MINUTES OF THE CUSTER CO. BOARD OF SUPERVISOR
September 29, 2026
The Custer County Board of Supervisors met in regular session on Tuesday, September 29, 2026, in
the boardroom of the Custer County Courthouse. Chairperson Blowers called the meeting to order at
9:00 a.m. and reported that the Open Meeting Laws brochure is available to anyone upon request.
Notice of the meeting was published on September 10, 2026. The following board members were
present – Blowers, Longmore, Kleeb, Gibbons, Parliament, Markham, and Govier, and Kelly
Jacobsen, Custer County Clerk.

Clay Mohr appeared before the board requesting closure of Cozad Road on August 13, 2027, and the
Dunning Rd August 14, 2027. Motion by Blowers 2nd by Parliament to approve this request. Roll call
vote. Ayes-All
Treas. Bryant presented the annual report Delinquent Parcels list that were delinquent and advertised
in February 2026, offered at public sale in March, not picked up by any investor. $327.11, utilities
assessment $3,091.06.
Bryant presented/reviewed the Certification of Distress Warrants.
Motion by Parliament, 2nd Markham, to approve the Certification of the Paid and Unpaid Distress
Warrants in the amount of $16,297.03. Roll call vote. Ayes-all
Bryant requested the Unpaid Distress Warrants be stricken from the tax rolls, in the amount of
$8,467.15. Motion by Parliament 2nd Govier to strike the qualifying personal property from the tax
roll. Roll call vote. Ayes-all
Nick Olson Custer County Highway Superintendent, Lance Harter Oak Creek Engineering presented
a Request for Additional Construction Observation Reimbursement Anselmo Road Asphalt
Resurfacing, Custer OCE#4-C-47 in the amount of $15,250.00
Motion by Gibbons, 2nd Parliament to approve said request. Roll call ayes Longmore, Govier,
Parliament, Gibbons. Nayes Markham, Kleeb
Mark Rempe, Custer County EM/911 Director, presented a request to appoint a voting member to the
East Central Region Board. Motion by Kleeb 2nd Parliament to appoint Rempe as a voting
representative Blowers alternative representative. Roll call vote. Ayes-Kleeb, Parliament, Longmore,
Govier, Nayes-Gibbons
Motion by Markham 2nd Kleeb, to adjourn as the County Board and convene as the Board of
Equalization at 9:33 a.m. Roll call vote. Ayes-all
Sheri Bryant Co. treasurer presented a motor vehicles exemption from Callaway Hospital
District for a 2025 Jeep SUV, deduction of $239.65. Motion by Longmore, 2nd Kleeb to approve
exemption. Roll call vote. Ayes-all
Elise Taylor Co. Assessor presented two tax exempt applications from First Baptist Church of
Ansley, Trustees of Baptist Church, these have transferred ownership. Recommend denial of
these two applications as they no longer qualify.

Bruce Morse and Reese Jensen spoke in favor of closing the road. Question was asked about who
should do a permanent easement. This will be looked into.
Motion by Markham 2nd Kleeb to close public hearing at 10:08 a.m. Roll call vote. Ayes-all
Darci Tibbs Zoning Administrator presented information on Data Center Regulations. The purpose
of these regulations is to not encourage or attract data centers, but to make sure that if one is
proposed in Custer County, we have appropriate standards and safeguards in place to protect the
health, safety, and welfare of our citizens, and to protect the ag and rural character of the county.
Motion by Parliament 2nd Longmore to open public hearing at 10:30 a.m. on Public Hearing Data
Center Regulations. Roll call vote. Ayes-all.

Motion by Parliament 2nd Markham to close public hearing at 10:32 a.m. on Public Hearing Data
Center Regulations. Roll call vote. Ayes-all.
Motion by Blowers 2nd Markham to approve Res. 77Z-26 to adopt Dada Center Regulations. Roll
call vote. Ayes-all. Not signed-next agenda
Darci Tibbs Zoning Administrator presented information on Temporary Moratorium on Battery
Energy Storage Systems. Tibbs expressed the planning commission’s desire for a 12-month
moratorium on battery energy storage systems to allow adequate time for research and the
development of appropriate regulations.
Motion by 2nd Markham to open public hearing at 10:45 a.m. on Public Hearing Data Center
Regulations. Roll call vote. Ayes-all.

Public comment-Jordan Arndt with Zelle introduced Sarah Graesser who will be the new point of
contact for Custer County.
Meeting adjourned 10:49 a.m.

Custer County Courthouse, the County website, and in the Custer County Chief. The agenda for the
