Action on the Minutes of the February 12, 2026 meeting.
SUBDIVISION/LAND DEVELOPMENT
1. Rich Sabbatini, Mircam Properties, 3 Peachwood Drive, Wilkes-Barre, PA is seeking Final
Plan Approval for the Mircam Yatesville Facility Land Development in Yatesville Borough. The
project is to construct a 160 ft. x 80 ft. (12,000 sq. ft.) commercial storage, office space, training
facility and a paved storage yard at 69 Pittston Ave. located in a (MI) Mining District. The site is
about 9.25 acres in size and is served by public sewer and water.
The project obtained zoning approval from Luzerne County Zoning Hearing Board
Three (3) Waivers are being requested. (Enclosed)
OLD BUSINESS:
The Luzerne County GIS, Planning & Zoning Department is reviewing an amendment to
the Luzerne County Zoning Ordinance, that was adopted March 9, 2021, for consideration
and comment from the Luzerne County Planning Commission and the public. The
Ordinance amending the Luzerne County Zoning Ordinance includes definitions
pertaining to Data Centers, related uses, land use conditions, standards for such uses and
the zoning districts that Data Centers will be permitted.
NEW BUSINESS:
The Luzerne County GIS, Planning & Zoning Department is introducing an amendment
to the Luzerne County Zoning Ordinance, that was adopted March 9, 2021, for
consideration and comment from the Luzerne County Planning Commission and the
public. The Ordinance amending the Luzerne County Zoning Ordinance includes
definitions pertaining to Battery Energy Storage Systems (BESS), related uses, land use
conditions, standards for such uses and the zoning districts where BESS will be permitted.

The Luzerne County GIS, Planning & Zoning Department is introducing an amendment to
the Luzerne County Subdivision/Land Development Ordinance (SALDO), adopted
November 14, 1963, and updated September 25, 2012, consideration and comment from the
Luzerne County Planning Commission. The Ordinance amending the Luzerne County
Subdivision/Land Development Ordinance (SALDO) includes definitions pertaining to
Financial Security/Performance Bonding and Developer’s Agreement, alterations to plan
submission requirements and general updates to plan design standards and plan
requirements.

General Requirements / Calculations of Runoff and Design Storm Frequency
Waiver requested for relief of the Luzerne County SALDO watercourse easement requirements and
adhering to the Yatesville Borough watercourse easement width requirement of a minimum of 35-feet
(Borough of Yatesville Stormwater Management Ordinance Section 305. Riparian Buffers).
The requested waiver has also been added to the revised Land Development Plans. If you have any questions or

To whom it may concern,
On behalf of Mircam Properties LLC, we are requesting a waiver of jurisdiction from Jenkins Township toreview
the plans for the above referenced project:
1. Waiver of Jurisdiction
Waiver requested for relief of Jenkins Township review of the Mircam Yatesville Facility plans. The
project site is comprised of 9.30 acres, 7.03 acres being in Yatesville Borough and 2.27 acres being in
Jenkins Township. The proposed building is to be constructed on the Yatesville Borough portion of the
parcel. The stormwater management basin will also be located on the Yatesville Borough portion of the
parcel and will be discharged to the existing point of discharge in Yatesville Borough. Stormwater runoff
is not anticipated to discharge to Jenkins Township. All project development will be within the
boundaries of Yatesville Borough and no development is anticipated to occur within Jenkins Township
boundaries.
The requested waiver has also been added to the revised Land Development Plans. If you have any questions or

F. Buffer Yards and Screen Planting. Unless otherwise regulated, where buffer yards are
required by the terms of this chapter, they shall be provided in accordance with the
following standards:
(1) A buffer yard of at least 20 feet shall be required where development involves abutment
of nonresidential and residential uses. The buffer yard shall be provided by whomever
initiates the development, and shall not apply to agricultural uses involving the raising of
crops and animals. Buffer yards shall not be applied to existing uses unless an expansion
greater than 50% is proposed.
(2) At least 10 feet of the buffer yard area shall be planted with a'dense screen planting
having an opacity of 80% after the first year and thereafter. The remainder of the buffer yard
area shall be planted with grass, seed, sod or ground cover. Buffer yards shall be kept free
of all debris and rubbish.
(3) When said district boundary is a public street, the buffer yard may be reduced to five
feet and shall be planted with a dense screen planting, having an opacity of 80% after the
first year and thereafter. (4) The required yard space for the district in which the use is
located may be considered as all or part of the buffer yard area.
(5) No structure, storage area or parking, loading/unloading area shall be permitted in the
required screen planting area; however, such area may be crossed by access drives.
Automobile parking may be permitted in that portion of the buffer yard not required for
screen planting.
(6) The screened buffer may consist of a masonry wall, wood fence, trees, shrubs, berms or
a combination thereof. In the event a masonry wall or wood fence is used for screening
purposes, vegetative landscaping shall be placed and maintained between the wall or
fence and the property line adjacent to the residential district or use to form an ornamental
screen.
