met this day for a Regular Meeting. Upon call of the roll, Mr. Minniear – present, Mr.

PUBLIC HEARING
1) ZC26-010: Rick Seitz requests a zoning map amendment from
RA-1 (Residential Agricultural District) to R-PUD (Residential
Planned Unit Development District) for a 97.3841-acre site and
a Preliminary PUD plan containing 292 residential units with a
mixture of attached and detached products.
Application withdrawn by the applicant. This case will not be heard.
2) ZC26-013: A text amendment to the Liberty Township Zoning
Resolution regarding planned unit development (PUD) expiration
regulations, data center regulations and miscellaneous updates.

Kim Gaker, 4951 Lesourdesville-West Chester Road, appreciates the opportunity to
speak about the Gaker property. Her property is identified to be down-zoned due to
her text amendment. Please consider the points in her letter as her property is
different than the other 2 properties that will be rezoned. History behind the property
– due to economic reasons in 2008-2009 they did not proceed with developing the
property. After their death – she and her husband bought the property off of the
estate. They paid the premium acre price as an investment 6 years ago based on
the appraisal stating that is was going to be a medium density property. Please
consider delaying the issues since this was an unexpected issue. They have a letter
of intent from a major developer. This change would cause headaches so they can
submit a plan in writing shortly. They would like a 3-year extension as their property
is different that the other two properties.
Douglas Gaker, 4951 Lesourdesville-West Chester Road. Wants to emphasize
respect and personal property rights. A three-year window does not seem fair.
They assumed their property would stay approved a medium density property. They
feel they are not given the same respect as a new developer and they have been
here over 60 years. Property is protected in the 5th amendment regarding personal
property rights. The issue has been settled in the law about down zoning of property
at the Supreme Court level. He has been tireless in the upkeep of his property to
keep his property natural. His life savings has been put into this farm. He reiterated
that the appraisal stated the zoning of the property. It will only be a matter of weeks
until a plan comes to the township. He feels going back and forth is not worth the
Township’s time.

PUBLIC HEARING
1) ZC26-012: Todd Terry requests a zoning map amendment from B-2 (General
Business District) to B-PUD (Business Planned Unit Development District) for
a 11.9871-acre site and a preliminary PUD plan for JT Truck Parking and
related uses.

Mr. McIntyre presented the staff report.
Applicant
Caitlin Yuchak, 5396 Princeton Road, spoke on behalf of the application. She is
seeking approval for a trailer sales and long-term fleet storage operation that will serve
local businesses and their corporate business partners. Truck, Trailer or Farm
Implement Sales and Service is permitted by-right in the B-2 (General Business
District) so the long-term fleet storage is the critical component is this request. They
would like to build upon the existing stormwater management system in place in
addition to installing additional fencing. Dust-free asphalt millings will be used at the
rear of the property with the front of the property being paved on both the Liberty
Township and Lemon Township sides. This proposal will be a phased, low-impact
commercial development. Phase 1 includes a trailer sales and leasing facility, as well
as long-term rental spaces for local business and fleets. Phase 2 would include a light

maintenance facility which would be reserved for the major site tenants and would not
be open to outside customers. They have two corporate partners with on
contemplating a multi-year lease. This parking proposal would be for corporate and
business partners, not singular individuals and/or operators. A security gate with
remote access will be available. Truck washing, overnight stays and loitering will be
strictly prohibited. Contract Leasing Company (CLC) is the main corporate partner and
specializes in the sales and leasing of semi-trailers. Kroger Fulfillment is the other
business partner. The operating hours will be the standard 8 am – 5 pm and will have
two employees onsite. One “yard tractor” will be onsite to move trailers internally within
the site. The light maintenance facility would be staffed by an outside vendor with 1-2
employees but don’t anticipate this being a high volume generator for the site. They
anticipate 2-3 trailers entering/exiting the site per week with the potential for 5-8 per
day at a maximum capacity. This proposal naturally fits within the existing commercial
and industrial character of the Route 4 Corridor with several nearby properties being
Butler Tech, Butler County Water Treatment Plant, Lithco Auto SelfStorage and three
other truck maintenance and/or transportation businesses. The site acts as a low
noise, low impact transitional use within the fabric of the corridor. TEC Engineering
was tasked with conducting a Turn Lane Analysis which was ultimately approved by
ODOT confirming a low volume operation will have little to no impact on Route 4 traffic.
A six-foot mound with an eight-foot solid fence is proposed along the rear of the
property which creates a fourteen-foot visual barrier. Light poles will be eighteen-feet
in height and will be full cut-off lights that face downwards. Lastly, this proposal will
not be a truck stop, restaurant, overnight rest area, gas station or other unstaffed
vacant lot.
Andrea Harth, representing TEC, stated that ODOT has already approved the traffic
study. It was approved in 2019. She presented the gap study, speed data, crossover
requirements and site distance requirements.

Doug Gaker, 4951 Lesourdsville-West Chester Road, stated that the property is
currently working as a truck stop. The proposed truck repair shop will be a big truck
repair shop. He has concerns about the traffic on route 4. He feels the traffic study
approved by ODOT is out of date and does not address the traffic that will happen
along route 4 regarding the turn lanes. He questions how this fits within a rural
township. This has been going on for several years – please don’t change previous
decisions.
Mr. Minniear asked if the lead space is long enough for a semi staging?
Ms. Yuchak stated it is large enough for queuing two semis and two and
wide enough for two side by side.
Kimberly Wilburn, #4 Telford Court, Rochester Court, spoke on behalf of the traffic
situation. She has lived in the trailer park for over 20 years and there is only one way
in and one way out and has seen several accidents. She feels the medians are not
large enough for a semi – they are barely big enough for the garbage truck. The traffic
speed is too high for the crossover and turn lanes.
Jessica Ray, #32 Cranbrook Drive, Rochester Court, has concerns about the

crossover traffic implications and safety, especially regarding EMS services. She also
has concern about the water runoff going into Gregory Creek and does that impact
the clean water act.
Mr. Minniear asked if the gate has card access?
Ms. Yuchak stated the gates are open during regular business hours
and card access after that time.
Douglas Kelly, #3 Telford Court, agrees with previous statements. He has concerns
about the traffic safety turning into the trailer park and the proposed business. You
really need to drive it during the day to feel the impact during peak times.
Don Kelley, #10 Balford Court, has concern about the traffic and environmental
impact. He feels there will be no way a semi can turn into the proposed business
without blocking two lanes of traffic.
Kim Gaker, 4951 Lesourdesville West -Chester Road. Also has concerns about the
traffic. She shared pictures of the areas and blind hills. Traffic is too tight to turn into
the proposed business. She has concerns about the sales and service facility. She
has concerns about OSHA requirements and noise levels.
Matthew Thorton, 5050 Hamilton-Middletown Road, who is required to clean up if
something happens there. Butler County and Zoning Commission have already said
no. He also agrees with the previous statements about traffic and safety.
Hubert Annlly, 3209 Cranbrook Drive, what is justification for the rezoning. What
happens if a third truck arrives? How is staging if a truck does not have the code. Any
turnaround will cause the truck to need to use two lanes to turn-a-round or turn into
the property. Please uphold the denials by Butler County and the Township Zoning
Board.
Trustee questions:
Mr. Minniear – what is the history of the zoning request to Lemon Township.
Ms. Yuchak stated that the property has been owned for 10 years and
operated as a tree and nursery center. Once it closed many people
would ask them to ask to park their truck there and that is how the vision
came. Lemon Township after approval – the property owners would be
required to have a sales, leasing and service facility.

Mr. Schramm – it is a complicated case as two different jurisdictions cobble together

a successful use. He is not concerned about the number of meetings as they have
been productive. He also stated that he has to trust the professionals about the traffic
study. He has to believe in the study and cannot override the traffic study. Can this
operate as a B-2.
Mr. Behrmann stated that sales and service are allowable, the storage
is the zoning issue.
Mr. Schramm stated that this is a difficult site for a new business to come into.
Mr. Farrell – in straight zoning there are 56 used in B-2. Some are intrusive compared
to this property. Such as, wine bars, SOB, 24-hour businesses are all allowable in B2 straight zoning. With a PUD if the use changes – the property owner must come
back to the township. Under straight zoning the use can change with no approvals.
He believes that the other uses could potentially produce more traffic than the
proposed use. He is not an expert on traffic studies and environmental – does he
always agree with them – no. But they must count on professional resources even if
we don’t agree.
Mr. Minniear – has been arguing with himself on the deliberation of this decision. He
does not feel that this fits with the comprehensive plan vision. The application does
not convince him that the application will have limited impact on the surrounding
residential area. With 24/7-hour access – with undetermined number of in and out
traffic. How to control the 24-hour idling even though it is not allowable. A previous
case regarding a gas station – he has the same concern about the diesel impact on
the residents. He feels there will be a conflict between the residential development
and this business. If he just looks at Rt.4 – it works but has concerns about the future
residential development.
Mr. Farrell – stated that the applicant changed and addressed every issue that the
Trustees had in the previous application. Can you control the opening gate? Can you
stop 24-hour access. The gas stations do have 24-hour access. He feels if you know
what surrounds you when you purchase that is their decision. With regards to gas
station – the order matters – the residential business was there first. There are many
more intrusive issues that can go in this location with straight zoning that was is
proposed.

Update on the Trails Plan – there are funds budgeted for a trails plan update. RFQ has
been submitted and we received several applications. At the next meeting he will be asking
for approval to contract with MSP within the budgeted amount on the township wide trails

Mr. Schramm – asked if the plan will identify areas where there is no opportunity to ask for
the help of developers or donations.
Mr. Behrmann stated that yes, this plan will show all areas within the
Township where no opportunity is available for help.
Administration
Ms. McKinney made a motion to approve the Township Administrator to enter into an
agreement with Butler County Engineer’s Office and West Chester Township for a road
widening project along Hamilton Mason Road between SR 747 and Quail Run Drive and

RESOLUTION TO LEVY SPECIAL ASSESSMENTS TO PAY FOR SUBDIVISION STREET
LIGHTING IN LIBERTY TOWNSHIP
Ohio.

RESOLVED by the Board of Trustees of Liberty Township, Butler County,

WHEREAS, the Liberty Township Board of Trustees has the authority to assess the
expense of maintaining the streetlights in two equal annual installments in the same manner
and times as the taxes are paid and collected in accordance with O.R.C. § 515.08;
WHEREAS, the Liberty Township Board of Trustees will assess property owners one
hundred percent (100%) for the expense incurred in the maintenance of the street lights, not
in excess of the special benefits resulting thereto from such lighting, in accordance with O.R.C.
§ 515.08;
WHEREAS, the boundaries of the said unincorporated districts and said assessments
shall be certified to the Butler County Auditor by certifying a copy of this resolution, in which
the Auditor shall annually place upon the tax duplicate for collection in equal annual
installments of said assessments for that year pursuant to O.R.C. § 515.11; and
WHEREAS, the assessments, when collected, shall go into the treasury of the township
and used by the Board of Trustees, thereof, only for the said purpose in which they are levied
pursuant to O.R.C. § 515.11;

Outstanding Checks

The Township collects union dues from eligible fire employees through payroll deduction. The
deducted dues are subsequently remitted to the union by check issued through Paycor.
During a review of a stop-payment notice, staff identified 15 union dues checks dating back to
2020 that had not been cashed totaling $14,893.69. Because these checks remained
outstanding for an extended period, stop payments were placed on the checks to prevent them
from being cashed.
However, the underlying union dues amount that was withheld from employees through payroll
deduction is still owed to the union. Following the stop-payments, the Township needs to
reissue payment for these outstanding dues.
Staff requests a motion to approve requisition 985-26 in the amount of $14,893.69 from
account 2191-220-190-0000.

Engine 112 repairs

The Department is requesting approval to proceed with additional repairs to
Engine 112. The apparatus was taken to Cummins on July 22 after entering
limp mode and displaying numerous check engine codes. Initial diagnostics
identified a damaged engine wiring harness, and a purchase order not to
exceed $4,000.00 was issued for the repair.
Following completion of the initial repair, Cummins determined that the main
wiring harness, a separate component, also required replacement. A second
purchase order not to exceed $9,550.00 was issued, and that repair has now
been completed. As the wiring systems were restored and additional
diagnostics could be performed, Cummins identified a faulty DEF header that
also requires replacement. The additional cost to replace the DEF header is
$3,627.49.
Cummins has advised that there is a low probability that additional issues
may be identified as repairs and testing continue. Because Engine 112
remains inoperable and the DEF header must be ordered before repairs can
proceed, the Department recommends moving forward with the additional
repair to return the apparatus to service as soon as possible.
A motion approving the additional repair to Engine 112 by Cummins in the
amount of $3,627.49 from Account No. 2191-220-323-0000.

Amending Pay Resolution

The Township's current pay resolution establishes the regular payroll schedule for employees.
The 2026 calendar results in 27 pay periods being processed during the 2026 calendar year rather
than the typical 26 pay periods.
The additional pay period was anticipated in the Township's financial planning process. However,
the 27th pay was originally accounted for in the 2027 financial plan based on the expectation that
the first payroll of 2027 would be issued in January.
The first regularly scheduled pay date of 2027 falls on January 1, 2027, which is a bank holiday.
As a result, the payroll would need to be processed and issued on the preceding business day in
accordance with the Township's payroll practices.
Because the preceding business day falls in December 2026, the payment would clear the
Township's bank account before the start of the 2027 calendar year. Consequently, the payroll
technically associated with the first 2027 pay period will result in an additional payroll
expenditure being recognized in 2026.
This creates a need to update the current pay resolution to accurately reflect the actual timing of
the payroll payment and the resulting 27 pays occurring in calendar year 2026.

AT 6385 COACH HOUSE WAY, LIBERTY TOWNSHIP 45011; TO ASSESS ABUTTING
PROPERTY OWNER ONE HUNDRED PERCENT FOR REPAIR AND MAINTENANCE OF
SIDEWALK; AND TO REQUIRE RESIDENT TO NOTIFY THE LIBERTY TOWNSHIP PUBLIC
WORKS DIRECTOR OF THEIR INTENT TO PERFORM THE REPAIR AND MAINTENANCE
RESOLVED by the Board of Trustees of Liberty Township, Butler County, Ohio, that
WHEREAS, the Liberty Township Board of Trustees has the authority to assess the
expense of construction, repair, and maintenance of the sidewalk to the property owner
abutting the construction, repair, or maintenance pursuant to O.R.C. § 5543.10;
WHEREAS, the Liberty Township Board of Trustees will assess abutting property
owner one hundred percent (100%) for repairs and maintenance of sidewalk at 6385
Coach House Way, Liberty Township 45011, in accordance with O.R.C. § 5543.10 and
Liberty Township Resolution 2006-164;
WHEREAS, Jerry Sebald, Liberty Township Public Works Director, requests the
Liberty Township Board of Trustees authorize repair and maintenance on the sidewalk at
6385 Coach House Way, Liberty Township 45011;
WHEREAS, the Public Works Department has marked the sidewalk which needs
repair at 6385 Coach House Way, Liberty Township 45011;
WHEREAS, the Liberty Township Board of Trustees desires that if a resident decides
to perform the repair and maintenance of sidewalks, he or she will follow standards set by
the Butler County Engineer and must arrange an inspection with the Liberty Township Public
Works Director; and
THEREFORE, BE IT RESOLVED that the Liberty Township Board of Trustees hereby
authorize the repairs and maintenance on the sidewalk at 6385 Coach House Way, Liberty
Township 45011;
BE IT FURTHER RESOLVED that the Liberty Township Board of Trustees resolves to
assess abutting property owner one hundred percent (100%) for repair and maintenance

Dear Board of Trustees of Liberty Township:
This letter outlines our proposal to enter into an agreement regarding real property as detailed herein. If this
proposal is acceptable, we will consider it as a letter of intent to enter into a formal agreement. Our proposal
is as follows:
1. Parties. Seller would be Board of Trustees of Liberty Township, a(n) Ohio Governmental Entity. Buyer
would be Schnicke Development Group, LLC, an Ohio limited liability company. Buyer is a land
development business that will perform lateral development on the Real Estate, and then sell the Real
Estate to Fischer Homes pursuant to a separate agreement.
2. Real Estate. The Real Estate would be 12 acres, parcel ID D2010010000008, Princeton Rd in Butler
County, Ohio (“Real Estate”).
3. Option Period. Seller would grant to Buyer the exclusive right and option to purchase the Real Estate
as follows:
a. Option Period. The Option Period would commence upon the Effective Date of the
Agreement and expire six calendar months thereafter for a $5,000.00 option money
payment which Buyer would deliver by 5 business days from the Effective Date (option
money payments collectively “Option Money Payments”).
b. Option Period Extension No. 1. Option Period Extension No. 1 would commence upon
the expiration of the Option Period and expire three calendar months thereafter for an
additional $10,000.00 option money payment.
c. Option Period Extension No. 2. Option Period Extension No. 2 would commence upon
the expiration of Option Period Extension No. 1 and expire three calendar months
thereafter for an additional $20,000.00 option money payment.
4. Option Money Payments. If Buyer would exercise its option to purchase the Real Estate, the Option
Money Payments would be credited toward the Purchase Price at Closing. If Buyer would fail to
exercise its Option to purchase the Real Estate, Seller would keep the Option Money Payments already
paid by Buyer less $5,000, the Agreement would terminate and the Parties would be relived of any
further rights or liabilities under the Agreement.
5. Purchase Price. The Purchase Price of the Real Estate would be $1,080,000.00 (“Purchase Price”).
6. Closing Deadline. Closing (“Closing”) would occur by 30 calendar days from Buyer’s notice of

fee simple good and marketable title (including mineral rights), free and clear of all liens and
encumbrances, assessments, delinquent/omitted taxes and any other CAUV recoupment taxes. Real
estate taxes would be prorated to the date of Closing.
8. Deliverables. By 5 business days from the Effective Date, Seller would provide to Buyer all documents
and information relating to utilities/easements, planning documents, agreements and performance
obligations (“Deliverables”).
9. Title/Survey. During the Option Period, Buyer would obtain a title report and title insurance
commitment for the Real Estate. Also, Buyer would obtain a survey of the Real Estate at its direction
and expense.
10. Plan Approvals. During the Option Period, Buyer would apply for plan approvals for the development
of the Real Estate as a residential community, at Buyer’s expense. Seller would cooperate with Buyer
and execute any necessary applications/documents to secure such approvals and permits.
11. Structure. Schnicke Development Group is Fischer Homes’ developer of choice for the Real Estate.
Schnicke Development Group will acquire the Real Estate and subsequently convey it to Fischer Homes
pursuant to a separate agreement. Following such conveyance, Fischer Homes will proceed with
residential construction on the Real Estate.

This letter sets forth the preliminary terms and conditions under which the parties may negotiate a definitive
Agreement and is intended solely as a basis for further discussion. This letter does not constitute a binding
agreement or an offer to enter into a binding agreement. Neither party shall be under any legal obligation
with respect to the transaction described herein unless and until a definitive Agreement is executed and
delivered by the parties.
