F. MAJOR Land Development — South Canaan Twp. — Lopatofsky, Thomas & Carol Ann

This proposed land development involves three adjoining parcels of 107 acres located on the
north side of SR 3022 (Jubinsky Rd.) for the construction of a utility solar farm. The revised
Preliminary Plan submission was received on August 25, 2026, based on the prior reviews by the
Township Engineer and our Office during the month of August. This utility solar farm proposal
was also presented before the South Canaan Supervisors during their August monthly meeting,

H. LOCAL MUNICIPAL SUBDIVISIONS - Reviewed by Staff (Remaining 25 municipalities)
I. STAFF REPORTS:

Texas Township Zoning Ordinance Amendment — In late July our office received for review a
proposed amendment to the Texas Township Zoning Ordinance. The amendment was proposed
to regulate Data Centers. As per the proposal, Data Centers would be permitted as a Conditional
Use in the Industrial Zoning District. Our comments on the proposed regulations were
forwarded to the Township on July 28%.

Additionally, we received two proposed amendments to the Texas Township Zoning Ordinance
involving the regulation of Skill Game Establishments and Medical Marijuana Dispensaries and
a short ordinance involving the regulation of Food Trucks and Mobile Food Vendors for review.
Our review letter with comments was forwarded to the Township on July 28" as well.

Clinton Township Subdivision & Land Development Ordinance (SALDO) Amendments —
A new Data Center SALDO draft amendment was submitted to our office for review. This was
the third proposed SALDO amendment to regulate Data Centers. The new ordinance was not
submitted as response to our previous review but was rather an entirely new proposal. Our
review was completed on August 12 and the comments were forwarded to Clinton Township.

Dyberry Township Data Center Ordinance — Dyberry Township proposed a stand-alone Data
Center Ordinance for the purpose of regulating this type of development in the Township. We
received the proposed regulations for review in late July. The Township was assisted in this
effort by their Township Solicitor, Brendan Ellis, Esq. Our review was completed and our
comments were forwarded to Dyberry Township on August 3". It is understood that this
proposed ordinance will become the model for several more Wayne County municipalities in the
future.

Damascus Township Zoning Ordinance Amendment — In late July, our office received a draft
proposal for an amendment to the Damascus Township Zoning Ordinance for the purpose of
regulating Data Centers. Based on the proposal, Data Centers would be permitted as a
Conditional Use in the Industrial Zoning District. Our review was completed and our comments
on the proposed draft were forwarded to Damascus Township on August 7*.

Preston Township Subdivision & Land Development Ordinance (SALDO) Amendments —
In early August our office received for review the latest draft of the proposed amendments to the
Preston Township SALDO. Our office previously reviewed a draft in March of this year. The
Township is nearing the conclusion of a multi-year process to amend large portions of their
SALDO. Our review of this latest draft yielded no detrimental comments and our review letter
was forwarded to Preston Township on August 18". It is anticipated that these amendments will
be adopted in the near future.
