CITY COUNCIL MEETING DATE:

November 2, 2026

TO:

Mayor & City Council

FROM:

Eric Johnson, Community Development Director

SUBJECT: Rezone Parcel 395-0133-00040 from C-1, Office/Light Industrial to C, Commercial

☐ RESOLUTION:

☒ ORDINANCE:

2026 -04

☐ OTHER:

REQUESTED ACTION
Amend the Hermantown Zoning Map by converting approximately 6.0 acres of C-1, Office/Light
Industrial zoning district to C, Commercial zoning district.
DESCRIPTION OF REQUEST:
The Applicant (Vermillion Homes) is requesting a rezoning of Parcel 395-0133-00040 from C-1,
Office/Light Industrial to C, Commercial.
SITE INFORMATION:
Parcel Size:
+/- 6.0 acres
Legal Access:
Norway Pines Place
Wetlands:
None per the National Wetland Inventory. Will need to be verified prior to
development
Existing Zoning:
C-1, Office/Light Industrial
Airport Overlay:
Zone 3
Shoreland Overlay:
N/A
Comprehensive Plan: Commercial
BACKGROUND:
The Applicant, who owns the property, has been marketing parcel 395-0133-00040 for a number of years.
The Applicant is currently in negotiations with a company who is interested in a portion of the parcel in
order to locate an auto/truck sales, repair business. The proposed use is allowed with a Commercial
Industrial Development Permit (CIDP). However, in addition to the future proposed business, which will
require submittal of a CIDP application, the applicant is pursuing an administrative parcel split of the
parcel as well.
A public hearing for the rezoning application was held on October 20, 2026. There were no members of the
public who spoke regarding the application. The Planning and Zoning Commission recommended the
application on a 7-0 vote to the City Council for their review and approval.
In 2023, the City rezoned parcels 395-0133-00020 and 395-0133-00040 from C, Commercial to C-1
Office/Light Industrial in order to accommodate a potential landscape contractor business. However, the
proposed business did not purchase the property and it has been on the market since then. The C-1,
Office/Light Industrial zoning district has minimum lot width and size standards, which the proposed
business would not meet as the proposed business is looking to purchase a 3 acre portion of parcel 395Working together to serve and build our community.

0133-00040 and not the entire 6 acres. The C, Commercial zoning district does not require a minimum
lot width or lot size and would allow for the subdivision of the property in order to accommodate the
proposed business and create an additional lot for future development.
Airport Overlay Zone 3
The property is located in the Duluth International Airport Overlay Zone 3. Additional regulations on the
height of structures, lighting, and communication equipment are in effect in Zone 3. Structures in Zone 3
cannot exceed 1,580 feet above sea level. Ground level elevation on the site ranges from 1,450 feet to
1,490 feet above sea level. Development can take place on the property and remain in compliance with
the Zone 3 standards. Current City zoning regulations impose a maximum building height of 45 feet
mitigating the likelihood of approaching the Zone 3 elevation limit.
Comprehensive Plan
The property is identified as Commercially guided land per the 2045 Comprehensive Plan. The Plan
defines this as ‘Land guided for large and small-scale commercial business providing goods and services.
This includes food and beverage, entertainment, offices, and regional-scale malls, shopping centers of
various sizes, freestanding large-format stores, freestanding smaller businesses, multi-story office
buildings, automobile dealerships, and institutions. Buildings should be scaled appropriately to the
surrounding neighborhood with appropriate buffers and pedestrian connections provided between
commercial areas and adjacent residential neighborhoods. Commercial areas are located in places with
visibility and access from the regional highway system.’
The land is currently zoned C-1, Office/Light Industrial Zone District which is intended for low-density
office, light industrial, limited commercial services, and public service developments.
The proposed zoning is for C, Commercial. The Commercial Zone District is intended to provide suitable
areas within the community for the grouping and establishment of general retail sales, offices,
professional buildings and service businesses. It is intended to provide convenient retail facilities for the
residents of Hermantown and the surrounding area.
The property does not have frontage or visibility from Miller Trunk Highway so it is not a primary site for
retail or high traffic service businesses. The site had been considered for a multi-residential development
in the past but the noise generated by proximity to the airport runway limits its potential for residential or
high value office space.
Development Permitting
The applicant is currently in negotiaitions with an auto/truck sales, repair business for approximately 3
acres of parcel 395-0133-0040 in order to locate the business to the parcel. Auto or truck sales, repair,
parts or supplies allowed in the C, Commercial zoning district and do not require a minimum lot width or
lot size, however the C-1, Office/Light Industrial zoning district does have minimum lot width and size
standards, which the proposed business would not meet. Any future development of the property will
require submittal of a Commercial Industrial Development Permit (CIDP) application.
A decision on rezoning property is independent of any decision on permitting development of a property.
Rezoning does not imply approval of future development. Any future development will have to meet all
City regulations including zoning, stormwater management, wetland processes, and others and is required
to have an approved Zoning Certificate/Commercial Industrial Development Permit.

Working together to serve and build our community.

RECOMMENDATIONS AND FINDINGS:
A review of the existing and potential land uses of the property, support rezoning the property to C,
Commercial. Staff recommends approval of the rezoning based on the following findings:
1. Notices of Planning and Zoning public hearing were mailed to property owners 350’ from project
boundary. A public notice for the Special Use Permit was posted in the October 8, 2026
Hermantown Star.
2. The proposed rezoning meets the criteria of the Comprehensive Plan and the overall goals and
policies of the Zoning Ordinance, is suitable for the proposed zoning, and is compatible with
surrounding zoning and land uses.
3. The Applicant will be required to pay park dedication fees consistent with the requirements of the
City Zoning Ordinance.
4. The approval only extends to the rezoning of parcel 395-0133-00040. The rezoning of the
property is independent of any decision on permitting development of a property. Rezoning does
not imply approval of future development.
5. Any future development will have to meet all City regulations including zoning, stormwater
management, wetland processes, and others and is required to have an approved Zoning
Certificate/Commercial Industrial Development Permit.
6. The Applicant shall sign a consent form assenting to all conditions of this approval.

The City Council of the City of Hermantown does ordain:
AN ORDINANCE AMENDING TITLE 2 OF THE HERMANTOWN CITY CODE
BY AMENDING THE OFFICIAL ZONING MAP OF PARCEL

395-0133-00040
Section 1. Amendment to Official Zoning Map. The Official Zoning Map of the City of
Hermantown is hereby amended so that Parcel 395-0133-00040 is zoned C, Commercial. See Exhibit A
for Legal Description.
Section 2. Purpose and Intent. The purpose of this amendment is to rezone Parcel 395-0133-00040
to C, Commercial with the following Findings of Fact:
Findings of Fact.
1.
The Planning Commission of the City of Hermantown (“Planning Commission”) held a
public hearing on the rezoning request on October 20, 2026 at which time all parties desiring to be heard
were afforded the opportunity to be heard.
2.
A rezoning to C, Commercial is compatible with the surrounding uses as it mirrors the
existing development patterns of the surrounding/abutting parcels.
3.
A rezoning to C, Commercial allows for the maximization of existing water and sanitary
sewer infrastructure.
4.
The Land falls within the City’s Urban Services Boundary. Sanitary sewer and water
mains are within the adjacent right of way of Norway Pines Place.
5.
Notices of Planning and Zoning public hearing were mailed to property owners 350’
from project boundary. A public notice for the Special Use Permit was posted in the October 8, 2026
Hermantown Star.
6. The proposed rezoning meets the criteria of the Comprehensive Plan and the overall goals
and policies of the Zoning Ordinance, is suitable for the proposed zoning, and is compatible with
surrounding zoning and land uses.
7.
The Applicant will be required to pay park dedication fees consistent with the
requirements of the City Zoning Ordinance.
8.
The approval only extends to the rezoning of parcel 395-0133-00040. The rezoning of
the property is independent of any decision on permitting development of a property. Rezoning does not
imply approval of future development.
9.
Any future development will have to meet all City regulations including zoning,
stormwater management, wetland processes, and others and is required to have an approved Zoning
Certificate/Commercial Industrial Development Permit.
10.

The Applicant shall sign a consent form assenting to all conditions of this approval.
