ISSUES FROM PERSONS NOT ON THE ORDER OF BUSINESS
Ellis County resident Mike Werth spoke on the Tallgrass Solar project that was approved. He asked the
Commission a few questions on the solar farm on the water runoff and asked about the engineering
plans that will be in place for water runoff. He inquired if they gave up authority on the decommission
and environmental plans. He said the importance of the decommission plan needs to be considered. He
is concerned about the cleanup after the 10-year contract. Leiker responded to Werth on the agreement
of the CUP and said the agreements are still being worked out. The flood plan and engineering plans go
to the State and not the County’s jurisdiction so the County cannot do anything on that. Leiker said the
agreements will be public when all agreements are finalized. Werth asked if they would contact the
higher level on this. Berges said this is not County land. All the studies that need to be done has to be
done by the landowner and Tallgrass. The private citizen who owns the land is taking all the risk and it is
not the County to tell the landowner to do what they want with their land. He reiterated it is not a
county project. Myers said the items that Werth mentioned are part of the CUP and all items must be
addressed or the CUP can be revoked.
INTRODUCTION OF NEW EMPLOYEES
Human Resource Manager Jennifer Taylor introduced new employees: Administrative Assistant (Health)
Bobie Jennings; Motor Vehicle/Tax Collector Ashlee Parker; and promotion of Weston Pfeifer to Heavy
Equipment Operator.
ELLIS COUNTY FAIRGROUNDS DEUTSCHEFEST HALL NAMING
Ellis County resident Leo Dorzweiler is asking the Commission to consider renaming Deutschefest Hall at
the Ellis County Fairgrounds to the Loran Zimmerman Deutschefest Meeting Room. Mr. Dorzweiler
would like to recognize the late Loran Zimmerman’s efforts, money, and time spent developing the
grounds, buildings, and County fair over his lifetime. Fairground Manager has suggested to title it as a
meeting room rather than a hall to help eliminate the confusion they receive regarding rentals. The
room can only hold up to about 60-80 total, which is not large enough to be considered a hall for larger
events. His concern was to be mindful of naming rights on buildings at the fairgrounds, as it could

Page 3

create issues in the future without any guidelines on for what purpose something is named. Both are in
agreeance and acknowledged Loran Zimmermans contributions to the Ellis County Fairgrounds and feel
this name change is acceptable. Commissioner Leiker mentioned he would like to consider signage for
the building if this name change is approved. Commissioner Leiker would like to see signs made for the
Schenck and Unrein buildings all to look similar and appropriate for the three spaces. Commissioner
Younger has requested staff to look at purchasing LED signs to display events being held in each space to
help eliminate confusion from the public. If the commission would like, staff could pursue both options
for cost estimates. No know costs at this point. If signs and LED displays are purchased, there would be
funds needed for those purchases. Leiker asked why they are wanting to do this now. Dorzweiler said if
you are going to pay tribute to someone you wait until they pass on and if they do this it gives people
incentive to work harder. Dorzweiler thanked everyone that has been giving money to Unsere Leute and
any money that they will have left will go to the Historical Society in Victoria. Younger thanked
Dorzweiler for the history. Leiker said he had no concerns at this time and going forward on naming
rights, but we need to come up with a route to go in the future with naming rights. Berges commented
about the signage that will need to be done. Myers went over the signage budget and getting bids and
using the fair rental deposit funds and there is enough funds to pay for this.

COUNTY PROPERTY IN SCHOENCHEN
Kyle Zimmerman with the City of Schoenchen council is asking the Commission to consider transferring
ownership of some land to the City of Schoenchen. Over the years, members of the Schoenchen City
Council have discussed the option of transferring ownership of a small piece of property in Schoenchen
to the city of Schoenchen. If the commission is okay with the request, staff could work with legal counsel
to start the process and have the final documents for approval at a future meeting. Zimmerman said the
County has owned the property since the 1940’s. He said there is not much of a deed on it. County
Counselor Jeter said the statute says the County can transfer the property if we retain some ownership
on it. We can deed to Schoenchen and reserve the right if it is not used for municipal purposes, it would
come back to the County and Schoenchen cannot sell it. Jeter suggested that the property get surveyed.
Jeter asked if Schoenchen would pay for the survey. Zimmerman said it will be brought up at the
meeting tonight but thought Schoenchen would pay for it. All three commissioners said they have no
problems with proceeding with the transfer.
CITIZENS COMMENT ON THE ELLIS EMS/FIRE STATION
Citizen Ellen Riedel gave comments regarding her concerns on the proposed Emergency Medical
Services facility project in Ellis. She has a petition of over 300 signatures on the opposition of the
project. She commented that the County has not been maintaining the current building. She said a new
building could be done for a fraction of the cost for metal buildings. She said Ellis is in dire need of pump
stations to pump water for fires. She said it is an abuse of authority to spend this kind of money. Leiker
asked Riedel what kind of building we are proposing. She said it is a combined EMS/Fire Station, and we
can build it far less than the 3.5 million. Berges said there is not even a design yet so there is no way no
one can say what kind of building is needed or not needed. Berges commented that the current building
is leased so it is not a county building. Berges said on this project we have been straightforward that we
are not raising taxes on this bond project. Discussion was had on the GO bond. Berges went over the
outline of the bond repayment. Riedel discussed the upkeep of the building and how that was going to
be done. Leiker said it does not mean that we would spend that 3.5 million. Myers explained the cost
needs analysis and design build.
JAIL SECURITY SYSTEM UPGRADE
Sheriff Scott Braun asked the Commission to review and approve the video jail control/access control
system. In response to the Request for Proposal (RFP) for the Video Control/Access Control System
Replacement project, Electronic Contracting Company (ECC) submitted Quote No. 80479 in full
compliance with all RFP requirements and specifications. The proposal was opened on June 12, 2026, at
1300 hours. Following the opening, the proposal was reviewed by Lieutenant Barnes and Sheriff Braun,
who identified several components and project elements that could be modified or removed while
maintaining the system's overall integrity and operational effectiveness. To bring the project cost more
in line with the County’s projected budget, ECC was requested to provide a revised proposal reflecting
those adjustments. On June 15, 2026, Electronic Contracting Company (ECC) submitted Quote No.
83983, which modified the scope of work and removed selected items to reduce costs. The revised

Page 4

proposal lowered the project cost to $359,112.49. In addition to the project cost, Electronic Contracting
Company (ECC) provided an optional Years 2–5 Care Plan at a cost of $25,054.41 per year, for a total
five-year project investment of $459,330.13. By committing to the multi-year Care Plan at the time of
purchase, Ellis County would save $3,340.53 annually, resulting in a total projected savings of
$16,702.60 over the five-year period. The revised proposal provides Ellis County with a modernized
video and access control system while reducing the initial project cost and offering long-term
maintenance and support savings through the optional Care Plan agreement. It should also be noted
that at least one additional proposal was submitted; however, the vendor failed to comply with the RFP
requirements and instructions. As a result, the proposal was deemed disqualified from consideration.
Leiker asked if this would be like other jails throughout the state. Braun said yes, it is similar and is a
Lenox system. Leiker asked about life expectancy. Braun said to get 13-15 years is good and said this is a
very good life span. Berges asked about the financing. Braun explained the 5-year contract, and this
would be covered under contractual services and not under the bond, but if the commission wanted it
under the bond, he could do that. Berges asked when this gets paid. Braun said this would be budgeted
every year. Younger asked if this is a safety thing for the personnel. Braun said this is the heart of the
system and is the reason why we can keep employees down and if this would go down, we would have
to increase staff to make sure everyone is safe. Leiker said some of this was preplanned and Braun said
yes, it has been talked about for quite some time.

COURTS/REPATH SOFTWARE UPDATE
Court Administrator Mike Smith and Chief Court Services Officer Teressa Greenwood updated the
Commissioners on the Repath software that was purchased in December. The software is a tool to use
on high-risk supervision and bond cases that gives location, curfew checks, text messaging for
appointments and drug testing. This tool has been used to protect victims of abuse and gives the Court
Services office a proactive approach to supervision that was not available before. Repath was previously
purchased with Opioid funds and is scheduled for renewal next year. The renewal rate for this is
$14,235.00 if we choose to continue with the service. Greenwood gave an update on the software.
There are currently 7 people on the program, and they are supervised before they are sentenced. They
are supervised by this software, and they are alerted when the defendant is near a zone where they
should not be. It alerts them of their curfew times and their travel. Leiker asked if this has been used to
pick someone up that has violated the program. Greenwood said yes, they have had to pick people up
for violations. Smith said this tool gives insight on someone that they do not know and on their
behavior. The Commissioners thanked them for the update.
MOTOR VEHICLE FEE CHANGES RESOLUTION 2026-13
Treasurer Vern Ruder asked the Commission to adopt the additional $5 transaction fee and approve
Resolution 2026-13 to begin on January 1, 2027, and end on December 31, 2028. With the approval of
Senate Bill 325, we now have an opportunity to address long-term funding challenges for county motor
vehicle operations. This legislation is designed to help ease the reliance on property tax dollars by
providing a more sustainable funding structure for these services. By properly funding the motor vehicle
department with both state support and commission approval we can begin to reduce the burden
currently placed on local taxpayers. The goal is to ensure that the department is financially supported
through its own operations, rather than depending on property tax revenue to make up for shortfalls in
state funding. Moving forward, this funding approach creates a reliable revenue source that will help
stabilize the department’s budget. It will be implemented through motor vehicle-related transactions,
including registration renewals, online renewals, and title processing. Ultimately, this shift allows us to
better align funding with services, while also providing meaningful property tax relief for our residents.
Ruder said that 70 percent of the treasury duties are motor vehicles. He said over $600,000 of his
budget is motor vehicle. He said this new legislation will generate money for the county. He
recommends that we adopt an additional $5 fee to help reduce the amount of property tax support
needed. Leiker said it can be from $5 to up to $10. Ruder said the $5 is already implemented, and that
he is asking for the additional $5 to be implemented and this would save money off the property tax
side. Berges commented that the $5 already went into effect, and this $5 is only allowed for 3 years.
Ruder said after 2029 this is a test for the State to see if we do need more motor vehicle funding. Ruder
said all the money will be funding 7 people in his office. He said he will be able to show the State that
this is helping fund the motor vehicle side.

COLA ADJUSTMENTS AND ELECTED OFFICIALS’ SALARIES RESOLUTION 2026-14
County Administrator Darin Myers asked the Commission to approve the 2026 COLA adjustments. In
2024, the Ellis County Commission approved the creation of a new Compensation Policy for employees
because of a study completed by staff working with the Arnold Group. Per the Compensation Policy,
each year the county commission can provide a cost-of-living adjustment (COLA) to county employees.
In determining a COLA adjustment, staff is to review the previous 3-year COLA average as identified by
the Social Security Administration. This rate for 2024 = 3.2%, 2025 =2.5%, and 2026 is 2.8%. That
makes a 2.8% adjustment for the 3-year average. COLA adjustments are considered to assist in keeping
wages and salaries on par with inflation. According to the Midwest Region CPI, the current inflation rate
for Kansas is right at 5%. Additional reasons for considering COLA adjustments are to: Keep the current
compensation policy and pay scale up to date, retain our talent, Boost morale and productivity, stay
competitive in the labor market, prevent wage compression, enhance Ellis County reputation for
attracting new talent. Moreover, COLA adjustments are more than a simple pay increase, as it is a
strategic tool for workforce stability. The risks of not approving adjustments can lead to hidden costs
involved in employee turnover, disengagement, and reputational damage. However, all factors must be
reviewed when considering budgets. Considering this 2.8% COLA adjustment, the attached documents
show the budget adjustments needed to implement the changes throughout each department, the
updated pay scale, and the resolution to adjust the salaries for elected officials. The adjustment was
also shared with the Wage & Benefits committee. Their next meeting is July 13th to meet with the
county’s insurance consultant and Blue Cross Blue Shield about the concerns regarding BCBS around the
state. The amount budgeted for a 2026 COLA adjustment is $220,186. However, by reviewing the
updated employee status, several positions in Ellis County have not filled throughout the year. The
attached spreadsheet would reduce a couple department’s budget authority for those positions for the
terms of being unfilled. Those funds would instead be used for the COLA adjustments. Also, the 2026
health insurance renewals were less than budgeted, so those current amounts were updated, which
have also been adjusted throughout all departments. In total, to implement the adjustments, the
budget stabilization line would be reduced by $2,132 which is then distributed as needed throughout all
departments to implement the 2.8% adjustment.
Motion:
Berges

I move to approve the attached budget adjustments, pay scale, and Elected Officials Salary Resolution

SUGGESTED MOTION LANGUAGE: I move to authorize PO # 7999 for $5,977.27 for the purchase of dispatch
consoles and cabinets from Xybix.
DISCUSSION:
On May 19, 2026, the Board of County Commissioners authorized purchase order #7997 for the purchase of
dispatch consoles and cabinets from Xybix. During a pre-order review of the required monitor configuration, it
was discovered that 4 of the 5 consoles quoted were incorrectly undersized and would not support the required
monitor configuration. A smaller portion of the increase is a result of us identifying the correct cables that are
needed to connect the monitors to their respective computers. These adjustments resulted in a net increase to
the quote of $5,977.27. Even with this increase, Xybix’s offer remains the lowest quote.
FINANCIAL IMPACT: This will increase the amount to be paid by the bond proceeds but remains less than
original budgeted estimates for the dispatch consoles and cabinets, had they not been included with the bond
project.

☐Yes ☒No

SUGGESTED MOTION LANGUAGE: None
DISCUSSION:
At the June 9th Commission meeting, ACCESS Transportation presented their 2027 budget request for
financial assistance from Ellis County. ACCESS has also presented their information to the City of Hays for their
portion of funding requests. During these discussions, information has been released about the financial
struggles of the operation, lack of funding, and thus has started to reduce services. As part of the discussions,
it has been suggested to form a task force to look at the organization, the operation, and funding strategies.
An Ellis County Commissioner has been requested to be a part of that task force, and this agenda is for the
board to discuss who can serve on the task force.

ELLIS COUNTY

AGENDA ITEM COVER SHEET

COMMISSION AGENDA DATE: July 14th, 2026
TOPIC: 2027 2nd Draft Budget
ACTION REQUESTED: Hear update and discussion on county budgets.
MOTION NEEDED:

☐Yes ☒No

SUGGESTED MOTION LANGUAGE: None
DISCUSSION: The next step in the budget process is to review the second draft budgets from
department heads and elected officials. The total estimated assessed valuation change from the
November 2026 abstract increased by roughly .2%, while the current inflation rate is roughly 5%.

The following budget documents show the all the county budgets to date, which include:
• Estimated 7% increase in health insurance premiums,
• Estimated 10% increase on property, vehicle, and liability insurance with KCAMP,
• Court appointed attorney salary increases – 2nd year,
• Bond Payments paid from reserves, which are not impacting 2027 tax levels,
• Decrease in $300,000 in interest rate revenue,
• Removal of $425,865 of Oil & Gas Depletion revenues,
• Salary adjustments,
• Same staffing levels as 2026,
• Essentially the same levels of transfers to reserves as 2026,
• Requested amounts for outside agencies.
There are still several items that need continued discussion as the end of the budget process
nears. They are as follows:
• Outside agencies requests are essentially flat from $1,334,158 in 2026 to $1,332,978 in
2027
o ACCESS Transportation 2026 = $50,000 2027 total request = $88,962 which is not
included in the above total amount.
• Consideration of additional Detention Officers for the Sheriff’s Office,
• Need for a facilities maintenance position for the Ellis County Fairgrounds.
The Ellis County Fire Department is essentially flat, with only a $1,215 increase from 2026.
Reserve funding is still included per the fire department’s capital plan. The fire districts budget
more heavily relies on oil valuations in the county. The total estimated assessed valuation for the
rural part of Ellis County decreased by 4.5%.
As a reminder, the Solid Waste budget is not funded by property tax dollars. This is an Enterprise
Fund, which its revenues are from those who use the facility. The proposed 2027 budget includes
the planned expansion on the north side of the transfer station building, current transfer station

Page 18

floor replacement, and a purchase of a backhoe replacement. Taking these three expenses out of
the budget, the budget is a balanced budget. Including these projects in the budget will create a
reduction in the unencumbered cash in this fund. This will not have an impact on future budgets or
require any price increases for the facility to customers.
On Wednesday July 15th and Thursday July 16th, the County Commissioners will hold special budget
meetings with all the department heads and elected officials to go over their individual budgets.
FINANCIAL IMPACT:

Currently, there is no financial impact for 2026 or 2027.

ELLIS COUNTY

AGENDA ITEM COVER SHEET

COMMISSION AGENDA DATE: July 14th, 2026
TOPIC: Revenue Neutral Rate
ACTION REQUESTED: Advise staff on the commission’s intent to exceed the Revenue Neutral Rate.
MOTION NEEDED:

☒Yes ☐No

SUGGESTED MOTION LANGUAGE: I move to approve the attached Revenue Neutral Rate letters to be
signed and completed by the County Administrator to be sent to the Ellis County Clerk to exceed the
Revenue Neutral Rates for the 2027 budget year for the general and fire department funds.
DISCUSSION:
Per state statute, each year the County Commission must decide whether to exceed the Revenue Neutral
Rate (RNR) for the following years’ budgets. If the commission is weighing the possibly of keeping the mill levy
flat, raising the levy, or even with projecting a slight decrease, it necessary to notify the County Clerk of the
intention to exceed the revenue neutral rate. This can also change the process slightly for the timeline of
when the budget is submitted.
The RNR rates are as follows per the County Clerk:
• General Fund - 2026 Mill Levy = 38.118, 2027 RNR mill levy rate = 40.717
• Fire District - 2026 Mill Levy = 3.924, 2027 RNR mill levy rate = 4.398
No matter if the RNR is exceeded or not, the commission must hold a public hearing before voting to adopt
a budget. That hearing is scheduled to be held at 8:30 am on September 8th, 2026, in the Ellis County
Commission Chambers at the commission meeting.
As the budget process completes in the coming month, this decision does not force the commission to
exceed the RNR rate but only gives the possibility to do so. If not approved, the commission cannot finalize a
budget that requires any property tax more than the current levied amount.
With the commission’s different budget goals being considered for 2027, and continued budget
discussions between the commission and staff, it is expected the RNR rate will be exceeded for the 2027
budget. The final exact figures cannot be figured yet as the commission finalizes the budgets over this last
final month, however they are currently only estimates.
The valuations used for calculating the General fund increased very slightly from $540,415,783 as of the
November 2025 Abstract to a June 2026 estimate of $541,415,783. This equates to about a .2% increase.
The valuations used for calculating the Fire District’s General Fund decreased from $186,042,457 to
$177,524,353.
Further work over the next two months with the budget will allow ample time to make any reductions or
changes to meet the commissioners’ budget goal. However, with this draft of the budget the General Fund
would need an estimated $22,031,977 in tax revenue for 2026 for the 2026 budget with an estimated mill
levy rate of 40.717. The Fire District would need an estimated $790,319 in tax revenue in 2026 for the 2027
budget with an estimated mill levy rate of 4.398.
