Minutes of Le Sueur County Board of Commissioners Meeting
July 7, 2026
The Le Sueur County Board of Commissioners met in regular session on Tuesday, July 7, 2026 at 9:00
a.m. in the Government Center at Le Center, Minnesota. Board members present were John King, Danny
O’Keefe, David Preisler, and Steve Rohlfing. Dennis Tietz was absent. Also present were Brent Christian,
Joe Martin and Pam Herrmann.
King moved, Preisler seconded, motion carried unanimously to approve the agenda for the business of the
day.

Dave Tiegs, County Engineer, came before the Board with one item for approval.
Rohlfing moved, King seconded, motion carried unanimously, to approve Plat “C.S.A.H. NO. 15 /
C.S.A.H. NO. 18 RIGHT OF WAY PLAT NO. 2” *This plat is the basis of the right of way acquisition
process for the upcoming CSAH 15 Reconstruction Project.
Holly Bushman, Water Resources Manager, came before the Board with one item for approval.
King moved, Preisler seconded, motion carried unanimously to approve the MDH Private Well Protection
Grant RFP application.
Brian Schultz, DNR South Regional Director & Ben Schaefer , DNR Lands & Minerals Coordinator &
Brooke Hacker, DNR South Regional Planner gave a presentation on Strategic Land Asset Management,
Payment in Lieu of Taxes, the School Trust Fund, Shallow Lake Projects, and an Overview of DNR
Lands and Activities in Le Sueur County.
Dani Ongie, Auditor-Treasurer, came before the Board with the Initiation of Redetermination of Benefits
(ROBs) for CDs 2, 31, 34, 53, 56 and 57.
John Kolb, Rinke Noon provided the purpose of meeting & procedural requirements.
Dani Ongie, Auditor-Treasurer provided the record of notices & system history.
King moved, Rohlfing seconded, motion carried unanimously to recess regular meeting and convene
public hearing.

Authority was presented with information regarding drainage system costs and assessments
necessary to pay drainage system costs. Based on the information provided, Commissioner

WHEREAS, section 103E.725 provides, all fees and costs incurred relating to a drainage system,
including repairs, inspections engineering, viewing and publications, are costs of the drainage
system and must be assessed against the property and entities benefited; and
WHEREAS, if there is not enough money in the drainage system account to pay drainage system
costs, the Drainage Authority must assess the costs on all property and entities that have been
assessed benefits for the drainage system. The Drainage Authority may order the assessments
be paid in 15 or less installments; and
WHEREAS, if assessments are to be paid in installments, the Drainage Authority may set an
interest rate not to exceed seven percent per year to be collected with each installment; and
WHEREAS, County staff has investigated the current drainage system funds and made a
recommendation for assessments, installment schedules, and interest rates.

First Judicial District Court and LeSueur County
COOPERATIVE AGREEMENT
This Agreement, by and between LeSueur County and the State of Minnesota acting through its
agent First Judicial District Administrator's Office (herein "Court") is entered into for the period of
June 1st, 2026 through June 30, 2027.
WHEREAS, the Court has established a Treatment Court program that is designed to intervene in
the chemically dependent lifestyles of adult drug offenders and to improve public safety, and;
WHEREAS, the Court and LESUEUR COUNTY desire to establish cooperative procedures for
the implementation and effective operation of the Treatment Court program, and;
WHEREAS, the Court wishes to enter such an Agreement with LESUEUR COUNTY to fund
operational costs in treatment court from LESUEUR COUNTY coextensive with the availability of
County, State and Federal Funds for such purchase, and
WHEREAS, LESUEUR COUNTY is empowered under Minnesota law to provide services to and
participate in the Treatment Court process;
NOW THEREFORE, the parties agree as follows:

Agreement. "This Agreement" means this Cooperative Agreement.
Court. "The Court" means the First Judicial District.
"Operation Costs" means:

2. Salaries, Contracts, and Employee Expenses $8,000
II. TERMS OF THE AGREEMENT
A. Agreement Period. Notwithstanding the date of signatures by the parties, the
Agreement period is from June 1st 2026 through June 30, 2027, unless otherwise
terminated by law or a provision of this Agreement.
B. Payment. The Court shall reimburse LESUEUR COUNTY for the cost of
Operational Costs identified in I.C.1 above related to the Adult Treatment
Court program.
C. Payment Rate. The Court shall compensate LESUEUR COUNTY for costs
LESUEUR COUNTY incurred for the Contracted Services on behalf of the Adult
Treatment Court program during each calendar quarter subject to the following
limitations. The cost of the Contracted Services provided to Adult Treatment Court
shall not exceed Twenty Eight Thousand Dollars ($28,000.00) in the period from
June 1st 2026 through June 30, 2027.

With or Without Cause. This Agreement may be terminated prior to the last day
of the Agreement period by either party, with or without cause, by giving thirty
(30) Calendar days written notice to the other party. This Agreement shall be
terminated on the date of termination specified in the written notice or thirty (30)
calendar days after the written notice is received by the receiving party,
whichever is later.
Non-Appropriation. Notwithstanding any provision of this Agreement to the
contrary, this Agreement may be terminated by either party in the event sufficient
funds from county, state, or federal sources are not appropriated, obtained and
continued at least at the level relied on for the performance of this Agreement, and
the non-appropriation of funds did not result from any act of bad faith on the part
of the Court.
E. ADMINISTRATION
1. Administration of the contract terms will be monitored for LESUEUR COUNTY
by Anna Franco, Coordinator, LeSueur County, 435 E Derrynane St, LeCenter,
Minnesota 56057 and all inquiries shall be directed to her attention.
2. Administration of the contract terms will be monitored for the Court by Brian Jones,
First Judicial District Administrator, 1620 S Frontage Road, Suite 200, Hastings,
Minnesota 55033, and all inquiries shall be directed to his attention.
F.
LIABLE FOR OWN ACTS.
LESUEUR COUNTY and the Court agree that each party will be responsible for its own
acts and the results thereof to the extent authorized by law and shall not be responsible
for the acts of any others and the results thereof. The Court liability shall be governed
by the provisions of the Minnesota Tort Claims Act, Minnesota Statutes, Section 3.736,
and other applicable law. It is understood and agreed that the provisions of the Municipal
Tort Claims Act, Minn. Stat. Ch. 466, and other applicable laws govern liability arising
from the acts or omissions of LESUEUR COUNTY or its employees. LESUEUR
COUNTY shall require that contractors selected by it shall be insured in amounts
consistent with the limits of liability under Minnesota Statutes, Section 3.736 and
Chapter 466, in the event of malpractice or injury to the treatment court participants
served by the contractor. Each Party warrants that it has an insurance or self-insurance
program that has minimum coverage consistent with the liability limits required of it.
G.
COMPLIANCE WITH LAWS/STANDARDS.
Each Party to this Agreement shall abide by all Federal State or local laws, statutes,
ordinances, rules and regulations now in effect or hereinafter adopted pertaining to
this Cooperative Agreement or to the facilities, programs and staff for which the Party
is responsible.

H. DATA PRIVACY.
It is expressly agreed that LESUEUR COUNTY and its employees are independently
required to comply with the requirements of the Minnesota Government Data Practices
Act. The Court and its employees are bound by the Minnesota Rules of Public Access to
Records of the Judicial Branch. Both parties agree that neither shall be liable for any
violation of any provision of the Data Practices Act or the Rules of Public Access to
Records of the Judicial Branch indirectly or directly arising out of, resulting from, or
in any manner attributable to the actions of the other party. LESUEUR COUNTY shall
require that its contractors comply with the requirements of the Minnesota Government
Data Practices Act and the Minnesota Rules of Public Access to Records of the Judicial
Branch with respect to data on Adult Treatment Court participants.
I. INDEPENDENT CONTRACTOR.
Any and all claims that arise or may arise against a Party to this Agreement, including its
officials, employees or agents as a consequence of any act or omission on the part of that
Party or its officials, employees or agents, while engaged in the performance of this
Agreement, shall in no way be the obligation or responsibility of the other Party.

Family Resource Center Initiative — Le Sueur County
Purpose of This Endorsement
This document records the role and commitment of the Le Sueur County Board of Commissioners
(“the Board”) in support of the Family Resource Center (FRC) initiative led by the Le Sueur County
Integrated Children’s Mental Health & Family Services Collaborative (“the Collaborative”). Unlike
the partner agencies participating in direct service delivery and programming, the Board’s role is
one of governance, fiscal oversight, and policy support — the foundation that allows the FRC to
move from concept to implementation.
Background
WHEREAS, the Collaborative has completed a community assessment identifying significant
need for a centralized Family Resource Center to strengthen family well-being, expand crisis
prevention efforts, and improve access to coordinated services for Le Sueur County families;
and
WHEREAS, this assessment was developed in partnership with parents and community
members, alongside the formal and informal partners of the Collaborative; and
WHEREAS, the proposal is grounded in the Family Resource Center model and Strengthening
Families / Protective Factors framework and is anticipated to reduce reliance on crisis-level
services, producing long-term benefits and potential cost savings for the county; and
WHEREAS, the Collaborative has presented the FRC concept and community assessment
findings to the Board and local stakeholders at the County Board Work Session held June 23,
2026; and
WHEREAS, the Collaborative Governing Board has agreed to seek and apply for grant funding
from the Sauer Family Foundation, for the purposes of developing and piloting the concept of
Family Resource Centers, including activities such as:
selecting a lead agency to own and operate the site(s)/location(s)
creating a governance agreement between the county, collaborative, lead agency, and
partner organizations contributing to the initiative
negotiating and formalizing partnership agreements using MOUs and contracts
selecting the scope of services to be offered at each location
creating a staffing schedule, operating hours, and an operating budget
developing branding, marketing, and outreach plans
establishing metrics and data collection tools to measure outcomes
creating a parent advisory council
assigning and training lead staff from the collaborative and initiative partners
establishing a plan for volunteer recruitment, onboarding, and training
purchasing programs and curriculums
NOW, THEREFORE, the Board affirms the following:

The Board’s role is distinct from that of operational and service-delivery partners. The Board’s
commitment is to:

Formally seek additional grant funds from Sauer Family Foundations or other entities to
pursue developing a formal strategic plan of implementing Family Resource Center(s).
Included in this phase is selection of lead entity, creating governance structures and
agreements, identifying scope of services, creating staffing plans, budgets, outreach plans,
and outcome measures.
•
Formally receive and consider the FRC concept and community assessment findings.
•
Provide policy-level support and public endorsement of the initiative as it advances.
•
Direct relevant county departments (e.g., Human Services, Public Health) to coordinate with
the Collaborative as planning continues.
•
Consider future funding requests — including levy allocation, grant match commitments, or
budget items — as they are formally brought before the Board.
•
Evaluate any request involving county staffing, contracts, or use of county facilities related to
the FRC.
•
Consider serving as fiscal host or grant administrator if a future funding source requires a
unit of government to hold the grant.
•
Receive periodic progress updates from the Collaborative to maintain appropriate oversight
and accountability.
Examples of Board Duties as the Initiative Advances
•
Reviewing and voting on specific funding or budget requests tied to the FRC.
•
Approving any new positions, contracts, or interdepartmental agreements needed to support
the FRC.

As Southern Minnesota Initiative Foundation (SMIF) marks 40 years of service to southern Minnesota, we
reflect on a legacy rooted in economic resilience and regional growth. Since our founding in 1986 in response
to the farm crisis, SMIF has reinvested more than $178 million to strengthen the region’s economic vitality.
Economic development is central to SMIF’s mission. Strong local economies depend on thriving small
businesses, an adaptable workforce and communities equipped to support both. From main streets in towns
like Truman to close-knit communities like Harmony, local leadership and strategic investment are essential to
sustaining long-term resilience.
SMIF partners with communities to drive this work. Through lending and technical assistance, we support
entrepreneurs and small business owners as they start, expand and adapt. Our long-term impact is sustained
through endowed funds that provide a stable foundation for continued investment. Our General Endowment
and Entrepreneur Fund offer stability and fuel business growth by offering flexible financing and support to
help enterprises remain rooted in the region.

“We have a city lot that we use every year for our
celebration for Halfway to St. Paddy's Day, as we
are the twinned sister city with Kilkenny, Ireland.
This space is pretty much a vacant lot. We want to
give it a life and also give it purpose for the residents
in town and any visitors that come through. The
space would have benches, lighting, flowers and a
band shell space that could be used by so many
individuals!”
