Tuttle, Health and Community Services Director Stacy York, IT
Director James Deane, and County Manager Austin Osborne.
9. BOARD COMMENT (No Action - No Public Comment):
Commissioner Mitchell: Praised the County Manager for a great presentation at the
meeting of the TRPA and Marlette Lake Oversight Committee at the Legislature.
10. DISCUSSION/FOR POSSIBLE ACTION: As directed by the board at the 01/20/26
board meeting, further discussion and consideration directing county staff to research
and develop findings and recommendations regarding potential ordinances limiting
certain short-term vacation rental to persons at or above 25-years-old or another age
limit, and to engaging with the community in developing draft regulations regarding the
allowance, use, and management of short-term rental uses countywide.
County Manager Austin Osborne deferred to short-term rental
owner Paul Mallory, who discussed the difficulty of renting to
people under 25, and following the policies of short-term rental
platforms for advertising. He sought a county ordinance because it
was required for those platforms.
Public Comment: Sean O’Hara, representing the Sierra Nevada
Association of Realtors said the association believes that it is
fundamental property right of homeowners to rent, sell, or leave
their property vacant as they see fit. Arrangements with Airbnb or
other short-term rental brokers should be the decision of the
property owner and not by ordinance or regulation.
17
Motion Made: I, Commissioner Mitchell, move to direct County staff to research
and develop findings and recommendations regarding potential ordinances
limiting certain short-term vacation rental to persons at or above 25-years-old or

transportation reliability, and protect homes, businesses, critical infrastructure, and
industrial operations affected by recurring flood events. J-U-B Engineering completed
preliminary engineering and hydraulic modeling in March of 2024 as part of the Long
Valley Creek Flood Hazard Mitigation Plan, and EDA funding would support final
design, permitting, and construction of the proposed improvements.

Title: Discussion and possible consideration approving letters between Storey County
and the Lockwood Community Corporation and the Canyon General Improvement
District indicating notice of intent for interlocal support and cooperation toward countyled efforts to reduce flood hazards and improve public safety as related to the Long

Staff Summary: Storey County, with support from the Lockwood community, has
engaged in local and regional planning efforts to mitigate flood hazards, improve public
safety, and reduce flood insurance rates for area homeowners.
In 2023, the county retained JUB Engineering to complete a stormwater modeling and
flood mitigation study for Lockwood. The JUB report, finalized in 2025, recommends
channel improvements, modifications to existing bridges, and phased approaches to
project completion aligned with available resources. These recommendations are
supported by hydraulic modeling and 15 percent design engineering for proposed
drainage and bridge improvements.
In 2026, the county identified potential federal funding through the Economic
Development Administration’s (EDA) FY2025 Disaster Supplemental Grant Program
that may partially fund design engineering and construction for all or a portion of project
alternatives outlined in the JUB report.
The project will occur on land owned or controlled in-part by the Canyon General
Improvement District, the Lockwood Community Corporation, and private landowners.
Cooperative agreements will be required for work to occur on these lands.

Before pursuing potential grant funding, advancing initial project stages, and formal
comprehensive interlocal agreements, it is recommended that the parties involved or
potentially affected formally indicate their intent to cooperate in this county-led, multijurisdictional effort. The enclosed draft Letter of Intent to Cooperate highlights that:
•
Storey County will serve as the lead agency for the project, including grant
administration, project management, design, permitting, and construction oversight.
•
The Canyon GID and Lockwood Community Corporation will cooperate by
providing necessary access, easements, local coordination, and assistance with public
outreach and post-construction maintenance responsibilities as mutually agreed.
•
The county will also coordinate with private property owners whose land may be
affected by the project.
The Notice of Intent would be non-binding and create no financial obligation or legal
liability for either party. A formal interlocal agreement will be executed upon grant
application approval and prior to any construction activities.
