to construct and operate a construction office for
his construction business. The site survey and plan note the following:

A construction office will be constructed; the office will be used by employees for
administrative duties.
The hours of operation for the construction office for the general public are from 8 a.m.
to 5 p.m. Monday through Friday. The general public will not be on-site very often.
There is a future expansion area to the west and east of the construction office in case the
office needs to be expanded.
Employees will park their personal vehicles behind the office.
A gravel parking area will be placed in front of the office, utilizing the existing drive off
of SW 140th St.; an expansion area noted for the parking area as well.
The property currently contains two (2) accessory structures where construction supplies
can be stored, although not all of the supplies can be stored indoors. Some items will be
stored in the general area approximately 500 feet north of the roadway.
There is an expansion area located to the north where a future lean-to may be constructed.
It is important to note that the property is also being used for agricultural purposes.
The owner intends to use the remainder of the land for the same purposes, but will store some of
his agricultural equipment in the same general location.
The property is located inside the County’s UGA and is surrounded by a mixture of zoning
classifications, including AG-40, RE, RR, and the City of Andover properties. There are
numerous CUPs in the immediate area, including a cell tower adjacent to the east of the property,
a solar farm, another communication tower, an office building, a real estate sales office, a selfstorage rental facility, the sale of used vehicles, and a contractor's shop. Staff believe the
proposed use would be compatible with the area. Rural water exists in the area and the property
is serviced by a water well, with a lagoon for wastewater purposes. SW Butler Rd is paved, and
SW 140th St is a gravel roadway maintained by Pleasant Township. Electricity is provided by
Butler Rural Electric. The Planning Commission approved and recommended approval by a vote
of 5-0. With the approval, the Planning Commission recommends the following condition:
Business hours for the general public shall be Monday through Friday, 8:00 am to 5:00 pm.
Surrounding property owners were notified of the public hearing.
Commissioner Herzet motioned to approve Resolution 26-19, a Conditional Use Permit to
construct and operate a construction office with recommended conditions, Case CU 26-03, on
property located at 16544 SW 140th St, Rose Hill, Kansas. Commissioner Masterson seconded.
Motion carried 5-0.

ITEM #5 – CU 26-04
Toby Stewart, Community Development Director, approached the Board for the consideration of
a CUP to construct and operate a barn with a meeting room, CU 26-04, on .5+/- acres of property
without right-of-way property owned by Rock Creek Township located at 1998 SW 210th St,
Douglass. The property is zoned AG-80 and is generally located at the northeast corner of SW
Haverhill Rd and SW 210th St. The Township desires to demolish a small building that has been
utilized by the township for years and, in its place, the Township wishes to construct a 50X50
foot barn with a meeting room to allow more room for equipment storage. There is an existing
entrance located off SW 210th St.; the Township will add an additional entrance on SW Haverhill

Rd, increasing the ease of access to the new building. Staff has reviewed the plan with the
County Engineer; the Engineer has no issues with the new entrance location.
The property is located outside the County’s UGA and is surrounded by AG-80 properties. SW
Haverhill Rd and SW 210th St are paved roadways maintained by the County. The property will
not be serviced by water or a private wastewater system. Electricity is provided by Evergy. The
size of the property does make the request challenging and requires the Board of Zoning Appeals
to give a variance to the required setbacks for the AG-80 zoning district. The Planning
Commission approved the CUP by a vote of 5-0, and the Board of Zoning Appeals approved the
variance request by a vote of 5-0. Neither Staff nor the Planning Commission recommend any
conditions. Surrounding property owners were notified of the public hearing.
Commissioner Herzet asked if the new building will be set far enough back from the intersection
so as to not pose a safety hazard; Mr. Stewart stated the Township plans to place the building as
far back as feasible. Commissioner Herzet asked if the Township plans to demolish the old
building; Mt. Stewart confirmed the Township does plan to destroy the current building.
Commissioner Jackson inquired if aggregate will be stored at the site; Mr. Stewart confirmed
that aggregate will be stored on site. Commissioner Jackson asked why the property is shaped the
way it is; Mr. Stewart commented he believes the property was gifted to the Township many
years ago, and road right of way (ROW) took a large portion of the property.
Commissioner Jackson motioned to approve Resolution 26-20, a Conditional Use Permit to
construct and operate a barn with a meeting room, Case CU 26-04, on property located at
1998 SW 210th St, Douglass, Kansas. Commissioner Woydziak seconded. Motion carried 5-0.

ITEM #6 – WORK SESSION
Toby Stewart, Community Development Director, came before the Board for a work session
regarding Butler County floodplain mapping update information. Through a discovery process
initiated by the Kansas Department of Agriculture (KDA) and conversations with County
stakeholders, it was determined that certain streams in Butler County warranted updating using
new modeling techniques. 2D modeling techniques will improve accuracy and give better
elevation data as 2D modeling utilizes excess rainfall on grid hydrology and the inclusion of
surveyed structures. Butler County does have zoning regulations (Article 18), and is a part of the
Community Rating System (CRS) program, which helps to provide lower costs to floodplain
insurance in Butler County. The County’s effective floodplain mapping was dated June 2, 2009,
for most of the County. A physical map revision was completed on January 22, 2020, for
Augusta and El Dorado levee-related projects. A kick-off meeting for this mapping project was
held on June 23, 2022, where enhanced engineering projects, developing regulatory draft
floodplain maps, developing a Flood Insurance study, and developing risk data tools for the
Butler County community were discussed.
The KDA is currently at the discovery phase and has developed a draft map dated March 6,
2026. Key stakeholders, along with the community, can make comments or suggestions as to key
areas on the map requiring further updates and can upload supporting documentation through the
draft map on the Division of Water Resources (DWS) website. Tributaries on the map are

highlighted in yellow, red, and green. Yellow indicates there is neither an increase nor a decrease
in floodplain area, red indicates there will be an increase and green indicates there will be a
decrease. Butler County and the KDA DWS are hosting two (2) public Open Houses for the
Community. Staff has mailed out notifications to all property owners in Butler County where
some change may occur on their property. The first open house will be on May 6, 2026, from
2:00 p.m. to 6:30 p.m. at the El Dorado Civic Center; the second will be held on May 7, 2026,
from 2:00 p.m. to 6:30 p.m. at the City of Andover Council Chambers. Property owners may
attend these open houses in order to find out if their properties are located in a floodplain and
how the risks may impact them. At the completion of the project, staff will need to present to the
Commissioners the updated Article 18 zoning regulations, and the Commission will need to
formally adopt the updated floodplain map; this will probably not happen for about a year.
Commissioner Jackson asked if Dam Breach Inundation Areas (DBIA) will be modified; Mr.
Stewart said conversations have been started and explained some of the steps and considerations
involved.
Commissioner Masterson inquired if the United States Department of Agriculture (USDA) is
notifying property owners of changes; Mr. Stewart replied the USDA is not sending out
notifications and stated the County is responsible for notifying landowners who will be most
affected by the change.
No action was taken.
Jacob Riley, Assistant Director Public Works, notified the Board that he needs to obtain
signatures on a form for the Multiuse Path for SW Butler Rd and SW 150th St that was presented
during last week’s Commission Meeting.

ITEM #7 – LANDFILL PUMPS
Jacob Riley, Assistant Director Public Works, came before the Board for the consideration of the
approval of an invoice for two (2) SurePumps for the Butler County Landfill Leachate Wet Well.
The Landfill utilizes a submerged pump in the leachate wet well to transfer leachate to the pond.
In the past, the original EPG pumps were replaced with another brand, and those pumps were
connected to the old control panel in a makeshift configuration, which has contributed to current
operational issues. The pumps were not functioning with the old control panel, and staff are
concerned that modifying the wiring could lead to the same issue again; therefore, staff
recommends setting these pumps aside for a future project. The correct pumps can be purchased
from EPG for $10,744. The vendor for this purchase is EPG. $10,744 will be paid out of 0045041-6501-000 (Equip & Machinery >$1000.)
Administrator Johnson inquired as to the level of the pond at the current moment; Mr. Riley
stated the pond’s level is currently okay.
Commissioner Jackson asked if the County has had to haul leachate to the City of El Dorado’s
Wastewater Treatment Facility in the recent past; Mr. Riley stated the County has not had to do
so and has begun to take emergency excess leachate to County wells.

Commissioner Masterson motioned to approve the purchase of pumps from EPG in the
amount of $10,744. Commissioner Herzet seconded. Motion carried 5-0.

relationship, to protect the interests of the County. The Executive Session will last for fifteen
(15) minutes beginning at 9:50 a.m., with the public meeting to resume in the Commission
Meeting Room at 10:05 a.m. Commissioner Jackson seconded. Motion carried 5-0.
Present in the Executive Session were the Commissioners, County Counselor Terrence
Huelskamp and County Administrator Will Johnson.

Commission Chair Murphy reconvened the meeting at 10:05 a.m.
Counselor Huelskamp handed Commission Chair Murphy a settlement agreement for the Pioneer
Balloon Bankruptcy case in which the County agrees to pay $89,969.64 to resolve adversarial
complaint 25-05046.
Commissioner Jackson motioned to approve a settlement agreement with the liquidation
trustee for American Corp in the amount of $89,969.64. Commissioner Woydziak seconded.
Motion carried 5-0.
Administrator Johnson stated the amount of $89,969.64 will be a reimbursement for one (1) tax
payment. Funds will be held back from taxing entities during the next tax distribution occurring
in June 2026. Counselor Huelskamp stated the taxes being delinquent and then being paid within
ninety (90) days of the bankruptcy’s filing is what caused the issue in this case.

COUNTY COMMISSIONERS
Commission Chair Murphy reminded the Board that the Community Emergency Response Team
(CERT) dinner is tonight at 6 p.m. the Point Events Center in Augusta.
Administrator Johnson reminded the Board of the El Dorado Senior Center Luncheon today at
11:15 a.m.
Commissioner Jackson stated he received a call from Randy Wells after last week’s Commission
Meeting regarding information shared about bids received for Public Works shirts.
Commissioner Jackson desired to ensure the Board was notified that information they received
about Mr. Wells charging shipping on the original bid order last year was incorrect; Mr. Wells
did not charge shipping on the original bid order but did charge shipping on a subsequent order
of a small number of items.
Administrator Johnson notified the Board the County will make an offer for the Health
Department Director position today.
Blue River Valley LLC sent the Board an invitation to a ribbon cutting in Potwin for May 7th at
11 a.m.
The next K254 Corridor Coalition meeting is May 8th at 12 p.m. in Park City; Administrator
Johnson will not be in attendance at that meeting.
Administrator Johnson will meet with school districts regarding district boundary issues in the
Briar Cliff neighborhood.
Administrator Johnson will present an Artificial Intelligence (AI) policy for internal use to the
Board next week.
Administrator Johnson met with a data center, Diode Ventures, a subsidiary of Black and
Veatch, yesterday. The company is looking into southern Butler County while Beltline Energy is
investigating the El Dorado area. Diode Ventures has an operating center in the northern Kansas
City area; Administrator Johnson may ask if he can take pictures of the location.
Administrator Johnson has asked Counselor Huelskamp and Mr. Stewart to complete a draft of
data center regulations within the next thirty (30) days.
Administrator Johnson would like to adjust the fee schedule for large scale commercial
applications.
Administrator Johnson will attend a Kansas Association of City/County management (KACM)
board meeting in Lawrence tomorrow night.
El Dorado Inc held a meeting regarding data centers yesterday evening.

BACKGROUND
The EMS El Dorado station training room is used daily for training, education classes, internal
meetings, other county department meetings, and host for regional/state organization meetings. It is well
designed to accommodate mid sized groups and the technology to host remote events. The room seating
capacity is 42 people with chairs and tables and 70 seats without tables comfortably.
ANALYSIS
The current chairs are 20 + years old and need replaced due to wear and several have been retired due
to being unsafe. The tables are a variety of low cost plastic and wood tables that do not accommodate
the capacity of the room. We consistently borrow tables and chairs from the community building to host
events. Following the County bid process approved by the commissioners, we received 4 total bids.
FINANCIAL CONSIDERATION
We estimated $17,000.00 in CIP for replacement. We received 4 total bids, 3 by DemandStar and one
by email submission. The lowest bid that meets all specifications was submitted by School Outfitters in
the total amount of $14,060.00. Staff recommends awarding the lowest bid. This will be funded by

Consider approving the award of purchase for liquid asphalts for the Highway Division of the
Department of Public Works.

BACKGROUND
The Public Works Department purchases 600,000 to 800,000 gallons of liquid asphalt each year for
asphalt road maintenance work and for the annual chip seal program. In the past, price quotes were
solicited from two local distribution terminals in El Dorado. As of 2004, only one liquid asphalt
terminal is still in operation locally. Since 2004, other terminals outside the El Dorado have been
solicited for submitting price quotations for liquid asphalts. To get a fair bid comparison, Butler County
requests bid prices for pick up at the actual terminal and a separate bid price for delivery.
ANALYSIS
I will bring a tabulation of bids received for liquid asphalts and a comparison of 2020-2026 prices. Bids
were received from 3 vendors for the items requested. The primary products used by Butler County are
CRS-1H and CHFRS-2P for chip sealing and SS-1H for tack oil for patching and for overlays.

AR-26-01
I. Purpose
Butler County recognizes the value of Artificial Intelligence (AI) to improve efficiency,
enhance service delivery, and support informed decision-making. This policy establishes
governance, safeguards, and acceptable use standards to ensure AI is used responsibly,
securely, transparently, and in compliance with applicable laws and County policies.
II. Scope
This policy applies to all Butler County employees, AI systems, and County data used with AI
tools.
III. Definitions
Artificial Intelligence (AI): Machine-based systems that generate predictions,
recommendations, or decisions.
AI System: Any tool or software using AI to automate or support tasks.
Sensitive Data: Includes CJIS, HIPAA, PII, financial, legal, and security-related data.
IV. Guiding Principles
• Human Oversight: AI supports—not replaces—human judgment.
• Security & Privacy: Protect all County data.
• Transparency: AI use must be documented.
• Accountability: Users are responsible for outcomes.
• Accuracy: Outputs must be verified.
• Workforce Training: Staff must be trained on AI use.
V. Acceptable Uses
AI may be used for drafting, summarization, translation, reporting, and research on nonsensitive information. All outputs must be reviewed before use.
