DESCRIPTION:

Subdivision of a 4-acre residential lot into 4 lots: one to
accommodate the existing dwelling and 3 to be developed
with 1 single-family home each

EXPIRES:

December 23, 2026

Background
The subject property is a four-acre residential lot in the Ivy Glen neighborhood near the West
Goshen Township border in the R-2 Residential zoning district. Most of the lots in Ivy Glen are
about half an acre, so this property is unusually large for the area. The property includes the
historic Daniel Meredith House (Twp. Historic Site 061.01), which is on the National Register of
Historic Places. The house remains in use as a private residence; accessory structures include a
detached garage and the ruins of a spring house. About two-thirds of the site is wooded, and
there is a wetland area of about 7,000 sq.ft. near its northwest corner. There are no regulated
steep slopes (15% and steeper) or any FEMA-designated flood hazard areas on the site.
The Planning Commission reviewed the application as a sketch plan in June 2024 and later
reviewed the land development/subdivision plan officially on February 17, 2026. The
Commission took no action at this meeting due to several concerns, with stormwater
management being the most significant. In April, the applicant submitted a revised submission,
which Township staff and their consultants reviewed. However, the applicant chose to withdraw
from the agenda due to unresolved stormwater concerns and conflicts with zoning standards.

1

The plan before you this evening is significantly revised from the former plan set and proposes
dividing the property into four lots instead of the previously proposed five. Proposed lot 4 will
be larger than the others and will include the spring house ruin and wetland-related areas. The
alterations address past concerns about stormwater and lot configuration and yard setbacks.
Lot 2 will accommodate the existing home; the remaining three lots will be sold as sites for
single-family detached dwellings. The Zoning Officer has confirmed that the proposed lots
satisfy the minimum requirements of the R-2 zoning district, and the proposed development on
each lot complies with the applicable area and bulk standards. The plan also addresses
concerns raised in our consultants' reviews and in public comments.
Regarding the historic resource, the Historical Commission discussed the impact of the new
houses on the historic house, the number of lots, and the preservation/stabilization of the
spring house ruins. At the August 11, 2025, meeting, the Commission passed a motion
supporting approval of the plan, including conditions that the Applicant consider reducing the
number of lots to provide a better setting for the historic house and preserve a visual
connection between the house and the spring house. The motion also memorialized concerns
about the proposed landscaping. Because of the revisions involved with this application, the
applicant will appear before this Commission at its November 9th meeting. However, this plan
appears to address most of those conditions.
Consultant Reviews
•

Spotts, Stevens and McCoy (“SSM”) review dated October 9, 2026. The review
is divided into sections according to topic.
−

Comments #1 through #4 identified the requested waivers from the Stormwater
Ordinance and the Subdivision and Land Development Ordinance (“S/LDO”). SSM
has no objection to the requested waivers from the Stormwater Ordinance
(comments #1 through #2 & #4). Comment #3 cites that a waiver can be granted
with a slight modification of the spillway design.

−

Comment #5 addresses a waiver from the sidewalk requirement in the S/LDO. This
request has been made since the original plan submission because no other
sidewalks are in the general vicinity of the proposed subdivision.

−

Comments #6 and #7 emphasize the S/LDO requirements that pertain to
landscaping, which is to be addressed by, our landscaping consultant [Theurkauf, as
outlined below].

−

Comment #8 requests that a table shall be included in the plans that clearly
demonstrate parking compliance, though it appears adequate parking is provided.

−

Comments #9 through #11 address S/LDO requirements. Comments # 9 and 11
address that applicant shall provide written descriptions for all easements, rights of
way and to include a probable cost estimate. The applicant generally submits these
items upon post-approval review. Comment #10 addresses the placement of
overhead utility lines which are otherwise required to be buried. The applicant shall
provide certification from the appropriate utilities if underground placement is not
possible.

•

−

Compliance with the Stormwater Management Ordinance is addressed in comments
#12 through #22. All of the comments are either administrative issues, direct minor
revisions, or specify information to be added to the plan drawing.

−

Comments # 23 through #25 are comments directed to address minor revisions or
specify information, or within best management practices.

Carroll Engineering review dated October 12, 2026.
The existing house has a gravity connection to the public sewer main in Glen Echo Rd.
The home proposed for Lot 4 will also have a gravity connection to this main. The
remaining three houses will have gravity connections to an existing main on the
adjoining Hollow Run property, near the southwest property line. In all cases, treatment
is provided by the West Goshen Authority. Carroll, comments 1and 2 under section C,
address minor edits to be made to the Sewer Planning Exemption

•

Theurkauf Design and Planning (“Theurkauf”) review dated October 2, 2026.
The review identifies that the following comments remain:
−

Comment #1 addresses the request for a waiver from the sidewalk requirement.
Theurkauf notes that there are no sidewalks in this neighborhood and supports the
request, subject to a contribution by the Applicant to the Township Sidewalk Fund
equivalent to the construction cost of the sidewalk that could be required, as is our
practice. SSM did not object to this waiver in their review; Staff agrees, and we note
that no sidewalks are shown along Glen Echo Rd. in the Township’s Bicycle and
Pedestrian Plan.

−

Comment #2 provides a tally of the required compensatory plantings and concludes
that the plan does not show all the required trees. It appears that additional trees
could be provided, but if the Applicant chooses not to, they have the option to pay a
fee in lieu of the deficiency as provided for by §281-34.G(6)(a) of the S/LDO.1
Based upon the landscaping shown, the fee amount is $6,270.00.

−

Comments on #3 notes that a minor error was found in the sizing of the trees for
the compensatory planting requirements. Involving 4 of the trees and requires a
revision of the table.

−

Comment #4 reviews the buffer plantings. Comment #4a supports a partial waiver
from the buffer width minimum to allow the design to be shown, noting that only a
portion of the buffer is undersized and all required buffer plantings have been
provided.

The remaining comments list resolved issues, minor errors to be corrected, and
administrative items.
•

1

Bowman review dated October 12, 2026. Bowman has no remaining concerns.
They also support the waiver requested from the sidewalk requirement and advise that
this project is subject to payment of a traffic impact fee of $5,796.00.

This is listed as a waiver on Sheet 2 of the plan set; however, payment of a fee in lieu of planting all
the required trees is an alternative allowed by this section of the S/LDO. No waiver is required.

3

The review of the Chester County Planning Commission was provided with the previous review.
They concluded that the plan is consistent with the County Comprehensive Plan and had no
concerns beyond those already raised by our consultants. The current plan shows a reduction
in the number of subdivided lots, and the same proposed use for single-family dwellings;
further review from the County is not required.
Staff Comment
The Applicant has taken steps to resolve of the concerns raised at the February 17th meeting
and in their subsequent April resubmission. From the onset of this application in late 2024, staff
has insisted that the initially five proposed lots present an imperfect lot configuration for the
available land, including impacts to stormwater, natural features, zoning standards, and
historical elements and brought about concerns from both the Planning and Historical
Commission.
If the Commission recalls its February meeting, there was extensive discussion citing that most
lots had impervious limits close to the 20% maximum coverage. This could limit future property
owners from making improvements (additions, patios) and thus require variance requests to the
Zoning Hearing Board. In response, staff inquired the Township Solicitor about the feasibility of
a deed restriction prohibiting the owners of these lots from applying to the Zoning Hearing
Board for relief from the limits on building and impervious cover. He responded that such a
deed restriction was possible, noting, “A deed restriction lawfully enacted does serve to override
the zoning applicable to the property and would run as a restrictive covenant with the land.”
However, he also cautioned that “…if a future owner ever is to challenge the deed restriction,
the law also dictates that if there is any ambiguity as to the interpretation of [the] language … a
court will always favor the interpretation in the scope of the least restrictive … use…” He also
stated that while this is a legal course of action, deed restrictions of this kind are too easily
forgotten – even with title searches – and there is also the challenge of enforcement, as such
restrictions are usually enforced privately (like by an HOA), leaving the question of what entity
would be in a position to enforce it. He concluded that, although this is possible, he does not
recommend this course of action. Applicant’s counsel did provide such an agreement.
The new lot configuration makes impervious coverage concerns in conjunction with executing
and enforcing a potential covenant agreement less of a concern. The chart below compares the
net lot areas and the proposed impervious coverages on each of the parcels. Lot 2, which
contains the existing dwelling, is the only property that comes within 2% of the maximum
impervious coverage. However, this could be further reduced if the shared lot line between Lot
2 and Lot 3 were moved slightly to the west to provide additional land to Lot 2.

Owners of nearby properties have expressed a variety of concerns, principally the effect upon
stormwater runoff and flooding, the size of the proposed homes, and the impact upon the
historic character of the property and the neighborhood more generally. Staff notes that SSM
has concluded that the proposed stormwater management system will manage new runoff in
compliance with our regulations, and as such will not worsen existing conditions – and may
improve them. While we understand the impacts on character, this is largely subjective; we can
only enforce the objective standards of our ordinances. Additionally, the reduction of the lot
and associated improvements will provide retention of additional naturalized areas, as noted,
especially with the larger Lot 4. In addition, Township staff has requested a condition that the
applicant provide a covenant for lot 4 restricting it from further subdivision.
The Commission should discuss with the applicant how the Operation and Maintenance
agreements for the Stormwater Management Systems will be implemented, as each lot (with
exception of lot 2) has its own system that an HOA will not oversee. Though this is a fairly
common practice (especially for a submission as small as this one), it would be best if this item
was addressed now and included as part of the conditions of approval, rather than debated as
part of any potential post-approval process.
We note that the plan now shows that the existing home on Lot 2 will be connected to public
water supply (required to allow the lot to be smaller than one acre) and fire connections are
now shown for all the proposed homes.
SSM’s prior review expressed concern about the impact of the construction of the various utility
connections upon Glen Echo Rd. We note that Sheet 5 of the plan now indicates an area of the
street to be milled and overlain following construction; Staff advises that the full width of the
road should be restored in this way, not just half of it.
In conclusion, Staff is now satisfied that the remaining concerns are sufficiently minor to be
addressed as conditions of approval. Please find attached a draft motion for your consideration.

BACKGROUND
Oak Knoll, LLC (C/o Glenn White) is proposing to subdivide the 4 gross acre property at 1358 Glen Echo
Road into four separate lots. Lot 2 is proposed to contain an existing dwelling and driveway while Lot 1,
Lot 3, and Lot 4 are proposed to contain new single-family detached dwellings. An existing stone
springhouse within a wetlands area is present on Lot 4.
The subject property is in the R-2 Residential District and fronts along Glen Echo Road at the intersection
with Twin Oaks Lane. The property is bound by existing residential uses (apartments to the west; single
family homes in all other directions).
REVIEW
The submitted information has been reviewed for compliance with the West Whiteland Township Zoning
(Chapter 325); Subdivision and Land Development (Chapter 281), and Stormwater Management (Chapter
270) Ordinances, as well as current engineering practices.
Issues regarding landscaping and buffering, sanitary sewer and traffic will be addressed by Theurkauf
Design and Planning, Carroll Engineering and Bowman, respectively.
We have the following comments.
WAIVER REQUESTS
1. Section 270-20.J(2) – A partial waiver is requested from the requirement that all infiltration
systems to be set back 20 feet from all property lines and right-of-way boundaries.
The waiver request is specifically for SCM-2 (Lot 1), SCM-4 (Lot 4) and SCM-5 (Lot 4). All
proposed infiltration beds are no less than 15-ft from a dwelling and right-of-way line; therefore,
we have no objection to this request.
2. Section 270-29.A(4)(a) – A waiver is requested to permit a 5-foot basin berm top width when
typically a minimum 8-foot wide top width berm is required.
Due to the shallow depths and small sizes of the basins, we have no objection to this request.
3. Section 270-29.A(5)(d) – A waiver is requested to provide less than 1-foot of freeboard in the
design of emergency spillways when typically a minim of 1-foot of freeboard is required.
All basins are relatively small and the spillways have been revised to contain a 12-foot width and
6-inch depth. We support the waiver subject to keeping the emergency spillways a minimum of
12-feet wide width while still providing a minimum 6-inches of freeboard. The current spillway
designs provide a minimum of 6-inches of freeboard.
4. Section 270-29.D(1) – A waiver is requested to permit a swale design of 6 inches of freeboard in
the 100-year storm event in lieu of the requirement that swales shall be designed with 1 foot of
freeboard in the 25-yr storm event.
We have no objection to this request.
5. Section 281-31.A – A waiver is requested to not provide sidewalks.
We have no objection to this request as there is no existing sidewalk in the general vicinity of this
subdivision.

Mr. John Weller | West Whiteland Township
SSM File 101008.0390
October 9, 2026

6. Section 281-34.G – A waiver is requested to not provide all required compensatory plantings
requirements.
We defer landscaping related requests to the Township’s Landscaping Consultant.
7. Section 281-35.E – A waiver is requested from the requirement that a 25 foot wide perimeter
buffer is required along the tract boundary lines on the south east side of Lot 1.
We defer landscaping related requests to the Township’s Landscaping Consultant.
ZONING
8. Section 325-39.G – Off-street parking calculations shall be provided on the plans and
demonstrate that parking requirements have been met.
It is noted that it appears adequate parking is provided; however, off-street parking calculations
demonstrating the same shall be provided on the plans.
SUBDIVISION AND LAND DEVELOPMENT
9. Section 281-16.D(7) – Applications for all preliminary plans shall contain all proposed
easements, rights-of-way, and any covenants applicable and/or references thereto, including
utility and maintenance easements as well as easements to extend utilities to adjoining properties
and such easements or covenants requiring maintenance and repair of sidewalks by the property
owners abutting thereon. All such easements, rights-of-way and covenants shall be in a form
capable of recordation and in a form and substance satisfactory to the Township Solicitor.
All proposed easements and right-of-way dedications shall include exhibits and associated legal
descriptions. The response letter indicates such items will be provided prior to the recording of
the plans.
10. Section 281-43 – All utility lines, including, but not limited to, electric, gas, cable television,
streetlight supply, and telephone, shall be placed underground at a depth no less than 24 inches.
The plans propose overhead electric along Glen Echo Road with three new utility poles proposed
within the Township’s right-of-way. Utilities shall be installed underground unless determined to
not be feasible by the electric provider.
If underground electric transmission is determined by the utility provider to not be feasible, the
total number of utility poles shall be minimized. Correspondence with the utility provider shall be
provided for consideration. It is further noted that a 27-inch pine tree conflicts with the proposed
overhead utility on Lot 2.
11. Section 281-54 – An improvements agreement and guarantee will be required. An Engineer’s
Probable Cost Opinion shall be provided for review.
STORMWATER MANAGEMENT
12. Sections 270-17.A(1)(a) and 270-32.G – The applicant shall provide the Township with a “letter
of adequacy” from the Chester County Conservation District for the E&S Plan prior to the
Township endorsing the plan.
13. Section 270-17.A(1)(b) – The applicant shall provide the Township with a copy of the required
Individual NPDES Permit prior to the Township endorsing the plan.

Mr. John Weller | West Whiteland Township
SSM File 101008.0390
October 9, 2026

14. Section 270-20.Q – All infiltration practices shall have appropriate positive overflow controls.
The contours (468, 470 & 472), downhill of the Type M inlet at SCM-3 (Inlet 3-1), shall be
shaped to channel the runoff into the downstream channel.
15. Sections 270-29.D (swales) and 270-29.E (storm sewers) – As previously requested, drainage
areas correlating to the design of the swales and storm sewers have been delineated on Sheet 6.
The grading associated with Swale 2 (SCM – 7) shall clearly direct the discharge of the
driveway/pipe on Lot 2 around Swale 2 (SCM-7) or the design for downstream facilities (Swale
SCM-7 and Infiltration Bed SCM-3) shall account for this additional drainage.
16. Section 270-29.E(7) – All storm sewers shall be constructed per PennDOT specifications as
outlined in Publication 408 Design Manual, Part 2, Highway Design and Standards for Roadway
Construction, RC-Series unless otherwise dictated by the Township Code.
The above shall be noted on the plans. Additionally, multiple 18-inch diameter Nyroplast
standpipes are proposed at a depth greater than 5-ft. Any stormwater structure which is greater
than a 5-ft depth must be replaced with a standard inlet which contains steps and is accessible. It
is noted that this is a requirement of PennDOT RC-46M.
17. Section 270-32.A(3) – The applicant’s statement on Sheet 6 shall be signed prior to the Township
endorsing the plan.
18. Section 270-43 – A stormwater operation and maintenance agreement shall be provided. The
agreement shall include the O&M requirements noted on the PCSM Plan detail sheets, or
reference the PCSM Plan drawing numbers where the O&M requirements are noted. O&M
agreements for each individual lot (Lots 1, 3, & 4) will be required.
19. The plan now proposes to connect the discharge pipe from SCM-03/Inlet 4-5 (Lot 4) directly into
the existing inlet in Glen Echo Road. We have the following comments specific to this storm
sewer:
a. The plan shall clearly note that the lot owner is responsible for the maintenance of the
outlet pipe including that portion within the right-of-way.
b. The plan shall note that the pipe connection shall be fully grouted to provide a watertight
connection.
c. A profile of this storm sewer shall be provided.
20. The weir wall materials (concrete, steel, etc.) and dimensions (thickness, etc.) in outlet structures
SCM-3 (Inlet 3-1) and SCM-5 (Inlet 4-5) shall be specified.
21. The plans shall provide sanitary sewer lateral profiles and note the anticipated depth of the
laterals. It is noted that these traverse under the proposed swale along the rear property line,
which may affect the overall lateral coverage.
22. We recommend the level spreader detail be revised to propose geotextile fabric along the top of
the stone trench a 6-inch depth below grade and that a 6-inch depth of R-4 Rock or river rock be
placed on top of the geotextile fabric in an effort to prevent the spreader from becoming clogged.
GENERAL
23. The plans shall note within the demolition notes on Sheet 2 that a West Whiteland Township
Demolition permit shall be acquired prior to commencing the demolition of any buildings or
structures on site.

Mr. John Weller | West Whiteland Township
SSM File 101008.0390
October 9, 2026

24. The plans shall note that all proposed sanitary sewers shall be in accordance with the West
Whiteland Township Sanitary Sewer Standards.
25. The existing dwelling contains a fence. It appears this fence is proposed to be removed. The plans
shall clarify if this fence is to be removed on the demolition plan.
26. Concrete monuments shall be along the shared access and utility easement, and at all bends of the
easement, such that the limits of the easement can easily be determined in the field.
We respectfully request for ease of review that response letters include a response to each comment and
indicate the sheet number(s) and/or report page numbers corresponding to the changes that have been
made.

If you have any questions please feel free to call me.

REVIEW COMMENTS – 1358 GLEN ECHO ROAD
PRELIMINARY SUBDIVISION/LAND DEVELOPMENT PLAN DATED 9-25-26
October 2, 2026
1.

Sidewalks – Section 281-321.A of the subdivision and land development ordinance (SLDO)
requires minimum 5-foot-wide sidewalks at all new developments. The plan does not indicate a
sidewalk on either of the Glen Echo Road frontages. It is noted that there are no existing sidewalks
in the area. A waiver has been requested.
If the Township has no plans to construct sidewalks within this neighborhood, a fee in lieu could
be considered to construct pedestrian access in an area of greater need.

2.

Tree Removal and Compensatory Plantings – Section 281-34.G (SLDO) requires mitigation for
viable mature trees (12-inch DBH and greater) that are removed. For the 48 trees proposed to be
removed, there is a replacement requirement of 164 trees.
Plantings applicable to the replacement requirement are as follows:
Deciduous trees, 2-inch cal.
Evergreen trees, 7-foot ht.

59
86

Total compensatory trees proposed
Total compensatory trees required
Compensatory tree deficit

145
164
19

Additional trees could be placed in the buffer areas between lots and on the southwest perimeter.
If no additional compensatory trees are planted, the fee in lieu should be $6,270.00.
3.

Compensatory Planting Requirements Table Error - The Compensatory Planting Requirements
Table currently categorizes (4) 24-inch trees under the 12-inch to 24-inch replacement category
rather than the 24-inch to 36-inch category. The table shall be revised to reflect that these (4)
trees are subject to a replacement criterion of 3 inches of replacement planting for every 1 inch
of tree removal.

4.

Perimeter Buffers - Section 281-35.E (SLDO) requires 25-foot-wide planted perimeter buffers
along property lines and around basins as follows:

Plant Type

Southeast cleared/225 LF

Large Shrub

RE:

Traffic Engineering Review - 1358 Glen Echo Road – Land Development Plan
West Whiteland Township, Chester County, PA
Bowman Project No. 310538-24-005

Dear Mr. Weller:
Bowman completed a traffic review of the proposed development located at 1358 Glen Echo Road. The
site currently contains a single-family home with a driveway to Glen Echo Road. It is proposed to subdivide
the lot, retain the existing home, and build three new homes. Access to Lot 1 is proposed by a conventional
residential driveway. Access to Lot 2 (existing home) is provided by the existing residential driveway. Access
to Lots 3 and 4 is proposed by a shared driveway. Our traffic review is based on the following documents.
-

Preliminary Subdivision & Land Development Plan for 1358 Glen Echo Road, prepared by JMR
Engineering, LLC., revised September 25, 2026.
Waiver Request Letter, prepared by JMR Engineering, LLC., dated September 25, 2026

Our office has no further traffic review comments; however, we offer the following for informational
purposes only.
1.

SALDO Section 281-31.A – The applicant requests a waiver to not construct sidewalk along the
site frontage. The Township’s Bicycle and Pedestrian Plan does not show sidewalk or other similar
infrastructure along Glen Echo Road. Furthermore, there are no existing sidewalks in the vicinity
of the site. Our office can support this waiver subject to review by the Township.

2.

Chapter 295-12 – This development is subject to the Township’s Transportation Impact Fee which
is equal to $1,449.00 per new weekday afternoon peak hour trip. Based on the Institute of
Transportation Engineers (ITE) publication Trip Generation Manual, 12th Edition for Single Family
Detached Housing (ITE Land Use Code 210), three new single-family homes will generate four
new weekday afternoon peak hour trips, and the resultant Transportation Impact Fee is $5,796.

If there are any questions or if additional information is requested, please contact our office.
Sincerely,

Christopher J. Williams, P.E.

systems prior to the issuance of a certificate of occupancy.
