MEMORANDUM FROM CITY ADMINISTRATOR

To:

Board of Aldermen

RE:

Tuesday, August 18th, 2026 Board of Alderman Meeting

1. Two weeks ago, the closure to a drain on the pool failed to completely close causing a loss of water.
On the list of bills to be paid are the parts to repair the closure.
2. GovernMentor has sent a letter to us stating they would be closing their business in 2028. We will
begin searching for a new firm. GovernMentor has said they are committed to helping with the
transition to a new company.
3. We have received notice that we have been awarded $60,988 from the Frankin County Transportation
Department. This grant was written to help offset funding for the 1st and Osage project.
4. The skatepark rules are included in your packet. These have been recommended by MIRMA.
5. We are still looking for volunteers to work the rodeo. Please contact Kelly O’Malley if you can help out.
The dates are September 18th and 19th.
6. We have an invoice from our Prosecuting Attorney billing us $30 for a correspondence he had with a
citizen concerning a court case that did not involve the citizen. I know it is only a small amount this
time. I have contacted the attorney to reduce the fee with no luck. I do not think we should pay for
this fee.
7. The electronic sign is not working. The sign is not communicating with the computer. Midwest Sign is
scheduled to come out and repair it. The breakers have been replaced which corrected the electrical
issues.
8. Just a reminder if you have any questions about the bills you can review the invoices in the office
where you pick up your packets or if you have any questions you can contact Kim or myself and we
will get you and answer.

any discussion. There was discussion about other sidewalks that also need repairs. Alderman
Hoven suggested Public Works come up with a plan on the sidewalk that needs repaired and the
costs. Alderman Gass was concerned about the city knowing of bad sidewalk and not correcting
it and someone getting hurt. Discussion followed. Administrator Litterell stated they are in the
process of repairing some on Candlewick and Westlake now. A voice vote was taken with a

can it go beyond Osage? Attorney Bond stated he would have to look into it.

Whereupon, Mayor Kelley declared the motion carried.
Public Participation
Corbett Shannon, urged the Board to adopt the proposed Interim Stay of acceptance for data
centers. A pause of 12 months is very important. This protects us. Beltline is a forest and they
have never built a data center anywhere. He asked that they govern on factual planning, and
include Beltline in this 12 month stay.
Nancy Watson, wanted to express her opinion on both ordinances for consideration. Both make
a lot of sense and she hoped they approve them. She was confused about the Beltline hearing
and how this affected them. She also stated it was hard to hear the Board and urged them to talk
into the microphones.
Twila Ashworth, stated she was not sure what the difference was between a moratorium and a
stay of acceptance. She is in favor of both of them. Is a Stay of Acceptance a tool to keep them
from coming back? This was not in effect when they came here in March. If they sue the city,
are we sure we can win the case? She did not want the city to get sued over a hearing, maybe we
should consider having the hearing.
John Rose, stated he was tired of waiting and wanted Beltline to have their hearing so they can
hear what they say.
Jessica Nicodemo, stated this started in January. They have done their research, created a
collation, and now it is time to end this. They want to feel safe again, and tonight can change
their future. Also, under I-44 towards PILOT the asphalt is caving.
Dana Bowers, stated she supports the Stay and agrees that there needs to be time to study. She
asked that they adopt the Stay tonight and preserve the due process for Beltline. A public
hearing for Beltline is not approval but gives them the opportunity to speak and get a complete
record of it. Due process is not a reward but the principal of it is ethics. We are better than this.
We owe them the process. Principals need upheld even when they are uncomfortable. We want
to hear them, adopt the Stay and complete the Beltline hearing.
Travis Layton, stated he wanted to provide endorsement for Dana Bowers on the Planning &
Zoning Board. She is an honest and ethical person, and above average for P & Z. If she doesn’t
know the answers she will reach out to whomever is needed. He thanked the Board for the Stay
of Acceptance and urged them to adopt it.
Jeannine Crider, stated she has visited three hyper scale centers and has recordings and videos of
the sounds. She visited the Colossus in Memphis and it is running on sixty generators. She
continued that after visiting for 20 minutes with a nearby neighbor she had a pounding headache.
She continued they are running these generators without a permit and made promises for the
water treatment plant and have done nothing. She played the video of the generators. She
continued at the data center in Altoona there was nothing for the noise to ping off of. These are

all massive data centers. Mayor Kelley stated she can also be followed on Facebook.
New Bills
a. Bill No. 5332-A An Ordinance fixing the Tax Rate for the City of Pacific, Counties of
Franklin and St. Louis, State of Missouri, for the year 2026 and establishing the effective
date thereof. (1st reading, Public Hearing)
Mayor Kelley asked for a sponsor. Alderman Gass stated he would sponsor the Bill. As posted
pursuant to the ordinance, City Clerk Barfield read Bill No. 5332-A by title only for the first
reading. Mayor Kelley asked for any discussion. Mayor Kelley stated this is the yearly tax rate
that is required to be set by September 1st.
Consideration of Bills Previously Introduced

second reading. Motion made by Alderman Lesh, seconded by Alderman Nickelson to
approve Amended Bill No. 5330. Mayor Kelley asked for any discussion. Alderman Lesh
stated this will make the zoning and annexation concurrent. Alderman Hoven asked Attorney
Bond if this will affect Beltline? Attorney Bond stated as drafted he could argue both ways, it
depends on how the Board wants to proceed. A roll call vote was taken with the following
results: Ayes: Alderman Nickelson, Alderman Gass, Alderman Hoven, Alderman Lesh.
Nays: none. Abstain: none. Whereupon, Mayor Kelley declared the motion carried 4-0

and consideration of any appropriate zoning test amendments or other actions. (2nd
reading)
As posted pursuant to the ordinance, City Clerk Barfield read Bill No. 5331 by title only for the
second reading. Motion made by Alderman Hoven, seconded by Alderman Lesh to approve
Bill No. 5331. Mayor Kelley asked for any discussion. Attorney Bond stated the Interim Stay of
Acceptance operates the same as a moratorium, the difference is with the Interim Stay there is
language in Section 4 that allows for a hardship and it could still be considered. It is a concept of
interest. Alderman Hoven stated if this includes Beltline, who pays if we get sued? Attorney
Bond stated this is a zoning case. He could not predict who would pay. Alderman Lesh stated if
this passes, the city can still choose to have the hearing. Attorney Bond stated yes, the hearing
could be held, whatever the result of the hearing is, they could still potentially sue. Alderman
Lesh stated this Stay of Acceptance allows the city to put regulations in place. Discussion
followed. Attorney Bond stated this Stay of Acceptance includes Beltline, there is no vested

taken with the following results: Ayes: Alderman Gass, Alderman Hoven, Alderman Lesh,

the motion carried 4-0, and Bill No. 5331 becomes Ordinance No. 3500.

Sage Lot Split Plat
Subdivision Plat Review #1

Dear Ms. Sage,
GBA received a copy of the set of Lot Spilt Plat on October 1, 2025. As requested, we have reviewed
the plat and do not have any comments.
The provided subdivision plat appears to meet the criteria for subdivision plats and the ordinances and
codes of the City of Pacific. The plat is located in an R-1A Single Family Residential Zoning district and
meets the requirements of that district. The new lot will have frontage on Smith Lane.
The plat is recommended for approval and will be presented to the Planning & Zoning Commission and
the Board of Alderman for approval.
