REGULAR MEETING OF
THE VILLAGE OF CLEMMONS COUNCIL
August 24, 2026
The Village of Clemmons Council met on Monday, August 24, 2026, at 6 p.m. The meeting was
held at the Village Hall, Clemmons, North Carolina. The following members were present:
Mayor Rogers, Council Members Barson, Combest, Smith, Taylor and Wooden. Attorney Kevin
Hornik was also present.
Call to Order & Pledge of Allegiance
Mayor Rogers called the meeting to order at 6:00 p.m. and led the Pledge of Allegiance.
Public Comments
There were 50 citizens in attendance. There were six individuals that spoke during public
comments:
-J.C. Church, 4771 Bridal Path, Winston-Salem, NC – stated he is a member of the “No Asphalt
Plant Community Group” and someone had posed as helping the group but was an imposter
giving a fake name. He does not reside in NC and is known to diffuse opposition for
corporations. He accused Council and Staff of colluding with this individual due to the fact that
the individual had sent emails, received responses to his questions and had attended Council
meetings in the past.
-Andrea Vail, 4370 Bridal Path, Winston-Salem, NC – expressed that she has studied what
asphalt industries do when wanting to locate at a specific place and stated the way they navigate
is through politics, calling politics the great unknown.
-Beth Norman, 3609 Comeragh Court, Clemmons, NC – stated there are thousands of homes and
businesses that will be impacted by this toxic asphalt plant and stated fines that have been levied
on Maymead at various locations for dangerous emissions. She stated Maymead can’t be trusted
for accurate information and reliable samples.
-Mary Grubbs, 4812 Terrence Drive, Winston-Salem, NC – questioned why the Village lacks
legal options to block this project as the data center in Rural Hall was voted down and Lewisville
just rezoned a couple of properties (read from newspaper articles) – why can’t we do the same?
-Frank Burns, 4671 Forest Manor Drive, Winston-Salem, NC – stated his opposition to the
asphalt plant and questioned why Council is not talking about this. He stated it is their job to
communicate with the County, and they are burying their heads in the sand.
-Aaron Gibbs, 4720 Kinnamon Road, Winston-Salem, NC – stated he built his home which is
1300’ from the potential site. He stated they will have to move as it would be irresponsible for
them to stay with three small children. He drove by their Statesville facility which is located in
an extremely industrial area and the downwind smell was very noticeable. He begged Council to
look at other avenues to stop this.
There was one digital comment received (attached hereto as Exhibit A and incorporated as a part
of the minutes).
Approval of the Minutes
Council Member Taylor moved to approve the minutes of August 10, 2026, regular meeting as

Mayor Rogers made the following announcement, “Tonight, I am pleased to present two grants
from the 2025–2027 biennium budget. The first grant, in the amount of $62,500, will be awarded
to the Shallow Ford Community Foundation. This grant recognizes the foundation’s ongoing
commitment to supporting communities throughout our region. Under the leadership of President
and CEO Emmy Corn, the foundation has provided meaningful support for a wide range of
initiatives, including arts programs and educational scholarships. We are proud to support its
continued community engagement efforts. The second grant, also in the amount of $62,500, will
be awarded to the Village of Clemmons. Mayor Mike Rogers has advocated for both grants to
strengthen community programs and events. This funding was specifically requested to assist
with programming and other costs for the amphitheater at Village Point. Together, these grants
represent a total investment of $125,000 to enhance amenities, expand entertainment
opportunities, and improve the quality of life for local residents”. These grants were secured by
Senator Dana Caudill-Jones.
Business – Action Items
A.
Fire Districts Update – Kyle Haney, Deputy Forsyth County Manager, made a
presentation to Council (attached hereto as Exhibit B and incorporated as a part of
the minutes). Mayor Rogers asked if the current rate will be sustainable in coming
years. Mr. Haney stated they are actively having this conversation and additional
funds will most likely be needed in the future. Council Member Taylor questioned
if the county-wide model will affect service level. Mr. Haney stated there are
needs across the entire system and this model is designed to address those needs.
He stated the County is committed to providing coverage for Clemmons.
Council Member Barson requested that Mr. Haney speak to the asphalt plant
topic. He stated that the role the County plays is administering federal and state
government laws. He made it clear that this is how they are required to go about
handling the situation – everything must be done under federal and state
requirements/laws.

Meeting
Zoning District
The PB District is primarily intended to accommodate office, retail, service,
(Purpose Statement)
institutional, and high-density residential uses which customarily serve
community and convenience business needs of smaller communities and urban
nodes in the city and county. The district is intended to encourage the
development of attractive, identifiable small towns and to accommodate the
pattern of building in the business concentrations surrounding the central core
of Winston-Salem and the central cores of other municipalities in the County.
The district should demonstrate pedestrian-oriented design through elements
such as buildings pulled up to the street, on-street parking, street trees, covered
arcades, awnings, storefront display windows, public/private outdoor spaces,
wide sidewalks, and building entrances facing the street. This district is intended
for application in GMAs 1, 2, and 3.
Applicable Rezoning
B.6-2.6(C)(a)(i) Is the proposal consistent with the purpose statement(s) of
Considerations from

institutional uses.

Transportation Plan (2009). In Figure 3.6 (Community Strategic Corridor
Recommendations – US 158/Clemmons Road East), the community vision
for the corridor is a 3-lane and 4-lane boulevard with striped bike lanes and
sidewalks. In Figure 4.1 (Recommended Bicycle and Pedestrian Facilities),
there is a recommendation for a striped bike lane on Clemmons Road.
The Clemmons Pedestrian Plan (2024) did not identify any
recommendations adjacent to this site.

CONFORMITY TO PLANS AND PLANNING ISSUES
Forsyth Legacy GMA
Growth Management Area 1 (City or Town Center)
Pertinent Legacy
GMA 1 (City/Town Centers) includes Downtown Winston-Salem and

the centers of Forsyth County’s small towns. It promotes a dense,
mixed-use and pedestrian-oriented urban form and is the hub for
government and private employment.
Recommendations for GMA 1:
•
Attract more retail and entertainment
•
Promote reuse of older buildings
•
Promote design excellence
Clemmons Community
Clemmons Community Compass designates the future land use for
Compass (2040)
this site as “mixed-use office.” The mixed-use office land use designation
should include a mix of office, institutional, and single-family detached
housing. This designation is intended for existing and newly developing
office employment areas.
Office developments within a block of Highway 158 should be limited
to smaller-scale office uses, such as the conversion of single-family
homes to office use. In denser areas, office uses should be developed
to provide a vertical (multi-story) or horizontal (multiple uses on a
site) mix within a development. Office developments should be
designed with consistent design themes as part of the development
program, including architectural features and signage. Internal
circulation for vehicles and pedestrians should be provided between
uses.
The site is also located within the US-158 Corridor Strategic Planning
Area. Relevant future land use intent elements include:
•
Redevelopment will occur along the corridor. New
development should revitalize the area and make it a
Page 5 of 8
pedestrian-friendly civic, office, and small-scale retail corridor
•
Design recommendations included in the Village
Transportation Plan should guide redevelopment to provide
additional pedestrian and bicycle amenities and designated
road improvements
•
Traditional architectural designs and materials are encouraged
in this corridor

site. The subject site is within proximity to a variety of residential,
commercial, and institutional uses. The subject site meets the intent
to preserve the historic nature of the US 158 Corridor Strategic

GOVERNING BOARD STATEMENT
Per G.S. §160D-605, “When adopting or rejecting any zoning text or map amendment, the governing board shall
approve a brief statement describing whether its action is consistent or inconsistent with an adopted comprehensive
plan. Additionally, when adopting or rejecting any petition for a zoning map amendment, a statement analyzing the
reasonableness of the proposed rezoning shall be approved by the governing board. This statement of
reasonableness may consider, among other factors, (i) the size, physical conditions, and other attributes of the area
proposed to be rezoned, (ii) the benefits and detriments to the landowners, the neighbors, and the surrounding
community, (iii) the relationship between the current actual and permissible development on the tract and adjoining
areas and the development that would be permissible under the proposed amendment; (iv) why the action taken is
in the public interest; and (v) any changed conditions warranting the amendment. The statement of reasonableness
and the plan consistency statement required by §160D-605 may be approved in a single statement.”
On August 18, 2026, the Planning Board recommended approval of Zoning Docket SZMA-26-3 by a vote of 7-0.
Zoning Docket SZMA-26-3 proposes a zoning map amendment changing tax PIN 5892-29-9804 from IP
(Institutional and Public) to PB-S (Pedestrian Business – Special), which is consistent with the Village of
Clemmons Community Compass. The following is a written recommendation from the Planning Board to the
Village Council addressing Community Compass plan consistency:
Planning Board Consistency Statement for Zoning Map Amendment: Docket # SZMA-26-3
The proposed zoning map amendment petition for Zoning Docket SZMA-26-3 for tax PIN 5892-29-9804 from
IP (Institutional and Public) to PB-S (Pedestrian Business – Special) is consistent with the Village of Clemmons
Community Compass:
•
Alignment with "Mixed Use Office” and “US-158 Corridor Strategic Planning Area” Future Land Use
Designations: The Community Compass designates this site for “mixed use office, which specifically
calls for a mix of office and institutional, and single-family. The request provides two of those uses and
provides internal circulation for this building and the adjacent Old Clemmons School/Historic Broyhill
Office Suites. The US 158 Corridor Strategic Planning Areas calls for redevelopment along the corridor
and as an revitalization project of a former civic use, it fulfills that requirement. The proposed switch to
Pedestrian Business – Special Use (PB-S) directly supports the mixed-use office land use designation by
allowing a redevelopment that revitalizes the area by providing pedestrian-friendly office and smallscare retail and the building features a traditional architectural civic design.
•
Promotion of Adaptive Reuse and Historic Character: A key priority of Growth Management Area 1
(GMA 1) and the US-158 Corridor Strategic Planning Area is the adaptive reuse of existing civic
structures. Re-zoning the former Clemmons Library building allows it to be repurposed alongside the
adjacent Old Clemmons School Broyhill Center, revitalizing a central property without adding new
impervious surface or altering the historic scale of the corridor.
•
Pedestrian-Oriented Site Layout & Design: The property already exemplifies the core urban design
goals of the PB-S district and the US-158 Streetscape Guidelines:
o Building Placement: The single-story (25-foot) building is pulled up toward the street,
maintaining a traditional street front.
o Parking Location: All 37 parking spaces are situated to the side and rear of the building,
preserving the visual landscape.
o Pedestrian & Green Amenities: The site features an existing front courtyard, mature street trees,
open green space, and a 5-foot public sidewalk along Clemmons Road, with ADA-compliant
crosswalks required at driveway entrances.
•
Compatibility with Surrounding Uses and Growth Management Goals: Located in Growth Management
Area 1 (Town Center), the requested PB-S district is explicitly intended for GMAs 1, 2, and 3. The
proposed mix of uses—including offices, specialty retail, studios, and small-scale service
establishments—is fully compatible with the surrounding institutional, commercial, and office properties
to the north, east, and south.
The following are two statements for Village Council to consider. The first may be used, partially or in its entirety,
if the proposed map amendment is found to be consistent and reasonable. The second statement may be used,
partially or in its entirety, if Village Council finds the proposed map amendment to be inconsistent and
unreasonable.
Consistency Statement for Zoning Map Amendment: Docket # SZMA-26-3
The proposed zoning map amendment petition for Zoning Docket SZMA-26-3 for tax PIN 5892-29-9804 from IP

proposed mix of uses—including offices, specialty retail, studios, and small-scale service
establishments—is fully compatible with the surrounding institutional, commercial, and office properties
to the north, east, and south.
•
Therefore, the zoning map amendment request is reasonable and in the public interest because it supports the
Clemmons Community Compass recommendations above and because:
1. Infill & Revitalization: It optimizes existing public infrastructure by adaptively reusing a vacant civic
landmark rather than encouraging sprawl.
2. Corridor Aesthetics: By keeping all parking hidden to the side and rear while preserving green courtyard
space and street trees, the development enhances the visual entryway along US-158.
3. Multimodal Access: Dedicated sidewalk links and crosswalk enhancements ensure safer pedestrian access
in the heart of the village center.
Inconsistency Statement for Zoning Map Amendment: Docket # SZMA-26-3
The proposed zoning map amendment petition for Zoning Docket SZMA-26-3 for tax PIN 5892-29-9804 from
IP (Institutional and Public) to PB-S (Pedestrian Business – Special) is inconsistent with the Village of
Clemmons Community Compass:
•
Overly Broad Permitted Uses: The Community Compass future land use designation for this site is
"mixed use office” which envisions a mix of office, institutional uses and single family detached homes.
The petition requests an extensive list of broad commercial uses—such as general merchandise stores,
convenience stores, hardware stores, and building contractors—that exceed the intended scope of
pedestrian friendly office and small scare retailed called for in the designation.
•
Incompatibility of High-Traffic Commercial Uses with Site Access: The Village Transportation Plan
recommends striped bike lanes and enhanced pedestrian facilities along Clemmons Road. Adding highturnover retail and commercial uses (e.g., convenience stores or general merchandise stores) to a 1.01acre site with two existing full-movement driveways on US-158 increases vehicular friction, conflict
points, and turning movements, directly undermining the goal of fostering a safer, pedestrian-friendly
environment.
•
Encroachment into Civic and Institutional Buffer Core: The site currently serves as an Institutional and
Public (IP) zoning buffer, occupied by the former library building, and is situated adjacent to public
schools and religious facilities. Shifting the site to a commercial Pedestrian Business (PB-S)
classification with extensive retail permissions could introduce potential land-use conflicts with nearby
sensitive civic and educational uses.
Therefore, the proposed zoning map amendment from IP (Institutional and Public) to PB-S (Pedestrian Business –
Special) is inconsistent with the Village of Clemmons Community Compass, unreasonable, and contrary to the
public interest because:
1. Commercial Overreach: Introduces auto-centric, high-volume retail uses into an area intended for lowimpact, walkable office and civic activities.
2. Safety Hazards: Threatens traffic operations and pedestrian safety along a key corridor by adding intensive
commercial trip generation to unsignalized full-movement access points.
3. Encroachment on Community Anchor Uses: Undermines the quiet, safe environment required for
surrounding civic, educational, and religious institutions.

Meeting
Zoning District
The LB District is primarily intended to accommodate moderately intense
(Purpose Statement)
neighborhood shopping, and service centers close to residential areas. The
district is established to provide locations for businesses that serve nearby
neighborhoods, including smaller business sites up to ten (10) acres in rural
areas. The district is typically located near the intersection of a collector street or
thoroughfare in areas which are otherwise developed with residences. Standards
are designed so that this district, in some instances, may serve as a transition
between residential districts and other commercial districts. This district is
intended for application in GMAs 2, 3, 4 and 5.

in the vicinity?
2.6-(C)(3)(a)(ii)
Yes – the proposed banking and financial institution is compatible with
the more intense building materials supply use to the east and serves
as a transitional and neighborhood-serving use for the residential uses
surrounding the property to the south, east, and west. There are also
moderately intense commercial uses to the north and west that the
proposed uses are compatible with as well.

CONFORMITY TO PLANS AND PLANNING ISSUES
Forsyth Legacy GMA
Growth Management Area 1 (City or Town Center)
Pertinent Legacy
GMA 1 (City/Town Centers) includes Downtown Winston-Salem and
Recommendations
the centers of Forsyth County’s small towns. It promotes a dense,
mixed-use and pedestrian-oriented urban form and is the hub for
Page 4 of 9
government and private employment.
Recommendations for GMA 1:
•
Attract more retail and entertainment
•
Promote design excellence
Clemmons Community
Clemmons Community Compass designates the future land use for
Compass (2040)
this site as “village-scale office and retail.” The village-scale office and
retail future land use classification is intended to maintain the historic
scale of development along the US-158 corridor. Village-scale office
and civic uses are appropriate in this corridor. Secondary uses include
smaller commercial uses, such as corner markets, small restaurants,
personal service shops, gift shops, and similar small retail uses.
Streetscape design standards developed for the US-158 corridor
provide guidance for streetscape design, site orientation, and
building frontages. Buildings within this corridor should not exceed
two-stories and buildings should front the road with parking to the
side or rear. Pedestrian access should be provided along the corridor
and enhanced landscape and tree protection should maintain this as
a “green corridor.”
The site is also located within the US-158 Corridor Strategic Planning
Area. Relevant future land use intent elements include:
•
Redevelopment will occur along the corridor. New
development should revitalize the area and make it a
pedestrian-friendly civic, office, and small-scale retail corridor
•
Design recommendations included in the Village
Transportation Plan should guide redevelopment to provide
additional pedestrian and bicycle amenities and designated
road improvements
•
Traditional architectural designs and materials are encouraged
in this corridor

Other Applicable Plans &
This site is within the East Campus District as defined in the US 158
Page 5 of 9
Planning Issues
Streetscape Guidelines (1997) from Hampton Road to Cordova Drive.
The East Campus was described as the following: The segment of
roadway between Hampton Road and Cordova Drive is currently five
lanes. A new center landscape median should replace selected
sections of the center lane. The median should be grassed and
planted with flowering trees. The median response will serve as a
strong pattern which signals the approach to downtown and will do
much to scale down the broad swath of asphalt along this section.
Along the edges of the corridor, informal massing of shade trees and
other plantings should be encouraged on private properties. Informal
walkways should continue throughout, following the topography of
the land and existing vegetation. Some selective clearing and limbing
up of trees may be necessary. A public/private partnership will need
to be worked out to provide the optimum benefits. The preservation
of trees over twelve inches in caliper should be encouraged within a
fifty-foot buffer of the right-of-way as existing woodlands become
developed. As the use of some residential units become commercial
and new development occurs, parking should be required in
back of the buildings. Architecture should once again be in keeping
with the traditional style of Clemmons.

Planning Area. The US-158 Streetscape Guidelines should be used to
ensure that the scale and design of new development is appropriate
with the historic village character of the area. The streetscape
guidelines encourage sidewalks and street trees as well as pedestrianscale lighting for the streetscape design; the site plan shows all of
these elements being provided. The streetscape design guidelines
also prefer parking to be to the rear or side of the building. Given
that this site has multiple street frontages, staff was amenable to
having accessible parking to the front of the building, as long as
ADA-compliant pedestrian connections were being provided
elsewhere from the proposed and existing sidewalks. The site has also
reserved an open space outdoor seating area towards the
intersection in keeping with the streetscape and strategic planning
area guidelines. The elevations provided are in keeping with the
traditional style of Clemmons as well, utilizing arches in the design
and brick materials.

On August 18, 2026, the Planning Board recommended approval of Zoning Docket SZMA-26-4 by a vote of 7-0.
Zoning Docket SZMA-26-4 proposes a zoning map amendment changing tax PIN 5893-40-2021 from PB-S
(Pedestrian Business – Special Use District) to LB-S (Limited Business – Special Use District). The following is a
written recommendation from the Planning Board to the Village Council addressing Community Compass plan
consistency:
Planning Board Consistency Statement for Zoning Map Amendment: Docket # SZMA-26-4
The proposed zoning map amendment petition for Zoning Docket SZMA-26-4 for tax PIN 5893-40-2021 from PBS (Pedestrian Business – Special) to LB-S (Limited Business – Special) is consistent with the Village of Clemmons
Community Compass:
•
Alignment with Future Land Use Intent: The Community Compass designates this location as "village-scale
office and retail." The requested Limited Business – Special (LB-S) classification and proposed lowintensity uses (specifically: banking and financial services, professional/medical offices, and personal
services) align directly with the intent to maintain village-scale commercial and office development along
the US-158 corridor.
•
Scale and Traditional Architectural Character: The 7,600-square-foot, single-story (32-foot) building height
is well within the two-story maximum recommended by corridor guidelines. Furthermore, the building
elevations incorporate traditional Clemmons design elements, including brick materials and architectural
arches.
•
Pedestrian Integration and Amenities: The project supports the plan's focus on pedestrian-friendly
infrastructure by incorporating a proposed 5-foot sidewalk along Clemmons Road (connecting with existing
sidewalks on Hampton Road and Cook Place Drive), ADA-compliant crosswalks, and an open-space
outdoor seating area framed with pedestrian-scale lighting near the main intersection.
•
Green Corridor and Environmental Considerations: The site plan complies with the corridor’s streetscape
and landscaping objectives by keeping impervious coverage to 43.56% (well below the 75% maximum),
Page 1 of 4
implementing required streetyard and bufferyard plantings with large tree varieties, and maintaining tree
protection standards during construction.
•
Appropriate Transitional Use: Positioned at the intersection of Clemmons Road and Hampton Road, the
proposed neighborhood-serving development provides an appropriate transition between the higherintensity industrial/building material supply uses to the east and the surrounding single-family residential
neighborhoods to the south and west.
Consistency Statement for Zoning Map Amendment: Docket # SZMA-26-4
The proposed zoning map amendment petition for Zoning Docket SZMA-26-4 for tax PIN 5893-40-2021 from PBS (Pedestrian Business – Special) to LB-S (Limited Business – Special) is consistent with the Village of Clemmons

Therefore, the zoning map amendment request is reasonable and in the public interest because it supports the
Clemmons Community Compass recommendations above and because:
1. Logical Land Use Transition: The proposed zoning district is located at the intersection of Clemmons Road
and Hampton Road. This parcel serves as an important buffer for land use, effectively transitioning from the
higher-intensity industrial and building-supply uses to the east, down to the low-density, single-family
residential neighborhoods to the south and west.
2. Compatible Intensity: The proposed zoning restricts the site to low-impact commercial and professional
office uses ensures that traffic generation and operational footprints remain harmonious with adjacent
residential areas.
3. Infrastructure Utilization: The proposed zoning district allows the development to maximize existing public
transportation infrastructure and pedestrian connections without overloading the local vehicular network.
Inconsistency Statement for Zoning Map Amendment: Docket # SZMA-26-4
The proposed zoning map amendment petition for Zoning Docket SZMA-26-4 for tax PIN 5893-40-2021 from PBS (Pedestrian Business – Special) to LB-S (Limited Business – Special) is inconsistent with the Village of
Clemmons Community Compass:
•
Incompatibility with Growth Management Area (GMA) Designations: The subject property is located in
Growth Management Area 1 (GMA 1 - City or Town Center), which prioritizes a dense, highly
pedestrian-oriented urban form. However, the purpose statement for the requested Limited Business
(LB) district specifically states that it is intended for application in GMAs 2, 3, 4, and 5, making the
requested zoning district fundamentally mismatched with the site's primary growth management
designation.
•
Deviation from Preferred Site Layout & Parking Guidelines: The US-158 Corridor Streetscape
Guidelines and Community Compass explicitly state that buildings should front the road, with parking
restricted to the rear or the side, to maintain the historic visual corridor. Placing accessible parking in
front of the building along the primary street frontage violates these spatial design standards and reduces
the seamless pedestrian framing intended for the corridor.
•
Autocentric Intensity and High Daily Trip Generation: The Community Compass envisions a "villagescale," walk-friendly corridor focusing on low-impact, small-scale retail and office uses. The proposed
financial institution, featuring drive-through service windows, generates 763 daily vehicle trips, a
significant increase over neighboring passive uses, thereby reinforcing auto-centric dependency and
vehicular turnover at a key intersection rather than promoting a slow, walkable village core.
•
Conflict with Comprehensive Pedestrian Infrastructure Goals: The Clemmons Pedestrian Plan (2024)
specifically calls for Project ID: SUP-03, establishing a Shared Use Path along the area. The standard 5foot sidewalk layout in the proposal falls short of providing a multi-modal, dedicated shared-use path
facility that safely accommodates both bicyclists and pedestrians along this high-volume arterial
corridor.
•
Loss of Historic Context and Woodland Buffers: The corridor guidelines emphasize preserving existing
woodlands and mature tree canopies within a 50-foot buffer of the right-of-way to maintain the "green
corridor" character. The development footprint affects the site's historic setting (formerly housing the
mid-nineteenth-century Greek Revival Cook-Bingham House). It replaces natural topography and
mature canopy with asphalt parking and drive-through lanes.
Therefore, the zoning map amendment request from PB-S to LB-S is unreasonable and contrary to the public
interest for the following reasons:
1. Subversion of Town Center Goals: The proposed zoning district permits a downgrading or misapplication
of district regulations within GMA 1, undermining long-term public investments aimed at building a
compact, walkable, and distinct town center core.
2. Increased Vehicular Hazards: The proposed zoning district would concentrate high-turnover drive-through
traffic at the intersection of Clemmons Road and Hampton Road, introducing unnecessary congestion and
heightening potential vehicular and pedestrian conflict points.
3. Irreversible Environmental and Cultural Degradation: The proposed site plan replaces mature woodland
canopy and historic site contexts with surface parking and drive-through lanes, permanently degrading the
aesthetic entry corridor.

REQUEST
The purpose of this text amendment is twofold:
1. Environmental & Floodplain Resilience: Establish a mandatory 150-foot setback for outdoor storage
areas and associated structures located in Industrial (LI, CPI, GI, CI) and High-Intensity Commercial (CPO,
GO, NSB, HB, GB, CB, MX) districts from any identified Special Flood Hazard Area (SFHA) or
Floodway. This requirement mitigates the risk of floodwater contamination, prevents floatable hazards
during storm events, and preserves natural floodway functions.
APPLICABLE SECTIONS OF THE UDO:
The following section is proposed for amendment:
Chapter B, Article II, Section 3-1.2 J Special Yard Requirements Where Nonresidential Districts Adjoin
Residential Districts.
CLEMMONS COMMUNITY COMPASS
This proposed amendment directly advances the vision, goals, and policy objectives outlined in the Clemmons
Community Compass 2040 Comprehensive Plan by establishing clear regulatory mechanisms to resolve landuse conflicts and protect sensitive natural resources.
The amendment furthers the Community Compass through two main policy pillars:
1. Environmental Stewardship & Floodplain Protection
Related Plan Goal: Goal 6 (Environmental Stewardship) and Chapter 7 (Environmental
Sustainability)
UDO Provision: Section 3-1.2(J)(2) requires structures and outdoor storage areas in Industrial
(LI, CPI, GI, CI) and High-Intensity Commercial (CPO, GO, NSB, HB, GB, CB, MX) districts
to be located at least 150 feet away from Special Flood Hazard Areas (SFHA) or Floodways.
How it furthers the plan:
Water Quality & Pollution Prevention: Outdoor storage in high-intensity and industrial zones
carries elevated risks of chemical runoff, sediment transport, and hazardous material wash-off during
storm events. A 150-foot setback ensures that potential contaminant sources are kept out of
vulnerable flood zones, protecting local waterways and the function of stormwater infrastructure.
Riparian & Floodplain Resilience: Protecting stream corridors and floodways aligns with the
plan's specific policy to encourage expanded protection of natural resources, preserve natural
drainage functions, and minimize degradation of environmentally sensitive lands.
2. Comprehensive Plan Implementation & Regulatory Consistency
Implementation Strategy: Chapter 8 (Implementation) and the Village's ongoing UDO Rewrite
process emphasize that long-range vision goals can only be realized through enforceable
development code updates.
How it furthers the plan:
UDO-91 converts high-level policy goals (protecting natural resources and ensuring
compatible land-use transitions) into predictable, enforceable zoning standards for staff,
developers, and citizens during site plan reviews.
RECOMMENDATIONS:
Staff – Recommends Approval
Planning Board – Recommends Approval (7-0 vote)

On August 18, 2026, the Planning Board unanimously recommended approval of Zoning Docket C-UDO-91. The
following is a written recommendation from the Planning Board to the Village Council addressing Community Compass
plan consistency:
Planning Board Consistency Statement for Unified Development Ordinances Text Amendment C-UDO-91:
The proposed UDO Text Amendment (Docket C-UDO-91), which establishes a mandatory 150-foot setback for
outdoor storage areas and associated structures in Industrial and High-Intensity Commercial zoning districts
from any Special Flood Hazard Area (SFHA) or Floodway, is consistent with the Village of Clemmons
Community Compass 2040 Comprehensive Plan, applicable long-range plans, and the intent of the Unified
Development Ordinance (UDO).
Environmental Stewardship & Floodplain Protection (Goal #6 & Chapter 7):
The Community Compass calls for expanded protection of environmentally sensitive lands, natural
stream corridors, and floodplains.
The 150-foot buffer directly advances these goals by reducing the risk of water contamination,
preventing chemical runoff, and eliminating floatable hazards during severe storm events.
Preserving the natural drainage functions of SFHAs and floodways aligns with the Village’s policy
objectives of enhancing flood resilience and safeguarding local water quality.
Comprehensive Plan Implementation & Code Modernization (Chapter 8):
The Community Compass emphasizes updating regulatory controls to turn vision goals into clear,
enforceable standards.
C-UDO-91 translates high-level environmental and land-use transition goals into predictable, objective
site development standards for staff, developers, and the community during site plan review.
Land Use Compatibility & Risk Reduction:
Placing a buffer between high-intensity/industrial storage uses and flood-prone areas mitigates land-use
conflicts and protects downstream properties from storm-driven debris and flood damage.
Consistency Statement for Unified Development Ordinances Text Amendment C-UDO-91:
Therefore, the proposed UDO Text Amendment (C-UDO-91) is reasonable and in the public interest because it
effectively translates the vision of the Clemmons Community Compass 2040 Comprehensive Plan into actionable
regulations that enhance public health, safety, and environmental stewardship.
1. Environmental Stewardship & Floodplain Protection: This amendment supports Goal #6 and Chapter 7 by
establishing a mandatory 150-foot setback for outdoor storage in Industrial and High-Intensity Commercial
districts. This buffer protects against hazardous runoff and preserves water quality and floodplain functions
by minimizing risks during high-water events.
2. Comprehensive Plan Implementation & Code Modernization: C-UDO-91 modernizes local development
regulations, replacing vague goals with clear, objective standards. This ensures predictability for developers
and community members during site plan reviews and aligns future growth with environmental standards.
3. Land Use Compatibility & Risk Reduction: The proposed amendment preventing storage facilities from
encroaching on floodplains reduces conflicts between land uses and mitigates secondary flood damage,
protecting property and downstream landowners.
In summary, C-UDO-91 balances responsible growth with environmental protection, promoting the health and
safety of the Clemmons community
Inconsistency Statement for Unified Development Ordinances Text Amendment C-UDO-91:
The Village of Clemmons Planning Board finds the proposed Unified Development Ordinances (UDO) text amendment
C-UDO-91 to be inconsistent with the Village of Clemmons Community Compass (2040 Comprehensive Plan).
While the request is intended to promote environmental resilience, it is inconsistent with the following:
Economic Development & Land Use Flexibility: The imposition of an expansive 150-foot setback across a
range of commercial and industrial zoning districts does not promote the development of these districts, which
typically serve as local employment centers. This could restrict or slow down economic development within the
Village, which conflicts with Goal #7 of the Clemmons Community Compass (Diverse Employment
Opportunities).
Therefore, the proposed UDO Text Amendment (C-UDO-91) is unreasonable and not in the public interest. The
rigid 150-foot setback imposes severe constraints on commercial and industrial properties, contradicting the
Village’s economic development goals by limiting buildable land and functionality.
1. The proposed amendment directly conflicts with Goal #7 of the Clemmons Community Compass, which
aims to promote diverse employment opportunities. It restricts outdoor operations and reduces developable
land in essential employment districts, hindering job creation and driving businesses to areas with more
flexible regulations.
2. The proposed zoning creates uniform setbacks and fails to consider site-specific factors such as topography
and existing developments that could mitigate runoff effectively. Instead of encouraging balanced growth,
C-UDO-91 creates unnecessary barriers that harm local businesses and the Village's economic
competitiveness.
In conclusion, C-UDO-91 is contrary to the public interest, as the economic drawbacks outweigh any perceived
benefits of a strict setback.
