COMMENTS FROM THE PUBLIC.
Jeff Hartl (37765 Cresent Hill Road) ~ The citizens are discontent with the city
government and feel forsaken. The Kansas Geological Survey warns that some parts of Kansas
do not have enough ground water for crop irrigation, livestock and human consumption. Why
are we being asked to sacrifice our drinking water to cool these data centers? The strength of
Osawatomie has never come from big industrial corporations. It comes from generations of
people, open spaces, and local businesses. We should not still be considering a data center.
Ian Day (36397 W. 367th Street) ~ There has been a new forever chemical submitted to
the EPA to be used in closed loop systems. It is called Opteon 2P50. It is highly toxic to anyone
handling it, aquatic life and the soil. When it breaks down it creates two forever chemicals. One
in the air and one in the water. It cannot be filtered out with water treatment filters and we do
not know how toxic this is to humans.
Polly Plain (330 Main St.) ~ Polly read the seven deadly sins from Laura Carter of
Virgina illustrating how they apply to the data center and leadership in Osawatomie.
Chasity Hendrickson (29980 W. 335th St.) ~ I do not support rezoning the additional
acreage from residential to industrial use. Farmland is precious & should be preserved. This
comment was emailed.
PUBLIC HEARINGS. – None.
PRESENTATIONS, PROCLAMATIONS AND APPOINTMENTS – None.
UNFINISHED BUSINESS.
ORDINANCE 3882 – APPROVING FRANCHISE AGREEMENT WITH EVERGY (no
action) - The city's franchise agreement with Evergy expired several years ago and has not been
renewed. As a result, the city was able to assume electric service responsibilities for the State
Hospital and several other properties located north of the Marais des Cygnes River that were within
the city limits.
Historically, the amount of franchise fee revenue generated through Evergy's facilities within the
city has been relatively limited. However, the city has recently been approached regarding a
potential development project in the Northland area that, if constructed, could result in
substantially increased electric consumption on properties that may be served by Evergy.
Now that three of those parcels are being considered for a data center complex, the demand for
electricity is significant and we will want to have a franchise agreement in place. The previous
agreement percentage was 5% and that is the number that has been provided to the developer for
consideration in the community benefits analysis. The franchise agreement will be applicable to
all Evergy served parcels within the City of Osawatomie, of which, there are very few, all south
of Pottawatomie Creek.
This franchise agreement has been negotiated and the modifications have been accepted by
Evergy. Our city attorney has also reviewed the agreement. Evergy published their notice to the
public of their intent to enter into this agreement in the July 8th edition of the Miami County
Republic, which is a requirement of them in state law. Motion made by Schasteen, seconded by
Macek to approve Ordinance 3882 – Granting to Evergy Kansas Metro, Inc., a Kansas
Corporation, it’s successors and assigns, an electric franchise, prescribing the terms thereof and
relating thereto, and repealing all ordinances or parts of ordinances inconsistent with or in conflict
with the terms hereof as presented. Yeas: all.
RESOLUTION 1389 – EXTENSION OF TIME REQUEST – 715 PACIFIC - In May the
council approved Resolution 1378 allowing a company to salvage the home at 715 Pacific. While
it doesn’t appear that a lot of work has happened on the property to date, the builders have been
working on getting the engineering and testing out of the way (asbestos and lead paint tests have
been conducted, but unsure if remediation has occurred yet). The builder has sent a detailed
message to staff explaining what has transpired at the property since the approval to save the house
was granted, and they’re also requesting a two-month extension.
These were the conditions placed on the property in Resolution 1378:
1. Work begins on June 1 and must be completed by August 31.
2. $10,000 shall be deposited with the city to cover the costs of demolition in the event
work is not completed by August 31.
3. Permits shall be pulled.
4. Work to be performed shall include, but not be limited to:
a. Repair or replacement of the foundation; to include jacking up the house if
needed;
b. Replacement of any damaged floor joists;
c. Replacement of the roof, including adding additional trusses and/or new
sheeting as needed;
d. Completely new electrical system;
e. Completely new plumbing from the meter to and throughout the house to
remove any lead, galvanized or copper pipes;
f. Gas system pressure tested and replaced if necessary;
g. New siding;
h. A lead paint and asbestos test shall be formed. Test results shall be provided to
the city Building Inspector and any lead or asbestos that is discovered shall be
abated in accordance with state environmental regulations;
The supplemental information attached to this agenda item include the framing plans for both the
first and second floors, the invoice from the engineering firm, as well as the builder’s explanation
of what has been done to the property thus far. Motion made by Bratton, seconded by Filipin to
approve Resolution 1389 – Granting an additional three (3) months (until November 30, 2026) to
complete the required repairs and obtain a certificate of occupancy on the house to restore 715
Pacific Ave. Yeas: All.
NEW BUSINESS
RESOLUTION 1388 – 510 MAIN DEMOLITION AND RETURN OF HEAL GRANT–
The developer and their contractor have done a more extensive evaluation of what it would take
to salvage the building and believe that the costs to just stabilize the building, let alone the costs
to make it useable are incredibly prohibitive. The risks involved with stabilizing the building are
too great and the cost to demolish and build a new building is less than the cost to save the existing
building.
Staff would recommend that the council approve this resolution which will terminate the HEAL
grant with the Department of Commerce as well as authorize an RFP to take the building down.
Once bids are received and opened, staff will bring them to the council with a recommendation of
award. Additionally, since the project has changed significantly, we need to amend the
development agreement to reflect the changed nature of the project as well as incorporate a
schedule of work. The goal has always been to transfer this out of city ownership and back to the
private sector, and the sooner that happens the better.
The timeline for this project started in December of 2024 with the search for a developer. In June
of 2025, US Federal Properties viewed the building, made an offer, and we worked through a basic
development agreement. In October 2025 the development agreement was approved for both 500
and 510 Main, as was an authorization to apply for the HEAL grant. Motion made by Filipin,
seconded by Henness to approve Resolution 1388 – Authorizing city staff to terminate the Historic
Asset Lifeline (HEAL) Grant with the Kansas Department of Commerce and issue an RFP for the
demolition of 510 Main as presented. Yeas: All.
RESOLUTION 1390 – ACCEPTANCE OF SHOOT HOUSE PAINTBALL OPTION TO
PURCHASE - Resolution 1250 was approved by the council on August 8, 2024 and it approved
an LOI and lease agreement with an option to purchase the land. The price of the land was
established based on an appraisal that was performed on the property prior to the lease agreement
being executed in June of 2025.
Title to the property remains with the city until the Lessee exercises their right to purchase the
property. The owners of Shoot House Paintball have exercised their right to purchase the property
and in order to complete the sale and secure title insurance, the underwriters for the insurance
company have requested a resolution be adopted by the council accepting and confirming the sale
of the property to Shoot House Paintball. The property is 10.53 acres and the agreed upon price
was $57,430.62. Motion made by Schasteen, seconded by Filipin to approve Resolution 1390 –
Accepting Shoot House Paintball’s exercise of its option to purchase city owned land as presented.
Yeas: All.
EXECUTIVE SESSION – None.
COUNCIL REPORTS
Derek Henness ~ I am happy we are back in Memorial Hall. Doug Walker and Lloyd
Builders did a tremendous job. Doug took a personal role in this and I want to give him the credit.
Lawrence Dickinson ~ The remodel of Memorial Hall is spectacular. Now we need to get
the outside completed.
MAYOR’S REPORT
Nick Hampson ~ Memorial Hall is a wonderful re-addition to our community. We
appreciate everyone that worked on it and they did a great job.
CITY MANAGER & STAFF REPORTS.
Bret Glendening ~ We've received the initial GMAX number. It is between $34 and $35
million. The reason we cannot give a specific amount is we are still going through the line items
and want to make certain that nothing is included that we don't need and that everything we do
need is included. Two things included in the $34-$35M GMAX are a couple of contingency
numbers. The first contingency is for subsurface risk and that is in the amount of approx. $1.3M.
If the contractor doesn't run into any more rock than they have estimated, we will get this
contingency back. Releases from contingency must be approved by both the engineer/owner's
advisor and the city council. The second bucket of contingency is related to the work at the
intake structure. It too is approximately $1.3M in value, and it is considered an "allowance". We
know there's work there, but we cannot easily quantify it. Earlier this week we had a dive team
down from Gardner to do some exploration and try to remove some of the uncertainty
surrounding the work. The best-case scenario for the cost of the new water plant is slightly over
$31M. On top of that, we have to add the CMAR fee which is between $3-$4M. Worst-case
scenario is the plant costs between $34 and $35m, and we add the $3-$4M CMAR fee. Again, all
of these are still preliminary as we are still working through the GMAX. Once staff and
engineering are comfortable with the number, we will have an amendment to the CMAR contract
on the agenda for the council to approve.
Michele Silsbee ~ This week we released an invitation to bid on repairs to city owned
buildings and structures from the April hailstorm damage. Contractors do not have to bid on the
whole package they are able to bid on a single building, by trade or what they feel comfortable
being able to bid on and complete the work on. There are twenty pieces of property listed. 500
Main is one of those. There is a roof repair listed and we will see what all that covers and then we
can have more conversations about it. I am really hoping that we can get that roof solidified in a
way that we don’t have to revisit it after this bid process.
Bret and I did have a conversation with BG Consultants to ask them to do a feasibility study on
using our remaining right of way at Carr Ave. as a potential solution for a pedestrian overpass
bridge. They are going to examine if it would be feasible to build a new overpass structure in that
right of way. The reason we are looking at that right of way is because the railroad has told us that
we will not be allowed to put any kind of structure in their right of way. The piers of our current
overpass are in the railroad right of way so a rebuild or an adjustment to the existing overpass is
likely not in the question.
OTHER DISCUSSION/MOTIONS.
Motion made by Bratton, seconded by Schasteen to adjourn. Yeas: All. The mayor
declared the meeting adjourned at 6:39 p.m.

RE: Resolution 1391 – Authorize installation of Jefferson Highway Route Markers and Historical Interpretive Sign
RECOMMENDATION: Osawatomie City Council approve Resolution 1391, as recommended by the Tourism Committee
DETAILS: The Jefferson Highway was established in 1915 as one of the first named auto trails in the United States,
running approximately 2,300 miles from Winnipeg, Manitoba, Canada to New Orleans, Louisiana. Named in honor of
President Thomas Jefferson and nicknamed “The Pine to Palm Highway,” the route predates the U.S. numbered highway
system and represents a significant chapter in early American automobile travel and road development.
The Jefferson Highway passed directly through Osawatomie, traversing the community’s historic street network and
crossing the Marais des Cygnes River via the 1st Street bridge, commonly known as the Asylum Bridge. Osawatomie’s
position along the Jefferson Highway is a genuine piece of local and national transportation history that is currently
unmarked within the community. The Tourism Committee initiated this project to recognize and promote that history. The
Jefferson Highway Association continues to support communities along the corridor in installing route markers, and a
number of Kansas communities have done so in recent years. Placing markers in Osawatomie would connect the City to
that broader network and give residents and visitors a tangible reference point for this piece of the community’s past.
The Tourism Committee considered the proposed resolution at its meeting on August 6, 2026 and approved it,
recommending it to City Council for adoption. The committee is proposing 2-3 signs to be installed at or near the
Osawatomie State Hospital right-of-way, near the historic Asylum Bridge at 1st Street, and potentially at a third location
to assist motorists in following the Jefferson Highway route through town during the current closure of the Asylum
Bridge. Eventually, a single interpretive sign explaining the history and significance of the Jefferson Highway and its
route through Osawatomie would be installed near the Asylum Bridge or at another appropriate location along the corridor
as determined by staff and the Tourism Committee.
The project is low-cost and partially funded by a private donation of $250 already in hand. Estimated costs are as follows:

RESOLUTION No. 1391
A RESOLUTION AUTHORIZING THE INSTALLATION OF JEFFERSON HIGHWAY
ROUTE MARKERS AND A HISTORICAL INTERPRETIVE SIGN WITHIN THE CITY
OF OSAWATOMIE
WHEREAS, the Jefferson Highway was established in 1915 as one of the first named
auto trails in the United States, stretching approximately 2,300 miles from Winnipeg, Manitoba,
Canada to New Orleans, Louisiana, and earning the nickname “The Pine to Palm Highway”; and
WHEREAS, the Jefferson Highway passed through the City of Osawatomie, Kansas,
traversing the community via its historic street network and crossing the Marais des Cygnes
River by way of the historic bridge at 1st Street, commonly known as the Asylum Bridge, which
served as a key crossing along the route; and
WHEREAS, the Jefferson Highway Association continues to promote and preserve
awareness of the historic route, and communities along the corridor have installed route markers
to help travelers and residents identify and appreciate the highway’s path through their towns;
and
WHEREAS, the current closure of the Asylum Bridge creates a need for supplemental
wayfinding signage to assist motorists in identifying the Jefferson Highway route through
Osawatomie; and
WHEREAS, the Tourism Committee of the City of Osawatomie has recommended the
installation of Jefferson Highway route markers at two to three locations within the City,
including in the right-of-way near the Osawatomie State Hospital and near the historic Asylum
Bridge at 1st Street, as well as a historical interpretive sign explaining the Jefferson Highway’s
history and significance to Osawatomie; and
WHEREAS, a donation of $250 has been received to support the cost of this project, and
the remaining costs are estimated to be modest and within the Tourism Committee’s available
resources.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY
OF OSAWATOMIE, KANSAS:
SECTION ONE: The Governing Body hereby authorizes the installation of Jefferson
Highway route marker signs at two to three locations within the City of Osawatomie, including
in the public right-of-way near the Osawatomie State Hospital and near the historic 1st Street
Asylum Bridge, and at such additional location as staff and the Tourism Committee determine is
appropriate to assist motorists in following the Jefferson Highway route through the community.
SECTION TWO: The Governing Body further authorizes the installation of a historical
interpretive sign at or near the Asylum Bridge location, or such other location along the Jefferson
Highway corridor as staff and the Tourism Committee determine to be most appropriate,
explaining the history and significance of the Jefferson Highway and its passage through
Osawatomie.
SECTION THREE: The City Manager or designee is authorized to coordinate with the
Kansas Department of Transportation and any other applicable agency as necessary to secure
right-of-way approval for sign placement, and to execute any agreements or permits required for
installation.
SECTION FOUR: The donation of $250 received in support of this project is hereby
accepted, and funds are authorized to be expended for materials, posts, hardware, and any related
costs associated with the fabrication and installation of the signs authorized herein.
PASSED AND APPROVED by the Governing Body of the City of Osawatomie, Kansas,
this 27th day of August, 2026, a majority voting in favor of.
APPROVED and signed by the Mayor.
