Chairperson Doheny asked the applicant about their listed business hours. Mr. Edberg stated the operational hours are
mostly in fall and winter when boats are being put into storage and then again in late spring when boats come out of
storage. The applicant estimated eighty percent of the boats they store are picked up by his employees and brought to
the site for storage. He also explained there is a locked gate that prevents someone from accessing the property after
hours but folks occasionally drop their boats during off hours.

FOLLOW-UP QUESTIONS AND COMMENTS FROM THE PLANNING COMMISSION:
Commissioner John King asked the applicant if they would offer outdoor storage. The applicant stated they would still
offer outdoor boat storage on the parcel to the south where that activity is allowed under an existing permit. No outdoor
storage would be allowed on the subject parcel.
Member Krenik asked the applicant if the business has (or plans to) incorporate any security measures. Mr. Edberg
stated the business incorporates a series of security lights, cameras, and alarms throughout the site and the access drive.
There is also a gate along the access drive that prevents vehicles from accessing the property during off hours.
Member Tina King asked the applicant if his business winterizes boats. Mr. Edberg stated they do winterize boats and
then wrap them for outdoor storage on the southern parcel.
Chairperson Doheny asked the applicant to confirm whether the listed number of five vehicle trips per day was accurate.
Mr. Edberg stated five vehicle trips per day is accurate when considering the total traffic the business generates
throughout a calendar year.

ITEM #3:
LE SUEUR COUNTY ZONING ORDINANCE AMENDMENT:
Amendments to the Zoning Ordinance to affect Section 1 - Purpose & Intent, Section 2 - Title,
Section 3 - Statutory Authorization, Jurisdiction, Scope & Interpretation, Section 5 - Classification of
Districts, Section 20 - Mineral Extraction, Section 27 - Essential Services, Section 28 - Cannabis
Businesses, Section 30 - Violations & Enforcement, and Section 31 - Validity.
Aaron Stubbs asked the members of the Planning Commission in what order they would like to proceed. The consensus
was to review a section one at a time and in numerical order. The Planning Commission would provide comments, then
accept public comments, and make a motion, before moving onto the next Section.
1.
SECTION 1 – Purpose and Intent:
a.
Provided a more detailed Purpose and Intent Section.
b.
Included specific citations of MN State Statutes that allow the County to create zoning regulations.
PUBLIC COMMENTS:
NONE.
PLANNING COMMISSION DISCUSSION:
NONE.
Motion made by SHIRLEY KATZENMEYER to recommend APPROVAL of the proposed amendments, and to
send the proposed changes to the County Board for further review.
Second by TINA KING.
MOTION APPROVED (4-0). MOTION CARRIED.
2.
SECTION 2 – Title:
a.
Pulled this Section apart from the current Ordnance that keeps Sections 1-3 as one.
b.
Made a minor, stylistic, change to the statement that does not alter the meaning of the statement.
PUBLIC COMMENTS:
A member of the public asked whether the County’s Comprehensive Plan was approved and adopted yet. Mr.
Stubbs explained the plan was adopted back in June and was currently in use.
That same citizen asked if we needed to add a reference to the specific Land Use Plan to differentiate between the
current plan and passed plans. Mr. Stubbs explained when the current plan was adopted, it was adopted in a manner
that repealed the previous plan and replaced it with the current plan so no specific reference was necessary.
PLANNING COMMISSION DISCUSSION:
NONE.
Motion made by DOUG KRENIK to recommend APPROVAL of the proposed amendments, and to send the
proposed changes to the County Board for further review.
Second by TINA KING.
MOTION APPROVED (4-0). MOTION CARRIED.
3.
SECTION 3 – Statutory Authorization, Jurisdiction, Scope & Interpretation:
a.
Expanded the jurisdiction to cover those instances when the County must permit a septic system within the
jurisdictional boundary of a city.
b.
Clarified that sending violations to the County Attorney’s Office does not require action from the Board of
Commissioners.
c.
Updated other subdivision of the Section to make them more concise but did not propose other policy changes.
PUBLIC COMMENTS:
Marie Meyer asked for clarification on Subdivision 3 and whether this proposed change gave the County the
authority to force people to tear down their house if it no longer met the current standards. Mr. Stubbs explained the
difference between a Legal Nonconforming Structure and a Nonconforming Structure which does not have the
same protections under MN Statute as a Legal Nonconforming Structure. Mr. Stubbs stated the County would not
be making residents tear down Nonconforming Structures. He also explained if/when a resident came to apply for a
permit to repair or replace a Nonconforming Structure, if that structure was not legal at the time it was constructed
or placed on the property, the County does have the authority to compel the owner of that structure to bring it into
compliance with current standards.
Ms. Meyer stated she believed this authority results in residents not getting permits for these types of projects. Mr.
Stubbs explained that would be considered a violation of the Ordinance and let Ms. Meyer know the Planning
Commission would be reviewing proposed language for violations later in the evening.
PLANNING COMMISSION DISCUSSION:
Member Tina King asked staff about the proposed change to Subdivision 7 of this Section and if zoning violations
needed to be reviewed by the Board of Commissioners prior to being sent to the County Attorney’s Office for
possible prosecution. Mr. Stubbs explained, Environmental Services does not present open violations to the Board
for review prior to sending them to the Attorney’s office. Commissioner John King supported that statement and
added the Environmental Services Department is tasked with the enforcement of the Zoning Ordinance, that is not a
function of the Board of Commissioners.
Motion made by TINA KING to recommend APPROVAL of the proposed amendments, and to send the proposed
changes to the County Board for further review.
Second by DOUG KRENIK.
MOTION APPROVED (4-0). MOTION CARRIED.
4.
SECTION 5 – Classification of Districts:
a.
Updated the list of Zoning and Overlay Districts to match the previously proposed changes and updates to
other Sections in the Ordinance.
b.
Proposed change to Subdivision 4 – Mr. Stubbs explained that under the current Ordinance when a parcel is
detached from a city, the zoning on that parcel automatically becomes Agriculture. Mr. Stubbs gave an
example of a parcel that recently detached from the City of Montgomery but was clearly commercial. That
parcel was automatically made a Legal Nonconforming parcel which it would have been much easier to simply
zone it commercial when it was being detached.
PUBLIC COMMENTS:
NONE.
PLANNING COMMISSION DISCUSSION:
Member Tina King commented the formatting letters had not updated when items were added or removed from
Subdivision 1. Mr. Stubbs stated he would make sure to update that list.
Motion made by SHIRLEY KATZENMEYER to recommend APPROVAL of the proposed amendments, and to
send the proposed changes to the County Board for further review.
Second by TINA KING.
MOTION APPROVED (4-0). MOTION CARRIED.
5.
SECTION 20 – Mineral Extraction:
a.
Modernized and added more detail to the Purpose and Policy language.
b.
Added some clarification for when Administrative Use Permits and/or Zoning Permits could be issued versus
Conditional or Interim Use Permits.
c.
Created a more comprehensive set of application requirements.
d.
Added a new process for Ancillary Equipment.
e.
Expanded the Annual Reporting requirements.
f.
Added considerably more detail to the Mining Operating Standards, specifically for Screening, Blasting, and
Water Resources.
g.
Expanded the Reclamation Standards to be specific to the mining type.
h.
Made the compliance language clearer and more concise.
PUBLIC COMMENTS:
NONE.
PLANNING COMMISSION DISCUSSION:
Member Krenik asked whether the standard requiring a “lockable” gate was necessary. Staff and the Planning
Commission discussed the question and thought the standard was in the best interest of public safety.
Chairperson Doheny stated she believed a standard should be added to page 20-13 requiring the operator to post
signage along the roadway alerting passing drivers that blasting was occurring in the area.
Member King encouraged staff to look at the mining standards from Blue Earth County and incorporate similar
language that allows for notification to occur via text message, phone call, etc.
Member King asked staff to better clarify the requirements of the Annual Report and determine what the most
appropriate date was based on how Gravel Tax is calculated.
Member King asked whether including Mineral Extraction as a Conditional Use was a better option than it being an
Interim Use. She stated she reviewed similar Ordinances from neighboring counties and noticed that some chose to
require an IUP rather than a CUP. Mr. Stubbs explained the major difference between an IUP and a CUP was the
ability to sunset an IUP. Mr. Stubbs explained since the County first adopted IUP’s, they have continued to
consider how much of an initial investment is required to start up a particular use. Those uses that have a larger
start-up cost are often categorized as Conditional Uses while those with a lower start up cost have traditionally been
listed as Interim Uses.
Chairperson Doheny asked staff to look further into the Reclamation Bond requirements and to be more specific
with the standards.
Member Krenik asked staff if the Annual Report was meant to be based on a calendar year or if it was a fiscal
calendar that stretches construction season to construction season. Staff thought the intention was to be calendar
years but stated they would clarify in the Ordnance.
Member King stated a standard should be added to control noxious weeds, similar to the current solar standard.
Motion made by DOUG KRENIK to recommend APPROVAL of the proposed amendments, and to send the
proposed changes to the County Board for further review.
Second by SHIRLEY KATZENMEYER.
MOTION APPROVED (4-0). MOTION CARRIED.
6.
SECTION 27 – Essential Services:
a.
Expands the list and definitions of Essential Services into three major categories – Government & Public
Service Facilities, Transmission & Advanced Utility Services, and Ancillary Equipment & Appurtenances.
b.
Added a procedural workflow for each newly created category
c.
Included a series of more modern options for Advanced Utility Services
PUBLIC COMMENTS:
NONE.
PLANNING COMMISSION DISCUSSION:
Member King asked staff if Data Centers fit into this framework. Mr. Stubbs explained the County currently has a
moratorium on the development of Data Centers and are reviewing other Ordinances as well as environmental
concerns to determine if there are a set of standards that could be adopted which provide an appropriate level of
protection for the citizens and resources of the County. A Data Center could in fact be categorized as an Advanced
Utility Service but until we have finished our research, it is unclear if performance standards would be included or
not.
Motion made by TINA KING to recommend APPROVAL of the proposed amendments, and to send the proposed
changes to the County Board for further review.
Second by SHIRLEY KATZENMEYER.
MOTION APPROVED (4-0). MOTION CARRIED.
7.
SECTION 28 – Cannabis Businesses:
a.
Updated the list of Zoning and Overlay Districts to match the previously proposed changes and updates to
other Sections in the Ordinance.
b.
Added licenses for Mezzobusinesses and Microbusinesses as these were added by the State after the release of
the initial model Ordinance.
PUBLIC COMMENTS:
NONE.
PLANNING COMMISSION DISCUSSION:
Chairperson Doheny asked if the State had yet created an Administrative Rule for the handling of solid waste as
stated in the model Ordinance. Mr. Stubbs stated he was unaware of the addition of a Rule but agreed to verify that.
Member Krenik asked staff for an explanation of what a Microbusiness and a Mezzobusiness were. Mr. Stubbs
explained these types of business were allowed to engage in cultivation, processing, manufacturing, and retail (if
they receive additional approval). The difference in the two license types is how much area can be dedicated to
each type of use.
Motion made by SHIRLEY KATZENMEYER to recommend APPROVAL of the proposed amendments, and to
send the proposed changes to the County Board for further review.
Second by TINA KING.
MOTION APPROVED (4-0). MOTION CARRIED.
8.
SECTION 30 – Violations, Fines, & Enforcement:
a.
Added purpose and statutory authority, detailed administrative citation procedures, compliance timelines, civil
penalties, stop-work orders, abatement, cost recovery, and full administrative appeals process. Modernizes
enforcement to align with Minnesota statutes.
b.
Added statutory citations including Minn. Stat. §§ 394.37, 145A.05, 375.51, and 375.54 grounding
enforcement in broader administrative and civil authority.
c.
Added detailed inspection authority and formal Notice of Violation (NOV) process.
d.
Expands tools significantly:
1) Administrative citations;
2) Civil penalties with scheduled amounts ($500–$1,000 per month);
3) Stop‑work orders;
4) Abatement authority and cost recovery; and,
5) Comprehensive appeals and hearing procedures.
e.
Provides tiered timelines:
1) Minor violations: 10–30 days;
2) Moderate violations: 30–60 days;
3) Serious violations: ≤10 days or immediate; and,
4) Allows written extensions.
f.
Adds a complete Administrative Appeal System including:
1) Filing requirements;
2) Automatic stay of fines;
3) Hearing officer or board options;
4) Hearing procedures;
5) Written decisions; and,
6) Right to appeal to district court.
g.
Preserves misdemeanor authority but adds that administrative and civil remedies may be used first.
h.
Does not include Sheriff section; instead emphasizes administrative enforcement mechanisms.
PUBLIC COMMENTS:
Christy Gibbs asked if the enforcement standards in this Section were for all County Ordinances or just for Zoning.
Mr. Stubbs explained the proposed standards being discussed were only for violations of the Zoning Ordinance. He
also explained there is currently an Administrative Penalty option is both the Solid Waste and Buffer Ordinances.
Marie Meyer asked whether the County had performance standards related to signs and their placement. Mr. Stubbs
explained, the County does in fact have sign standards that are located in Section 19 of the current Zoning
Ordinance. Ms. Meyer asked whether the members of the Planning Commission were required to follow County
Ordinances. Ms. Meyer stated Member King’s campaign signs have been posted too close to the road or even in the
road right of way. She also claimed the signs have been placed on several properties without first receiving consent
from the landowner. Deputy Zoning Administrator Michelle Mettler commented the regulations related to political
signs were governed under MN Statute and not by the County’s Zoning Ordinance. Mr. Stubbs explained campaign
signs do not meet the standards to require permits. Commissioner John King stated this discussion was about the
proposed language for Section 30 of the Zoning Ordinance and not the proper venue for those allegations. He stated
if Ms. Meyer believed there was a safety issue, she should contact the Sheriff’s Department and if she believed the
signs to be some form of campaign violation, she should contact the Minnesota Office of the Secretary of State or
the Minnesota Campaign Finance & Public Disclosure Board.
PLANNING COMMISSION DISCUSSION:
Member King stated the language on page 30-1 was worded in a manner that is inconsistent with language later in
the Section. Specifically, the statement on page 30-1 says each day a violation remains constitutes a separate
violation. Later in the Section the administrative penalty breakdown is a monthly occurrence and not daily.
Commissioner John King stated these standards will need to be reviewed by an attorney to insure they are applied
correctly and do not create a larger issue for the County if they are adopted. Mr. Stubbs agreed and stated this
particular Section would be in front of the Commissioners next week for review. If they are open to the idea of
creating an administrative penalty process, he would then have it reviewed by an attorney before asking the Board
for final action.
Motion made by DOUG KRENIK to recommend APPROVAL of the proposed amendments, and to send the
proposed changes to the County Board for further review.
Second by TINA KING.
