State Environmental Quality Review Act
Determination of Non-Significance and Negative Declaration

Adoption of Proposed Rezone of the 26 Market St Parcel from its Existing Classification
of Mixed Light lndustrial (MLl) to Mixed-Use Downtown (MU-D)
Whereas, pursuant to Chapter 190 (Zoning) of the Lockport City Code ("Zoning Code") $
190-46.1 , the City of Lockport Common Council is vested with the authority to amend the Zoning
Code; and
Whereas, the Common Council seeks to amend S 190-11.3(A) as the OfficialZoning Map
of the City of Lockport, to provide for a change in zoning classification of a parcel of land identified
as 26 Market Street, Lockport, NY 14094, SBL No. 109.55-1-5, ("Property") from its existing
classification of Mixed Light lndustrial (MLl) to Mixed Use - Downtown (MU-D); and
Whereas, the Property is a parking lot serving 4 Market Street also known as the Bewley
Building, a five-story, wedge-shaped commercial block building with a rusticated ashlar stone
base and brick upper floors, as well as incorporation of stone from a 19th century opera house
that once stood on the site, and the Bewley Building is at the center of the City's downtown core
history, as it has been listed on the State and National Register of Historic Places for almost a
decade; and
Whereas, the Property and Bewley Building parcel are under common ownership and the
parking on the Property serves the Bewley Building; and
Whereas, the Bewley Building parcel is zoned MU-D but the abutting Property is zoned
MLl, which makes both continued operations and any potential redevelopment or adaptive reuse
of this significant and historic part of the City overly cumbersome; and
Whereas, the proposed amendment will align the zoning of abutting parcels to MLl, which
will further zoning, DRl, and Comprehensive Plan initiatives that ensure the growth and stability
of the downtown core and City as a whole; and
Whereas, the Common Council has determined that the proposed amendment
constitutes an unlisted action pursuant to State Environmental Quality Review Act (SEQRA)
regulations 6 NYCRR 617.7; and
Whereas, any development of the Bewley Building and/or Property, as well as a sale
between private parties for the Bewley Building and/or Property that results in a development,
will require independent environmental review under SEQRA, and independent site plan or
special use permit review as set forth in the Zoning Code; and
Whereas, the Common Council, as lead agency, duly considered the proposed
amendment, including completion of parts 1,2, and 3 of the Short Environmental Assessment
Form, the criteria for determining significance as set forth in 6 NYCRR $ 617.7(c) of the SEQRA
regulations, and such other information deemed appropriate, including public comments
received at or before the public hearing on August 12,2026, took a hard look at those relevant
areas of environmental concern, and determined that the proposed amendment will not result in
any significant adverse environmental impact.
Now, therefore, be it resolved that the Common Council, as Lead Agency declares:
1. Based upon a thorough review and examination of the known facts relating to the
proposed amendment, all potentially significant adverse environmental impacts, and the
Application materials submitted together with the entire record and proceedings, the

Common Council, as Lead Agency, determines that the proposed amendment will not
have a significant adverse impact on the environment, that a draft environmental impact
statement will not be prepared, and, as a result, the Common Council, as Lead Agency
hereby issues a Negative Declaration of environmental significance.

2. The attached Short Environmental Assessment Forms Parts 1, 2, and 3, incorporated
herein by reference, is incorporated herein and made part of this Negative Declaration.

Whereas, on March 26,2025, the City of Lockport adopted a comprehensive update to
Chapter 190 (ZONING) of the City Code and the Official Zoning Map, Local Law No. 1 of 2025;
and

seeks to exercise its right to amend the City Zoning Code; and
Whereas, pursuant to Zoning Code S 190-46.1 the City of Lockport Common Council is

history, as it has been listed on the State and National Register of Historic Places for almost a
decade; and
Whereas, the proposed amendment will align the zoning of abutting parcels to MLl,; and
Whereas, the Common Council referred and the Planning Bord reviewed the proposed
amendment on June 1,2026, and
Whereas, pursuant to General Municipal Law $ 239-m and the lntermunicipalAgreement
with the Niagara County Planning Board, a full statement of the proposed amendment was
referred to the Niagara County Planning Board; and
Whereas, on May 18, 2026, the Niagara County Planning Board determined that the
rezoning had no significant countywide or inter-community impact, referral No. 7046; and

other information deemed appropriate, including public comments received at or before the
public hearing on August 12,2026, took a hard look at those relevant areas of environmental
concern, and determined that the proposed amendment will not result in any significant adverse
environmental impact; and
Whereas, the Common Council finds that the proposed amendment is in accordance
with the City's Comprehensive Plan, Zoning Code, DRI and satisfies the Review Criteria as set
forth in Zoning Code S 190-46.1.F; now therefore

IEXIERNALI Aug12 Council Meeting

Dear Mayor Lombardi, members of the Lockport Common Council (Mr. Kirchberger, Dr. Craig, Mr.
Wyche, Mr. O'Malley, Ms. Fogle, Mr. Wiley,) and City Clerk, Ms. Stoddard,

I want to express my appreciation for all the time, introspection, and concern that you offer to the
citizens of Lockport. I attended the last Council meeting as was impressed with your efficiency in
running the meeting and the sincere attention and concern that you showed the public speakers and
their concerns. Thank you!
Also, I am especially pleased that there was a unanimous vote to consider changing the zoning
problem conc-erning the Bewley Buitding. As a former tenant, I wish that Lockport continues to "be
ilive" downtown. I know it is a challenging decision and your decision will not be easy. Yet, I hope
that the nex! meeting on August rz provides added public incentives for the PathStone's housing
project for the Bewley Building getting the needed approval from your votes.
Thank you in advance.

RE: Public Hearing on Rezoning the Bewley Building Parking Lot
Dear Council Members:

Since I am unable to attend the public hearing in person on August 12,2026,1
wish to have my sentiments read into the record in support of the rezoning that is a
prerequisite to further development of the Bewley Building'
The Bewley Building is an integral part of the fabric of downtown Lockport. Many
of our older citizens recall visiting the Bewley Building for doctor or dentist
appointments, meetings with attorneys and/or accountants, and other businesses
housed in its five floors.
I myself practiced law from the Bewley Building in the early 1990's following
some renovations that Charlene Seekins and her staff oversaw. But even then, its

prominence in the business community had begun to fade, especially with the
development of Professional Parkway. \Mth each passing year, there have been more
and more vacancies. Then COVID made commercial real estate a losing proposition, so
of course a place like the Bewley Building was doomed under its original business
model.

As early as2023, Pathstone first approached the City with a plan to convert the
Bewley Building into moderate income housing. While individual rents would be
unsubsidized, the state would earmark funds to assist with construction costs as an
incentive to attract other investors through targeted tax credits. The total renovation
would be $65+ million, but the state share would be a small fraction of that. The state's
goal is to encourage housing for people with moderate incomes. lf a prospective tenant
earns between certain limits, the person is eligible for an apartment that might otherwise
be beyond their reach in terms of quality and cost.
Having these apartments in a downtown setting can have ripple effects. Not only
would the storefronts in the Bewley Building benefit from tenants'foot traffic, but other
local businesses would likewise increase their customer base.

The naysayers who talk of the project in terms of subsidized housing are just
playing bogeyman to scare people. Pathstone has had multiple success stories with this
type of development. This model is becoming more common throughout many
iommunities throughout the region. This proposal is also a great vehicle for revitalizing
nearly vacant property.
Please vote through the rezoning request for the Bewley Building parking lot. lt
will be the start of something bigger and better than you might imagine.
Very truly yours,

rf r/ez7/

CITY OF LOCKPORT - HAZARDOUS TREE REMOVAL REQUEST
Formal Complaint Letter
Jeremy Beidle
157 Olcott Street Lockport, NY 14094 Phone: 716-990-6880 Email: [email protected]

Date: July 2I,2026

Director of Highways & Parks
City of Lockport, NY
Subject: Urgent Request for Removal of Hazardous Tree - 157 Olcott Street
Dear Director,

I am submitting this formal complaint to request immediate removal of the hazardous tree located directly in
front of my residence at 157 Olcott Street, Lockport, NY. The condition of this tree has deteriorated to the
point where it poses a clear and imminent danger to residents, city employees, public infrastructure, and
essential services.
Over recent months, the tree has shed large branches without warning, and the trunk shows visible decay and
structural instability. During the storm on Saturdayo July 18th, the tree contributed to a localized power
outage, causing live electrical lines to fall across the roadway and onto vehicles. Most critically, our mail
carrier became trapped inside her postal Jeep when a downed power line landed across her vehicle.
Emergency crews were required to secure the area and ensure her safety. This incident demonstrates the
severity of the hazard and the urgent need for corrective action.

Beyond this emergency, our mail carrier has repeatedly expressed concem about delivering mail due to falling
limbs and the unstable canopy overhead. The sidewalk and curb area beneath the tree are routinely littered with
debris, creating unsafe conditions for postal workers, pedestrians, and neighbors. This represents a preventable
workplace hazard and arecuning public safety issue'

Given the tree's proximity to the roadway, sidewalk, and utility lines, the consequences of inaction include:

.
.
.
.
.

Injury to residents, pedestrians, or municipal workers
Damage to vehicles and private property

Disruption of mail service

Additional power outages or electrical hazards
Increased liability exposure for the City

As residents and taxpayers, we rely on the City's commitment to maintaining safe public spaces and addressing
known hazards before they result in avoidable harm.

I respectfully request that the City dispatch an inspection team as soon as possible and schedule removal of this
tree at the earliest available opportunity. I am prepared to provide photographs, documentation, or any
additional information needed to support this urgent request.
Thank you for your prompt attention to this matter and for your continued service to the residents of Lockport.
Please see documented photos of past and recent incidents of fallen limbs and damages.

Sincerelyo

Jeremy Beidle

Part 3 Determination of Significance
For every question inPart 2 that was answered "moderate to large impact may occur", or if there is a need to explain why a
particular element of the proposed action may or will not result in a significant adverse environmental impact, please
complete Part 3. Part 3 should, in sufficient detail, identify the impact, including any measures or design elements that
havebeen included by the project sponsor to avoid or reduce impacts. Part 3 should also explain how the lead agency
determined that the impactmay or will not be significant. Each potential impact should be assessed considering its setting,
probability of occurring, duration, irreversibility, geographic scope and magnitude. Also consider the potential for shortterm, long-term and cumulative impacts.

The proposed amendment to the zoning map (rezoning) does not have any physical impact to the environment and
achieves zoning and planning goals. Any subsequent redevelopment the parcel to be rezoned and adjoining Bewley
Building will undergo separate, independent SEQRA review. Therefore, there are no significant adverse
environmental impacts.

Check this box ifyou have determined, based on the information and analysis above, and any supporting documentation,
that the proposed action may result in one or more potentially large or sigtificant adverse impacts and an
environmental impact statement is required.
