WHEREAS, an application was filed in the Office of the Municipal Clerk on April 11,
2025, for a Person-to-Person transfer of a Plenary Retail Distribution Liquor License (License No.
1204-44-016-009) from ONG Strategic Business Objectives LLC dba Fine Wines & Liquor to
East Brunswick Liquors Inc.; and
WHEREAS, the submitted application form was completed in all respects, the transfer
fees were paid, and the license had been properly renewed for that licensing period; and
WHEREAS, the Township Council authorized the transfer of liquor license # 1204-44016-009 from ONG Strategic Business Objective LLC to East Brunswick Liquors via Resolution
# 25-220 on June 23, 2025; and
WHEREAS, the buyer decided not to pursue the purchase of the liquor license, and ONG
Strategic Business Objectives remains the owner of the liquor license for the licensed premises,
50 Racetrack Road.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township
of East Brunswick, County of Middlesex, State of New Jersey, that it hereby repeals the personto-person transfer of the Plenary Retail Distribution Liquor License [No. 1204-44-016-009]

WHEREAS, the property or properties listed were un-kept and the owner(s) did not
respond to the appropriate notice, creating a blight and health hazard to the local neighborhood;
and
WHEREAS, the Code Enforcement Officer has authorized a lawn mowing service to bring
the properties into compliance and said costs are to be established as a lien against the property in
accordance with Ordinance #99-10; and
WHEREAS, the repayment of cost shall become a Dedication by Rider under N.J.S.A.
40A:4-39 under recycling of fees as permitted by P.L. 1981, Chapter 278.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township
of East Brunswick, County of Middlesex, State of New Jersey, that a property lien is hereby
established on the properties listed above for the said amount, and the amount may be increased
from time to time to maintain the property in accordance with the Township Code.
BE IT FURTHER RESOLVED, that the Township request permission of the Director
of the Division of Local Governmental Services to pay expenditures of the recycled fees for code
maintenance as permitted by N.J.S.A. 40A:4-39.
BE IT FURTHER RESOLVED, that the Collector of Revenue is required to list the items
as open on all future searches, and the Chief Finance Officer is directed to take all necessary
collection steps as appropriate to satisfy the said lien, and said funds as collected are to be applied
to the code enforcement budget line as permitted under N.J.S.A. 40:48-2.12(F).

WHEREAS, the Chief Financial Officer certified that funds are available for the purpose
of awarding this contract from capital accounts C-16-24-023-000-021; C-16-24-023-000-022 and
C-16-26-013-000-021.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township
of East Brunswick, County of Middlesex, State of New Jersey, that a contract is hereby awarded
to Main Line Commercial Pools, LLC, located at 441 Feheley Drive, King of Prussia, PA 19406,
for the removal and installation of two (2) filter body tanks for Crystal Springs Family Waterpark
in the amount not to exceed $125,000.00; and the Mayor and Township Clerk are hereby

WHEREAS, on October 25, 2023, and December 10, 2025, at the sales for delinquent
taxes and liens held by the Collector of Revenue for the Township of East Brunswick, County of
Middlesex, for various blocks and lots were sold; and
WHEREAS, said property and/or liens have been redeemed by the owners of those
persons having an interest, and the purchasers of said property are legally entitled to a refund of
monies paid at the time of redemption.
NOW, THEREFORE, BE IT RESOLVED, that the amount covering the Certificate of

TITLE III B GRANT FOR SOCIALIZATION AND RECREATION SERVICES FOR THE
ELDERLY THROUGH THE MIDDLESEX COUNTY OFFICE OF AGING AND
DISABLED SERVICES IN THE AMOUNT OF $3,000.00
WHEREAS, the community seeks to optimize the quality of life for its older adult
residents by ensuring programs and activities offered are both meaningful and beneficial to
enhance independence, reduce loneliness, and improve quality of life; and
WHEREAS, the Township of East Brunswick strives to save tax dollars and assure
comprehensive services to older adults in the township; and
WHEREAS, the Township believes it is necessary to identify and address certain issues
impacting residents 60 years of age and over that are frail, of lower income, culturally diverse,
and/or experiencing economic and social needs; and
WHEREAS, the Township of East Brunswick applied for a grant through the Middlesex
County Office of Aging and Disabled Services for the Area Plan Contract Grant and was awarded
$3,000.00 to improve the overall quality of life for senior residents 60 years of age and older
through various programs and activities.
NOW, THEREFORE , BE IT RESOLVED, by the Township Council of the Township
of East Brunswick, that it hereby authorizes the acceptance of a grant from the Middlesex County
Office of Aging and Disabled Services in the amount of $3,000.00 for a mid-year amendment Area
Plan Contract Grant funds for Title III B- Socialization and Recreation Grant to facilitate extended
socialization/recreation services for senior adults 60 years of age and older.

WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local
Government Services may approve the insertion of any special item of revenue to the budget of
any county or municipality when such item shall have been made available by law and the amount
thereof was not determined at the time of adoption of the budget; and
WHEREAS, the said Director may also approve the insertion of any item of appropriation
for an equal amount; and
WHEREAS, the Township of East Brunswick has received an increase in grant funding
for Title III B – Socialization & Recreation by an additional $3,000 from the Middlesex County
Office on Aging 2026 Grant, and wishes to amend its 2026 Budget to include this amount as
revenue; and
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township
of East Brunswick, County of Middlesex, State of New Jersey, that it hereby requests the Director
of Local Government Services to approve the insertion of an item of revenue in the budget of the
year 2026 in the sum of $3,000.00 which is now available, as follows:

MIDDLESEX, STATE OF NEW JERSEY, AMENDING CHAPTER 228, “ZONING,” OF
THE CODE OF THE TOWNSHIP OF EAST BRUNSWICK TO AMEND §228-3,
“DEFINITIONS AND WORD USAGE,” TO ADD A DEFINITION FOR “DATA
CENTER” AND TO AMEND §228-229.4, “PROHIBITED USES,” TO DESIGNATE DATA
CENTERS AS A PROHIBITED USE WITHIN ALL COMMERCIAL, BUSINESS, AND
INDUSTRIAL ZONING DISTRICTS OF THE TOWNSHIP OF EAST BRUNSWICK
WHEREAS, the East Brunswick Township Council (the “Council”) is authorized to adopt
land use and zoning regulations pursuant to the Municipal Land Use Law, N.J.S.A. 40:55D-1 et
seq., in order to promote the public health, safety, morals, and general welfare; and
WHEREAS, Chapter 228, “Zoning,” of the Code of the Township of East Brunswick
governs the use and development of land within the Township, including the establishment of
permitted and prohibited uses within each zoning district; and
WHEREAS, data center development has accelerated significantly throughout New Jersey
and the broader Mid-Atlantic region, driven by increased demand for cloud computing, artificial
intelligence infrastructure, and digital communications capacity; and
WHEREAS, data centers, by their nature, present an intense and unique form of land use
and development, posing significant challenges related to electricity consumption, noise, air
quality, water use, community character, and long-term municipal planning objectives; and
WHEREAS, data centers, and particularly large-scale or hyperscale facilities, may require
substantial and continuous volumes of water for cooling operations, may demand significant
amounts of electricity comparable to that of a small power generation facility, and may require
extensive supporting infrastructure, including electrical substations and backup diesel generator
arrays; and
WHEREAS, the high-volume water consumption and cooling processes associated with
data center operations have the potential to accelerate the depletion of local groundwater resources
and to adversely affect the availability, pressure, and quality of water relied upon by residential
and commercial users within the Township and neighboring communities; and
WHEREAS, the significant and continuous electrical demand associated with data center
operations, and the infrastructure necessary to support such demand, raise concerns regarding
increased energy costs for ratepayers, strain on the regional electrical grid, and impacts upon noise,
air quality, and community character; and

WHEREAS, municipal regulations designed for the protection of the public health, safety,
and welfare, the preservation of environmental and water resources, and the maintenance of
community character are a well-recognized and proper exercise of municipal authority; and
WHEREAS, on May 27, 2026, Governor Sherrill announced plans for a comprehensive
statewide plan to address the growing impact of data centers on energy demand, resource use, and
local communities; and
WHEREAS, as part of the comprehensive statewide plan, Governor Sherrill announced
the provision of resources to ensure municipalities can negotiate from positions of strength; and
WHEREAS, the statewide resources to ensure municipalities can negotiate from a position
of strength will take time to be implemented and provided; and
WHEREAS, the Legislature passed and the Governor on July 7, 2026 signed a package of
three bills designed to assist the state and municipalities in addressing the impact of data centers;
and
WHEREAS, the Township Council has determined that it is necessary and in the best
interest of the health, safety, and welfare of the residents of the Township of East Brunswick to
amend Chapter 228 of the Code of the Township of East Brunswick to (i) define the term “Data
Center” and (ii) prohibit data centers as a use within all commercial, business, and industrial
zoning districts of the Township.
NOW, THEREFORE, BE IT ORDAINED, by the Township Council of the Township
of East Brunswick, County of Middlesex, State of New Jersey, that Chapter 228, “Zoning,” of the
Revised General Ordinances of the Township of East Brunswick is hereby amended and
supplemented, with additions shown in italics and bold, as follows:

DATA CENTER — Shall include, but not be limited to, any facility used primarily for the
storage, management, and processing of digital or electronic data, which houses computer and
network systems, including associated components such as servers, network equipment and
appliances, telecommunications, and data storage systems, systems for monitoring and
managing infrastructure performance, Internet-related equipment and services, data
communications connections, environmental controls, fire protection systems, and security
systems and services. Typical accessory components of a Data Center may include transformers,
electrical substations, environmental controls, fire suppression systems, generators, redundant
power supplies, and security facilities.
The term “Data Center” is intended to be construed broadly and shall include, but not be limited
to, all facilities whose primary purpose is housing active information technology or digital
infrastructure, including but not limited to hyperscale facilities, colocation facilities, cloud
computing infrastructure, cryptocurrency mining operations, artificial intelligence processing

facilities, and other high-density digital infrastructure uses, regardless of how such facility is
labeled or described. Such facilities may be characterized by large-scale or small-scale building
footprints, substantial supporting infrastructure, continuous or near-continuous energy
consumption, reliance on backup power generation systems, and associated mechanical and
cooling operations necessary to maintain system functionality.

BE IT FURTHER ORDAINED, following introduction and prior to a public hearing and
final adoption, the Municipal Clerk shall forward this Ordinance to the Township Planning Board
for review and a written report pursuant to N.J.S.A. 40:55D-26 to confirm substantial consistency
with the municipal Master Plan; and
BE IT FURTHER ORDAINED, that if any article, section, subsection, sentence, clause,
or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision

shall not affect the remaining portions of this Ordinance, and they shall remain in full force and
effect, and to this end the provisions of this Ordinance are hereby declared severable.
BE IT FURTHER ORDAINED, that all other ordinances or parts of ordinances
inconsistent or in conflict with this Ordinance are hereby repealed to the extent of such
inconsistency or conflict. In the event of any inconsistency between the provisions of this
Ordinance and any prior ordinance of the Township, the provisions hereof shall govern. All other
parts, portions, and provisions of the Ordinances of the Township are hereby ratified and
confirmed, except where inconsistent with the terms hereof.
BE IT FURTHER ORDAINED, that this Ordinance shall take effect twenty (20) days
after final passage, adoption, and publication according to law.

ORDINANCE NO: 26-22

INTRO.: JULY 27, 2026

AN ORDINANCE AMENDING CHAPTER 218 OF THE CODE OF THE TOWNSHIP OF
EAST BRUNSWICK ENTITLED “WATER” TO ESTABLISH MANDATORY WATER
METER AND ADVANCED METERING INFRASTRUCTURE (AMI) REPLACEMENT,
CUSTOMER ACCESS REQUIREMENTS, AND ENFORCEMENT PROCEDURES
WHEREAS, The Township of East Brunswick owns and operates a municipal water
utility for the benefit of its residents and businesses; and
WHEREAS, the Township has implemented an Advanced Metering Infrastructure (AMI)
program to replace existing water meters and install remote meter reading equipment to improve
the efficiency, reliability, and accuracy of the municipal water system; and
WHEREAS, the installation of modern water meters and remote reading equipment will
improve billing accuracy, enhance leak detection, reduce non-revenue water loss, improve
customer service, reduce operating costs, eliminate estimated meter readings, and improve the
overall management of the Township's water utility; and
WHEREAS, successful implementation of the AMI program requires all water customers
to provide reasonable access to their water meters for inspection, replacement, testing,
maintenance, repair, and installation of remote reading equipment; and
WHEREAS, the Township Council finds that it is in the public interest to establish
mandatory access requirements together with reasonable enforcement procedures to ensure
completion of the Township-wide meter replacement program.
NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township
of East Brunswick, County of Middlesex, State of New Jersey, as follows:
Section 1.

Chapter 218, “Water”, a new Section, 22, is hereby added as follows:

Mandatory Water Meter Replacement and Advanced Metering Infrastructure (AMI)
A. Purpose - The purpose of this section is to require the replacement of all existing water meters
and installation of remote reading equipment necessary for the operation of the Township's
Advanced Metering Infrastructure (AMI) system.

B. Applicability - The provisions of this section shall apply to every property receiving water
service from the Township of East Brunswick Water Utility.
C. Authority to Replace Meters - The Township shall have the authority to inspect, test, repair,
maintain, replace, or upgrade any water meter, radio transmitter, remote reading device, or
associated equipment serving any customer connected to the municipal water system.
Replacement work may be performed by Township employees or contractors authorized by the
Township.
D. Customer Responsibility - The owner of any property served by the Township water system
shall provide reasonable access to the Township or its authorized contractor for the purpose of
replacing, inspecting, testing, repairing, maintaining, or upgrading water meters and remote
reading equipment. Where the property is occupied by a tenant, both the owner and occupant shall
cooperate in providing access. Failure of a tenant to cooperate shall not relieve the property owner
of responsibility for compliance.
E. Installation Cost - The initial replacement of a standard water meter and associated remote
reading equipment as part of the Township's AMI program shall be performed without charge to
the property owner.
This provision shall not apply where additional work becomes necessary because the owner or
occupant refuses or fails to provide reasonable access after notice
F. Notice Requirements - Prior to enforcement under this section, the Township shall make
reasonable efforts to schedule the replacement, including:
(1) Written notice mailed to the property owner.
(2) Additional written notice by regular mail, electronic mail, telephone, door hanger, text message,
or other reasonable means.
(3) A Final Notice advising that failure to schedule installation within thirty (30) days may result in
administrative charges and recovery of additional installation costs.
The Township shall maintain records of all reasonable attempts to schedule installation.
G. Incompatible Meter Service Charge; Final Meter Reading / Billing Charge - If the
property owner fails to provide access within thirty (30) days following issuance of the Final
Notice, an Incompatible Meter Service Charge of $250.00 per month shall be added to the
customer's utility account effective January 1, 2027.
The Incompatible Meter Service Charge shall continue until the required installation has been
completed, up to an amount not to exceed $2,000.00. Upon successful installation, no additional

monthly charges shall accrue. The Business Administrator and Water Utility Director may waive
or suspend the charge upon demonstration of hardship or other circumstances beyond the
customer's reasonable control.
A $250.00 Final Meter Reading / Billing Charge shall be charged to a customer that requests a
final meter reading / billing upon sale of the property that has not had their meter replaced prior
to the sale of the property effective January 1, 2027.
H. Recovery of Extraordinary Installation Costs - If the property owner continues to deny
access after reasonable notice, the Township may perform such work as is reasonably necessary
to obtain an operational meter, including installation of an exterior meter pit or other alternative
metering configuration. Any entry onto the property shall be made pursuant to lawful process,
including, but not limited to, obtaining a court order permitting entry onto the property. If the
Township is required to obtain a court order for entry onto the property, the property owner shall
be responsible for all costs incurred by the Township in obtaining said order, including attorneys’
fees and costs.
The property owner shall reimburse the Township for all actual costs incurred, including but not
limited to:

Excavation

•

Pavement restoration

•

Sidewalk restoration

•

Landscaping restoration

•

Contractor costs

•

Engineering

•

Inspection

•

Administrative costs

•

Materials

•

Radio transmitter equipment

•

Meter equipment

Attorneys fees and costs.
Such costs shall be added to the customer's utility account.

I. Utility Billing - Until the replacement meter is installed, the Township may estimate water
consumption using any reasonable methodology authorized by the Utility. Following installation,
the Utility may reconcile estimated consumption with actual meter readings.
J. Collection of Charges - Administrative compliance charges, installation costs, repair costs, and
other charges authorized under this section shall constitute lawful water utility charges. - Such
charges shall be collectible in the same manner as other municipal water utility charges, including
the imposition of liens where authorized by law.
K. Appeals - Any property owner may file a written appeal within twenty (20) days of the
assessment of an Incompatible Meter Service Charge. Appeals shall be submitted to the Business
Administrator or designee. The filing of an appeal shall not automatically stay enforcement
unless specifically authorized by the Business Administrator.
L. Emergency Access - Nothing contained herein shall prevent the Township from entering upon
property as otherwise authorized by law to protect the public water system or respond to
emergencies.
M. Violations - Failure to comply with the requirements of this section shall constitute a violation
of the Township Code. Each thirty-day period of continued noncompliance shall constitute a
separate offense. The remedies provided herein shall be cumulative and in addition to any other
remedy authorized by law.
Section 2.

If any section, subsection, sentence, clause, or phrase of this ordinance is held

unconstitutional or invalid by a court of competent jurisdiction, such decision shall not affect the
remaining portions of this ordinance.
Section 3.

All ordinances or parts of ordinances inconsistent herewith are hereby repealed to

the extent of such inconsistency.
Section 4.

This ordinance shall take effect upon final passage, publication, and filing according

to law.
