ADMINISTRATION
Select Committee on Data Centers. The joint legislative and bi-partisan committee on data
centers began meeting last week. To date, they have received testimony from invited state
officials, the regional transmission organization (PJM), opponents, and interested parties.
Data center companies have been invited to provide testimony at a meeting scheduled for
June 4. The committee co-chairs are Representative Adam Holmes and Senator Brian Chavez.
Other committee members include representatives Thaddeus Clagett, Heidi Workman, and
Chris Glasser and senators Bill Reineke, Shane Wilken, and Willis Blackshear, Jr.
Special City Council Meeting on Data Centers. This special meeting of city council is
scheduled for June 25, 2026 at 6:30 pm and will be held at the Big Walnut High School. Staff
continue to vet potential speakers, searching for subject matter experts with state or regional
knowledge who can assist with data center development issues that are within our local
control. We are not trying to duplicate the testimony that is being received by the state Select
Committee on Data Centers. Information from the select committee will be compiled and
considered by staff when formulating future recommendations.
COMMUNITY AND ECONOMIC DEVELOPMENT
Fishing Derby and Second Saturday on the Square. There are two upcoming community
events in Sunbury worth noting. The first is the annual Terry Hummel Memorial youth fishing
derby sponsored by the American Legion Post 457. This event will be held on June 6 from 8
am to 12 pm at Sunbury Reservoir Park. Fishing equipment and bait will be provided to youth
who participate. On June 13, a reimagined version of the farmers market will kick-off its
series of Second Saturday Markets on the Square. The theme for the first market is furry
friends and will include a tail-wagging day of shopping, treats, and fun on the Square. The
event will run from 10 am to 2 pm and include food trucks, small business vendors, pet
rescues, and more. Leashed and friendly pets are invited to join their owners for a day of
family fun and shopping small.
PUBLIC WORKS AND ENGINEERING
E Granville Street Widening Contracts. First reading for a contract modification to the design
contract to add an RMR (Regulated Materials Review) Study for American Structurepoint.
This is required by ODOT and is due to historic research that indicates that railroad

maintenance may have occurred near the overpass. Next council meeting there will be a first
reading for Right-of-Way Acquisition services on 34 parcels by OR Colan who was selected
through our Quality Based Selection Process.
Master Services Agreement with Verdantas. The last MSA was updated in 2020 and has
several items that need to be cleaned up related to the CT consulting firm being acquired by
Verdantas and the City moving to in-house City Engineering management. The agreement
would cover future Task Items that would have specified contract specific monetary
proposals, most of which have been anticipated in the overall budget for general consultant
engineering services, but it does not have any project costs for the MSA.
JR Smith Park Improvements. Substantial completion of the park is now at the end of
October due to mass excavation delays. The contractor will continue to work on expediting
critical path items and the City will evaluate whether any components can have an earlier
‘soft’ opening, such as the playground equipment.
W Cherry Street and New Cheshire Road Signal Improvements Bid Results. Three bidders
submitted for the new traffic signal project with Danbert Electrical Company being the
apparent low bidder at $445,914.39 ($475,000 Engineer’s Estimate). The first reading for
recommendation of award will be in two weeks on June 17. Approval as quickly as possible
is requested due to the 18-week supply chain lead time for signal poles after the contract is
executed and submittals approved. This update is being shared at the Services Committee.
PUBLIC SAFETY
Ohio Law Enforcement Body Armor Program. The Ohio Attorney General’s office awarded
the Sunbury police department a grant totaling $18,145.35 to purchase additional body
armor. This is the second grant the department has received from the state in the last year
to purchase safety equipment.
Memorial Day Activities. Officers reported no issues at the Memorial Day events on the
Square last weekend.
Speed Signs. There was a public inquiry about speed on Rainbow Avenue following the last
city council meeting and a request to install a speed sign. A review of traffic data from
recent months shows that of the 221 traffic citations issued citywide, seven (7) were issued
on Rainbow Avenue. Sunbury currently has four (4) speed signs that are being strategically
assigned to cover more than 100 streets throughout the city.
E-Bikes. The police department continues to receive reports of e-bikes (no pedals) being
driven on city streets by juveniles. These bikes are considered electric motorcycles and are
not street legal and if they were they would require a valid license with a motorcycle
endorsement to operate. The topic of e-bikes, scooters, and other motorized vehicles will
be discussed at the Services Committee meeting on June 3, 2026.

ORDINANCE 2026.10
AN ORDINANCE CONSENTING TO THE OHIO DEPARTMENT OF
TRANSPORTATION FOR ASPHALT OVERLAY, PAVEMENT REPAIR,
GUARDRAIL UPGRADES, AND RESURFACING RAMPS AND COLLECTORDISTRIBUTOR LANES OF I-71 THROUGH THE CITY OF SUNBURY
WHEREAS, the State of Ohio has identified the need for the following described project:
This project proposes to perform asphalt overlay, pavement repairs, guardrail upgrades,
and resurfacing work on ramps and collector-distributor lanes of I-71 through the City of Sunbury,
as part of the project PID 114906.
WHEREAS, the City of Sunbury, Delaware County, Ohio, hereinafter referred to as the
Local Public Agency (LPA), desires to give their consent to the portion of the project to take place
within the City limits and set forth herein.
NOW, THEREFORE, BE IT ORDAINED by the Council for the City of Sunbury,
Delaware County, State of Ohio, as follows:
SECTION I: Being in the public interest, the LPA gives consent to the Director of
Transportation to complete the above described project.
SECTION II: The LPA shall cooperate with the Director of Transportation in the abovedescribed project.
The Ohio Department of Transportation agrees to assume and bear one hundred percent
(100%) of all the costs of the improvement.
The City agrees to assume and bear one hundred percent (100%) of the total cost of those
features requested by the City which are not necessary for the improvement as determined by the
State and Federal Highway Administration.
SECTION III: The LPA agrees that all right-of-way required for the described project
will be acquired and/or made available in accordance with current State and Federal regulations.
Right-of-way costs include eligible utility costs.
SECTION IV: Upon completion of the project, and unless otherwise agreed, the LPA
shall: (1) provide adequate maintenance for the project in accordance with all applicable state and
federal law, including, but not limited to, Title 23, U.S.C., Section 116; (2) provide ample financial
resources, as necessary, for the maintenance of the project; (3) maintain the right-of-way, keeping
it free of obstruction, and (4) hold said right-of-way inviolate for public highway purposes.
SECTION V: The City Manager of said City is hereby empowered on behalf of the City
of Sunbury to enter into contracts with the Director of Transportation necessary to complete the
above-described project.

SECTION VI: It is found and determined that all former actions of this Council
concerning or relating to the adoption of this Ordinance were adopted in an open meeting of this
Council, and that all deliberations of this Council and any of its committees that resulted in such
formal action were meetings open to the public, and in compliance with all legal requirements,
including Section 121.22 of the Ohio Revised Code.
WHEREFORE, this Ordinance shall take effect and be in force from and after the earliest
time permitted by law.

REMOVAL; TO PERFORM CERTAIN MAINTENANCE AND/OR REPAIR ON STATE
HIGHWAYS INSIDE THE CITY CORPORATION, AND TO AUTHORIZE THE CITY
TO ENTER INTO AN AGREEMENT WITH THE STATE OF OHIO DEPARTMENT OF
TRANSPORTATION FOR CERTAIN MAINTENANCE AND/OR REPAIR.
WHEREAS, pursuant to Section 723.01 of the Ohio Revised Code, the CITY is
responsible for the care, supervision and control of the public highways within their municipal
corporation; and
WHEREAS, pursuant to Section 5501.41 of the Ohio Revised Code, the Director of the
Ohio Department of Transportation (“ODOT”) may, upon consent of the legislative authority of
the municipal corporation, remove snow and ice and use snow and ice control material on State
Highways within the corporate limits of the municipal corporation; and,
WHEREAS, the Director of Transportation, under Section 5511.01 of the Revised Code
of Ohio, may, upon the consent of the legislative authority of the municipal corporation, perform
maintenance and/or repair on the State Highways within the corporate limits of the municipal
corporation; and
WHEREAS, portions of State Highway Numbers 36, 37, and 71 lie within the City of
Sunbury, Delaware County upon which ODOT is willing to perform snow and ice removal and
apply snow and ice control material for the City as long as an agreement is entered into; and
WHEREAS, portions of State Highway Numbers 36, 37, and 71 lie within the City of
Sunbury, Delaware County upon which ODOT is willing to perform certain maintenance and
repair for the City as long as an agreement is entered into; and
WHEREAS, this ordinance is not intended to and shall not supersede any section of the
Ohio Revised Code pertaining to the responsibilities of the City and ODOT regarding any other
maintenance and repair or responsibilities pertaining to the roads under their respective
jurisdictions; and
WHEREAS, the work proposed to be authorized under this ordinance shall be restricted
to, if an Agreement is entered into, the removal of snow and ice and the use of snow and ice control
material on State Highways within the corporate limits of the City but shall not include the removal
of snow and ice and the use of snow and ice control material on driveways, parking areas, and
intersecting roads and streets, and, may include if an Agreement is entered into, the maintenance
and/or repair of the State Highways within the corporate limits of the City.

NOW, THEREFORE, BE IT ORDAINED by the Council for the City of Sunbury,
Delaware County, State of Ohio, that:
SECTION I: It is hereby declared to be in the public interest that the consent of said City
be, and such consent is hereby given to ODOT, if an agreement is entered into, for ODOT to
remove snow and ice and use snow and ice control material on any State Highway listed in the
agreement in accordance with the standard practices of ODOT.
SECTION II: It is hereby declared to be in the public interest that the consent of said
City be, and such consent is hereby given to ODOT, if an agreement is entered into, for ODOT to
perform certain maintenance and/or repair on any State Highway listed in the agreement in
accordance with the standard practices of ODOT.
SECTION III: The City Manager is authorized to enter into any agreement with ODOT
for the removal of snow and ice and the use of snow and ice control material and for the
performance of certain maintenance and/or repair of the State Highways as determined by the City
and ODOT.
SECTION VI: It is found and determined that all former actions of this Council
concerning or relating to the adoption of this Ordinance were adopted in an open meeting of this
Council, and that all deliberations of this Council and any of its committees that resulted in such
formal action were meetings open to the public, and in compliance with all legal requirements,

ORDINANCE NO. 2026.01.1 First Amended
AN ORDINANCE AMENDING THE 2026 ANNUAL APPROPRIATIONS
WHEREAS, Council for the City of Sunbury has previously enacted an Ordinance setting
annual appropriations for the year 2026; and
WHEREAS, Council now wishes to amend and increase the appropriation to the General
Fund – Supplies, Police by $4,000.00 for a donation from the Eagles for custom patches,
Wages, Admin by $30,000.00 for the Assistant City Manager, Supplies, Admin by
$10,000.00 for community events, Supplies, Street by $33,650.00 for reimbursements
received for snow & salt services, and Transfer Out to Fund 702 of $154,000 for Kintner
Crossing Intersection Improvements; and
WHEREAS, Council now wishes to amend and increase the appropriation to the Parks
and Recreation Fund – Joint Recreation Center by $4,250 to accounting, legal, and other
administrative expenses; and
WHEREAS, Council now wishes to amend and increase appropriations to the Sewer Fund
– Capital Swr Lnd Bldg by $14,070 to replace a rooftop HVAC unit. and Sewer Fund –
Other Reimbursements by $190,380.00 to refund the overpayment of sewer connection
fees by Pulte; and
WHEREAS, Council now wishes to amend and increase the appropriation to the Capital
Projects Fund – Capital Outlay by $750,000.00 towards the construction of a roundabout
at Golf Course Rd & Cheshire Rd and Capital Outlay of $400,000.00 towards the addition
of a traffic signal at Cheshire Rd & State Rt 37 E; and
WHEREAS, all fund balances are sufficient to cover these appropriations.
NOW, THEREFORE, BE IT ORDAINED by the Council for the City of Sunbury,
